Airworthiness Directives 2004 - Revocation and Remaking - Aircraft - General

The instrument works with a small set of legal concepts, expressed in plain terms in the text. Those concepts are:

• Delegate action under delegated authority: the instrument is made by "DAVID ALAN VILLIERS, delegate of the Civil Aviation Safety Authority," and the delegate acts "under subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998." The instrument therefore rests on delegated power in the CASR framework: a delegate of CASA is authorised to make or revoke airworthiness directives under that provision.

• Revocation and remaking of instruments: the instrument explicitly exercises revocation power in respect of named Airworthiness Directives, and exercises power to remake those directives "as separate instruments." The two operations are linked: revocation (removing the previously extant form of each AD) and remaking (issuing a separate, attached instrument that replicates the latest published form).

• Attachment and cross-reference: the Schedule lists the ADs and the main body states that each AD is "mentioned in Schedule 1 and attached." The note clarifies that the remade ADs are to be identical to the latest published editions. The structural concept here is a parent instrument that both revokes and attaches the new version of multiple subordinate instruments.

• Identification of instruments by AD name/number and amendment notation: Schedule 1 identifies each AD by an AD name and AD number (for example, "Flight Manual Stowage Requirements - CANCELLED AD/GENERAL/3 Amdt 1" or "Emergency Exits AD/GENERAL/37 Amdt 8"). Many entries include amendment numbers; many others are annotated "CANCELLED." Those annotations are part of the Schedule as published.

• Scope descriptor: the Schedule header uses the descriptor "Aircraft - General," indicating the thematic grouping of the listed ADs; the instrument does not expand the scope beyond that label.

These are the operative legal notions in the instrument. The instrument does not define or elaborate on the substantive content of any AD, nor does it create new substantive compliance obligations itself. Instead, it performs an administrative re-issuance of existing ADs into separate attached instruments while stating that their text will be identical to the latest published editions.

The instrument names and restructures a set of Airworthiness Directives and so affects, at minimum, the legal status of those particular directives and their addressees. The text itself provides the following pointers to the parties whose legal position is altered by the revocation and remaking:

• The delegate (decision-maker): the instrument is made by the CASA delegate, who is the legal actor effecting revocation and re-issuance under subregulation 39.001(1). That delegate is recorded by name and signature (David Alan Villiers).

• The identified Airworthiness Directives: the ADs listed in Schedule 1 are the objects of the instrument's operation. The instrument revokes the previously extant form of each named AD and remakes it as a separate attached instrument. The specific AD identifiers (e.g. AD/GENERAL/4, AD/GENERAL/22, AD/GENERAL/37) are therefore central to understanding who is affected: anyone whose regulatory obligations are governed by those ADs.

• Implicitly affected persons and entities: while the instrument does not itself recite categories of obligated parties, the practical consequence of altering the legal form of ADs is that parties who were subject to the previous versions of those ADs are the primary affected group. That will include operators, owners, maintenance organisations and other parties who, under the relevant AD, were required to take or were restricted from taking particular technical actions. The instrument does not itself set out those substantive obligations; it remakes the ADs that contain them.

• Regulatory administrators and legal users: the instrument changes the legal provenance and document lineage of the listed ADs. Users who cite or rely on the ADs in technical manuals, maintenance records, regulatory submissions, or legal pleadings are affected because the ADs are being reissued as separate instruments attached to this instrument.

The instrument itself does not create new categories of obligations or new addressees. The text focuses on revocation and remaking; the substantive duties and the persons who must comply with them remain defined by the attached ADs as remade. A practical corollary is that anyone who previously relied on the prior instrument form (for example, a consolidated instrument or a publication series) must confirm whether references, citations, and record-keeping need to be updated to reflect the separate attached instruments.

The operative duties and rights created or preserved by this instrument are procedural and administrative rather than substantive technical prescriptions. The instrument itself establishes the following legal effects and thereby determines related duties and rights:

• Duty to revocation and replacement: the instrument exercises the delegate's power to revoke the listed ADs. The duty it operationalises is the administrative act of revocation; it does not record a continuing compliance action for third parties (those are in the remade ADs).

• Duty to operate under delegate authority: the instrument is explicit that the delegate acts pursuant to subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998. The text thereby confirms the delegate's authority to make and revoke ADs under that regulatory provision.

• Right/power to reissue separate instruments: the instrument confers the practical right (on the delegate) to re-make each AD as a separate instrument and to attach those separate ADs to the instrument. That alters the legal form and identity of the ADs by replacing the prior instrument with a set of attached, separately identified instruments.

• Preservation of substantive content: by including the note "Each attached Airworthiness Directive is being re-made in exactly the same form as appears in the latest published edition of the Directive," the instrument preserves the substantive requirements of the remade ADs as identical to the latest published text. The immediate legal consequence is that those substantive duties, as set out in the attached ADs, are carried forward unchanged in text even though their instrument identity has been changed.

• No new duties in the parent instrument: the instrument itself does not impose new technical duties, conditions, or prohibitions on operators. Any operative duties and rights that affect aircraft operations, maintenance, inspection, modification or placarding will be found in the attached AD instruments that have been remade.

• Duty to consult attached ADs for substantive obligations: for persons seeking to know what technical duties apply as a practical matter, the instrument creates a requirement to consult the attached remade ADs. Because the parent instrument revokes and remakes, the attached versions are the operative legal documents carrying any binding obligations.

• Administrative duty to update citations and records: while not explicitly stated, the act of remaking ADs as separate instruments creates a practical duty (on administrators, legal advisers and regulated entities) to ensure that references and records point to the remade instruments rather than to the prior versions that have been revoked.

In short, the instrument reorganises the form and legal identity of a set of ADs, preserves their substantive textual content (per the note), and places the burden on users to consult the separately attached AD instruments for substantive duties and rights. All of the delegate's actions are expressly made under the cited CASR authority.

The instrument itself contains no provisions creating penalties, fines, or enforcement mechanisms. The text records an administrative action (revocation and remaking of specified Airworthiness Directives) and does not include any new offence provisions or enforcement instrument clauses. Two points follow directly from the text:

• No penalty clauses in this instrument: the body of the instrument confines itself to revocation and remaking, and the Schedule lists ADs; there are no expressed penalties, infringement notices or enforcement steps contained in the instrument as published.

• Enforcement and penalties, to the extent they apply, are to be found in the substantive ADs and in the Civil Aviation Safety Regulations 1998: because this instrument does not itself state enforcement measures, any penalties or compliance enforcement would derive from the remade ADs (if those documents contain enforcement language) and from the broader regulatory framework under which airworthiness directives and aviation safety obligations are enforced. The instrument provides no text to the contrary.

Consequently, persons seeking to understand enforcement risk, sanctions or penalties relating to any of the listed items must look to (a) the attached remade ADs for any directive-level enforcement language, and (b) the Civil Aviation Safety Regulations or other statutory instruments that create offences or enforcement powers applicable to failure to comply with a lawfully issued AD. This instrument modifies the provenance of the ADs but does not itself alter or prescribe enforcement standards.

The instrument expressly identifies its source of authority as subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998. That is the only external legal reference in the instrument text. The interactions with other laws are therefore architectural and limited to the following textually grounded connections:

• Delegated regulatory power: the instrument is an exercise of a delegate power conferred by the CASR regime, specifically subregulation 39.001(1). The parent statute/regulation (CASR 1998) provides the legal basis for issuing, revoking and re-issuing airworthiness directives; the instrument is an implementation of that delegated power.

• ADs as subordinate instruments: by revoking and remaking the listed ADs as separate instruments attached to this parent instrument, the instrument restructures the legal form of those subordinate instruments. The remade ADs will therefore exist as separate legal instruments made under the delegate's authority, and their legal operation will be as subordinate statutory/administrative instruments within the CASR framework.

• Continuity of substantive content: the instrument asserts that the remade ADs are "in exactly the same form as appears in the latest published edition of the Directive." That statement indicates the intention to preserve the textual substance of the ADs, and therefore to maintain continued legal operation of the substantive requirements as previously published, albeit under new instrument identifiers.

• Citation and legal provenance: because the instrument revokes prior versions of the listed ADs and creates separate attached instruments, references in other instruments, approvals, manuals, maintenance records or contractual documents that cited the previous AD forms may need to be reconciled with the new remade instruments. That is an interaction point between this instrument and any other regulatory or contractual documents that cite the ADs.

• Silence on broader legislative interactions: the instrument does not mention other laws, civil liability regimes, administrative review rights, or external enforcement mechanisms. Those interactions would therefore be mediated by the CASR framework and by the substantive content of the remade ADs, none of which the parent instrument expands upon.

In sum, the instrument operates within the CASR delegated-authority architecture, reconstituting a set of ADs as separate instruments while preserving their textual content. The most immediate cross-law interaction is the need for users to reconcile citations and legal provenance across the CASR regime and any documents that reference the prior forms of the ADs.

The instrument itself is an amendment-style administrative action: it revokes prior versions of listed Airworthiness Directives and remakes each as separate attached instruments. The instrument is dated 20 December 2004 and records that the remade ADs will be in "exactly the same form as appears in the latest published edition of the Directive."

The Schedule evidences prior amendment activity for many of the listed ADs by appending amendment numbers (for example, "Amdt 1," "Amdt 2," "Amdt 3," up to "Amdt 8" in the case of AD/GENERAL/37). The presence of amendment numbers next to AD identifiers in Schedule 1 indicates that those ADs had been amended before this instrument was made. Examples include:

• "Flight Manual Stowage Requirements - CANCELLED AD/GENERAL/3 Amdt 1" , shows a prior amendment number (Amdt 1) and a "CANCELLED" annotation;
• "Emergency Exits AD/GENERAL/37 Amdt 8" , shows eight amendments; and
• "Engine Oil Tank - Modification AD/GENERAL/22" , listed without an explicit cancellation annotation but still part of the revocation and remaking.

The Schedule includes both items annotated "CANCELLED" and items without that annotation. The parent instrument revokes all ADs "mentioned in Schedule 1" regardless of whether Schedule annotations identify them as cancelled or amended. The instrument therefore functions as a consolidated administrative step to reissue a set of ADs as separate attached instruments, preserving the textual content of the latest published editions.

No separate amendment log or explanatory memorandum is included in the instrument text beyond the Schedule annotations and the single-note sentence. The instrument does not itself record previous dates of the ADs' original issuance or list the substantive changes made in prior amendments; it only records the present action of revocation and remaking and reproduces the AD identifiers and amendment annotations in the Schedule.

For practitioners tracking instrument lineage, the relevant amendment-history indicators present in the Schedule are the amendment numbers beside each AD identifier. Those indicators show that many of the ADs had undergone prior amendment cycles before being subject to this 2004 revocation/remaking exercise.

The instrument text contains no references to litigation, judicial decisions, appeals, or challenges. It does not record any past or pending court proceedings in relation to the listed Airworthiness Directives, nor does it include any statement about review rights, appeal periods or judicial determinations. From the text alone:

• No cases are cited; no litigation record is provided.
• No administrative review or appeal rights are mentioned in the instrument.

Accordingly, there is nothing in the published instrument to indicate that any of the listed ADs have been the subject of litigation, nor that this revocation-and-remaking exercise was in response to judicial action. Any questions about litigation history or judicial interpretation of any of the ADs must be pursued in external sources, because the instrument itself contains no such material.

The instrument is short and administrative, but the text and the Schedule create several concrete practical issues that require attention from practitioners. Those items arise directly from the wording and structure of the instrument.

• Remaking identical text but changing legal identity: the instrument's note declares that each attached AD "is being re-made in exactly the same form as appears in the latest published edition of the Directive." That preserves textual substance but changes the instrument identity by creating separate attached instruments. The result is that citations, legal references and database entries that previously pointed to the older instrument form may no longer reference the active legal instrument. Practitioners must confirm whether references in safety management systems, maintenance schedules, or contractual obligations should be updated to cite the newly remade attached instrument rather than the prior revoked form.

• Schedule entries annotated "CANCELLED": the Schedule lists many entries annotated "CANCELLED" (for example, "Electrical Switch - CANCELLED AD/GENERAL/1," "Fuel System - CANCELLED AD/GENERAL/2," and many others). The instrument nonetheless revokes the ADs mentioned in Schedule 1 and remakes each AD mentioned in Schedule 1 and attached. The presence of "CANCELLED" as a Schedule annotation creates potential ambiguity about what is being remade in practice: is a previously cancelled AD being remade as a cancelled instrument (i.e. a remade instrument that retains the cancelled status), or is the annotation a historical label carried into the Schedule? The instrument text does not explain the operational meaning of the "CANCELLED" annotations in the Schedule; accordingly, practitioners must inspect the attached instruments themselves to determine the operative status and substance.

• Multiple amendment levels: several ADs are identified with amendment numbers (for example, Amdt 1 through Amdt 8). The note suggests the remade instruments replicate the "latest published edition," so the remade AD should carry forward the latest amendment content. Nevertheless, the Schedule does not list dates or the content of those amendments. A practitioner should not assume that amendment numbering alone tells the story about the precise operative text; the attachments must be checked.

• Potential for disconnect between publications and instrument identity: the instrument refers to "the latest published edition of the Directive." That phrase presumes the existence of published editions and a publication mechanism. The parent instrument does not itself contain those editions; it attaches the remade ADs. For users relying on other repositories (consolidated registers, training materials, maintenance manuals), there is a risk that the published edition used as reference may not match the attached instrument identity. Verification is therefore necessary.

• Administrative rather than substantive change: because the instrument preserves the substantive text (per the note) but alters legal form, there is a risk that non-legal staff (technicians, line managers) will overlook the need to update legal citations, leading to discrepancies between operational practice and documentary compliance. That mismatch can have downstream compliance consequences even though the technical obligations are unchanged.

• No explicit enforcement or penalty guidance in this instrument: because this is an administrative re-issuance, the instrument provides no direction on enforcement, compliance windows, or transitional arrangements for operators who may have relied on the prior instrument forms. If any such transitional relief existed, it is not expressed here.

These are concrete, text-based sources of confusion and risk. The instrument requires practitioners to look beyond its four corners,to the attached remade ADs and to any CASR provisions,to determine operative obligations, timelines and enforcement posture.

Compliance in relation to this instrument is procedural and documentary: the instrument remakes listed Airworthiness Directives as separate attached instruments and revokes previously extant forms. The instrument itself does not impose new technical measures, but it changes the legal instruments that carry those measures. Practical steps, grounded in the text, are as follows:

1. Obtain and read the attached remade Airworthiness Directives: the instrument expressly remakes each AD that is "mentioned in Schedule 1 and attached." The substantive duties, compliance timelines, and any enforcement language will be located in those attached instruments. The parent instrument's stated preservation of text ("exactly the same form as appears in the latest published edition") directs the reader to the attached ADs for operative content.

2. Reconcile existing citations and records: because the instrument revokes prior versions of the ADs listed in Schedule 1 and remakes them as separate attached instruments, entities that previously cited or filed the old instrument versions must update their references to the remade instruments. This will include maintenance logbooks, continuing airworthiness management documents, safety manuals and regulatory filings that rely on the ADs.

3. Verify status for ADs marked "CANCELLED" in Schedule 1: the Schedule includes many AD entries annotated "CANCELLED." The parent instrument nonetheless remakes the listed ADs and attaches them. Practitioners should check the attachments to confirm whether the remade attached ADs carry the cancelled status, whether they are empty instruments for record-keeping, or whether the annotation is historical. The instrument text does not itself resolve that point.

4. Confirm that the remade ADs reproduce the intended "latest published edition": the instrument's note commits to reproducing "exactly the same form" as the latest published edition. For legal certainty, recipients should compare the attached remade ADs against the previously published editions (if available) to confirm there has been no divergence in text during the remaking process.

5. Update compliance workflows: even if the technical requirements in the remade ADs are unchanged, the change in instrument identity can affect compliance checklists, audit trails and regulatory reporting. Update internal workflows to reflect the attached remade AD numbers, amendment annotations, and any new filing references required by the regulator.

6. Liaise with regulatory contacts if necessary: the instrument is an exercise of delegated authority under subregulation 39.001(1). If there is uncertainty about the practical effect of remaking an AD that carried a "CANCELLED" annotation, or if an operational question arises about transitional compliance, seek clarification through the appropriate CASA delegate or administrative contact listed in the official publication medium. (The instrument is signed by the delegate, David Alan Villiers, and it is therefore a CASA exercise of authority.)

7. Maintain a copy of this revocation/remaking instrument in compliance records: because the instrument revokes prior forms of the ADs and reissues them, keep a copy of the 20 December 2004 instrument and its Schedule in regulatory records to document the change in legal provenance, which may be relevant in audits or inspections.

These steps follow directly from the instrument's mechanics: it revokes prior AD forms, remakes them as separate attached instruments, and preserves their text as the latest published editions. Compliance therefore turns on locating and following the remade attached ADs and ensuring documentary and citation consistency after the parent instrument's administrative reorganisation.
