Airspace (Consequentials and Other Measures) Act 2007

This Act uses three main statutory devices: consequential amendment, technical substitution, and transitional regulation-making power. The source implements those devices against an institutional background of two statutory bodies , CASA (Civil Aviation Safety Authority) and Airservices Australia , and against the Airspace Act 2007 and Air Services Act 1995.

Consequential amendment: The Act expressly adds functions conferred under the Airspace Act 2007 to the list of matters CASA may perform (Schedule 1, item 1). That is a structural change to the catalogue of CASA’s functions in the Civil Aviation Act 1988, inserting a new paragraph (cc) after para 9(3)(cb). The Act then inserts a new statutory duty for CASA to act consistently with the Australian Airspace Policy Statement (Schedule 1, item 2, new s 11A(1)-(3)). The Australian Airspace Policy Statement is defined within the new section by reference to subsection 8(1) of the Airspace Act 2007 (Schedule 1, new s 11A(3)).

Technical amendments: Schedule 2 changes internal cross‑references and definitions in both the Air Services Act 1995 and the Civil Aviation Act 1988. These are precise textual substitutions: subsection 19(2) of the Air Services Act 1995 omits certain subparagraph references; subsection 77(3) is amended in two places to substitute “covered by paragraph 8(1)(a)” for earlier cross‑references to para 8(1)(b). In the Civil Aviation Act 1988, the definition of aviation safety standards is altered by repealing and substituting subparagraphs so that services and facilities are described as those “covered by paragraph 8(1)(a) of the Air Services Act 1995” (Schedule 2, items 1-5). Those changes can alter the scope of what counts as relevant services and facilities under those statutory definitions by shifting the paragraph referenced in the Air Services Act 1995.

Transitional regulation power: Schedule 3 creates a conditional power for the Governor‑General to make regulations of a transitional nature where regulations under the Air Services Act 1995 repeal Part 2 of the Air Services Regulations in connection with enactment of Part 3 of the Airspace Act 2007 (Schedule 3, subitem (1) and note). The power expressly permits saving and application provisions, and permits regulations that deem specified past or present things done by or in relation to Airservices Australia under Part 2 to have effect after repeal as if done by or in relation to CASA for the purposes of regulations under Part 3 of the Airspace Act 2007 (Schedule 3, subitems (2)-(3)). The item clarifies that subitem (3) does not limit the power in subitem (2) and defines “Airservices Australia” and “CASA” for the transitional item (Schedule 3, subitems (4)-(5)).

Interlocking commencement timing: The Act ties some of its amendments to the commencement of particular parts of the Airspace Act 2007. Schedule 1 and Schedule 3 commence at the same time as ss 3-15 of the Airspace Act 2007 (s 2, commencement table); Schedule 2 commences on assent (s 2).

The main statutory concepts are therefore institutional assignment of functions, a statutory consistency duty to a policy statement with a notice requirement when deviating, textual realignment of cross‑references and definitions, and a transitional mechanism to transfer or save actions when responsibility moves from Airservices Australia to CASA.

The Act directly affects three groups of public actors and indirectly affects private parties and regulated entities that interact with airspace management or air navigation services.

Directly affected public actors

• CASA (Civil Aviation Safety Authority): The Act explicitly expands the catalogue of matters relevant to CASA by adding any functions conferred on CASA under the Airspace Act 2007 (Schedule 1, item 1). It imposes a statutory duty on CASA to exercise powers and perform functions in a manner consistent with the Australian Airspace Policy Statement, subject to subsection 9A(1), and to notify the Minister in writing if it proposes to act inconsistently (Schedule 1, new s 11A(1)-(3)). The Act therefore changes both CASA’s statutory remit and its decision-making constraints.
• Airservices Australia: The Schedule 3 transitional provision is expressly tied to the transfer of airspace management functions from Airservices Australia to CASA (Schedule 3, note). The transitional regulation power contemplates regulations that treat acts done by or in relation to Airservices Australia as if done by or in relation to CASA after repeal (Schedule 3, subitem (3)). Thus Airservices Australia is the source of functions and actions that may be deemed to carry forward under the new regime.
• The Minister: The new s 11A(2) creates an administrative step: if CASA proposes to act inconsistently with the Australian Airspace Policy Statement, CASA must notify the Minister in writing and state its reasons. That makes the Minister an addressee of a required notification and a participant in the policy oversight chain.

Indirectly affected private actors and regulated parties

• Airspace users and operators (commercial airlines, general aviation, aerial work operators, aerodrome operators, air navigation services suppliers): While the Act does not directly regulate operational behaviour, its amendments shift where airspace management functions are located and how CASA must align decision-making with the Australian Airspace Policy Statement. Changes in institutional responsibility and the consistency duty can affect the way airspace is managed in practice, the processes for approvals or restrictions, and the administrative interlocutory path for decisions. The Act itself contains a note that it relates to transfer of airspace management functions (Schedule 3, note), which signals that regulated entities will encounter CASA rather than Airservices for some matters once the transfer occurs.
• Entities referenced by the Air Services Act 1995 and Civil Aviation Act 1988: The technical substitutions in Schedule 2 change which paragraph (8(1)(a) rather than 8(1)(b)) is used to define “AA service” and “rescue and fire fighting operations” (Air Services Act 1995, Schedule 2, items 2-3), and alter the definition of “aviation safety standards” in the Civil Aviation Act 1988 (Schedule 2, items 4-5). Any person whose rights or obligations depend on these defined terms will be affected by the altered scope of those definitions.

Who pays and who decides

• Who pays: The Act itself does not create a new funding stream or fee, nor does it impose criminal fines. The primary fiscal consequence implicit in the Act is that CASA becomes the statutory holder for at least some airspace management functions (Schedule 1, item 1; Schedule 3, note), which may change the locus of administrative costs between Airservices Australia and CASA. The Act does not specify appropriation or fee arrangements.
• Who decides: Decision‑making about airspace policy and the operational exercise of functions will be taken by CASA consistent with the Australian Airspace Policy Statement, except where subsection 9A(1) applies (Schedule 1, new s 11A(1)-(2)). The Minister receives notifications under s 11A(2) where CASA proposes inconsistency with the Policy Statement, making the Minister a recipient of a statutory notice but not, by this Act, a statutory veto.

Temporal and conditional effects

• Timing: Some amendments do not commence until provisions of the Airspace Act 2007 (ss 3-15) commence (s 2), so the practical effect on stakeholders depends on that later commencement. Schedule 2’s technical amendments, however, are immediate on assent (s 2).
• Conditional transitions: The transitional regulation power in Schedule 3 only applies if regulations are made under the Air Services Act 1995 repealing Part 2 of the Air Services Regulations in connection with enactment of Part 3 of the Airspace Act 2007 (Schedule 3, subitem (1)). That makes the substantive transfer and the consequential deeming of acts conditional on further regulation being made.

In sum, CASA and Airservices Australia are the principal public actors whose responsibilities and administrative relations are altered. The Minister acquires a statutory notification role. Private and commercial users of airspace are affected indirectly through the institutional and definitional changes. All of these effects are contingent on the relevant commencements and on any transitional regulations made under Schedule 3.

This Act creates a small set of explicit duties and modifies the statutory context for rights under the two affected Acts. The central new duty is imposed on CASA; other “duties” are created in the sense of enabling authorities and definitional clarifications that reshape statutory rights and obligations elsewhere.

CASA’s consistency duty and notification obligation

• Consistency duty: Schedule 1 inserts a new section 11A into the Civil Aviation Act 1988. Section 11A(1) requires that, subject to subsection 9A(1), CASA must exercise its powers and perform its functions in a manner consistent with the Australian Airspace Policy Statement. This is an explicit statutory direction binding CASA on the face of the Civil Aviation Act.
• Notification duty: Section 11A(2) requires CASA to notify the Minister in writing if it proposes to exercise a power or perform a function in a manner inconsistent with the Australian Airspace Policy Statement and to state its reasons. That creates a procedural obligation directed at administrative transparency between CASA and the Minister when CASA intends to depart from the policy statement.

Scope of the consistency duty

• The Australian Airspace Policy Statement is defined in s 11A(3) as the statement made under subsection 8(1) of the Airspace Act 2007. The Act therefore ties CASA’s statutory duty to a policy instrument that is located in another Act. The consistency duty is subject to subsection 9A(1) , a qualification that appears in the Civil Aviation Act outside this Act’s text (Schedule 1, new s 11A(1)). The presence of that qualification means CASA’s duty to be consistent is not absolute on the face of the insertion; the qualification must be examined in the Civil Aviation Act to identify its effect.
• The notification requirement is to the Minister; the Act does not create a power in the Minister in this Act to direct CASA or to veto CASA’s proposed action. The text requires notification and reasons but does not specify a decision-making or override power for the Minister in relation to the proposed inconsistent action (Schedule 1, new s 11A(2)).

Consequential recognition of Airspace Act functions

• Schedule 1, item 1 inserts a new paragraph (cc) after para 9(3)(cb) in the Civil Aviation Act that expressly includes “any functions conferred on CASA under the Airspace Act 2007 or under regulations under that Act.” That means functions conferred under the Airspace Act 2007 are recognised as part of CASA’s functions for the purposes of the Civil Aviation Act 1988. This is not a free-standing duty but it formally incorporates that power set into CASA’s statutory remit.

Technical redefinitions and their implications for rights/obligations

• Schedule 2’s substitutions change definitions and cross-references which underpin statutory rights and obligations elsewhere. For example, in the Air Services Act 1995, subsection 77(3) is amended to substitute “covered by paragraph 8(1)(a)” where it previously referred to paragraph 8(1)(b). That alters which services are caught by defined terms such as “AA service” and “rescue and fire fighting operations” (Schedule 2, items 2-3). In the Civil Aviation Act 1988, the definition of “aviation safety standards” is amended so the referenced services and facilities are those “covered by paragraph 8(1)(a) of the Air Services Act 1995” (Schedule 2, items 4-5). These definitional changes can shift the set of entities or activities that have statutory entitlements or obligations under those Acts.

Transitional regulation power and saving/deeming

• Schedule 3 gives the Governor‑General a regulation-making power to deal with transitional matters arising if regulations repeal Part 2 of the Air Services Regulations in connection with Part 3 of the Airspace Act 2007 (Schedule 3, subitems (1)-(2)). Regulations under this power may include saving or application provisions and may provide that things done by or in relation to Airservices Australia continue to have effect as if done by or in relation to CASA under new regulations (Schedule 3, subitem (3)). This is a mechanism by which existing administrative acts, licences, approvals, or other instruments can be preserved or reallocated without reissue; for affected entities, it functions as a statutory right to continuity where the regulations so provide.

Absence of new penal sanctions or private rights in this Act

• The Act does not itself introduce new criminal penalties, civil sanctions, or private enforcement remedies. Its duties are administrative in nature (see Schedule 1, new s 11A). The Act instead alters institutional duties, definitions, and provides a regulatory transition mechanism.

In short, the key express duty created by this Act is CASA’s obligation to act consistently with the Australian Airspace Policy Statement and to notify the Minister of proposed inconsistencies (Schedule 1, new s 11A). The Act also formally incorporates Airspace Act functions into CASA’s remit (Schedule 1, item 1) and changes definitions which underpin statutory rights and obligations in the Air Services Act 1995 and Civil Aviation Act 1988 (Schedule 2). The transitional regulation-making power (Schedule 3) creates a statutory mechanism to preserve the legal effect of prior acts or instruments during a change in institutional responsibility.

This Act does not create express criminal offences, pecuniary penalties, or an enforcement regime of its own. The primary enforcement mechanisms are administrative and statutory oversight embedded in the amendments.

Absence of new criminal or civil penalties

• Nowhere in the text of this Act are new offences, fines, or statutory civil penalties created. The inserted duties (for example, CASA’s duty to be consistent with the Australian Airspace Policy Statement and its notification obligation) are administrative performance obligations. The Act does not specify a penalty for failing to comply with s 11A or any other inserted provision (Schedule 1, new s 11A). Nor does the Act itself confer powers to impose fines or other sanctions for breach of s 11A.

Administrative oversight and internal accountability

• The enforcement lever the Act does create is procedural: s 11A(2) obliges CASA to notify the Minister in writing if CASA proposes to act inconsistently with the Australian Airspace Policy Statement and to provide reasons. That notification obligation places a record and an avenue for ministerial oversight into the administrative process. The Act does not in its text establish a ministerial power to veto or disallow the proposed inconsistent action; the Act only requires notification and reasons (Schedule 1, new s 11A(2)). Any remedial or disciplinary response to non‑compliance would arise under the institutional framework governing CASA (for example administrative law, statutory governance arrangements, or other provisions of the Civil Aviation Act), none of which are expanded with penalties by this Act.

Regulation-making and transitional saving provisions as non‑penal enforcement tools

• Schedule 3 gives the Governor‑General power to make regulations of a transitional nature, including saving and application provisions (Schedule 3, subitem (2)). Regulations made under that head can ensure continuity of legal effects (for example, by deeming acts of Airservices Australia to be acts of CASA after transfer) (Schedule 3, subitem (3)). Such regulation-making is an enforcement‑adjacent mechanism to preserve legal rights and obligations during institutional change; it does not itself impose sanctions.

Judicial or administrative review

• The Act does not explicitly create new statutory rights of review or appeal connected to the inserted provisions. Standard administrative law remedies (judicial review) or any existing statutory review rights under the Civil Aviation Act 1988 or Air Services Act 1995 remain available according to those Acts’ terms. For example, if CASA exercises a power in a way some party claims is inconsistent with the Australian Airspace Policy Statement, affected parties would need to rely on the available statutory or common law administrative review mechanisms outside this Act to challenge the action. The Act itself does not expand or constrain those avenues.

Practical enforcement implications

• The practical enforcement instrument created by the Act is the requirement to notify the Minister where CASA proposes inconsistent conduct (Schedule 1, new s 11A(2)); that creates a paper trail and a point of ministerial awareness but not, by the text, a mandatory corrective power. The regulatory transition power in Schedule 3 operates administratively through subordinate regulation to preserve rights and obligations during the transfer of responsibilities, rather than by imposing sanctions for non‑compliance.

In sum, enforcement following from this Act is administrative and regulatory rather than penal. The Act imposes procedural and directional duties (notably s 11A), aligns statutory remits by amendment, and empowers transitional regulations, but it does not itself establish a fines-based or criminal enforcement regime.

The Act is explicitly consequential; its function is to modify and align existing aviation statutes and to interact with subordinate instruments. Its interactions are therefore cross‑statutory and temporal.

Primary cross-references and interactions

• Civil Aviation Act 1988: Schedule 1 inserts a new paragraph recognising Airspace Act 2007 functions as part of CASA’s remit and inserts s 11A into the Civil Aviation Act 1988 requiring CASA to be consistent with the Australian Airspace Policy Statement (Schedule 1, items 1-2). The new s 11A(3) defines the Australian Airspace Policy Statement by reference to subsection 8(1) of the Airspace Act 2007, directly linking the Civil Aviation Act to the Airspace Act 2007. The consistency duty is subject to subsection 9A(1) of the Civil Aviation Act, which remains part of that Act and thus creates an internal qualification or exception to the new duty (Schedule 1, new s 11A(1)).
• Airspace Act 2007: The Act’s commencement structure links Schedules 1 and 3 to the commencement of sections 3-15 of the Airspace Act 2007 (s 2). The new s 11A(3) in the Civil Aviation Act defines the Australian Airspace Policy Statement as the statement made under s 8(1) of the Airspace Act 2007. The Schedule 3 transitional provisions are explicitly designed to operate in the event of repeal of Part 2 of the Air Services Regulations in connection with enactment of Part 3 of the Airspace Act 2007 (Schedule 3, subitem (1) and note). In short, this Act is an accessory to the Airspace Act 2007 and modifies other legislation to implement that Act’s framework.
• Air Services Act 1995 and Air Services Regulations: Schedule 2 contains technical amendments to the Air Services Act 1995 (Schedule 2, items 1-3), and Schedule 3 is conditional on regulations made under the Air Services Act 1995 which repeal Part 2 of the Air Services Regulations (Schedule 3, subitem (1)). Schedule 3 contemplates the Governor‑General making regulations to manage transitional matters that arise from that repeal (Schedule 3, subitems (2)-(3)). Thus the Act interacts with subordinate regulations under the Air Services Act 1995 and provides for regulatory continuity when a statutory transfer of functions occurs.
• Definitions and scope alignment across Acts: Schedule 2 alters definitions in the Civil Aviation Act 1988 so they reference “services and facilities of the kind covered by paragraph 8(1)(a) of the Air Services Act 1995” (Schedule 2, items 4-5). At the same time, the Air Services Act 1995 is itself amended to use paragraph 8(1)(a) in relevant definitions (Schedule 2, items 2-3). These changes reallocate the conceptual scope of defined terms across statutes, which can change which persons or activities are subject to particular regulatory regimes.
• Subordinate instruments and saving provisions: The Act contemplates subordinate regulations that may save or reapply prior acts (Schedule 3, subitem (2)-(3)). Those subordinate regulations will be the primary instruments by which existing licences, authorisations, or administrative actions taken under the repealed Part 2 of the Air Services Regulations can be preserved or deemed to have been taken by CASA under new regulations. The Act therefore delegates key transitional detail to secondary instruments under the Governor‑General’s regulation‑making power.

Temporal and conditional interactions

• Commencement linkage: Schedule 1 and Schedule 3 do not commence until ss 3-15 of the Airspace Act 2007 commence; Schedule 2 commences on assent (s 2). This staggers the operational effect of the amendments and ties them to the implementation schedule of the Airspace Act 2007. The effect is that certain definitional changes (Schedule 2) take effect immediately while function transfers and the consistency duty take effect only when the Airspace Act provisions commence.
• Conditional regulatory triggers: Schedule 3 only applies if regulations under the Air Services Act 1995 repeal Part 2 of the Air Services Regulations in connection with the enactment of Part 3 of the Airspace Act 2007 (Schedule 3, subitem (1)). So the Act’s transitional mechanism is contingent on further regulatory action.

Limits of interaction set in the Act

• The Act does not itself provide the content of the Australian Airspace Policy Statement, the detailed rules in Part 3 of the Airspace Act 2007, or the specific transitional regulations. It only provides the statutory hooks and conditional regulatory powers to align and preserve effects across the statutes. Substantive operational detail is left to the Airspace Act 2007 and subordinate regulation-making powers.

In short, this Act operates as a connective tissue between the Civil Aviation Act 1988, the Air Services Act 1995 (and its regulations), and the Airspace Act 2007. It alters definitions, incorporates Airspace Act functions into CASA’s remit, imposes a statutory policy‑consistency duty on CASA, and enables transitional regulation-making to preserve continuity when responsibility for airspace management moves from Airservices Australia to CASA.

The Act includes its own commencement table and records only the original enactment details; the text does not record any later amendments. The amendment history we can extract from the text is limited to the Act’s own original enactment and commencement staging.

Original enactment and assent

• The Act was assented to on 30 March 2007. The commencement table in s 2 lists the dates and conditions for commencement of the Act’s provisions. Sections 1-3 and anything not covered elsewhere commence on the day of Royal Assent (30 March 2007). Schedule 2 also commences on that day (s 2, commencement table).

Staged commencements linked to Airspace Act 2007

• Schedule 1 and Schedule 3 commence “at the same time as sections 3 to 15 of the Airspace Act 2007 commence.” The commencement table indicates that occurs on 1 July 2007 for the originally published version (s 2, commencement table). The table contains a note that it relates only to provisions as originally passed and assented to, and that it will not be expanded to deal with provisions inserted after assent (s 2(2) note).

Schedules and their substance as passed

• Schedule 1 (Consequential amendments) amended the Civil Aviation Act 1988 by inserting a new paragraph to list functions of CASA under the Airspace Act 2007 (Schedule 1, item 1), and by inserting s 11A as a consistency duty and notification requirement (Schedule 1, item 2).
• Schedule 2 (Technical amendments) made textual substitutions in the Air Services Act 1995 and Civil Aviation Act 1988 to reassign references to paragraph 8(1)(a) where previously paragraph 8(1)(b) was used, and to rework the definition of aviation safety standards (Schedule 2, items 1-5). Schedule 2 commenced on assent.
• Schedule 3 (Transitional provision) created a regulation-making power for transitional matters if repeal of Part 2 of the Air Services Regulations occurs in connection with enactment of Part 3 of the Airspace Act 2007 (Schedule 3, items (1)-(4)). The Schedule contains a clarifying note that it relates to the transfer of airspace management functions from Airservices Australia to CASA (Schedule 3, note).

Parliamentary record references

• The Act records that the Minister’s second reading speech was made in the House of Representatives on 29 November 2006 and in the Senate on 6 February 2007 (endnote).

No subsequent amendments recorded in the text supplied

• The supplied text contains no further amendment history, revision notes, or later versions. The Act’s s 2(2) explicitly cautions that the commencement table relates only to provisions as originally passed and assented; it will not be expanded to deal with provisions inserted after assent.

Implications for legal research

• To track any changes made after this original enactment, researchers will need to consult consolidated statute versions, legislative amendment records, or the official legislation database; the text supplied contains only the original enactment material and does not include later amendments or repeals.

Overall, the amendment history in the supplied source comprises the Act’s original passage in 2007, the staged commencements tied to the Airspace Act 2007, and the content of Schedules 1-3 as enacted. No later amending instruments or repeals are recorded in the material provided.

The statutory text supplied contains no litigation history. The Act itself does not record any judicial decisions or dispute outcomes arising from its provisions. The only procedural legislative record included in the Act is the note of the Minister’s second reading speech dates (House of Representatives, 29 November 2006; Senate, 6 February 2007). There are no case names, judgments, or references to litigation within the Act’s text.

What the Act contains and what remains external

• The Act inserts administrative duties and creates regulatory hooks, for example CASA’s duty to be consistent with the Australian Airspace Policy Statement and the Governor‑General’s transitional regulation power. Any judicial consideration of those duties, or of disputes arising from the consequential amendments (for example judicial review of CASA action alleged to be inconsistent with the Policy Statement), would be found in court or tribunal records external to the Act. Those records are not present in the text supplied.

How to locate litigation if needed

• To find litigation that engages the inserted provisions (for example judicial review of CASA decisions under the Civil Aviation Act 1988 after the insertion of s 11A), one would need to search case law databases, court registries, or consolidated legislative histories referencing this Act and the Airspace Act 2007. The supplied source does not provide those materials.

Absence of recorded decisions in the Act

• The supplied Act text contains no provisions that summarise or record judicial interpretations or disputes about its provisions. Therefore no litigation history can be summarised from this source alone.

In short, there is no litigation history contained in the material provided. Any litigation engaging these enactments is outside the scope of the supplied text and would need to be obtained from external case law resources.

The text of the Act is short but contains several features that can cause practical traps if unconsidered. These are procedural, definitional, and contingent‑on‑regulation issues rather than substantive policy matters contained in the Act.

1. Staggered and conditional commencements

• Schedule 2 commences on assent but Schedules 1 and 3 only commence when ss 3-15 of the Airspace Act 2007 commence (s 2). Practitioners must not assume all amendments operate immediately. Timing affects which entity (Airservices Australia or CASA) has the statutory function at any given time. Check the actual commencement of the Airspace Act provisions and any subsequent amending instruments before advising clients.

2. Consistency duty is subject to an internal qualification

• The new s 11A(1) in the Civil Aviation Act requires CASA to act consistently with the Australian Airspace Policy Statement “subject to subsection 9A(1)”. That cross‑reference is outside this Act’s text; the qualification could materially limit or modify the consistency requirement. Do not treat s 11A as absolute without reading subsection 9A(1) of the Civil Aviation Act 1988.

3. Notification is not a ministerial veto

• Section 11A(2) requires CASA to notify the Minister in writing if it proposes inconsistency and to state reasons. The Act does not, in this insertion, create an express ministerial power to prevent the action or to require reconsideration. Users should not assume notification translates into a statutory control power; the Act is procedural on its face.

4. Definitional shifts may narrow or widen statutory scope without explicit discussion

• Schedule 2 replaces references to paragraph 8(1)(b) with references to paragraph 8(1)(a) in multiple places (Air Services Act 1995, Schedule 2, items 2-3) and changes definitions in the Civil Aviation Act (Schedule 2, items 4-5). Those textual shifts can change who falls within defined categories such as “AA service”, “rescue and fire fighting operations” and what is covered by “aviation safety standards”. Check the content of paragraph 8(1)(a) and 8(1)(b) of the Air Services Act 1995 to know the practical effect.

5. Transitional regulations may effect continuity without reissuance

• Schedule 3 permits regulations to make acts done by or in relation to Airservices Australia have effect after repeal as if done by or in relation to CASA under the new Part 3 regulations (Schedule 3, subitem (3)). That can preserve licences, approvals, or procedural outcomes without reissuing them. However, reliance on deemed continuity requires the relevant transitional regulations to be made, and those regulations will determine which documents or rights are preserved.

6. The Australian Airspace Policy Statement is external

• The consistency duty refers to the Australian Airspace Policy Statement as made under s 8(1) of the Airspace Act 2007 (Schedule 1, new s 11A(3)). The contents and legal status of that Policy Statement are not in this Act. Any assessment of CASA’s obligations depends on the text of the Policy Statement and on how it is produced and updated under the Airspace Act 2007.

7. No penalties in the Act for non-compliance with s 11A

• The Act imposes an administrative duty but does not specify sanctions for breach. Enforcement would therefore be by other means (for example, administrative review, political oversight, or remedies available under other statutes). Do not assume a direct statutory penalty regime flows from the wording of this Act.

8. Conditional trigger for Schedule 3

• Schedule 3 applies only “if regulations are made under the Air Services Act 1995 repealing Part 2 of the Air Services Regulations in connection with the enactment of Part 3 of the Airspace Act 2007” (Schedule 3, subitem (1)). The presence and content of transitional protections therefore depend on a twofold regulatory action: repeal plus connection to Part 3. Confirm these steps have occurred before relying on Schedule 3’s protections.

9. Textual amendments may have drafting quirks

• Several Schedule 2 items operate by omission and substitution of cross‑references. Small drafting errors or unintended interactions may occur if the targeted paragraph numbering in the other Act changes later. Practitioners should verify consolidated texts when advising.

10. Narrow record in this Act for accountability or remedy

• The Act creates obligations primarily in administrative form. Parties seeking remedies where those obligations are not observed will need to map the available judicial review, statutory appeal, and internal accountability mechanisms in the Civil Aviation Act 1988 and the Airspace Act 2007.

These “gotchas” highlight that the Act is a connective instrument: its practical legal impact depends on other instruments (the Airspace Act 2007, its Policy Statement, regulations under the Air Services Act 1995) and on precise timing. Practitioners should follow the related instruments and commencement notices closely.

Compliance under this Act is primarily an administrative exercise for public agencies and a continuity-checking exercise for regulated parties. The Act’s requirements and default operation are limited in number; practical compliance focuses on timing, notification obligations, definitional consequences, and transitional arrangements.

For CASA (principal duties)

1. Track commencement timing

• Confirm when ss 3-15 of the Airspace Act 2007 commence because Schedule 1 (which inserts s 11A and recognises Airspace Act functions) and Schedule 3 commence at that time (s 2). Do not assume those provisions operate on assent if the Airspace Act provisions have a later commencement.

2. Align decision-making to the Australian Airspace Policy Statement

• Prepare internal policies and decision‑making procedures to ensure powers and functions are exercised “in a manner consistent with the Australian Airspace Policy Statement” subject to subsection 9A(1) (Schedule 1, new s 11A(1)). That requires obtaining and maintaining a current copy of the Policy Statement made under s 8(1) of the Airspace Act 2007 and documenting how decisions conform to it.

3. Implement the notification process

• Create a formal internal compliance workflow for the s 11A(2) requirement: if CASA proposes to exercise a power or perform a function in a manner inconsistent with the Australian Airspace Policy Statement, CASA must notify the Minister in writing and set out reasons (Schedule 1, new s 11A(2)). That workflow should include legal sign-off, content standards for the written reasons, timelines for notification, and records retention.

4. Map functions transferred from Airservices Australia

• Once Part 3 of the Airspace Act 2007 and the relevant regulations commence, map the functions conferred under that Act that now fall within CASA’s remit (Schedule 1, item 1). Update organisational charts, delegations, and operational manuals to reflect any newly conferred functions.

For Airservices Australia

1. Prepare for transitional regulation outcomes

• If subordinate regulations repeal Part 2 of the Air Services Regulations in connection with enactment of Part 3 of the Airspace Act 2007, Schedule 3 allows the Governor‑General to make regulations that preserve the effect of things done by or in relation to Airservices Australia as if done by CASA (Schedule 3, subitem (3)). Airservices should prepare inventories of licences, approvals, agreements, and other instruments likely to require transitional saving and liaise with the relevant policy and drafting authorities to ensure accurate transitional regulations.

2. Maintain records and identify items for saving

• The transitional power is exercised by regulation. To enable pragmatic transitional saving, Airservices should maintain clear records of acts and instruments under Part 2 that should be preserved or adapted to CASA’s new regulatory regime.

For Ministers and the Department

1. Process notifications in s 11A(2)

• Establish an administrative process to receive, log, and consider s 11A(2) notifications from CASA. While the Act does not provide a statutory veto, the notification is a point for ministerial visibility and possible political or administrative follow-up.

For regulated private parties (airspace users, aerodrome operators, service providers)

1. Monitor regulatory and commencement notices

• Track commencement notices for ss 3-15 of the Airspace Act 2007 and for regulations under the Air Services Act 1995 that repeal Part 2 of its Regulations. The practical effect on who issues approvals and which standards apply hinges on these commencements and on subordinate regulations.

2. Check definitional impacts

• Review whether the Schedule 2 amendments to definitions affect the entity’s regulatory classification. Schedule 2 substitutes references to paragraph 8(1)(a) and changes wording in the Civil Aviation Act 1988 for the definition of “aviation safety standards” (Schedule 2, items 1-5). Confirm whether the entity’s activities remain classified under the same statutory categories and whether regulatory obligations or entitlements are affected.

3. Identify documents that may be preserved by transitional regulations

• If an approval, licence, or instrument was issued by Airservices Australia under Part 2 of the Air Services Regulations, identify whether transitional regulations should deem those things to be by or in relation to CASA (Schedule 3, subitem (3)). Where continuity is necessary for ongoing operations, prepare to engage with regulators on transitional instrument contents.

For drafters and legal advisers

1. Verify cross‑statutory references

• Before advising on rights and obligations post-enactment, verify the current text of the Air Services Act 1995 (paragraph 8(1)(a) versus 8(1)(b)), the Civil Aviation Act 1988 (including subsection 9A(1)), and the Airspace Act 2007 (including s 8(1)). The Act hooks into those provisions; the practical content depends on them.

2. Prepare client-facing compliance memos that cover:

• commencement dates and dependency on the Airspace Act 2007;
• CASA’s notification process and likely administrative timelines;
• definitional changes and who exercises which functions post-transfer;
• how transitional regulations will be sought and what they must cover to protect client interests.

Record-keeping and audit trail

• Because Schedule 3 contemplates deeming previously done actions to be actions of CASA, maintaining strong records of actions, authorisations, licences and correspondence is essential. Parties relying on continuity should ensure documents are readily locatable and that any transitional regulations accurately reference those documents.

In short, compliance under this Act is largely about administrative preparedness: tracking commencement dates and subordinate regulations, aligning CASA’s internal decision-making processes to the Australian Airspace Policy Statement, ensuring the s 11A(2) notification procedure is implemented, and preparing inventories and records to enable transitional saving where Part 2 of the Air Services Regulations is repealed and functions transfer to CASA.
