#### 36 Commonwealth may pay the FAC an amount before disposal of shares (1) This section applies in relation to an airport‑lessee company during the period: (a) beginning when the company was granted an airport lease under section 21; and (b) ending at the company’s sale time. (2) The Finance Minister may determine in writing that the FAC should be paid a specified amount of capital. The determination must specify a company as the nominated company in relation to the payment. (3) The Finance Minister may authorise the payment by the Commonwealth to the FAC of the amount specified under subsection (2). (4) If, because of subsection (2), an amount (the capital amount) is payable to the FAC, the Finance Minister may determine in writing that the FAC must pay a specified amount to the Commonwealth, so long as the specified amount does not exceed the capital amount. (5) The amount payable because of subsection (2) may be set‑off against the amount payable under subsection (4). (6) The amount payable under subsection (4) is payable by way of return of capital to the Commonwealth.
