What it does
This instrument, the Airports (Major Airport Developments) Determination 2021, is a statutory determination made under subsection 89(8) of the Airports Act 1996 (the Act) and dated 25 March 2021 (s 3; front matter). It commences on the day after registration (s 2). The determination defines how the phrase "cost of construction" is to be interpreted for the purposes of paragraph 89(7) of the Act by specifying categories of costs that are included and categories that are not included (see ss 6-7). It also supplies several operative definitions used only in the instrument or clarifies that certain expressions are defined in the Act (s 4).
Mechanically, the instrument does three things. First, it sets what is meant by "costs associated with an activity or thing" for the purposes of the included/excluded lists: that phrase includes all material, equipment, labour and freight costs, and all taxes other than GST (s 5). Second, it lists specific components that are to be treated as forming part of the "cost of construction" for the Act (s 6). Those include, among other items, site establishment, earthworks, specified elements of building construction (footings, structure, cladding, roofing), construction or installation of base services, builders' margins, and for developments that consist of constructing a new building, certain car parking facilities and base building fit-out (s 6). Third, it identifies components that are not to be treated as part of the cost of construction, including design, legal and financial consultant fees, contingencies, tenant fit-out and tenant-supplied items, obtaining permits or approvals, site remediation, trunk infrastructure, financial incentives to attract tenants, most car parking (except as allowed by s 6), landscaping and GST (s 7).
The instrument is narrowly drafted: it does not create offences, procedural steps or decision-making powers itself. Its operation is to qualify and clarify the reach of paragraph 89(7) of the Act by binding how the statutory phrase "cost of construction" should be calculated when applying the Act (s 6 heading and s 7 heading, read with s 3). It also cross-refers to the GST Act for the meaning of GST (s 4). In short, this instrument is a cost-definition tool for the Airports Act approval and compliance framework: it tells administrators and regulated parties what line items to include or exclude when a "major airport development" requires the statutory measurement of "cost of construction."
