67 Occupier may voluntarily prepare remediation plan
(a) an assessor gives an airport environment officer for an airport a written assessment in accordance with section 64 in relation to an area at an airport; and
(b) the written assessment indicates that the assessor believes that air, water or soil pollution, or offensive noise, has occurred in the area.
(2) The occupier of the area may give the airport environment officer for the airport a remediation plan to clean up, remedy or rectify (as appropriate) the air, water or soil pollution, or offensive noise in the area.
(3) The remediation plan must be developed in consultation with an assessor and must set out the objectives of the plan, including a timetable for achieving the objectives of the plan and details of:
(a) if the plan is for cleaning up the air, water or soil pollution—the air, water or soil pollution quality standards that can reasonably be achieved under the plan that will:
(i) end generation (including migration) of pollution from the area occupied (if that is occurring) within the shortest time reasonably practicable; and
(ii) restore all affected potential beneficial uses of any waters (both within the meaning of subsection 16(3)) before the occupier ceases occupation; and
(iii) restore all affected potential beneficial uses (within the meaning of subsection 17(3)) of soil and land before the occupier ceases occupation; and
(iv) restore all beneficial uses (within the meaning of subsection 17(3)) of groundwater (if any) before the occupier ceases occupation; or
(b) otherwise—an appropriate risk management program that will, at least:
(i) end generation (including migration) of pollution from the area occupied (if that is occurring) within the shortest time reasonably practicable; and
(ii) ensure that any ongoing effects of the pollution are minimised.
(4) The airport environment officer must, before the end of 30 days after receiving the remediation plan:
(a) approve or refuse to approve the plan; and
(b) give the occupier written notice of the decision; and
(c) if the decision is to refuse to approve the plan—set out the reasons for the refusal in the notice.
assessor means:
(a) to the extent that an investigation report relates to soil pollution at an airport—a person who is appointed, registered or otherwise recognised as an environmental auditor under a law of the State in which the airport is located, or under a law of another State, providing for environmental auditor accreditation; or
(b) to the extent that an investigation report relates to air pollution, water pollution or offensive noise (or any combination of air pollution, water pollution and offensive noise) at an airport—a person who is certified, registered or otherwise recognised by a professional body (or under a professional scheme) to undertake environmental assessments, investigations or auditing in the State in which the airport is located, or in another State.
