52 Authorisation may be transferred
(1) Subject to subsection (2), the holder of an authorisation may, if ownership of an undertaking to which the authorisation applies is to be transferred to another person, transfer the authorisation to the other person (the transferee) if:
(a) the holder of the authorisation gives written notice of the proposed transfer to an airport environment officer; and
(b) the notice includes a statement:
(i) that the airport‑lessee company for the airport endorses the proposed transfer; or
(ii) if the airport‑lessee company for the airport does not endorse the proposed transfer—setting out the reasons why the airport‑lessee company for the airport does not endorse the proposed transfer; and
(c) the transferee gives the airport environment officer a written undertaking that the transferee will comply with the terms and conditions of the authorisation; and
(d) the airport environment officer gives the holder of the authorisation a notice under subsection (2) permitting the holder:
(i) to transfer the authorisation; or
(ii) to transfer the authorisation subject to conditions.
(2) If an airport environment officer is satisfied that in all the circumstances it is appropriate to do so, the officer may, by written notice given to the holder of the authorisation:
(a) permit the holder to transfer the authorisation; or
(b) permit the holder to transfer the authorisation subject to conditions specified in the notice; or
(c) refuse to permit the holder to transfer the authorisation.
(3) A notice under subsection (2) may specify a day by which the holder must transfer the authorisation.
(4) If the holder does not transfer the authorisation by the day specified in the notice, the permission to transfer the authorisation is taken to be revoked at the end of that day.
(5) An airport environment officer must, at the same time as the airport environment officer gives a notice to a holder under subsection (2), also give a copy of the notice to the airport‑lessee company for the airport concerned.
(6) If a permission to transfer an authorisation is taken to be revoked under subsection (4), an airport environment officer must, as soon as practicable after the permission is taken to be revoked, notify the airport‑lessee company mentioned in subsection (5) of that fact.
(7) For the purposes of this instrument, a person to whom an authorisation is transferred in accordance with this section becomes the holder of the authorisation.
