45  Authorisation granted under section 43 is subject to conditions

  An authorisation granted under section 43 is subject to:

 (a) the condition that the holder of the authorisation must comply with the environment management plan referred to in subsection 41(3) that accompanied the application for the authorisation; and

 (b) any other conditions specified in the authorisation.

Note 1: Under section 79 an airport environment officer may require the holder of an authorisation to comply with a condition of the authorisation.

Note 2: If an authorisation is transferred under section 52, the transfer of the authorisation may be subject to conditions.
