41 Application for authorisation
(1) A person may apply to an airport environment officer for an authorisation under this section in relation to an airport.
(2) The application must be in writing and must:
(a) set out:
(i) the name of the applicant; and
(ii) the name of the airport concerned; and
(iii) the actions or activities to be covered by the authorisation; and
(b) for an action or activity that is likely to generate pollution—set out any investigation levels or objectives for the airport:
(i) under Schedule 1, 2 or 3 (the relevant Schedule); or
(ii) under a local standard applying in substitution for the relevant Schedule;
that are intended to be exceeded if the authorisation is granted, and the likely extent of the excess; and
(c) for an action or activity that is likely to generate noise—state whether the noise generated at the airport will be excessive:
(i) under the indicators in Schedule 4; or
(ii) under the indicators in a local standard applying in substitution for the indicators in Schedule 4;
if the authorisation is granted, and the likely level of the noise; and
(d) the reasons why the authorisation is required; and
(e) the period for which the authorisation is required.
Note: In cases of urgency, an application for an authorisation may be made orally, and granted, under section 47.
(3) The application must be accompanied by:
(a) an environment management plan detailing the actions that the applicant will take:
(i) to ensure that any actions or activities carried out in accordance with the authorisation will not result in pollution or noise that is overall more environmentally damaging than would be the case if the relevant investigation levels, noise guidelines or local standards mentioned in paragraphs (2)(b) and (c) were exactly complied with; or
(ii) if the applicant believes the outcome described in subparagraph (a)(i) can be achieved only over a period that exceeds the period for which the authorisation will have effect—to ensure that satisfactory progress is made towards achieving that outcome during the period for which the authorisation has effect; and
(b) if the applicant is not the airport‑lessee company for the airport—a written statement from the airport‑lessee company for the airport:
(i) endorsing the application and environment management plan; or
(ii) if the airport‑lessee company for the airport does not endorse the application and plan—setting out the reasons why the airport‑lessee company for the airport does not endorse the application and plan.
