104  Certain applications under the old regulations

 (1) This section applies in relation to a prescribed application made under the old regulations if:

 (a) the prescribed application was made before 1 April 2027; and

 (b) immediately before 1 April 2027, the prescribed application has not been finally dealt with in accordance with the old regulations.

 (2) Despite the repeal of the old regulations by Schedule 1 to the Airports (Environment Protection) (Repeal and Consequential Amendments) Regulations 2026, the old regulations continue to apply to the prescribed application on and after 1 April 2027 as if the repeal had not been made.

prescribed application means any of the following :

 (a) a request under regulation 5.03 of the old regulations for a local standard;

 (b) an application under regulation 5.07 of the old regulations for an authorisation;

 (c) an application under regulation 5.13 of the old regulations for an urgent authorisation;

 (d) a request under subregulation 5.16(2) of the old regulations to vary an authorisation;

 (e) an assignment of an interest in an authorisation under regulation 5.19 of the old regulations;

 (f) a request for access under subregulation 6.05(2) of the old regulations;

 (g) a request for a direction under subregulation 6.05(3) of the old regulations;

 (h) a plan submitted for approval under subregulation 6.14(1) of the old regulations.
