81 Secretary may appoint authorised persons

The Secretary may, in writing, appoint a person as an authorised person for the purposes of sections 38 and 39 if the Secretary is satisfied that: (a) the person is an appropriate expert with the required skills and experience to exercise the powers and perform the duties of an authorised person; and (b) if the person is an officer of the Department—the functions of the person as an officer of the Department are relevant to the functions of an authorised person.
