Air Transport (Route Licensing—Passenger Services) Act 2002

Declared route: A declared route is a route between two South Australian airports declared by the Minister in the Gazette under s 5(1). The declaration must describe the route, state the number of licences expected to be made available, outline possible licence conditions and the application process (s 5(2)). A declaration initially has effect for a term not exceeding three years (s 5(5)), which may be extended subject to overall limits (total period not to exceed six years, s 5(9)). The Minister may revoke or vary declarations at any time (s 5(8), s 5(10)).

Route service licence: A route service licence is the statutory permission to operate a scheduled passenger service on a declared route (see definitions in s 3 and requirement in s 6). Licences are issued by the Minister on application (s 7) and may contain conditions addressing term, performance/service levels, flight schedules, fares, infrastructure obligations, reporting, suspension and cancellation (s 8(1)(a)-(i)). The Act makes continuous CASA certification a condition of licence (s 8(2)) and provides that loss of that certification immediately suspends the licence by operation of law (s 8(4)).

Scheduled air service versus charter service: The Act distinguishes scheduled air services and charter services in the definitions (s 3). Scheduled air service is a passenger service conducted according to a fixed schedule between two airports in the State, or any other class prescribed by regulation (s 3). Charter services are defined by exclusion: seats are not made available to the public generally, plus any further regulatory criteria (s 3). The prohibition on operating a scheduled service without a route licence does not apply to charter services, emergency substitute services, alternative or additional services contemplated by licence terms, services with ministerial consent under s 10, or prescribed kinds of service (s 6(2)).

Ministerial discretion and criteria: The Minister has broad powers to declare routes, determine licence numbers and award licences. The Minister must, in deciding how many licences to award and to whom, take into account the prescribed criteria in s 4, which include monopoly risks (s 4(1)(a)), benefits of sustaining and developing services and competition (s 4(1)(b)), promoting efficiency and innovation (s 4(1)(c)), and public benefits of maintaining services in the State (s 4(1)(d)). The statute expressly states these are matters the Minister must take into account "insofar as the Minister thinks appropriate" (s 4(1)), which retains scope for ministerial judgment.

Exclusivity and limitations: A licence may confer an exclusive right to operate scheduled air services on the declared route (s 9(1)(a)), and otherwise regulate new or existing services on the route (s 9(1)(b)). However, exclusivity is subject to exceptions in regulations or in the licence itself and cannot prevent operation of services of a kind specified by regulation or the licence (s 9(2)). This creates a conditional, regulatory exclusivity that can be qualified by subordinate rules.

Incumbent protection: If an operator is already operating a scheduled service on a route at the time of declaration, the Minister must offer that existing operator a licence on terms the Minister considers fair and reasonable before inviting general industry applications (s 12(1)), unless the incumbent has publicly declared an intention to discontinue services (s 12(2)). The incumbent then has 14 days to accept (s 12(3)).

Enforcement and administration: The Act establishes authorised officers with inspection and information powers (s 16(5)), makes provision for Ministerial delegations (s 17), allows for exemptions by Gazette (s 18), requires annual administrative reporting (s 19), and sets penalties for a range of contraventions (see ss 6, 8, 10, 16(9), 18(4), 21). Regulations can cover furnishing information, service of notices, fines up to $5,000 for regulatory offences, and may delegate determination to the Minister or other authorities (s 26).

Review and dispute resolution: Review rights are limited and specific. A licence holder dissatisfied with specified ministerial decisions (variations under s 8(5) and s 8(6), consent refusals under s 10(1), refusal to accept surrender under s 14(1), suspension or cancellation except when licence expiration follows declaration expiration) or an existing operator dissatisfied with conditions of an offer under s 12 may seek review by the South Australian Civil and Administrative Tribunal (s 15(1)). Time limits for applications are short (14 or 21 days, s 15(2)). Otherwise, ministerial decisions under Parts 2 and 3 are not subject to review or appeal in the Tribunal or any court (s 15(4)), subject to statutory protections.

Interaction with safety and other law: The Act explicitly leaves safety certification to CASA by requiring appropriate CASA certification as a condition of licence (s 8(2)), and disclaims any warranty by the Minister or Crown as to an operator’s safety or reliability (s 14(2)). The Act does not relieve persons of obligations to hold other licences or registrations required by law (s 25).

Regulatory architecture: The legislative architecture is a mix of primary statutory authorisations, ministerial discretion and detailed power in regulations. Regulations can prescribe classes of service, procedural specifications, permissible delegations and limits on fees (s 26). Many core choices, route declaration, number of licences, exclusivity and licence conditions, are left to ministerial decision within the Act’s broad framework.

Operators of scheduled passenger services between South Australian airports: The primary target group is any person or entity that operates, or wishes to operate, scheduled passenger air services on a route that the Minister declares under s 5(1). Once a route is declared, s 6(1) makes it an offence to operate a scheduled air service on that route without holding a route service licence. This places a direct compliance obligation on carriers who provide scheduled services within the State.

Existing operators on routes at the time of declaration: Operators already providing scheduled services on a route declared under s 5 are singled out for preferential procedural treatment. The Minister must offer an existing operator a licence on terms the Minister regards as fair and reasonable before making a general industry invitation (s 12(1)), giving incumbents a first opportunity to secure statutory rights. Existing operators who publicly declare they intend to discontinue services are excluded from that protection (s 12(2)). The incumbent has 14 days to accept (s 12(3)), which compresses decision timelines for operators.

Potential entrants and competitors: Potential new entrants and competing carriers are affected because the Minister controls the number of licences expected to be made available (s 5(2)) and determines whether licences are awarded by invitation, tender or other method (s 7(2)). Licences may carry exclusivity (s 9(1)), fare and schedule controls (s 8(1)(b)-(c)), and infrastructure or capital obligations (s 8(1)(f)). That combination can alter market entry economics and competitive dynamics.

Local communities and passengers: The Act is framed to consider public interest and local community impacts when declaring a route (s 5(3)-(4)). The Minister must consider apparent public demand, declared intentions of operators, social or economic costs to local communities if no declaration is made, improvement potential, adequacy of alternative transport services and financial issues (s 5(4)(a)-(f)). Effects on passengers emerge indirectly through licence conditions (fares, schedules, service quality) that the Minister can impose (s 8(1)(b)-(c)).

Airport owners and service providers: Licence conditions may require the holder to provide infrastructure or undertake capital expenditure (s 8(1)(f)). That can create obligations affecting airports, ground handlers, leasing arrangements and local councils. The Minister may also require fees to be paid for administering licences (s 11(1)(b)), which can influence operating costs.

Regulators and authorised officers: The Minister’s administrative unit and authorised officers appointed under s 16 are responsible for enforcing the Act. Authorised officers have statutory powers to enter premises, require documents, examine and copy records, require evidence of licences, question persons and give directions tied to administration and enforcement (s 16(5)). Those powers affect businesses’ recordkeeping, internal compliance practices, and interactions with inspectors.

Legal advisers, consultants and tenders: Because the Minister can invite licence applications by tender or otherwise (s 7(2)) and may require statutory declarations or further information (s 7(4)), advisers and consultants that prepare tenders, business cases or statutory material on behalf of applicants are affected. The Minister may require verification and standards set out in regulations or invitations (s 7(5)), creating demand for compliance resources.

Other regulators and obligations: The Act expressly does not displace other regulatory requirements: licence holders must maintain CASA certification and may have other obligations under other laws (s 8(2), s 25). Entities therefore face a layered compliance environment including aviation safety, airport operations and any relevant national competition or consumer laws that continue to apply.

Trade and contract counterparties: The Act constrains assignment and dealing with licences without ministerial consent (s 10(1)-(3)). This affects transactions (sales, securitisations, leases, joint ventures) involving route rights; a purported dealing without consent is void (s 10(3)), creating a statutory title risk that must be addressed in transactional documentation.

Media, Parliament and oversight: The Minister must report to Parliament within 12 sitting days after awarding a licence (s 13). The Minister must publish declarations and changes in the Gazette and ensure publication on a website or in newspapers, and serve notices on operators where relevant (s 5(11)). That affects transparency, political accountability and public awareness of ministerial actions.

Legal review bodies and licensees: Licence holders and existing operators receiving offers have a focused right of review to the South Australian Civil and Administrative Tribunal for specified decisions (s 15). Wider judicial or administrative review is restricted by s 15(4), narrowing the legal pathways available to challenge most ministerial decisions under Parts 2 and 3.

Who bears costs and who gains benefits: Licence holders bear compliance costs, application and administration fees (s 7(3), s 11(1)), potential capital obligations (s 8(1)(f)), reporting burdens (s 8(1)(g)), and the risk of sanctions for breaches (ss 6, 8 and others). Potentially concentrated benefits, such as exclusivity or favourable fare-setting,accrue to licence holders if the Minister grants them. Local communities and passengers may benefit from maintained or improved scheduled services if the Minister’s interventions lead to service provision, but those benefits are indirect and depend on conditions imposed (s 5(3)-(4), s 8(1)(b)-(c)).

Obligation to hold a licence for scheduled services: The central rule is an affirmative obligation. During a declaration period a person must not operate a scheduled air service on a declared route unless they are the holder of a route service licence issued under the Act (s 6(1)). Operating without a licence attracts the maximum penalty stated after s 6, which is $35,000.

Exclusions from the licensing obligation: The obligation does not apply to charter services and several narrowly described exceptions (s 6(2)). Specifically excluded are: charters as defined (s 3), services substituting for licensed scheduled services due to emergency, technical difficulties or routine maintenance (s 6(2)(b)), alternative or additional services contemplated by licence terms (s 6(2)(c)), air services operated with the consent of the Minister under s 10 (s 6(2)(d)), and services of a prescribed kind (s 6(2)(e)). The definitions of scheduled and charter services can be varied by regulations (s 3).

Application and information duties: All licences are granted on application (s 7(1)). Applications must be in the form and manner required by the Minister and accompanied by the prescribed fee (s 7(3)(a)-(b)). The Minister may require applicants to provide further information and statutory declarations (s 7(4)). Applicants must meet any regulatory or invited-application requirements and satisfy the Minister of any other matters the Minister deems relevant (s 7(5)). If an application is refused, the applicant may request a written statement of reasons (s 7(6)).

Licence conditions and ongoing obligations: Licence conditions can be extensive: term and extensions, performance and service levels, aircraft quality and type, flight schedules, fares (and review schemes), alternative services in specified circumstances, amounts payable, infrastructure or capital expenditure, reporting requirements, and suspension/cancellation provisions (s 8(1)(a)-(i)). It is a condition of every licence that the holder have and maintain appropriate CASA certification for the relevant services (s 8(2)). The statute provides that breach of the CASA‑certification condition automatically suspends the licence for the period of breach (s 8(4)). The Minister must give a reasonable opportunity to make representations before suspending or cancelling under a licence condition, except where s 8(4) operates by force of law (s 8(3)).

Variation and requests for variation of conditions: The Minister may vary licence conditions after consultation with the licence holder, by written notice (s 8(5)). The licence holder may apply to the Minister to vary conditions, and the Minister may grant or refuse the variation as the Minister thinks fit (s 8(6)). Variations may add, substitute or delete conditions (s 8(7)), but variations cannot affect the CASA certification requirement imposed by s 8(2) (s 8(8)).

Exclusive rights and their limits: A licence may confer an exclusive right to operate scheduled services on the declared route (s 9(1)(a)). However, an exclusivity right cannot prevent another person operating a service of a kind specified by regulation or in the licence (s 9(2)(a)), and exclusivity will be subject to other qualifications prescribed by regulation or specified in the licence itself (s 9(2)(b)). That means exclusivity is not absolute and can be constrained in subordinate instruments.

Assignment and dealing restrictions: Licence holders must not transfer, assign, subcontract or otherwise deal with the licence or rights under it without Ministerial consent (s 10(1)). The Minister must be satisfied that adequate provision will be made for operation of services and as to other matters the Minister considers relevant before consenting (s 10(2)). A purported dealing without consent is void (s 10(3)). There are specific carve‑outs in s 10(4) for temporary replacement services and circumstances prescribed by regulation or specified in the licence.

Fees and payments: The Minister may require payment of fees for lodging tenders for licences and fees for administering a licence (s 11(1)(a)-(b)). The Minister determines amounts, subject to regulatory limits (s 11(2)). The prescribed fee must accompany an application (s 7(3)(b)).

Incumbent offer duty: If an operator is operating a scheduled service on a route at the time of declaration, the Minister must offer that existing operator a licence on terms the Minister thinks fair and reasonable before a general invitation is made (s 12(1)). The incumbent has 14 days to accept (s 12(3)). The duty to offer is removed if the incumbent has publicly declared an intention to discontinue services (s 12(2)).

Reporting obligations and parliamentary oversight: The Minister must table a report in both Houses within 12 sitting days after awarding a licence that states the licence holder’s full name, term, performance/service level and schedule details, initial fares and other information the Minister considers appropriate (s 13). The administrative unit responsible under the Minister must produce annual reports on administration of the Act (s 19), which the Minister must table within 12 sitting days of receipt (s 19(3)).

Inspection and information production duties: Authorised officers can enter and inspect premises, require production of documents (including electronic records), examine, copy or take extracts, require evidence of licensing, and require persons to answer questions (s 16(5)(a)-(e)). Occupiers must give reasonable assistance to authorised officers (s 16(8)). Protections include no requirement to answer questions or produce documents that would tend to incriminate or make the person liable to penalty (s 16(10)) and privilege for legal professional privilege (s 16(11)).

Obligation not to mislead: Persons must not make statements false or misleading in material particulars in any information provided under the Act (s 21). The maximum penalty for such an offence is $10,000.

Exemptions and delegations: The Minister may grant exemptions by Gazette on any terms (s 18(1)-(2)) and may vary or revoke them (s 18(3)). The Minister may delegate functions and powers under the Act, subject to conditions and revocable at will (s 17).

Review and appeal rights: The holder of a route service licence or affected existing operator has a right to seek review by the South Australian Civil and Administrative Tribunal for specified decisions (s 15(1)). The Minister must give reasons on request (s 15(3)). Time limits for review are short (14 or 21 days; s 15(2)). Otherwise decisions under Parts 2 and 3 are not subject to Tribunal or court review or appeal (s 15(4)).

Evidentiary and other statutory features: The Act provides for evidentiary certificates purporting to be signed by the Minister that, in absence of contrary proof, establish delegation, licence holding and existence of licence conditions (s 24). The Act expressly does not relieve persons of obligations under other laws, so CASA and other regulatory requirements remain in force (s 25). Regulations may set further operational detail and impose fines (s 26).

Statutory offence structure and quantum: The Act sets maximum monetary penalties for key contraventions and for certain procedural offences. Operating a scheduled air service on a declared route without a route service licence is an offence carrying a maximum penalty of $35,000 (s 6; see "Maximum penalty: $35 000" following s 6(2)). Contravening or failing to comply with a condition of a route service licence is also an offence with a maximum penalty of $35,000 (s 8(9)). Assigning, transferring or otherwise dealing with a licence without the Minister’s consent attracts a maximum penalty of $20,000 (s 10(1)). Contravening a condition of an exemption is an offence with a maximum penalty of $20,000 (s 18(4)). Hindering, obstructing or using abusive language toward an authorised officer, or failing to provide answers or obey directions without reasonable excuse, carries a maximum penalty of $5,000 (s 16(9)). Providing false or misleading information under the Act is a separate offence with a maximum penalty of $10,000 (s 21).

Continuing offences and daily penalties: For ongoing breaches, the Act imposes additional daily penalties. If a person is convicted of an offence involving a continuing act or omission, they are liable, in addition to the basic penalty, to a penalty for each day the act or omission continues of up to one‑tenth of the maximum penalty for the offence, and further offences may be charged if the breach continues after conviction (s 22(1)(a)-(b)). For an offence consisting of an omission, the omission is treated as continuing until the required action is done (s 22(2)). These provisions create a continuing liability exposure for persistent breaches.

Authorised officers’ enforcement powers: Authorised officers appointed by the Minister may enter and inspect premises, require production of documents (including electronic records), examine, copy or take extracts, require evidence of licences, and require persons to answer questions (s 16(5)(a)-(e)). They may give directions reasonably required for the exercise of these powers (s 16(5)(f)). Entry to domestic premises or premises not belonging to a licence holder generally requires a warrant issued by a magistrate unless immediate action is justified on reasonable grounds (s 16(6)). Authorised officers must produce identity cards and note limits on their authority (s 16(3)-(4)). A person has statutory protections against self‑incrimination and legal professional privilege in response to authorised officer powers (s 16(10)-(11)).

Ministerial suspension, cancellation and variation: The Minister can impose conditions that provide for suspension or cancellation and the grounds for such measures (s 8(1)(h)). The Minister must give a reasonable opportunity to make representations before suspending or cancelling a licence under a condition (s 8(3)), though the statutory suspension on loss of CASA certification operates immediately by force of s 8(4). The Minister may, after consultation, vary licence conditions by written notice (s 8(5)). If a licence is suspended or cancelled, the affected holder (subject to s 15(4)) may seek review in the Tribunal where that specific statutory route is available (s 15(1)(a)(v)).

Void transactions and transfer consent: Any purported dealing in contravention of the prohibition on transfers, assignments or other dealings without Ministerial consent is void (s 10(3)). This creates a statutory enforcement mechanism to strike down unauthorised transfers and protect the Minister’s discretionary control of licence incumbency.

Administrative oversight and Parliament: The Minister must lay a report before both Houses of Parliament within 12 sitting days after awarding a route service licence (s 13), setting out the licensee’s identity, licence term, required performance and service levels at commencement, initial fares and other relevant information. The administrative unit responsible under the Minister must present annual reports on operation and administration by 30 September each year (s 19(1)), and the Minister must table those reports within 12 sitting days of receipt (s 19(3)). Those reporting obligations create parliamentary and public scrutiny channels for enforcement outcomes and ministerial exercise of discretion.

Evidentiary devices to support enforcement actions: The Act allows an apparently genuine certificate signed by the Minister to be used, absent proof to the contrary, as evidence that a person was a delegate, was or was not a licence holder at a specified time, or that a provision was a condition of a licence (s 24). That streamlines proofs in prosecutions and administrative enforcement proceedings.

Regulatory criminalisation and subordinate penalties: Regulations may prescribe further offences and fines not exceeding $5,000 (s 26(2)(c)). Regulations can also facilitate proof of regulatory offences (s 26(2)(d)). This allows the enforcement architecture to be extended by subordinate instruments without primary legislation amendments.

Limits on review of enforcement decisions: The Act limits review of many ministerial decisions under Parts 2 and 3, stating that except as provided in s 15, decisions are not subject to review or appeal in the Tribunal or any court (s 15(4)). This constrains judicial and administrative review for many enforcement or discretionary acts.

Safety and CASA requirements: The Act explicitly makes appropriate CASA certification a licence condition (s 8(2)) and requires licence holders to obtain and maintain CASA certification as a precondition to commence and continue operations under a route service licence. The statute therefore layers route‑licensing conditions on top of the national safety and operational regulatory framework administered by the Civil Aviation Safety Authority. Section 14(2) clarifies that awarding a route service licence does not create any warranty by the Minister or Crown about the licensee’s fitness to operate safely; obligations and liabilities under safety law remain with operators.

Other statutory licences and registrations preserved: Section 25 states that nothing in the Act relieves a person of any obligation to hold or effect any licence or registration required by law. This preserves parallel regulatory regimes (for example, work health and safety, corporate registration, airport leases, consumer protection and competition law) and clarifies that route‑licensing is additive rather than replacing other regulatory compliance.

Ministerial discretion and regulations: The Act grants broad regulatory powers under s 26. Regulations can define service classes, prescribe information requirements, set service of documents, impose fines up to $5,000 for regulatory contraventions, and provide that matters may be determined at the discretion of the Minister or another prescribed person or authority (s 26(2)-(3)). That statutory design allows subordinate instruments to modify enforcement practicalities and procedural standards, potentially aligning the Act with other State or national regulatory schemes but also enabling delegation of key operational determinations to the executive.

Competition and economic regulation: The Act enables the Minister to impose fare controls (s 8(1)(c)), performance obligations (s 8(1)(b)), and to grant exclusivity (s 9(1)). Those instruments are economic regulatory levers and interact with competition policy and consumer protection frameworks. The Minister must take into account the risk of monopoly and market share close to monopoly and the benefits of competition when deciding licence numbers and awardees (s 4(1)(a)-(b)), but the statute leaves significant judgement to the Minister ("insofar as the Minister thinks appropriate", s 4(1)). Any fare or exclusivity conditions imposed under this Act will operate alongside general competition laws and could engage public interest or competition oversight, although the Act itself does not create a direct override.

Property, contract and transaction law: The prohibition on dealing with a licence without Ministerial consent and the voidness of unauthorised dealings (s 10(1)-(3)) affect property and contractual rights. Transactions involving licences (sale, security interests, joint ventures) must account for Ministerial consent requirements; otherwise dealings may be void. Parties will need to structure commercial agreements with contractual protections, warranties and conditions precedent to manage the statutory title risk.

Administrative law and review: The Act prescribes limited review routes for specified decisions to the South Australian Civil and Administrative Tribunal (s 15). Section 15(4) restricts review or appeal in the Tribunal or any court of most decisions under Parts 2 and 3, narrowing administrative law remedies. However, s 15(3) requires the Minister to state reasons if so required by a person affected by a decision that may be the subject of Tribunal review. The legislative history shows an amendment that substituted the review regime to SACAT (2019) and transitional provisions (Legislative history: Statutes Amendment (SACAT) Act 2019, Pt 2), indicating the Act’s review architecture is integrated with State administrative adjudication systems.

Parliamentary reporting and transparency obligations: The Minister must report to Parliament after awarding licences (s 13) and lay annual reports from the administrative unit (s 19). Those obligations create statutory channels for parliamentary oversight, potentially interfacing with other parliamentary inquiries or audits.

Evidentiary and criminal law procedure: The evidentiary certificate mechanism (s 24) interacts with criminal and administrative procedures by shifting evidentiary burdens unless proof to the contrary is produced. The continuing offence provisions in s 22 interact with sentencing frameworks by authorising daily penalties in addition to base fines.

Local government, airport leasing and contract obligations: Licence conditions may require infrastructure provision or capital expenditure by the licence holder (s 8(1)(f)), affecting local government and airport owners/lessees who contract with carriers or depend on carriers for airport viability. Those obligations will interact with property rights, lease covenants, planning approvals and funding arrangements at local and State levels.

Subordinate regulation and delegation: Sections 17 and 26 permit delegation and detailed regulation. The Act contemplates that many operational modalities will be handled by subordinate instruments, and that some matters may be subject to the Minister’s discretion or determined by another prescribed person or authority (s 26(3)(b)). That creates operational interaction points between this statute and administrative rules, policy instruments and delegated decision‑making frameworks.

The Act’s legislative timeline and amendments, as recorded in the provided legislative history, show the following primary changes and consequential adjustments.

Original enactment: The Air Transport (Route Licensing,Passenger Services) Act 2002 (No 13 of 2002) received assent on 5 September 2002 and commenced 14 November 2002 (Gazette 14.11.2002 p4100).

2009 Statutes Amendment (Public Sector Consequential Amendments) Act 2009 (No 84 of 2009): This amending Act appears in the legislative history as deleting s 20 of the principal Act (s 20 deleted by 84/2009 s 24) with effect 1 February 2010 (Gazette 28.1.2010 p320). The legislative history notes the deletion but the principal Act document provided does not show s 20 (it has been removed).

2011 Statutes Amendment (Directors' Liability) Act 2011 (No 36 of 2011): The legislative history records that Pt 3 (s 5) of that amending Act varied a provision (s 5?) with commencement 1 January 2012 (Gazette 15.12.2011 p4988). The provided Act shows s 23 has been deleted by that Act (s 23 deleted by 36/2011 s 5), effective 1 January 2012. Exact text changes in the main body are reflected in the consolidated version rather than replicated here.

2019 Statutes Amendment (SACAT) Act 2019 (No 14 of 2019): The review and appeals architecture was updated by the 2019 amendment. The legislative history shows that the definition and references to Tribunal were inserted by 14/2019 s 4 (Tribunal defined in s 3(1) as the South Australian Civil and Administrative Tribunal) with commencement 2 December 2019. Part 4 of the principal Act was substituted by 14/2019 s 5, commencing 2 December 2019. The transitional provisions associated with that Act are included in the Legislative history: those transitional provisions allow ongoing rights of appeal previously exercisable in the Administrative and Disciplinary Division of the District Court to be exercised before the Tribunal in relation to matters in existence but not yet exercised before the relevant day (Statutes Amendment (SACAT) Act 2019, Pt 2).

2019 Statutes Amendment and Repeal (Simplify) Act 2019 (No 25 of 2019): Section 5(11) was amended by 25/2019 s 6, with effect 6 April 2020 (Gazette 2.4.2020 p631). The legislative notes indicate other minor consequential amendments have been made by this Act. The consolidated text reflects those changes, such as the publication and service obligations in s 5(11).

Noted deletions: The legislative history records deletions of certain provisions previously numbered s 20 and s 23 by the 2009 and 2011 amending Acts respectively (s 20 deleted by 84/2009 s 24; s 23 deleted by 36/2011 s 5). The consolidated Act provided here reflects those deletions.

Transitional provisions: The 2019 amendment that substituted Pt 4 included transitional provisions (Statutes Amendment (SACAT) Act 2019, Pt 2, s 6) specifying that a right of appeal previously under s 15 of the principal Act in relation to matters in existence before the relevant day may be exercised before the Tribunal; and that proceedings before the previous body commenced before the relevant day are not affected. The transitional text reaffirms the integration of the Act’s review pathways with the SACAT regime under the South Australian Civil and Administrative Tribunal Act 2013.

Notes on revision practice: The legislative history contains a general note that references to other legislation, instruments, titles of bodies or offices are not automatically updated by the revision and publication program and may be obsolete. The history lists historical consolidated versions (1.2.2010, 1.1.2012, and 2.12.2019), indicating the Act has been subject to consolidation at those points.

Implication for practitioners: The amendment history shows targeted changes to review mechanisms (2019), deletion of certain provisions in 2009 and 2011, and procedural publishing and service adjustments in 2020. When advising clients, practitioners should ensure they consult the consolidated statute and the up‑to‑date regulations specified under s 26, as the Minister’s delegated instruments and regulation‑making power can substantially affect operational detail. The domestic effect of the 2019 SACAT amendment is to re‑route certain reviews to the Tribunal and to provide transitional mechanisms for appeals in progress.

The provided source contains no reported judicial decisions or administrative rulings applying the Act. The legislative history records amendments and transitional provisions that changed the review forum from the Administrative and Disciplinary Division of the District Court to the South Australian Civil and Administrative Tribunal (SACAT) (Statutes Amendment (SACAT) Act 2019). The Act now provides a specified administrative review route to the Tribunal for certain ministerial decisions (s 15), and the legislative history contains transitional provisions enabling pending appeals to be brought in the Tribunal where appropriate.

Because the statute limits review and appeal rights for many ministerial decisions under Parts 2 and 3 (s 15(4)), case law may be constrained to a narrow set of disputes where Tribunal review is expressly provided. The Tribunal has jurisdiction for the listed reviewable decisions (s 15(1)), and practitioners should expect any litigation to focus on the discrete matters that are reviewable: variations of licence conditions (s 8(5) and s 8(6)), refusals of consent to dealings (s 10(1)), refusals of licence surrender (s 14(1)), decisions to suspend or cancel licences (except cancellations due to expiry of the declaration), and conditions fixed for existing operators (s 12(1)). Outside of those provisions, the Act states that decisions under Parts 2 and 3 are not subject to review or appeal in Tribunal or any court (s 15(4)), which will likely shape litigation strategies and the availability of judicial review.

Practitioners should also note the evidentiary provision (s 24), which permits a Ministerial certificate to operate as prima facie proof, absent contrary evidence; that evidentiary device reduces the scope for procedural challenges on some factual points but does not, on its face, remove all avenues for legal challenge where statutory error is alleged. Given the absence of cases in the source, those advising clients should monitor Tribunal and court registries for decisions interpreting ministerial discretion under s 4, the limits on exclusivity under s 9(2), the application of s 10(3) to transactions, the boundaries of s 8(4)’s automatic suspension on loss of CASA certification, and the interaction between ministerial conditions and competition or consumer regulatory principles.

Ministerial discretion and breadth of criteria: Although s 4 lists criteria the Minister must take into account when deciding licence numbers and awardees (monopoly risk, sustainable services, efficiency and innovation, public benefits), the statute qualifies that the Minister must take those matters into account "insofar as the Minister thinks appropriate" (s 4(1)). That language leaves significant room for ministerial judgment and makes it harder to predict outcomes from an objective standards test. Practitioners should not assume that the presence of competition concerns will necessarily prevent exclusivity or a limited number of licences; the Minister retains latitude.

Publication does not bind subsequent action: The Minister must publish certain information when declaring a route (s 5(2)), including the expected number of licences and conditions, but s 5(12) expressly says publication does not prevent the Minister later deciding or acting differently from what was published. Applicants and incumbents should therefore treat published notices as indicative rather than immutable.

Short timelines and compressed decision windows: Existing operators must accept an offer within 14 days (s 12(3)). Reviews by the Tribunal must be commenced within 14 or 21 days depending on the decision (s 15(2)). Practitioners must manage short procedural windows for accepting incumbency offers and for filing review applications; missing these windows may foreclose remedies.

Limited reviewability of ministerial decisions: Section 15(4) states that, except as provided by s 15, a decision of the Minister under Parts 2 or 3 is not subject to review or appeal in the Tribunal or any court. That restriction may preclude broader judicial or administrative challenge to many important ministerial decisions, so legal strategies based on merits review should be framed within the narrow exceptions the Act provides.

Automatic suspension on CASA certification loss: The licence is immediately suspended by operation of law if the licence holder breaches the condition requiring appropriate CASA certification (s 8(4)). That creates an abrupt operational risk for licence holders facing regulatory or enforcement action by CASA; licence holders have no unilateral right to operate during the suspension, and the Minister may proceed to cancellation if the breach is not remedied in a reasonable time. Licensees should therefore embed CASA compliance and contingency planning.

Voidness of unauthorised dealings and title risk: Any purported dealing with a licence without Ministerial consent is void (s 10(3)). Lenders, investors and purchasers must ensure Ministerial consent as a condition precedent, or risk entering into transactions that have no legal effect. Contractual protections (conditional completion, escrow arrangements, warranties and indemnities) will be essential.

Exclusivity is conditional and regulatory: Although a licence may confer exclusivity (s 9(1)), the exclusivity is subject to qualifications in regulations or the licence itself (s 9(2)). Parties that rely on exclusivity should examine both the licence text and applicable regulations for carve‑outs; exclusivity may not bar services of specified kinds or regulatory exceptions.

Ministerial power to revoke declarations: The Minister may revoke a declared route at any time (s 5(10)). Revocation can terminate the statutory restriction on competing services and may indirectly affect the economic value of a licence (which exists only during the declaration). Licence holders should account for the finite and revocable nature of route declarations, and the limitation that any declaration period cannot exceed six years in total (s 5(9)).

Regulation can delegate substantive determinations: Regulations may provide that matters be determined at the Minister’s discretion or by another prescribed person or authority (s 26(3)(b)). Subordinate instruments can therefore transfer operational choice points away from detailed statutory standards to opaque administrative discretion, increasing uncertainty for market participants.

No warranty on safety or operational fitness: The Minister’s award of a route service licence is expressly not a warranty or representation about safety or reliability, and the Crown bears no liability on that score (s 14(2)). Parties relying on a licence award must not expect statutory endorsement of operational competence; CASA certification and other legal obligations remain primary.

Evidentiary certificates: Certificates signed by the Minister purporting to evidence delegation, licence holding, or licence conditions are admissible as proof unless rebutted (s 24). That can streamline prosecutions or administrative enforcement but creates an evidentiary presumption practitioners must be ready to contest with contrary material.

Continuing offence exposure: For ongoing breaches the continuing offence provisions (s 22) expose defendants to daily penalties in addition to base fines, and further offences if the breach persists after conviction. This can create compounding financial exposure for unresolved compliance issues.

Authorised officers’ entry powers and limits: Authorised officers may enter and inspect premises and require documents (s 16(5)). Entry to domestic premises or premises not of the licence holder requires a magistrate’s warrant unless immediate action is justified on reasonable grounds (s 16(6)). Operators should carefully follow identity checks (s 16(3)-(4)) and confidentiality protections (s 16(10)-(11)).

Overlap with other legal obligations: Section 25 preserves other statutory obligations. For example, licence conditions that require infrastructure expenditure (s 8(1)(f)) will interact with development approvals, airport lease terms and national regulatory requirements. Licensees need cross‑disciplinary compliance planning.

Fees and administrative costs: The Minister may set tender and administration fees and may vary them by licence (s 11). Regulations may limit fees, but cost exposure is variable and can be imposed or repeated during the license term (s 11(1)(b)). Applicants should budget for ongoing administrative fees.

Pre‑start checklist for any carrier proposing scheduled services on a South Australian route:

1. Confirm route status: Check whether the Minister has declared the route under s 5(1). If the route is declared, operating scheduled services without a route service licence is an offence (s 6(1)).

2. Assess service characterisation: Determine whether the intended service is a scheduled air service as defined (s 3) or a charter service or otherwise prescribed class that is excluded (s 3, s 6(2)). If class is uncertain, consider seeking clarity from the Minister or the responsible administrative unit and review regulations under s 26.

3. Incumbent status and timing: If already operating on the route at time of declaration, be ready to receive an offer from the Minister and to accept within 14 days (s 12(1), s 12(3)). Be aware that the Minister must offer incumbents a licence before a general industry invitation unless the incumbent has publicly declared discontinuation (s 12(2)).

4. Application preparation: Prepare an application in the form required by the Minister including the prescribed fee (s 7(3)). Expect to provide detailed operational, financial and safety documentation, and to verify information by statutory declaration if requested (s 7(4)). Anticipate that the Minister may request further information and set regulatory standards or criteria in invitation documents (s 7(4)-(5)).

5. CASA certification: Secure and maintain appropriate CASA certification before commencing operations, since s 8(2) makes that a condition of any licence and s 8(4) causes immediate suspension if the condition is breached. Integrate CASA compliance and monitoring into operational governance.

6. Licence condition expectations: Plan for potential licence conditions: performance levels, aircraft types, flight schedules, fare controls, reporting obligations, and capital or infrastructure commitments (s 8(1)). Where possible, model the cost and revenue impacts of possible fare restrictions and infrastructure obligations and document how you would meet them.

7. Financial and contractual structuring: Where licence exclusivity or restrictions on assignment apply, structure transactions to anticipate s 10(1) consent requirements. Insert conditions precedent, ministerial consent warranties, escrow and indemnities into sale, financing and joint venture documents to manage the voidness risk under s 10(3).

8. Reporting and recordkeeping: Put in place recordkeeping systems for the information the Minister may require (s 8(1)(g), s 26(2)(a)), including capacity to produce electronic records in an understandable form, and to respond promptly to authorised officer requests (s 16(5)(b)-(c)). Maintain compliance logs for CASA certification and other licences required by law (s 25).

9. Responding to authorised officers: Authorised officers will carry identity cards and may exercise inspection and information powers (s 16(3)-(5)). Ensure staff are trained to request production of identity cards, to cooperate within legal limits, and to assert self‑incrimination and legal professional privilege where appropriate (s 16(10)-(11)).

10. Manage media, disclosure and Parliament reporting obligations: Be prepared that the Minister will table information about licence awards in Parliament within 12 sitting days (s 13). Manage public communications and confidentiality accordingly.

11. Budget for fees and fines: Anticipate prescribed application fees and possible administration fees that may vary by licence (s 7(3)(b), s 11(1)-(2)). Also manage exposure to statutory fines for contraventions (ss 6, 8, 10, 16(9), 18(4), 21) and continuing offence daily penalties (s 22).

12. Seek legal clarity on ambiguities: Given the Minister’s significant discretion (s 4) and the Act’s partial insulation of many decisions from review (s 15(4)), seek pre‑application engagement with the administrative unit to understand likely licence terms, the application process and any relevant regulations under s 26. If the Minister proposes to vary a condition, note the right to make representations and the limited grounds and timeframes for Tribunal review (s 8(3), s 15).

13. Litigate or seek review promptly if necessary: If you are a licence holder dissatisfied with a specific class of ministerial decision listed in s 15(1) (variation of conditions, refusal of consent to dealings or surrender, suspension/cancellation decisions, or existing operator offer conditions), lodge a review application to the Tribunal within the statutory time limits (s 15(2)). Preserve material and request reasons from the Minister where relevant (s 15(3)).

14. Consider exemptions: If your proposed service is incompatible with the licensing regime, consider applying for an exemption under s 18. Exemptions are granted by Gazette and may be conditional, and can be varied or revoked at any time (s 18(1)-(3)). Ensure compliance with any conditions attached to an exemption, as contravention is an offence (s 18(4)).

15. Cross‑check other legal obligations: The Act does not displace other legal requirements (s 25). Ensure corporate, safety, competition, consumer, planning and tax obligations are addressed in parallel to route licence compliance.

16. Contractual protections for financiers and partners: Lenders and investors should negotiate protections that anticipate the Minister’s discretion and the risk of void transfers absent consent (s 10). Lenders should seek assignment consent mechanisms or regulatory completion conditions to mitigate enforceability risks.

17. Record communications and invitations: Because the Minister may invite applications by tender or other methods (s 7(2)), document any invitation terms, published notices (s 5(2)), and communications. Note that published information may be varied later by the Minister (s 5(12)), so preserve correspondence showing representations and attachments to decision processes.

18. Monitor regulations and delegated instruments: Regularly check regulations made under s 26, and any determinations delegated to the Minister or other prescribed authorities, since regulations may define classes of services, set administrative procedures, and cap fees, all of which materially affect compliance and commercial decisions.

By following these steps, carriers and advisers can align operational planning and corporate transactions with the Act’s licence, reporting and enforcement requirements. The central practical priorities are: securing and maintaining CASA certification, managing ministerial discretion and consent processes (especially for incumbency offers and licence dealings), and building robust reporting and record systems to meet authorised officer requests and ministerial reporting obligations.
