26 Noise certificates

Issued certificates (1) A noise certificate issued under regulation 6 of the old law that was in force immediately before the commencement of this section continues in force (and may be dealt with) as if it were a noise certificate issued under section 9 of this instrument. (2) A noise certificate issued under regulation 6A of the old law that was in force immediately before the commencement of this section continues in force (and may be dealt with) as if it were a noise certificate issued under section 8 of this instrument. Deemed certificates (3) A noise certificate deemed to be issued under regulation 8 of the old law that was in force immediately before the commencement of this section continues in force (and may be dealt with) as if it were a noise certificate taken to be issued under section 12 of this instrument. Applications (4) An application for a noise certificate under regulation 5 of the old law that was pending immediately before the commencement of this section is taken, on and after that commencement, to be an application made under section 7 of this instrument. Revocations (5) A notice given under subregulation 10(1) of the old law for which the prescribed period ends after the commencement of this section is taken, on and after that commencement, to be a notice given under subsection 13(1) of this instrument. (6) Despite the repeal of subregulation 10(4) of the old law by the Air Navigation (Aircraft Noise—Repeal and Consequential Amendments) Regulations 2018, that subregulation continues to apply on and after the commencement of this section in relation to a notice of revocation of a noise certificate given before that commencement.
