Air Navigation Act 1937

The Act uses a small set of structural concepts to achieve its effect. Those concepts, and how the Act implements them, are:

• Dynamic incorporation: The Act defines the "Commonwealth Act" and the "Regulations" as the Commonwealth Air Navigation Act 1920-1936 as amended and the Air Navigation Regulations made under it, "as in force from time to time" (s 3). That wording means updates to the Commonwealth Act or the Regulations are incorporated into Western Australian law without separate state amendment. Section 4 then directs that those Regulations, when applicable to the Territories, shall apply mutatis mutandis within Western Australia and are to be read and construed as if incorporated in the State Act (s 4).

• Mutatis mutandis application: The phrase "mutatis mutandis" (s 4) signals that the Regulations are applied with necessary modifications to fit the State context. The Act does not list how or which modifications are to be made; rather it establishes the principle that adaptation is permissible and intended. That makes the Regulations operative in Western Australia subject to suitable textual or contextual adjustments, the detail of which will necessarily come from the text of the Regulations and any interpretive practice.

• Vesting and recognition of authority: Section 5 provides that where the Regulations vest a power or function in a person or authority, "the like power or function under the regulations in their application by virtue of this Act shall be vested in or exercisable by that person or authority for the purposes of the regulations in such application" (s 5). That means the Act preserves the identity of decision-makers: powers exercisable under the Commonwealth Regulations continue to be exercisable by the same persons or authorities when the Regulations operate within the State.

• Cross-jurisdictional recognition of credentials and actions: Section 6 gives effect in Western Australia to certificates, licences and registrations granted or recognised by or under the Regulations under the Commonwealth Act, and those granted under the Regulations in other States. It also gives effect to cancellations and suspensions of such credentials as if they had been made under the Regulations as applied by this Act (s 6).

• Fee allocation: Section 7 directs that all fees payable under the Regulations in their application by virtue of this Act are to be paid to the Commonwealth, expressly "to meet the cost of the administration of the regulations in such application" (s 7). That allocates the revenue stream generated by the Regulations’ fees to the Commonwealth rather than Western Australia.

• Non-derogation of a specific State provision: Section 8 expressly preserves the operation of Division 4 of Part III of the Transport Co-ordination Act 1966, stating that the Air Navigation Act shall not affect that Division (s 8). The Act therefore acknowledges a pre-existing State statutory structure that remains applicable.

• Definitions and scope: The defined terms in section 3 constrain scope. "Territories" is defined to include territories under Commonwealth authority and such as are governed under a mandate. The Act’s application is framed by reference to Regulations applicable to navigation within those Territories, and then imports those Regulations into WA law (s 3, s 4).

These concepts together create an architecture in which Commonwealth aviation rules, their administration and decision-makers, and their credential outcomes bind aircraft operators and personnel in Western Australia, with fees flowing to the Commonwealth. The Act is short because it operates by reference; substantive duties, penalties and procedural specifics are primarily in the Commonwealth Regulations that the Act incorporates.

The Act affects a narrow set of actors by design: those involved in air navigation, the persons and authorities vested with regulatory functions under the Commonwealth Regulations, and Western Australian entities that interact with Commonwealth-issued or other-State-issued aviation credentials.

Primary affected parties

• Aircraft operators, owners, pilots and aircrew operating within Western Australia: The Regulations, as applied under this Act, cover airworthiness, licensing and competence of pilots, air traffic rules and aerodrome regulation as stated in the Preamble. Those persons must comply with the Regulations as incorporated into Western Australian law (Preamble; s 4).

• Holders of certificates, licences and registrations issued under the Commonwealth Regulations or under those Regulations via another State: Such credentials "shall in this State have the same force and effect" as if granted under the Regulations applied by this Act, and suspensions or cancellations of them also have the same effect (s 6). That means holders of Commonwealth or interstate aviation credentials are automatically recognised for operation within Western Australia subject to any suspensions or cancellations that have been made.

• Commonwealth authorities and persons who exercise powers under the Regulations: The Act preserves and vests the same powers and functions in those persons or authorities for the Regulations’ application in Western Australia (s 5). That includes any Commonwealth administrative or enforcement bodies named or empowered in the Regulations.

• Western Australian government agencies with overlapping responsibilities: The Act explicitly leaves unaffected Part III Division 4 of the Transport Co-ordination Act 1966 (s 8), so bodies operating under that Division remain stakeholders and must be read together with the Commonwealth regulatory overlay.

Secondary and consequentially affected parties

• Businesses engaged in aerodrome operation, aircraft maintenance, training and certification services: Their operations will be governed by the content of the Commonwealth Regulations as applied; they will therefore need to align practices, contracting and compliance functions with the incorporated Regulations.

• Legal, accounting and compliance advisors assisting aviation clients: They will be required to interpret and advise on Commonwealth Regulations as applied within WA, including monitoring amendments in the Commonwealth Regulations (s 3, s 4).

• Fee payers and accounting functions in Western Australian companies: Fees under the Regulations applied by virtue of this Act are payable to the Commonwealth (s 7). Organisations budgeting for permits, registrations and licensing must account for payments to the Commonwealth.

What the Act does not affect (as stated)

• The Act does not itself create a separate State licensing or certificate scheme; instead it imports the Commonwealth scheme (s 4, s 6).

• The Act does not, on its face, transfer regulatory sovereignty to a State body; it preserves the powers of the persons and authorities whom the Regulations empower (s 5).

• The Act contains no independent penalties or offences; those are in the Regulations that it incorporates (s 4).

In practice, anyone whose activities are regulated by the Commonwealth Air Navigation Regulations in the Territories will find those same rules applying within Western Australia by virtue of this Act. Persons who hold Commonwealth or interstate aviation credentials will have those credentials treated as effective in WA, while fees associated with regulation are paid to the Commonwealth (s 6, s 7).

Because the Air Navigation Act 1937 operates primarily by reference to the Commonwealth Air Navigation Regulations, the Act’s operative duties and rights are the duties and rights that the Regulations create, read into Western Australian law via the Act’s incorporation mechanism (s 4). The Act itself defines a structure for rights and duties rather than specifying many substantive obligations. From the Act’s text and Preamble the following duties, rights and practical legal effects can be extracted.

Duties that arise through incorporation

• Compliance with technical and operational standards: The Preamble identifies the subject matters the uniform rules were intended to cover, airworthiness of aircraft, licensing and competence of pilots, air traffic rules, and regulation of aerodromes. Those are the principal categories of obligations that the Commonwealth Regulations will contain and which, once incorporated, create obligations in Western Australia (Preamble; s 4).

• Compliance with administrative requirements in the Regulations: Licensing, registration, certification and associated procedural requirements imposed by the Regulations will be enforceable in Western Australia because the Regulations are to be read and take effect as part of this Act (s 4).

• Payment of fees under the Regulations: Fees payable under the Regulations as applied to Western Australia are to be paid to the Commonwealth to fund administration (s 7). The duty to pay fees attaches to persons or entities specified in the relevant Regulations.

Rights and legal effects created or preserved by the Act

• Recognition of credentials: Section 6 provides that any certificate, licence or registration granted or issued under the Regulations, whether by the Commonwealth or under the Regulations as applied by another State, has the same force and effect in Western Australia. This is a right of recognition; holders of such credentials may rely on them for lawful operation within Western Australia (s 6).

• Effect of cancellations or suspensions: Cancellations and suspensions effected under the Regulations elsewhere (Commonwealth or other State application) also have effect in Western Australia as if made under the Regulations as applied by this Act (s 6). That produces a legal consequence for holders of credentials: adverse administrative action taken elsewhere is effective in WA without the need for separate state action.

• Continuity of administrative authority: Section 5 preserves or vests the same powers and functions in the persons or authorities identified by the Regulations. That is, rights of decision-making, enforcement discretion, and administrative processes rest with the same named authorities in Commonwealth law when the Regulations operate within Western Australia (s 5).

Limitations and omissions

• The Act does not itself specify offences, penalty levels, or enforcement procedures; those are located in the Regulations (s 4). Parties interested in particular duties or penalties must consult the text of the Commonwealth Regulations as in force.

• The Act does not provide an independent judicial or administrative appeal scheme specific to Western Australia; appeal rights, judicial review pathways, and procedural protections are those in the incorporated Regulations and the Commonwealth Act (s 3, s 4, s 6). Where the Regulations vest powers in Commonwealth authorities, appeal routes specified by the Regulations or the Commonwealth Act will be operative.

• The Act creates no separate State licensing power for aviation that would run parallel to the Commonwealth Regime. Any State-based requirements that might overlap must be considered alongside the Act’s operation and the explicit preservation of Part III Division 4 of the Transport Co-ordination Act 1966 (s 8) where relevant.

Practical compliance points from the Act

• Holders of Commonwealth or interstate certificates should treat those credentials as valid in WA, subject to any suspension or cancellation that has been applied elsewhere (s 6).

• Operators should budget for fees payable to the Commonwealth, not to a State treasury (s 7).

• Entities and individuals must monitor Commonwealth Regulations as they change, because the incorporation is dynamic and updates apply by virtue of the Act (s 3, s 4).

In short, the Act imports the Commonwealth regulatory duties and rights into Western Australia, preserves the identity of regulatory decision-makers, recognises credentials across jurisdictions, and assigns regulatory fees to the Commonwealth. Those are the primary legal entitlements and obligations created by the Act’s structure.

The Air Navigation Act 1937 is an enabling and incorporation statute; it does not itself enumerate specific offences, penalties or procedural enforcement mechanisms. Instead, the Act delegates substance to the Commonwealth framework by importing the Air Navigation Regulations and preserving the exercise of powers vested by those Regulations. The practical implication is that enforcement and penalties applicable within Western Australia are those set out in the Commonwealth Air Navigation Regulations and, where relevant, the Commonwealth Act the Regulations are made under (s 3, s 4, s 5).

Statutory pointers in the Act

• Section 4: The Regulations "shall be read and construed and take effect accordingly" within Western Australia. Therefore any offence provisions, penalty schedules, infringement processes, or criminal sanctions included in the Regulations are enforceable in Western Australia by virtue of incorporation (s 4).

• Section 5: Where the Regulations vest enforcement or regulatory powers in particular persons or authorities, the Act vests the same power or function in those same persons or authorities for the Regulations’ application in Western Australia (s 5). That means who enforces the Regulations within Western Australia is determined by the identity of the enforcer set out in the Regulations or the Commonwealth Act. The Act does not itself create a parallel enforcement body.

• Section 6: Recognition of cancellations and suspensions, where a licence or certificate has been cancelled or suspended under the Regulations elsewhere, that administrative action will have the same effect in Western Australia (s 6). Administrative enforcement actions taken by Commonwealth bodies or under other State applications of the Regulations therefore extend to WA automatically.

• Section 7: Fees are payable to the Commonwealth, to meet the cost of administration of the Regulations in their application to the State (s 7). The allocation of fees to the Commonwealth creates a funding and administrative incentive for the Commonwealth bodies charged with enforcement or regulatory administration.

What the Act does not provide in enforcement terms

• The Act contains no standalone offence clauses, penalty levels, fine amounts, criminal code references, or procedural rules for prosecutions in Western Australia. If penalties are to be imposed, the charging instrument will be the Commonwealth Regulations as applied under this Act. Therefore, enforcement in practice will follow the processes, evidential rules and penalty framework specified in those Regulations.

• The Act does not itself set out appeal mechanisms or judicial review procedures specific to Western Australia; any such routes will be those contained in the Regulations or the Commonwealth Act, or the ordinary judicial review remedies available in Commonwealth or State courts to review administrative action.

Implications for enforcement actors and regulated persons

• Enforcers: Persons and authorities holding enforcement powers under the Commonwealth Regulations retain those powers when those Regulations operate in Western Australia (s 5). Administrative decisions, including suspension or cancellation of certificates, take immediate effect in Western Australia (s 6).

• Regulated persons: Operators, pilots and other credential holders should assume that any enforcement action taken under the Commonwealth Regulations, whether by Commonwealth authorities or under other States’ statutory application, will be effective in Western Australia without a separate state proceeding (s 6). Fee obligations are payable to the Commonwealth (s 7).

In cases where a practitioner needs to advise on a specific penalty or enforcement process, the Act directs attention to the substantive Commonwealth instruments. The Act is a vehicle for that Commonwealth enforcement architecture; it does not itself prescribe enforcement detail.

The Air Navigation Act 1937 interacts with several categories of law through incorporation, recognition and non-derogation clauses. The Act is deliberately concise and operates by reference, so understanding its interaction with other laws requires tracing the legal instruments the Act imports and the specific State provision it preserves.

Interaction with Commonwealth legislation and regulations

• Commonwealth Air Navigation Act and Regulations: The primary interaction is with the Commonwealth Act (defined in s 3 as the Air Navigation Act 1920-1936 of the Commonwealth, including amendments) and the Air Navigation Regulations made under that Act (s 3). The Regulations as applicable to the Territories are incorporated mutatis mutandis into Western Australian law (s 4). Consequently, the content and amendments of the Commonwealth Act and the Regulations directly shape the aviation law that operates in Western Australia.

• Dynamic updating: Because "Commonwealth Act" and "Regulations" are defined to include amendments from time to time (s 3), changes at Commonwealth level (amendments to the Act, new or varied Regulations) apply in Western Australia without separate State amendment. Practically, this makes Western Australian aviation law depend on Commonwealth legislative and regulatory change.

Interaction with other States’ application of the Regulations

• Recognition of credentials from other States: Section 6 expressly recognises certificates, licences and registrations granted under the Regulations by operation of law in other States. A credential issued or recognised under the Regulations in another State will have the same force in Western Australia (s 6). Cancellations or suspensions effected in other States therefore also have effect in Western Australia.

Interaction with Western Australian legislation

• Transport Co-ordination Act 1966, Part III Division 4: Section 8 states that the Air Navigation Act does not affect the operation of Division 4 of Part III of the Transport Co-ordination Act 1966. This is an explicit non-derogation provision preserving a State statutory regime that likely relates to transport coordination, including road and air interface matters (s 8). The Act therefore requires reading in conjunction with that Division where relevant. The notes indicate the historical changes to the short title of that State Act, but the operative effect is that the Air Navigation Act leaves that State provision intact.

• State administrative and judicial infrastructure: Although enforcement powers under the Regulations may be vested in Commonwealth authorities, Western Australian courts and administrative processes will still be relevant for judicial review, civil disputes, property rights, tort claims and other matters not displaced by federal regulatory primacy. The Act itself does not displace State court jurisdiction.

Cross-jurisdictional administrative effects

• Fees and funding: Section 7 directs fees under the Regulations applied in Western Australia to be paid to the Commonwealth. That financial flow affects budgeting and cost-recovery for regulatory administration and affects how Western Australian businesses transact with regulatory authorities (s 7).

• Administrative decisions carrying interstate effect: Because the Act recognises Commonwealth and other-State regulatory actions, administrative decisions taken by Commonwealth authorities or under the Regulations in other States have legal effect in Western Australia (s 6). That reduces the need for duplicate state administrative processes but creates dependency on Commonwealth administrative determinations.

Potential areas requiring cross-referencing or coordination

• Identity of regulatory decision-makers: Section 5 vests powers in "that person or authority" referred to in the Regulations; to determine who holds regulatory decision-making power for aviation in Western Australia, one must read the text of the Commonwealth Regulations and the Commonwealth Act (s 5). This requires cross-referencing between the State Act and the Commonwealth instruments.

• Interpretation and adaptation (mutatis mutandis): The Act allows necessary modifications in applying Commonwealth Regulations to Western Australia but does not specify colouring for those adaptations; interpretation will therefore depend on the Regulations themselves and, potentially, judicial consideration when disputes arise (s 4).

In summary, the Air Navigation Act 1937 is a conduit between Commonwealth aviation law and Western Australian operations. It creates tight legal interaction with Commonwealth law, recognises interstate regulatory decisions, preserves a specified State provision, and funnels fee revenue to the Commonwealth. Practitioners must therefore read the Act together with the Commonwealth Air Navigation Act and Regulations and the specified State transport provision to determine the full legal position.

The text supplied includes a compilation table and notes which record the formal amendments and reprints up to the reprint date of 5 November 2004. The Act itself incorporates the Commonwealth Act and Regulations as amended from time to time (s 3), but the Western Australian Act’s own amendment history in the supplied text is as follows.

Primary amendments recorded in the compilation table

• Air Navigation Act 1937 (6 of 1937): Assent 8 December 1937; commencement 4 February 1938 (s 2; Gazette 4 Feb 1938 p. 159). This is the original enactment (Compilation table).

• Air Navigation Act Amendment Act 1945 (No. 21 of 1945): This amendment appears in the notes as having been inserted; section 8 indicating non-effect on Part III Division 4 was inserted by No. 21 of 1945 s 2 (Notes below the Act). The compilation table records assent 9 January 1946; commencement 9 January 1946. The notes indicate that s 8 was inserted by that 1945 amendment.

• Air Navigation Act Amendment Act 1969 (No. 25 of 1969): This is recorded in the compilation table as having assent on 16 May 1969 and commencement on 16 May 1969. The Act’s text notes that s 8 was amended by No. 25 of 1969 s 2 (Notes below s 8).

Reprints

• A reprint incorporating the above amendments was approved 16 March 1970.

• Reprint 2 of the Air Navigation Act 1937 is noted as the state of the Act as at 5 November 2004, which is the version supplied (Compilation table).

Notes on references and short titles

• The Notes beneath the Act explain changes in short titles of the Transport-related State Act referenced in s 8. That State Act was formerly referred to as the Road and Air Transport Commission Act 1966, later changed to the Transport Commission Act 1966 and then to the Transport Co-ordination Act 1966. Those references were updated under the Reprints Act 1984 s 7(3)(gb) (Notes).

What the supplied compilation history does not contain

• The compilation table and notes in the supplied source provide a trace of the principal amendments and reprints up to 5 November 2004 but do not list subsequent amendments beyond that reprint date. The Act’s definition of the Commonwealth Act and the Regulations is dynamic and will capture Commonwealth amendments, but any further State amendments after 5 November 2004 are not present in the supplied text.

• The supplied material does not include text of the Commonwealth Air Navigation Act or its Regulations, nor any amendments to those Commonwealth instruments. Understanding the full, current regulatory framework therefore requires consulting the Commonwealth Act and the Regulations in force at the relevant time.

Practical consequences of the amendment history

• Section 8’s insertion and subsequent amendment history show the drafters intended to preserve particular State transport coordination provisions. This provision survived through the recorded amendments and reprints.

• The reprint status as at 5 November 2004 means the Act as supplied reflects the State-level changes up to that date; because the Act imports Commonwealth law dynamically, its substantive content in practice may have changed since that reprint due to Commonwealth amendments.

For a full compliance or advisory task, practitioners should check whether there have been State amendments after the 2004 reprint and, crucially, examine the current Commonwealth Air Navigation Act and Air Navigation Regulations as they exist at the present date.

The supplied legislation text and accompanying compilation notes do not record any cases, judicial decisions, or litigation history. No judicial decisions, statutory interpretations, or case names are cited within the Act text or the reprint notes provided.

Implications and next steps given the absence of litigation data in the source

• Absence within the Act does not mean the Act has not been litigated. The provided source is a statutory reprint and compilation table; it is not a case law digest. Practitioners should therefore conduct targeted legal research in judicial databases and law reports to identify any cases that have interpreted the Act, its incorporation of the Commonwealth Regulations, or the application of the mutatis mutandis principle in this context.

• Key interpretive issues likely to attract litigation (and hence are sensible points to search for cases) include:

  • How courts treat the mutatis mutandis incorporation when Commonwealth Regulations use terminology tied to Commonwealth institutions or geographic references.
  • The identity and scope of powers exercisable by Commonwealth authorities under s 5 when applying the Regulations in Western Australia.
  • The effect of s 6 on recognition of interstate cancellations and suspensions, including procedural fairness or due process questions where administrative action in another State is given effect in Western Australia.
  • Disputes over the allocation of fees under s 7 and whether collection or administration practices align with the statutory allocation to the Commonwealth.
  • Any conflicts or interpretive tension between the Regulations as applied and provisions preserved in Part III Division 4 of the Transport Co-ordination Act 1966 (s 8).

• Because the Act incorporates the substantive Regulation text, many disputes will in practice involve the Commonwealth instruments rather than the State Act alone. Therefore litigation may be found in records dealing with Commonwealth aviation law or cross-jurisdictional regulatory disputes.

Recommended research approach

• Search Commonwealth and State judicial databases for cases citing the Air Navigation Act 1937, the Commonwealth Air Navigation Act (1920-1936 or its successors) and the Air Navigation Regulations.

• Review administrative tribunal decisions and Commonwealth agency determinations where administrative action under the Regulations has been contested.

• Investigate State court decisions on the interaction of s 8 with State transport law for any reported disputes.

In short, the supplied source contains no litigation history. To identify relevant judicial treatment of the Act or the incorporated Regulations, further case-law and administrative-decision research is required in primary legal databases and tribunal records.

The Act’s brevity and method of operation by reference create several practical pitfalls or "gotchas" for counsel, compliance officers and operators. These are matters where simple reading of the short Act may conceal non-trivial legal or administrative consequences. Each point is grounded in the Act’s text.

Dynamic incorporation risk (s 3, s 4)

• The Act incorporates the Commonwealth Act and the Regulations as "in force from time to time" (s 3). That means a change in Commonwealth law can automatically alter the legal obligations of Western Australian operators without State legislative action. Entities that assume the State Act is static may be surprised by legal changes originating at Commonwealth level.

Uncertain content without reading the Regulations (s 4)

• The Act does not set out substantive rules. To know what duties, offences, evidential standards, or administrative processes apply, one must consult the Commonwealth Regulations and the Commonwealth Act. Advising clients solely from the State Act text risks missing the core substantive obligations.

Mutatis mutandis adaptation ambiguity (s 4)

• The Act applies the Regulations mutatis mutandis. The Act provides no express guidance on how particular textual or contextual adaptations should be made. Questions can arise, for example, where a Regulation refers to a Commonwealth Minister, a Commonwealth territory or a federal administrative body: practitioners must determine how those references operate within the Western Australian context. The absence of explicit adaptation rules can lead to interpretive disputes.

Authority identity and practical administration (s 5)

• Section 5 vests powers in "that person or authority" who holds such powers under the Regulations. To establish who acts (and where appeals or reviews lie) parties must refer to the Regulations and possibly to the Commonwealth Act. Misidentifying the enforcing authority can lead to misdirected applications, procedural errors or missed appeal deadlines.

Recognition of interstate cancellations and suspensions (s 6)

• The Act gives effect to cancellations and suspensions made under the Regulations elsewhere as if made under this Act. That means an administrative sanction imposed in another State or by a Commonwealth body can terminate a person’s right to operate in Western Australia without any separate WA proceeding. Practitioners should note that procedural fairness issues or differences in administrative standards between jurisdictions may create cross-border enforcement disputes.

Fee collection to Commonwealth (s 7)

• Section 7 requires fees to be paid to the Commonwealth. Businesses accustomed to paying State fees must redirect payments and accounting processes. Confusion about the recipient may lead to payment defaults or disputes about fee receipts and the legitimacy of Commonwealth collection mechanisms.

Non-effect on a specified State provision (s 8)

• Section 8 saves the operation of Division 4 of Part III of the Transport Co-ordination Act 1966. Practitioners must not assume full federal regulatory dominance precludes State transport coordination measures; there may be State procedures or restrictions that remain relevant even with the Commonwealth Regulations in force.

Commencement by proclamation (s 2)

• The Act comes into operation on a date fixed by proclamation. The State-level commencement timing may differ from Commonwealth regulatory effective dates, creating transitional complexity. Failure to confirm the proclamation date may lead to incorrect assumptions about the regulatory regime in force at particular times.

Limited State-specific appeal and enforcement machinery (s 4-s 6)

• Because the Act does not create State-specific enforcement procedures, litigants must trace appeal routes and remedial processes to Commonwealth instruments and administrative fora. This can complicate litigation strategy where relief in State courts interacts with federal administrative action.

Dependence on external instruments for definitions and scope (s 3)

• The Act’s defined terms reference the Commonwealth Act and the Regulations. If the Regulations contain terms of art or reference to other Commonwealth instruments, understanding the full scope requires pulling in those instruments. The chain of references can become long and increase due diligence costs.

In sum, the key gotchas are dynamic incorporation of external law, interpretive uncertainty from mutatis mutandis adaptation, cross-jurisdictional enforcement effects (including automatic recognition of suspensions and cancellations), and practical administration obligations such as paying fees to the Commonwealth. Each of these flows directly from the Act’s structure (s 3-s 8) and means that compliance requires active monitoring of Commonwealth law and careful cross-referencing between State and Commonwealth instruments.

Compliance under this Act requires treating Commonwealth Air Navigation Regulations as the operative source of obligations in Western Australia and aligning administrative, operational and legal processes accordingly. The Act sets specific administrative touchpoints that compliance officers and legal advisers should follow.

Core compliance steps

1. Monitor the Commonwealth Act and Regulations continuously (s 3, s 4)

   • Because the Act incorporates the Commonwealth Air Navigation Act and the Air Navigation Regulations "as in force from time to time" (s 3), entities must establish a process to track amendments to those Commonwealth instruments. This includes subscribing to Commonwealth legislative and regulatory updates and tracking Gazettal notices and regulatory instruments that amend the Regulations.

2. Read the Regulations for substantive obligations (s 4; Preamble)

   • The Act does not state substantive technical requirements. To identify duties on airworthiness, pilot licensing, air traffic rules and aerodrome regulation (Preamble), review the current text of the Commonwealth Regulations. Compliance checklists, maintenance programmes, pilot training standards and aerodrome operating certificates should be mapped to the Regulation provisions.

3. Verify credential status and understand cross-jurisdictional effect (s 6)

   • Treat certificates, licences and registrations issued under the Commonwealth Regulations or under another State's application of those Regulations as effective in Western Australia (s 6). Maintain records of credential status and monitor for cancellations or suspensions effected by Commonwealth authorities or other States, because such actions are effective in WA without further state action.

4. Identify the enforcing authority and appeal avenues (s 5)

   • Determine which person or authority exercises the relevant powers under the Regulations by reading the Regulations and the Commonwealth Act. Document the applicable administrative processes, including where to make applications, how enforcement action is taken, and how to lodge appeals or reviews. Ensure that communications and applications are addressed to the correct Commonwealth authority.

5. Adjust accounting to pay fees to the Commonwealth (s 7)

   • Ensure fee payment workflows, invoicing, and internal accounting systems route fees payable under the Regulations to the Commonwealth, as directed by s 7. Keep receipts and confirmations of payment to avoid disputes about fee compliance.

6. Coordinate with State transport coordination provisions where relevant (s 8)

   • Check Part III Division 4 of the Transport Co-ordination Act 1966 for any State-specific requirements that may still apply. Maintain an internal cross-reference matrix between Commonwealth regulatory obligations and any residual State transport coordination rules affecting aerodromes, ground transport interfaces, or licensing overlaps.

7. Build procedural compatibility for administrative actions from other jurisdictions (s 6)

   • Develop policies for responding to suspensions or cancellations enacted by other States or Commonwealth authorities. That includes client notices, contract clauses that trigger on loss of credentials, and contingency operational plans.

8. Maintain a legal review process for interpretive questions (s 4)

   • Because the Act allows mutatis mutandis application and does not provide explicit adaptation rules, create a legal review pipeline to address ambiguous textual conflicts, references to Commonwealth bodies or officers, and situations where a Regulation’s wording seems tied to Commonwealth-specific institutions. Escalate interpretive questions to counsel before taking action.

Operational checklist items

• Update safety management systems (SMS) to align with the current Regulations’ requirements for maintenance, airworthiness, crew qualifications and reporting obligations.

• Ensure training and licensing programmes meet Commonwealth standards as applied in Western Australia.

• Audit contracts with maintenance providers and aerodrome operators for compliance clauses tied to Commonwealth regulatory obligations and for clauses dealing with suspension or revocation of credentials.

• Keep a register of all certificates and licences held by the organisation, including issuance dates, expiry dates, and any notices of suspension or cancellation from Commonwealth or interstate authorities.

• Document who in the organisation is responsible for regulatory monitoring, payment of fees, and liaison with Commonwealth authorities.

Litigation and dispute readiness

• Because the Act gives effect to administrative suspension and cancellation decisions made by Commonwealth or interstate bodies (s 6), prepare to engage with Commonwealth administrative review mechanisms and judicial review as necessary. Keep timely records and evidence in case of review applications.

• Where there is potential overlap with the Transport Co-ordination Act 1966 (s 8), coordinate legal strategy to consider both State and Commonwealth avenues.

Summary compliance principle

• Treat the Commonwealth Air Navigation Regulations as the operative law for aviation activities within Western Australia. Ensure administrative, financial and legal processes are aligned to that reality: monitor Commonwealth instruments, pay fees to the Commonwealth, ensure credentials are current and recognised, and identify the correct authorities for applications or dispute resolution (s 3-s 7).
