Agricultural Produce (Wine Industry) Regulations 2016

The regulations rely on a small set of recurring concepts. Each concept anchors an operational obligation or a delegated discretion.

Approved. The term “approved” appears in the context of forms and approvals and is defined to mean “approved by the Commission” (Reg 3). The Commission therefore has procedural control over the form in which returns and perhaps notices or other things must be provided. This creates an administrative choice point: the Commission decides the precise format and may change it by varying its approvals.

Processing facility and operator. “Processing facility” is defined as a facility where wine grapes are processed in a wine‑making process (Reg 3). The operator of a processing facility is defined in Reg 9(1) as the person who controls and manages the processing facility. The regulations split obligations between owner/producer and the operator: producers have to file returns (Reg 8) and pay charges for grapes processed (Reg 7); operators must file returns about grapes they received and processed at the facility (Reg 9). The dual reporting model creates overlapping reporting streams that the Commission can cross‑check.

Wine producer. “Wine producer” is defined narrowly: a person who is the owner of wine grapes when they are received at a processing facility and whose business is or includes the production of wine from those grapes (Reg 3). The definition links three factual states: ownership at the time grapes are received, the receipt at a processing facility, and an active business element (business includes production of wine). Each limb affects who is captured by the levy and return obligations.

Wine‑making process; registered geographical indication. The regs rely on external Commonwealth definitions. “Wine‑making process” is given the meaning in the Primary Industries (Excise) Levies Act 1999 (Schedule 26 cl 1) and “registered geographical indication” has the meaning given in the Australian Grape and Wine Authority Act 2013 (s 4(1)) (Reg 3). The importation of Commonwealth definitions means the scope of regulated activity and certain locational identifiers are determined by other statutes rather than by these regulations, requiring users to consult those Commonwealth provisions to know the precise technical scope.

Statistical information and notice-making powers. Regulation 5 prescribes particular items the Commission may treat as “statistical information” when it issues a notice under Act s 13. These items are concrete, recordable variables: quantities of wine produced, quantities of grapes processed, supplier identity and ABN, quantities purchased from each supplier, quantities produced by the wine producer, registered geographical indication, and grape variety (Reg 5). Regulation 6 prescribes how a charge notice under Act s 14(3) must be published and requires at least 14 days’ public notice before payment falls due (Reg 6).

Payments and timing. The regulations fix the payment timing for charges: liability arises where grapes are processed in a wine‑making process in a financial year and the due date for payment is 31 July following that financial year (Reg 7). Returns obligations use the same annual deadline: both wine producers and operators must lodge approved‑form returns by 31 July each year (Regs 8 and 9).

Penalties. Non‑compliance with the returns requirements triggers a monetary fine. Both Reg 8 (returns by wine producers) and Reg 9 (returns by operators) specify a penalty: a fine of $2,000 (Reg 8; Reg 9). The instrument therefore places specific monetary consequences on failure to supply the prescribed data.

Committee services. By prescribing that the services set out in Act s 12(1)(a)-(m) are services the Wine Producers’ Committee may provide (Reg 4), the regulations operate as a direct implementation link between the Committee’s statutory capacity and the industry. The specific service list is in the parent Act; the regulation confirms those listed services are the Committee’s authorised activities.

Collectively, these concepts form a simple compliance architecture: definitional gates determine who is captured; Commission approvals and notices determine the form and timing; statutorily prescribed data fields determine the content to be collected; and fixed deadlines and monetary penalties enforce annual reporting and payment compliance.

The regulations identify three primary groups of affected persons and one institutional decision‑maker.

Wine producers. The core regulated population is “wine producer” as defined in Reg 3. A wine producer is someone who (a) owns the grapes when they are received at a processing facility and (b) whose business includes the production of wine. That means persons who own grapes but do not have wine production as part of their business are outside the definition; similarly, grape owners who sell grapes prior to delivery to a processing facility and are not the owner when received will not fit. Wine producers are subject to two principal obligations: pay any charges imposed by the Commission for grapes processed in a financial year (Reg 7) and lodge an approved‑form annual return by 31 July with specified personal, business and production data (Reg 8). If they fail to file the return they face a fine of $2,000 (Reg 8).

Operators of processing facilities. The operator of a processing facility , defined as the person who controls and manages the processing facility (Reg 9(1)) , must also lodge an approved‑form return by 31 July each year. That return requires the operator’s identity and contact details and a record of all wine producers from whom the operator received grapes to process in the previous financial year, with quantities, registered geographical indications and grape varieties (Reg 9(2)(a)-(f)). The operator’s own grapes processed must also be identified (Reg 9(2)(d)). Failure to lodge the return attracts a $2,000 fine (Reg 9).

Grape producers (as suppliers). Although grape producers in many cases are not directly specified as duty‑holders, they are indirectly affected. Regulation 5(2)(c) and (d) and Regulation 8(c)-(d) require wine producers to report the name, vineyard address, telephone number, email address and ABN of each grape producer from whom they purchased grapes in a specified period and the quantity purchased from each. Thus grape producers will see their identity, location and ABN transmitted to the Commission where their grapes are sold to a wine producer. Similarly, operators must list the wine producers whose grapes they processed (Reg 9(2)(b)), and include registered geographical indications and varieties (Reg 9(2)(e)-(f)). These data requirements affect the privacy and business information footprint of grape suppliers.

The Wine Producers’ Committee and the Commission. The Wine Producers’ Committee is the body established under section 11 of the Act; Reg 4 prescribes the services the Committee may provide by reference to Act s 12(1)(a)-(m). The Commission exercises approval powers (“approved” forms) and specification powers (“specified” periods or items) under the Act, and the regulations give concrete effect to those powers by defining what constitutes statistical information (Reg 5) and providing the Commission with means to publicise charges and require returns (Regs 6-9). Thus the Commission is the administrative decision‑maker and the principal enforcer of the reporting and payment regime.

Other stakeholders. Newspapers circulating in the local areas of wine producers are implicated by the publication requirement for charges (Reg 6). Commonwealth agencies are indirectly implicated because the regulations refer to Commonwealth definitions (registered geographical indication, wine‑making process), requiring coordination by regulated parties to determine scope. Accountants and compliance advisers engaged by producers and operators will also be affected because of the recordkeeping and reporting tasks imposed by Regs 5, 8 and 9.

In sum, the regulations place ongoing reporting and payment obligations on wine producers and processing facility operators, require the transmission of supplier identity and ABN data to the Commission, empower the Commission to determine approved forms and specified periods, and require public notice of imposed charges in local newspapers. The identity and record collection requirements impose operational tasks on producers and operators and create information flows from grape suppliers to the Commission.

This section sets out the principal positive obligations and discrete rights or procedural entitlements emerging from the regulations.

Duties: filing annual returns. Wine producers must, by 31 July each year, provide the Commission with an approved‑form return containing specified identity and production data: name, postal address, vineyard address, phone, email and ABN; quantity of grapes processed in a wine‑making process in the previous financial year; names, vineyard addresses, contact details and ABNs of grape producers from whom the wine producer purchased grapes in the previous financial year; quantities purchased from each supplier; quantities produced by the wine producer; registered geographical indications for the grapes; and the grape varieties (Reg 8). Operators of processing facilities have parallel duties by 31 July (Reg 9(2)). Both duties are annual and tied to the financial year.

Duties: payment of charges. A wine producer whose grapes are processed in a wine‑making process in a financial year is liable to pay such charges as are imposed by the Commission under section 14(1) of the Act, and those charges are due by 31 July following the end of that financial year (Reg 7). The regulation does not itself set the charge quantum; it fixes the liability trigger (grapes processed) and the due date.

Duties: provision of statistical information when specified. Regulation 5 prescribes the categories of information the Commission may require under Act s 13. A notice under s 13 will specify the period or date and will require a wine producer to supply one or more of the listed items (Reg 5). The “specified” period is determined by the Commission via notice (Reg 5(1)).

Procedural right: notice before charge due. Where the Commission imposes a charge under Act s 14(1) and must publish a notice under s 14(3), Regulation 6 requires that the notice be published in a newspaper circulating in the area(s) where affected producers are located and must be published at least 14 days before the charge is due for payment under Regulation 7. This provides a procedural minimum notice period and limits the permitted medium of public notice to newspapers circulating locally to the producers.

Commission discretion: approved forms and specification. The Commission has discretion to approve the forms in which returns are lodged (Reg 3 “approved”). Regulation 5(1) makes clear that the Commission specifies the period or date for which statistical information is sought by a notice under Act s 13. These are explicit administrative discretions that can shape compliance costs: format and timing are set by the Commission.

Penalties and enforcement powers. Failure to comply with the returns obligations attracts a monetary fine of $2,000 (Reg 8; Reg 9). The regulations do not specify additional enforcement processes in the text provided (for example, late payment interest, enforcement mechanisms or appeal rights), but do create a direct monetary sanction for return non‑compliance.

Rights not created or limited. The regulations do not themselves create rights of access to the collected data, confidentiality protections, or procedural appeal mechanisms against the Commission’s approvals or specifications; they do, however, limit public notice to newspaper publication and require minimum advance notice (Reg 6). Where the Act confers additional rights or processes (for example, review or confidentiality under the Agricultural Produce Commission Act 1988), those are not set out in these regulations and would need to be found in the parent Act.

Recordkeeping implication. Implicit in the reporting duties is a duty to maintain records sufficient to populate the required approved‑form returns for the previous financial year, including commercial identifiers and ABNs of suppliers and detailed quantities per supplier (Reg 8(c)-(d), Reg 9(2)(b)-(c)). The regulations make such data submission an explicit statutory duty.

In summary, the regulations impose recurring annual duties to report specific production and supplier data and to pay any Commission‑imposed charges by 31 July. They provide a procedural protection requiring at least 14 days’ newspaper notice before charges fall due, and they allocate administrative discretion to the Commission over form and specification. Monetary fines of $2,000 apply for failure to lodge the required returns.

The regulations are narrowly prescriptive about monetary penalties and leave other enforcement modalities to the parent Act or Commission practice. Two explicit penalty provisions appear.

Monetary fines for returns obligations. Regulation 8, which prescribes returns by wine producers, concludes with “Penalty: a fine of $2 000.” Regulation 9, which prescribes returns by operators of processing facilities, ends with “Penalty for this subregulation: a fine of $2 000.” Those are straightforward fixed monetary penalties attached to the statutory duty to deliver approved‑form returns by 31 July each year (Regs 8 and 9). The regulations do not specify whether these fines are enforceable as fines in court, infringement notices, or administrative penalties; the regulations simply specify the amount.

Timing and enforcement trigger. The due date for returns and for payment of charges is 31 July following the end of the financial year (Regs 7-9). Enforcement of the returns penalty therefore becomes relevant from that date when a wine producer or operator has not lodged the approved form. The regulations do not include graduated penalties, late fees, interest on unpaid charges, or other enforcement devices; they set a single monetary penalty for non‑provision of returns.

Publication requirement as a precondition to payment enforcement. Regulation 6 requires a notice referred to in Act s 14(3) to be published in a newspaper circulating where the affected wine producers are located and at least 14 days before the charge is due under Reg 7. This condition establishes a minimum advance public notice requirement that the Commission must meet before the charge payment date occurs. If the Commission fails to publish the notice as prescribed, the procedural precondition for collection may be imperfect, which could have practical enforcement implications; the regulation itself, however, does not specify remedies for defective publication.

Commission powers and Act references. The regulations rely on the Commission’s powers under the Agricultural Produce Commission Act 1988 (sections 11, 12, 13, 14 are referenced in Regs 4-7). The regulations do not restate the Commission’s enforcement powers in full, so the scope of sanctions beyond the $2,000 return fines will be found in the parent Act. For example, the Commission imposes charges under s 14(1) of the Act; Reg 7 fixes the due date and liable population for such charges. Enforcement of unpaid charges, methods of collection and dispute resolution are not addressed in these regulations and must be located in the Act or in Commission policy.

No procedural appeal or confidentiality terms included. The regulations do not include provisions that set out appeal pathways against Commission notices or penalties, nor do they contain confidentiality protections for the data provided in returns. Any dispute, review or confidentiality regime therefore would be a matter for the Agricultural Produce Commission Act 1988 or other applicable law.

Publication medium and potential enforcement visibility. The requirement that charge notices be published in newspapers circulating in the relevant areas (Reg 6) both limits and makes public the Commission’s charging decisions. Enforcement visibility is therefore partly public: the imposition of a charge must be publicised locally.

In summary, the regulatory instrument attaches two explicit $2,000 fines for failure to lodge annual returns (Reg 8; Reg 9). It requires public notice of charges at least 14 days before payment is due (Reg 6). Other enforcement mechanisms, collection processes and review rights are not specified in the regulations and should be located in the Agricultural Produce Commission Act 1988 or Commission practice.

The regulations expressly cross‑refer to the parent Agricultural Produce Commission Act 1988 and to specific Commonwealth statutes, creating cross‑jurisdictional definitional and operational dependencies.

Interaction with the Agricultural Produce Commission Act 1988. The regulations are made under that Act and give operational effect to particular sections. Regulation 4 operates for the purpose of section 12(1) of the Act by prescribing that the services listed in section 12(1)(a)-(m) of the Act are services the Wine Producers’ Committee may provide. Regulation 5 operates for the purpose of section 13 of the Act by prescribing what constitutes “statistical information” that the Commission may request by notice. Regulation 6 and 7 operate for the purpose of section 14 of the Act: Reg 6 prescribes how a notice under s 14(3) must be published and the timing relative to payment; Reg 7 fixes who is liable for charges imposed under s 14(1) and the due date. The regulations therefore supply the procedural and definitional glue for the Commission’s statutory powers; the full legal scope of the Commission’s power to impose charges, to require information, to sanction non‑payment, and to regulate Committee services will be governed by the parent Act and expanded by Commission policy.

Reliance on Commonwealth definitions. Two defined terms in Reg 3 are explicitly taken from Commonwealth law. “Registered geographical indication” is given the meaning in the Australian Grape and Wine Authority Act 2013 (Commonwealth) s 4(1) and “wine‑making process” has the meaning given in the Primary Industries (Excise) Levies Act 1999 (Commonwealth) Schedule 26 cl 1. By importing those definitions, the regulations make certain state regulatory effects depend on Commonwealth definitions and potentially on Commonwealth registers. Practically, that means the scope of what counts as a “wine‑making process” and the territorial extent or labelling significance of “registered geographical indications” are determined by Commonwealth statutory regimes rather than by this instrument.

Interplay with federal levies and excise frameworks. Although these regulations do not levy excise or federal charges, the use of the Primary Industries (Excise) Levies Act 1999 definition suggests alignment with how federal levy frameworks treat wine‑making activity. Regulated parties will need to coordinate their compliance with both federal levy/excise obligations and the state Commission’s returns and charges, because the triggering activity (grapes processed in a wine‑making process) is defined by Commonwealth law.

Data and privacy law interface. The regulations require the collection and transmission of personal and business identifiers , names, vineyard addresses, telephone numbers, email addresses and ABNs , from wine producers and operators to the Commission (Regs 5, 8, 9). The handling, storage, disclosure and potential use of those data will therefore intersect with privacy and information‑management legal obligations under state and Commonwealth privacy laws and government information access regimes. These regulations do not set confidentiality or disclosure limits; regulated entities and the Commission must consider applicable privacy frameworks in how the data are managed.

Commercial and contract law implications. The definition of “wine producer” as owner of grapes when they are received at a processing facility ties statutory liability to a factual point in the supply chain (Reg 3). That creates a possible interaction with commercial arrangements (sale contracts, delivery terms, consignment agreements) that determine ownership at delivery. Parties may need to align contractual terms to allocate statutory liability for charges or reporting obligations, subject to the statute.

Publication and media law. Regulation 6’s requirement that notices be published in newspapers circulating in the area(s) where affected producers are located connects the Commission’s statutory process to local print media. This intersects with defamation, advertising and publication rules insofar as the content of notices and the identities of affected producers may be publicised; the regulations, however, prescribe only the medium and timing.

Limits to the regulations’ interactions. The regulations do not attempt to pre‑empt or displace other statutory regimes (for example, marketing boards, food safety regulation, labelling laws) and are narrowly focused on the Commission’s powers and data collection for the wine industry. The precise extent of overlap with other state regulatory instruments remains a matter of mapping the Commission’s functions in the parent Act against other statutory duties.

In short, the regulations operationalise state statutory powers while depending on Commonwealth definitions for key terms; they create data flows that engage privacy and commercial law considerations; and they require contract and supply chain attention to the ownership trigger that determines statutory capture.

The instrument’s provided compilation details a single enactment entry and commencement particulars; no later amendments are recorded in the supplied text.

Enactment and gazettal. The regulations were made as the Agricultural Produce (Wine Industry) Regulations 2016. The compilation table records Gazettal on 14 June 2016 (14 Jun 2016 p. 2005‑13) (Compilation table).

Commencement schedule. Regulation 2 sets staggered commencement: regulations 1 and 2 commenced on 14 June 2016 (the Gazettal date) and the rest of the regulations commenced on 15 June 2016 (Reg 2). The compilation table confirms those dates (Compilation table).

No amendments recorded in the provided compilation. The compilation table reproduced in the supplied material contains only the original citation, gazettal and commencement lines and does not list any amendment instruments or subsequent Gazette entries. From the material provided, there is therefore no recorded amendment history beyond the initial making and commencement in June 2016.

What this means for users. Practitioners should treat the version of the regulations supplied as the original 2016 instrument. If any later amendments exist, they are not included in the supplied text and must be located in the official consolidated regulations database or Government Gazettes. The regulations themselves do not include transitional or saving provisions within the supplied text.

Record of defined terms. The supplied material includes a “Defined terms” note that lists the defined terms and the provisions where they are defined (Approved 3, operator 9(1), processing facility 3, registered geographical indication 3, specified 5(1), wine producer 3, Wine Producers’ Committee 3, wine‑making process 3). That note is informational and not part of the operative law, but it confirms the definitions locations in the instrument.

No amendment chronology or repeal events. Because the supplied compilation table lacks entries beyond the original Gazettal, there is no recorded sequence of modifications, repeals, or saving provisions to analyse here.

For complete due diligence, users should consult WA legislation databases or the Government Gazette for any subsequent amending regulations, but the supplied source records only the 2016 original instrument and its immediate commencement.

The supplied legislation text and compilation material do not record any litigation history. There are no cases, decisions or tribunal matters referenced in the regulations themselves, and the compilation notes do not include any court decisions or references.

What the absence of recorded litigation in the source implies. The regulations are prescriptive and technical in nature, setting out definitions, data collection obligations, deadlines and monetary penalties. The supplied text does not state any contested matters, nor does it cite judicial interpretation or administrative determinations. Consequently, if litigation relevant to these regulations exists, it is not included in the material provided and must be searched for separately in court records, tribunal databases or reported decisions.

Where disputes are most likely to arise. Based on the content of the regulations, the categories of issue that could generate litigation or administrative reviews (not recorded here) include:

• disputes over whether a person qualifies as a “wine producer” under Reg 3 (ownership timing and business‑inclusion test);
• disputes over whether a particular activity constitutes a “wine‑making process” given the Commonwealth definition that is incorporated by Reg 3;
• disputes about the Commission’s specification powers (what periods or dates are “specified” under Reg 5(1)) or disputes about the Commission’s approved form decisions (Reg 3 “approved”);
• challenges to the imposition or quantum of charges made under Act s 14(1) where payment is required under Reg 7, with possible procedural challenges to publication under Reg 6; and
• disputes regarding data handling, publication and confidentiality of returns provided under Regs 8 and 9, which might engage privacy law or administrative law review of Commission decisions.

None of these potential litigation heads are evidenced in the supplied text. Practitioners seeking existing authorities must perform external searches of court and tribunal databases.

No named cases in the instrument. The regulations do not name any judicial decisions and do not reference precedents. Any legal interpretations must therefore be sourced externally.

In short, the provided instrument contains no litigation history. Users requiring case law should search external legal databases for decisions interpreting the Agricultural Produce Commission Act 1988 or the 2016 regulations as applied to the wine industry.

This section highlights concrete traps, tight timelines, definitional thresholds and information risks that the regulations create, grounded in the text.

Ownership timing determines capture. “Wine producer” is defined as a person who is the owner of wine grapes when they are received at a processing facility and whose business includes production of wine (Reg 3). Ownership status at the moment of receipt is decisive. Contract drafting that transfers ownership prior to delivery or that keeps ownership with the seller until after processing will determine who is subject to charges and reporting; the regulation ties statutory capture to a specific contractual fact.

Business‑inclusion limb. The definition requires that the person’s business is or includes the production of wine. An entity owning grapes but not conducting wine production as part of its business may not be a “wine producer” for these regulations (Reg 3). Parties who have hybrid or occasional wine‑making activity should examine whether their business falls within the captured definition.

Cross‑referenced Commonwealth terms can shift scope. “Wine‑making process” and “registered geographical indication” are defined in Commonwealth Acts (Reg 3). Changes or differing interpretations in those Commonwealth regimes can alter the scope of state reporting and charge liability without state amendment. Regulated parties must therefore consult the Commonwealth definitions to be certain of the triggers and regional identifiers.

Approved form is Commission controlled. Both returns and any other “approved” items are subject to Commission approval (Reg 3). The Commission can specify form, likely including digital or paper formats. Not checking the Commission’s current approved form may lead to technically non‑compliant filings.

Data scope is broad and includes supplier identifiers. The returns require names, vineyard addresses, telephone numbers, email addresses and ABNs of grape producers from whom grapes were purchased, and quantity data by supplier (Reg 5(2)(c)-(d); Reg 8(c)-(d)). That is detailed supplier‑level data. Expect recordkeeping and privacy considerations; grape suppliers should be aware their ABNs and contact details will be reported to a regulator.

Dual reporting increases cross‑check risk. Both wine producers (Reg 8) and processing facility operators (Reg 9) must report overlapping information about grapes processed and suppliers. This allows the Commission to reconcile producer and operator returns. Inconsistencies could trigger inquiries or compliance action.

Tight annual deadline. All returns and payments governed by these regulations are due by 31 July following the end of the financial year (Regs 7-9). The 31 July deadline is fixed in the regulations. Missing that deadline exposes a party to the $2,000 fine (Regs 8 and 9) and may complicate settlement of charges.

Publication requirement is geographically local and time‑bound. Notices of charges must be published in a newspaper circulating in the area(s) where the affected producers are located, and at least 14 days before a due date (Reg 6). If affected producers are geographically dispersed, the Commission must publish in multiple local newspapers. Practically, this may create delays or disputes about adequate notice if the Commission does not publish in all relevant local media.

Penalty amount is fixed and modest. The penalty for failing to provide returns is a fine of $2,000 (Regs 8, 9). For medium and large producers, the fine may be small relative to compliance effort; for smallholders it may be material. The regulations provide no graduated sanctioning scheme in the text provided.

No confidentiality provisions in the regs. The regulations do not prescribe confidentiality protections for the information supplied. The absence of confidentiality rules in the instrument itself means regulated parties must rely on the parent Act or general privacy law for any protections.

Operator definition focuses on control and management. The operator is the person who controls and manages the facility (Reg 9(1)). Where facilities are subject to shared control or complex management arrangements, identifying the operator may be contentious and create compliance uncertainty.

Notice specification by Commission. The regulation defines “specified” to mean specified by the Commission in a notice under section 13 of the Act (Reg 5(1)). That gives the Commission the power to pick periods or dates for which statistical information is required. Parties must be alert to ad‑hoc or bespoke data notices from the Commission and respond within regulatory timelines.

In short, the main gotchas are the ownership timing rule, the business‑inclusion limb, the importation of Commonwealth definitions, the Commission’s control of forms and specified periods, overlapping reporting by producers and operators, a fixed 31 July deadline, and the requirement to transmit detailed supplier identifiers without explicit confidentiality protections in the regs.

This checklist sets out concrete steps a wine producer, an operator of a processing facility, or an adviser should follow to meet the regulations’ duties and reduce compliance risk. Citations to the relevant regulations are given in each step.

1. Confirm status as a “wine producer” or “operator.” Determine whether you meet the definition of “wine producer” (owner of grapes when received at a processing facility and business includes wine production) (Reg 3) or “operator” (person who controls and manages the processing facility) (Reg 9(1)). The determination affects who must lodge which return and who is liable for charges (Reg 7).

2. Consult Commonwealth definitions. For activities to be within scope, check the Commonwealth definitions of “wine‑making process” (Primary Industries (Excise) Levies Act 1999 Schedule 26 cl 1) and “registered geographical indication” (Australian Grape and Wine Authority Act 2013 s 4(1)) that are incorporated by Reg 3. Make sure your operational activities and GIs are aligned with those definitions.

3. Register and maintain contact and ABN details. Ensure that your business name, postal address, vineyard address, telephone number, email address and ABN are current and readily accessible. These are required fields on the approved return for both wine producers and operators (Reg 8(a); Reg 9(2)(a)).

4. Keep supplier records. Maintain contemporaneous records of each grape supplier (name, vineyard address, phone, email, ABN) and quantities purchased from each within the financial year (Reg 5(2)(c)-(d); Reg 8(c)-(d)). Build processes to capture supplier ABNs and contact details at point of purchase or delivery.

5. Record quantities and classifications. Track the quantity of wine produced for sale, the quantity of grapes processed, and the quantity of grapes produced by the wine producer in the financial year (Reg 5(2)(a), (b), (e); Reg 8(b), (e)). Also record the relevant registered geographical indication and grape variety for each supplier and for own production (Reg 5(2)(f)-(g); Reg 8(f)-(g); Reg 9(2)(e)-(f)).

6. Coordinate with operators. If you are a wine producer delivering grapes to a processing facility, coordinate with the facility operator to ensure consistent reporting. Operators have to report the wine producers from whom they received grapes and the quantities (Reg 9(2)(b)-(c)). Reconcile records to reduce the likelihood of Commission queries.

7. Monitor Commission notices and approved forms. Obtain the Commission’s current approved form for returns and any notices specifying periods for statistical information under Act s 13, because “approved” and “specified” are Commission controls (Reg 3; Reg 5(1)). Subscribe to the Commission’s mailing list or check its website regularly.

8. Calendar the 31 July deadline. All returns and charge payments for a financial year must be lodged or paid by 31 July following that financial year (Regs 7-9). Set internal timelines to prepare and review data well before 31 July to allow time for reconciliation and correction.

9. Prepare for newspaper notice timings. If a Commission charge is announced, expect the Commission to publish a notice at least 14 days before the payment due date in newspapers circulating in the area(s) where affected producers are located (Reg 6). Ensure you monitor local newspapers for such notices and keep evidence of publication if needed for audit or dispute.

10. Implement privacy protections. Because returns include supplier contact details and ABNs, put in place appropriate data handling practices consistent with state and Commonwealth privacy obligations. The regulations do not themselves provide confidentiality assurances, so adopt governance for secure storage, limited access and lawful use.

11. Plan for the $2,000 penalty risk. Understand that failure to lodge the approved‑form return by 31 July exposes the entity to a $2,000 fine (Reg 8; Reg 9). Consider internal audit or compliance checks before that date to avoid inadvertent non‑compliance.

12. Align commercial contracts to statutory ownership triggers. If you wish to avoid statutory capture or to allocate charge liabilities, ensure that sales, delivery and consignment contracts expressly allocate ownership at delivery to the intended party, because ownership when grapes are received at the processing facility is a statutory test (Reg 3).

13. Keep contemporaneous evidence of deliveries and processing. Maintain delivery dockets showing date, owner at delivery, processing facility and quantities. These documents will support positions on whether grapes were owned at receipt and will assist in cross‑checking operator returns.

14. Seek clarification from the Commission when necessary. If the Commission’s approved form or a specified notice is unclear, request written clarification. Given the Commission’s approval powers and ability to specify periods (Reg 3; Reg 5(1)), obtaining clarification reduces the risk of technical non‑compliance.

15. Maintain a register of GEOs and varieties. Because returns require registered geographical indications and grape varieties (Regs 5, 8, 9), maintain a register mapping suppliers and parcels to the appropriate GI and variety designation as used in Commonwealth registers.

Following these steps will materially reduce the risk of non‑compliance with the regulations’ reporting and payment obligations, help avoid the statutory $2,000 fines for failing to lodge returns, and ensure that contractual arrangements reflect the statutory ownership test that determines capture under the instrument.
