Agricultural and Veterinary Chemicals (Northern Territory) Act 1994

The Act’s architecture rests on a small set of structural concepts that determine governance, procedural law and allocation of rights and obligations. Those concepts are:

• Adoption of a national Code and Regulations. Section 5 makes the Agvet Code in the Schedule to the Agricultural and Veterinary Chemicals Code Act apply as Territory law. Section 6 does the same for the Agvet Regulations made under the Code Act. The “Agvet Code of the Northern Territory” and “Agvet Regulations of the Northern Territory” are labels for those adopted instruments (s 3 definitions; ss 5-6).

• “Applicable provisions” and cross-jurisdictional operation. The Act defines applicable provisions to include the Agvet Code and Regulations of the Territory and any Commonwealth law that applies in relation to those provisions (s 3). Section 10 treats references to Agvet Codes and Regulations in instruments as including separate references to each jurisdiction’s Agvet Code and Regulations, enabling documents to operate as if a single national code exists for certain purposes.

• Application of Commonwealth administrative laws. The Act declares that specified Commonwealth administrative statutes and their regulations operate as Territory law for matters arising under the applicable provisions (s 15(1); the statutes are listed in the s 3 definition of Commonwealth administrative laws). Related subsections clarify that statutory requirements in the Agvet Code do not displace those Commonwealth administrative law obligations (s 15(2)-(3)) and that such matters are to be treated as matters arising under Commonwealth law for Territory purposes (s 15(4)).

• Central role of the NRA. The NRA has the functions and powers conferred by the Act and the adopted Agvet Code and is given necessary ancillary powers to perform them, including contracting, property dealings and appointment of agents (s 20). The Territory may enter an agreement permitting the NRA to act as the Territory’s agent (s 21). The NRA may exercise functions conferred by corresponding laws in other jurisdictions and by interjurisdictional arrangements (s 22).

• Commonwealth overlay and ministerial direction. The Commonwealth Minister can, in exceptional circumstances, direct the NRA in relation to functions conferred under the Territory’s applicable provisions (s 23). Commonwealth delegation and ministerial powers extend to powers expressed to be conferred by this Act (s 26).

• Enforcement and prosecutors. The Federal Court is given civil jurisdiction over matters arising under the applicable provisions (s 18). The Commonwealth Director of Public Prosecutions may institute and carry on prosecutions and related proceedings for offences against the Agvet Code and Regulations as applied in the Territory (s 33). Commonwealth ancillary criminal laws dealing with aiding, abetting, attempts and related offences are applied to offences under the Agvet Code and Regulations of the Territory (s 8).

• Crown liability and civil exemptions. The Agvet Code binds the Crown in the right of the Territory (s 11), but the Crown is not liable to prosecution (s 12). The Act provides specific civil liability protections for the State and the Territory’s co-ordinator for certain losses connected to approvals, registrations, permits, licences and manufacturing steps (s 30). Conversely, NRA approvals are not a defence for private persons sued for loss arising from importation, manufacture, supply or handling (s 30(2)).

• Operational details and supporting instruments. The Act imports manufacturing principles applicable under the Commonwealth Act (s 25), validates certain orders and regulations made under the Commonwealth Code Act (s 24), allows transfer of records from previous registering authorities to the NRA (s 29), and prescribes the regulatory power to make Territory regulations not inconsistent with the Act (s 31). Section 30A designates eligible laws for the Agvet Code permit definition.

These concepts combine to create a legal and administrative regime where the national Agvet framework operates in the Territory, Commonwealth procedural safeguards and review mechanisms apply, the NRA performs core regulatory functions, and prosecutorial and judicial pathways are largely hosted at the Commonwealth level.

The Act affects several identifiable groups, with different rights, responsibilities and exposures established by the statutory scheme.

• Manufacturers, importers, formulators and suppliers of agricultural and veterinary chemical products. The Act imports the Agvet Code and Regulations as Territory law, so persons engaged in the importation, manufacture, supply, handling or use of active constituents and chemical products in the Territory are subject to the code’s registration, licensing, permit and compliance regimes as applied in the Territory (ss 5-6; definition references in s 3). Those persons are subject to NRA decisions, permits, exemptions and licences and must comply with the manufacturing principles adopted under s 25. They are also subject to civil liability for losses arising from importation, manufacture, supply or handling, and NRA approval is not a defence to such suits (s 30(2)).

• The National Registration Authority for Agricultural and Veterinary Chemicals (NRA). The NRA is the administrative centre for the regime in the Territory. It has the functions and powers expressed in this Act and in the adopted Agvet Code, including ancillary powers necessary to perform its functions (s 20). The NRA can enter contracts, hold property and appoint agents (s 20(2)). Under agreements with the Territory and Commonwealth it may act as the Territory’s agent to perform or exercise functions and powers on the Territory’s behalf (s 21).

• The Commonwealth Minister and Commonwealth officers. The Commonwealth Minister retains a power to give directions to the NRA in exceptional circumstances (s 23). Commonwealth officers and authorities acquire functions and powers under Commonwealth administrative laws to act in relation to matters arising under the applicable provisions of the Territory, and are required under s 16(2) to act as nearly as practicable as they would under Commonwealth law.

• The Northern Territory Government and its agencies. The Agvet Code binds the Crown in right of the Territory (s 11). Territory officers can be authorised to exercise inspector powers under the NRA authorisation scheme contemplated in the Agricultural and Veterinary Chemicals (Administration) Act, and such authorised officers have those powers and functions conferred on them (s 27). Fees and taxes imposed under the applicable provisions are to be paid to the Commonwealth (s 28), shifting revenue flows away from Territory coffers. The State benefits from limited civil liability protections under s 30(1) for specified classes of loss.

• Courts, prosecutors and administrative review bodies. The Federal Court holds civil jurisdiction over all civil matters arising under the applicable provisions (s 18). The Commonwealth Director of Public Prosecutions may institute and carry on indictable and summary prosecutions, and related proceedings, for offences against the Agvet Code and Agvet Regulations of the Territory (s 33). Commonwealth administrative law bodies named in the definition of Commonwealth administrative laws are applied as Territory law in relation to applicable matters (s 15(1)), which affects procedural rights for affected persons and the NRA.

• Individuals and public interest actors. Persons seeking access to documents or decisions may invoke the Freedom of Information Act 1982 and other Commonwealth administrative laws as they apply to the matters under the Agvet Code in the Territory (s 15(3)). The application of the Ombudsman Act and Privacy Act as Commonwealth administrative laws (s 3 definition and s 15(1)) means ombudsman and privacy complaint pathways are available in relation to decisions and handling of information connected to the applicable provisions.

• Previous registering authorities and their records. Authorities in the Territory that previously performed corresponding registration functions may transfer documents or substances in their custody to the NRA despite any other Territory law (s 29). That affects record custodianship and evidentiary flows.

Who pays and who receives revenue. Persons subject to fees and taxes under the Agvet Regulations of this jurisdiction must pay those fees and taxes, and the Act requires payment of such fees and taxes to the Commonwealth (ss 32 and 28).

In short, the regime affects regulated businesses in the agricultural and veterinary chemicals sector, the NRA as regulator, Commonwealth and Territory officers involved in administration and enforcement, judicial and prosecutorial bodies, and persons with rights of access and administrative review. The Act reallocates regulatory authority and revenue between the Territory and Commonwealth, and changes where prosecutorial and civil adjudication occur.

The Act delegates and aligns a series of duties and rights. Many duties stem from the adopted Agvet Code and Regulations, which the Act imports; other duties arise directly under this Act.

Duties on regulated persons

• Compliance with the Agvet Code and Agvet Regulations. The primary duty on persons involved with agricultural and veterinary chemical products in the Territory is to comply with the adopted Agvet Code and Agvet Regulations. Those instruments set out registration, permit, licensing, and manufacturing obligations. The Act makes those instruments applicable as Territory law (ss 5-6).

• Payment of fees and taxes. The Act prescribes that fees and taxes authorised by the Agvet Regulations of this jurisdiction are imposed and must be paid. Section 32 states that the Agvet Regulations prescribe the fees including taxes. Section 28 requires all fees, taxes and other money (other than penalties and fines) authorised under applicable provisions to be paid to the Commonwealth.

• Interaction with manufacturing principles. Subject to the Agvet Code and Regulations of this jurisdiction, the manufacturing principles in force under section 23 of the Agricultural and Veterinary Chemicals Act have effect for purposes of Part 8 of that Code (s 25). Businesses engaged in manufacturing must align with those principles to the extent incorporated.

Rights and procedural protections

• Access to Commonwealth administrative law protections. The Act expressly applies a set of Commonwealth administrative laws as Territory law for matters arising under the applicable provisions (s 15(1)). Those laws include the Administrative Review Tribunal Act 2024, the Administrative Decisions (Judicial Review) Act 1977, the Freedom of Information Act 1982, the Ombudsman Act 1976 and the Privacy Act 1988 as defined in s 3. This gives persons affected by NRA decisions access to established administrative review, judicial review, FOI and privacy complaint channels as applied in Territory matters.

• Statutory obligations of reasons and confidentiality do not displace Commonwealth obligations. Section 15(2) and 15(3) clarify that Agvet Code provisions requiring brief reasons for decisions and those relating to disclosure of confidential commercial information do not alter the NRA’s obligations under the Administrative Review Tribunal Act or the FOI Act as those Acts apply by virtue of s 15(1).

• Use of Federal Court jurisdiction. For civil matters arising under the applicable provisions, jurisdiction is conferred on the Federal Court (s 18(1)). That gives affected parties the right to litigate civil disputes under the Agvet Code in the Federal Court while not removing Territory courts’ jurisdiction (s 18(2)).

Duties on the NRA and Commonwealth officers

• Performance of conferred functions under the Code. The NRA has functions and powers conferred or expressed to be conferred on it under this Act and the Agvet Code of this jurisdiction (s 20(1)). It must exercise those powers in accordance with the provisions of the adopted Code and with applicable Commonwealth administrative law obligations applied by s 15.

• Conformity with Commonwealth administrative law standards. Where a Commonwealth administrative law confers a function or power on a Commonwealth officer or authority, that law confers the same function or power in relation to a matter arising in relation to an applicable provision of this jurisdiction (s 16(1)). In exercising those functions and powers, officers must act as nearly as practicable as they would under the Commonwealth administrative law (s 16(2)).

• Obligation to act under delegations and agreements. The Minister may enter into agreements enabling the NRA to act as the State’s agent for the exercise of powers and performance of functions (s 21). Delegation and authorisation powers provided under the Agricultural and Veterinary Chemicals (Administration) Act extend to powers expressed to be conferred under this Act (s 26).

Crown and State rights and immunities

• The Agvet Code binds the Crown in the right of the Territory (s 11). However the Crown is not liable to prosecution under the Act or the Agvet Code in the Territory (s 12). The Act also provides specific immunity from damages for the State and the Territory’s co-ordinator for loss or injury directly or indirectly suffered as a result of certain handling, approval, registration, permit and licensing outcomes and specified manufacturing steps (s 30(1)). Those immunities are limited in scope to the categories listed in s 30(1).

Prosecutorial powers and enforcement rights

• Prosecutions may be instituted or carried on by the Commonwealth Director of Public Prosecutions in respect of indictable and summary offences against the Agvet Code and Agvet Regulations as applied in the Territory (s 33). Commonwealth ancillary criminal laws that criminalise aiding and abetting etc apply as Territory law in relation to offences under the Agvet Code and Regulations (s 8).

Interpretive and operational rights

• The Act imports Commonwealth interpretive practice for the adopted Code and Regulations. Section 7 provides that the Acts Interpretation Act 1901 applies as a law of the Territory to the adopted instruments and instruments made under them, and that for that purpose the Commonwealth Act applies as if the Agvet Code were a Commonwealth Act (s 7(2)-(3)). This affects statutory construction and deadlines.

In sum, the Act distributes duties primarily to regulated persons (compliance and payment), to the NRA (administration under adopted Code plus Commonwealth administrative law duties), and to Commonwealth officers and prosecutorial authorities (enforcement functions). Rights include access to Commonwealth administrative processes, Federal Court jurisdiction for civil matters, and specified immunities for the State.

The Act frames enforcement by importing the Agvet Code and Agvet Regulations and then assigning jurisdiction, prosecutorial authority and ancillary criminal law application. While the Act does not list specific penalty amounts or maximum sentences, it establishes the procedural channels and prosecutorial agents that will enforce the offences created by the adopted Code and Regulations.

Enforcement mechanisms and jurisdictions

• Federal Court civil jurisdiction. Section 18 confers jurisdiction on the Federal Court with respect to all civil matters arising under the applicable provisions of this jurisdiction. This provision locates civil enforcement and disputes in the Federal Court while preserving Territory courts’ jurisdiction (s 18(2)). The effect is that civil enforcement under the Agvet Code in the Territory can be litigated in the Federal Court.

• Commonwealth DPP prosecutions. Section 33 confers functions on the Commonwealth Director of Public Prosecutions to institute and carry on prosecutions on indictment for indictable offences and to institute proceedings for summary conviction of persons in respect of offences against the Agvet Code and Regulations of the Territory. The Director may also carry on prosecutions instituted by the Attorney-General or at the Attorney-General’s request and to institute proceedings for committal for trial. The Director has power to do anything incidental or conducive to those functions (s 33(a)-(g)). This places criminal enforcement broadly in Commonwealth prosecutorial hands.

• Application of Commonwealth ancillary criminal laws. Section 8 applies designated Commonwealth ancillary criminal laws as laws of the Territory in relation to offences against the Agvet Code and Regulations. Those laws, defined in s 8(1), include sections of the Crimes Act 1914 dealing with aiding, abetting, accessories, attempts, incitement or conspiracy. Subsection 8(2) imports those provisions as if references to a Commonwealth law were references to the Agvet Code and Regulations and excludes Territory laws that would have the same effect. Subsection 8(3) treats references to an offence in the Agvet Code or Regulations as including related offences under the ancillary criminal laws. The effect is to import common-law style accomplice and attempt criminalisation into the enforcement of Agvet offences in the Territory.

• Inspectors and authorised officers. Section 27 permits the conferral of inspector powers on Territory officers where they are authorised under section 69F of the Agricultural and Veterinary Chemicals (Administration) Act by the CEO of the NRA. Those officers exercise the powers and functions conferred and, under s 27(2), acts performed in accordance with the authorisation are taken to have been validly exercised despite any failure to comply with a condition or restriction of the authorisation. That provision provides operational certainty for enforcement activities by authorised Territory officers.

Penalty structure and civil remedies

• The Act itself does not specify fines or penalty amounts. Those are contained in the Agvet Code and the Agvet Regulations which the Act imports (ss 5-6). Enforcement consequences, including criminal offences and administrative penalty regimes, must therefore be read in conjunction with the content of the adopted Code and Regulations.

• Civil liability. Section 30 establishes two relevant propositions. First, s 30(1) provides that no action, suit or other proceeding for damages lies against the State or a person who is or has been a co-ordinator of the Territory for losses or injury directly or indirectly suffered as a result of specified NRA-related regulatory actions or manufacturing activities. Second, s 30(2) states that where a civil action is brought against a private person responsible for importation, manufacture, supply or handling of an approved active constituent, registered chemical product or a product for which a permit or licence was issued, it is not a defence that the NRA had approved or registered the constituent or product or issued the permit or licence. In short, the Act shields the State and certain officials from damages but does not protect private parties from civil liability even if they held NRA approvals.

Procedural rights and review

• Commonwealth administrative law application. Section 15 applies Commonwealth administrative laws to matters arising in relation to the applicable provisions as if those provisions were Commonwealth law. That gives parties affected by NRA decisions rights of review and procedural protections under the named Commonwealth statutes, including administrative review and judicial review processes, FOI access, Ombudsman oversight and privacy protections. Subsections 15(2) and 15(3) ensure that particular Code-imposed requirements do not reduce the operation of specified Commonwealth obligations.

Operational enforcement features that affect behaviour

• Payment flows. Section 28 requires fees and taxes (other than penalties and fines) authorised under the applicable provisions to be paid to the Commonwealth. Collection and remittance pathways become an enforcement and compliance point with financial consequences for regulated parties.

• Ministerial direction. Section 23 empowers the Commonwealth Minister to give directions to the NRA in exceptional circumstances under the conferral in the Agricultural and Veterinary Chemicals (Administration) Act. That power may materially affect enforcement priorities and could be exercised to coordinate emergency responses.

• Prosecution centralisation. With the Commonwealth DPP empowered to prosecute and the Federal Court given civil jurisdiction, enforcement becomes more centralised at the Commonwealth level. This affects tactical options for both regulators and regulated parties in enforcement and defence.

In sum, penalties and enforcement are implemented through the imported Agvet Code and Regulations, with Commonwealth prosecutorial and civil adjudicative infrastructure specified in this Act. The Act creates immunities for the State and a named co-ordinator, applies ancillary criminal laws to extend accomplice and attempt liability, and offers procedural protections by applying Commonwealth administrative laws.

The Act deliberately integrates Territory administration into the Commonwealth Agvet regulatory architecture and various Commonwealth statutes. It creates specific cross-references and operability rules that determine which laws govern particular matters.

Adoption and interpretive integration

• Adopts the Commonwealth Agvet Code and Regulations. Sections 5 and 6 adopt the Code in the Schedule to the Agricultural and Veterinary Chemicals Code Act and the regulations made under section 6 of that Code Act as the Agvet Code and Agvet Regulations of the Northern Territory. Those adopted instruments become Territory law, subject to the interpretive rules in s 7.

• Acts Interpretation Act 1901 application. Section 7(2) provides that, subject to Part 1 of the adopted Agvet Code, the Commonwealth Acts Interpretation Act 1901 applies as a law of the Territory to the Agvet Code and Regulations and any instruments made under them. Section 7(3) treats the application as if the Agvet Code were a Commonwealth Act for interpretive purposes. The Interpretation Act 1978 does not apply to the adopted Code and Regulations (s 7(4)).

Commonwealth administrative laws and territory matters

• Application of Commonwealth administrative laws. Section 15(1) applies a defined set of Commonwealth administrative laws as Territory law in relation to matters arising under the adopted provisions. The definition in s 3 lists the Administrative Review Tribunal Act 2024, the Administrative Decisions (Judicial Review) Act 1977, the Freedom of Information Act 1982, the Ombudsman Act 1976 and the Privacy Act 1988 and their associated regulations. Subsection 15(4) declares that for Territory law purposes those matters are to be treated as matters arising in relation to Commonwealth law rather than Territory law.

• Interaction with particular Agvet Code provisions. Sections 15(2) and 15(3) state that particular provisions in the Agvet Code requiring brief reasons or dealing with disclosure of confidential commercial information do not affect the NRA’s obligations under the named Commonwealth administrative laws as applied by s 15. The consequence is that the Commonwealth statutes’ requirements for reasons and FOI disclosure prevail for matters arising under the adopted Agvet provisions.

Cross-jurisdictional references and single national operation

• References to other jurisdictions’ Code and Regulations. Sections 9 and 10 govern references to Agvet Codes and Regulations of other jurisdictions. Section 10(2) makes a reference in an instrument to Agvet Codes or Regulations be taken as including the Agvet Code or Regulations of the Territory and to include separate references to the Agvet Code or Regulations of each other jurisdiction, with the object stated in s 10(1) of enabling the Codes to operate as if they constituted a single national code in appropriate circumstances.

• Conferral and exercise of functions across jurisdictions. Section 22 allows the NRA to perform acts in the Territory in the performance of functions or powers conferred by laws of other jurisdictions that correspond to this Act or the Agvet Code. Section 21 permits agreements for the NRA to act as the Territory’s agent for performance of functions, which creates contractual and operational interfacing with Commonwealth ministers and possibly other States.

Crown and prerogative interactions

• Binding the Crown and preserving prerogative limitations. Section 11 binds the Crown in right of the Territory to the Agvet Code, but section 12 exempts the Crown from criminal prosecution. Section 13 makes clear that if, because of this Part, a provision of the law of another jurisdiction binds the Crown in right of the Territory, the Crown is subject to that provision despite prerogative rights or privileges.

Transfers and recordkeeping

• Transfer of documents and substances. Section 29 permits authorities in the Territory that previously performed corresponding registration functions to give documents or substances in their possession to the NRA despite any other Territory law. That creates a legal channel for records and evidential material to move from local agencies to the NRA without being impeded by other legislation.

Fees, taxes and financial interplay

• Fees paid to the Commonwealth. Section 28 requires all fees, taxes and other money (other than penalties and fines) payable under applicable provisions be paid to the Commonwealth. Section 32 states that the Agvet Regulations prescribe the fees, including those that are taxes. That provision reassigns revenue streams from local regulation to the Commonwealth.

Overlap with Territory regulatory regimes

• Eligible laws for permit definition. Section 30A declares the Medicines, Poisons and Therapeutic Goods Act 2012 and laws declared under it to be eligible laws for the purpose of the definition of permit in section 109 of the Agvet Code of this jurisdiction. This creates a specific interaction between the Agvet Code permit definition and Territory medicines, poisons and therapeutic goods legislation.

• Validation of orders and manufacturing principles. Section 24 gives orders made under section 7 of the Commonwealth Code Act the same effect in the Territory as provisions of the Agvet Regulations. Section 25 incorporates manufacturing principles in force under the Commonwealth Act for Part 8 of the Code. These clauses integrate procedural and technical standards between regimes.

Criminal law interactions

• Ancillary criminal laws application. Section 8 applies select provisions of the Crimes Act 1914 (Cth) as laws of the Territory in relation to offences against the Agvet Code and Regulations, while excluding Territory laws to the same effect. That choice imports Commonwealth criminal accomplice and attempt provisions into enforcement of the imported Agvet offences.

In summary, the Act creates a layered interoperation: the Agvet Code and Regulations are imported and interpreted using Commonwealth interpretive practice; Commonwealth administrative statutes apply to procedural matters and override certain Code provisions for those purposes; the NRA may operate across jurisdictions under agreements; records can transfer to the NRA; fees and taxes flow to the Commonwealth; and specified Commonwealth criminal provisions apply in relation to Agvet offences in the Territory.

The Act was enacted in 1994 and its reprint shows a sequence of amendments and related enactments listed in the Endnotes. The Endnotes and the body of the Act supply the formal amendment entries; this section summarises them and identifies the statutory provisions affected.

Commencement

• The Act received assent on 22 September 1994 and commenced 15 March 1995 as indicated in the Endnotes list of legislation. The Statute Law Revision and Repeals Act 2026 updated the reprint and is recorded in the endnotes as commencing 10 February 2026.

Noted amendments and consolidation changes

• The Endnotes list several subsequent Acts that amended or otherwise affected this Act. Specific amending Acts listed include the Statute Law Revision Act (No. 2) 1995, the Agricultural and Veterinary Chemicals (Control of Use) Act 2004, the Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010, the Medicines, Poisons and Therapeutic Goods Act 2012, the Justice and Other Legislation Amendment (Australian Crime Commission) Act 2017 and the Statute Law Revision and Repeals Act 2026. The Endnotes record their assent and commencement dates. Those amending Acts are included in the legislative history in the Endnotes at pages 16-17.

Section-specific amendments recorded in the reprint

• The List of Amendments in the Endnotes shows specific sections altered by later Acts. For example:
  • Section 3 was amended by No. 40, 2010, s 118 and by No. 3, 2026, s 4.
  • Section 7 was amended by No. 3, 2026, s 5.
  • Section 8 was amended by No. 3, 2026, s 6.
  • Section 15 was amended by No. 3, 2026, s 7.
  • Section 17 was amended by No. 3, 2026, s 8.
  • Section 18 was amended by No. 9, 2017, s 9.
  • Section 30A was inserted by No. 42, 1995, s 2, and subsequently amended by No. 35, 2004, s 141 and No. 13, 2012, s 304.

General and technical amendments

• The Endnotes include a reference to general amendments of a formal nature made by the Interpretation Legislation Amendment Act 2018 to sections 1, 7 and 30A, indicating non-substantive or technical changes to the text were made to align with interpretation law reforms.

Regulatory and consequential changes

• Several amendments reflect cross-references required by changes in related Commonwealth or Territory Acts. For example, additions to s 3’s definition list reflect the inclusion of the Administrative Review Tribunal Act 2024 in the definition of Commonwealth administrative laws. Section 30A’s insertion and later amendments show ongoing alignment with Territory medicines and poisons legislation as that law evolved. The 2017 amendment to s 18 indicates a change relating to jurisdictional allocation, although the reprint text now records the amended state of s 18.

Notes on commencement mechanics

• Section 2 indicates this Act commences on a date fixed by the Administrator by Gazette notice. The Endnotes record the historical commencement as 15 March 1995. Later amendments list their own commencement details as noted in the Endnotes.

What the reprint shows

• The reprint contains the Act as in force at 10 February 2026 and the Endnotes document amendments up to that date. The listed amending Acts and specified section changes give an audit trail for where particular provisions were modified or inserted. To trace the precise text changes over time one must consult the individual amending Acts listed in the Endnotes.

In short, the Act has been amended intermittently since 1994 to reflect administrative and regulatory changes, to integrate with Territory legislation like the Medicines, Poisons and Therapeutic Goods Act 2012, and to update cross-references and interpretation machinery. The Endnotes provide the formal record of the amending instruments and the sections they altered.

The text provided does not include any case law or judicial decisions arising under this Act. The Act’s Endnotes and sections name no judicial decisions, and no cases are referenced in the statutory text. The only jurisdictional and procedural litigation infrastructure set by the Act is the conferral of jurisdiction and prosecutorial functions, rather than the outcome of any particular litigation.

Statutory litigation channels established by the Act

• Civil jurisdiction. Section 18 confers jurisdiction on the Federal Court with respect to all civil matters arising under the applicable Agvet provisions of the Territory. That provision frames where civil disputes under the adopted Agvet Code and Regulations may be litigated, but the Act does not record any particular cases.

• Criminal prosecutions. Section 33 empowers the Commonwealth Director of Public Prosecutions to institute and carry on prosecutions for indictable and summary offences against the Agvet Code and Regulations of the Territory. The Act sets out prosecutorial authority without referencing prosecutions actually pursued.

• Administrative review. Section 15 applies Commonwealth administrative laws to matters arising under the applicable provisions. That confers rights to administrative review and judicial review under Commonwealth statutes named in s 3. The Act itself does not include decisions or records of administrative review outcomes.

Limitations on the reprint

• The reprint is a legislative text and its Endnotes provide amendment history but not judicial interpretations. Therefore, to construct a litigation history one must consult court records, the Federal Court’s decisions database, any tribunal decisions under the Administrative Review Tribunal Act 2024, and Commonwealth DPP prosecution records. Those materials are not part of the provided text, and no case names can be stated from the Act itself.

Practical consequence for practitioners

• The Act allocates forums and prosecutorial authority. For dispute planning and litigation strategy, practitioners must be aware that civil claims arising under the adopted Agvet provisions can be brought in the Federal Court (s 18), that Commonwealth administrative law review paths apply (s 15), and that the Commonwealth DPP may prosecute (s 33). Actual litigation outcomes and precedents are beyond the text and must be obtained from case law databases.

In sum, the statute determines the legal channels for litigation and review but does not record historical litigation. Building a litigation history for advice or precedent research requires searching judicial and tribunal decisions external to the Act.

This Act contains several provisions that create non-obvious operational consequences and compliance traps. The following points are drawn from the statutory text and describe concrete legal mechanisms that practitioners and compliance officers should note.

1. NRA approval is not a shield for private civil liability. Section 30(2) states explicitly that where a civil action is brought against a private person responsible for importation, manufacture, supply or handling of an approved or registered product, or one subject to a permit or licence, it is not a defence to rely on the fact the NRA had approved, registered, issued a permit or licence. That means regulated firms cannot assume NRA approval will immunise them from private tort claims or contract-based suits.

2. The State has a narrow civil immunity that does not extend to private operators. Section 30(1) gives the State and the co-ordinator immunity from damages for specified categories of loss connected to NRA approvals, registrations, permits, licences and manufacturing steps. Those immunities are limited to the listed scenarios; private entities remain exposed.

3. Fees and taxes flow to the Commonwealth. Sections 28 and 32 require fees and taxes prescribed by the Agvet Regulations to be paid to the Commonwealth. Those flows may surprise entities expecting local fee retention. The Act separates penalties and fines from other fees and taxes in that penalties and fines are not directed to be paid to the Commonwealth under s 28.

4. Commonwealth administrative laws override certain local Code requirements. Section 15 applies Commonwealth administrative laws to matters arising under the applicable provisions and clarifies that certain Agvet Code provisions cannot displace obligations under the Administrative Review Tribunal Act or the FOI Act. Practitioners must therefore use Commonwealth administrative law procedures for review and FOI, not relying solely on Code-prescribed processes.

5. Delegation and authorisation validation even when conditions are breached. Section 27(2) deems powers and functions exercised by Territory officers under an NRA authorisation to have been validly exercised despite any failure to comply with a condition or restriction of that authorisation. That provision can validate enforcement acts taken pursuant to authorisations even if the authorisation was not fully complied with, and may constrict later challenges based on technical authorisation defects.

6. Application of Commonwealth criminal accomplice and attempt provisions. Section 8 applies specified sections of the Crimes Act 1914 as Territory law in relation to offences under the Agvet Code and Regulations. This imports aiding, abetting, attempt and conspiracy liability. Where liability for accessory conduct is strategically important, the imported criminal provisions will broaden the exposure of corporate officers and third parties.

7. The Crown is bound but not prosecutable. Section 11 binds the Crown in right of the Territory to the Agvet Code, but section 12 expressly states the Crown is not liable to prosecution. This creates an asymmetry between the Crown’s regulatory obligations and its exposure to criminal sanction.

8. Ministerial direction power. Section 23 extends the Commonwealth Minister’s power to give directions to the NRA in exceptional circumstances to functions and powers conferred under the Territory’s applicable provisions. Direction power can be used to alter enforcement or administrative priorities in situations the Commonwealth Minister deems exceptional. The threshold for “exceptional circumstances” is not defined in the Act.

9. Transfer of documents despite other laws. Section 29 permits a previous registering authority in the Territory to give documents or substances to the NRA despite anything in any other Territory law. This can override records retention, confidentiality or evidentiary protections contained in other Territory statutes and must be considered where transfer of materials could implicate other legal obligations.

10. Federal Court civil jurisdiction does not exclude Territory courts. Section 18 confers civil jurisdiction on the Federal Court but does not oust Territory court jurisdiction. Practitioners should consider forum choice, procedural rules and cross-vesting arrangements under s 19, which states the Act does not affect the operation of Territory cross-vesting provisions.

11. Definition dependencies and external instruments. The Act imports the Agvet Code through the Schedule to the Agricultural and Veterinary Chemicals Code Act and depends on terms and provisions in that Code and the Agvet Regulations. Contracting parties and compliance teams must read the adopted Code and Regulations to understand specific obligations, because the Act itself supplies structural and procedural rules but not the substantive regulatory detail.

12. Eligible laws list for permits. Section 30A declares the Medicines, Poisons and Therapeutic Goods Act 2012 to be an eligible law for the permit definition in s 109 of the Agvet Code of this jurisdiction. That cross-reference may create unexpected regulatory overlaps and compliance obligations for entities dealing with chemicals that have medicinal or poison classification interactions.

Each of these items is a statutory mechanism rather than an assertion of likely outcomes. They affect litigation strategy, compliance priorities and administrative processes in concrete ways and should be checked against the relevant Agvet Code provisions and any NRA policy or guidance.

Compliance with the regime established by this Act requires attention to obligations under the adopted Agvet Code and Regulations, the NRA’s processes, the application of Commonwealth administrative law as it now applies to Territory matters, fee payment flows and record-keeping obligations. The following practical steps draw on the Act’s provisions and indicate where responsibilities and action points lie.

1. Identify whether the Agvet Code and Regulations apply to your activities

• Confirm that the activity falls within the scope of the Agvet Code and Regulations as applied to the Territory (ss 5-6 and definitions in s 3). The Act makes the national Agvet Code and Regulations operative in the Northern Territory, so check the adopted Code’s definitions and coverage to establish if a product, active constituent or activity is regulated.

2. Engage with the NRA for registrations, permits and licences

• Submit registration and permit applications to the NRA in accordance with the procedures in the adopted Agvet Code and Regulations. The NRA is the factual decision-maker for approvals, permits, exemptions and licences under the adopted regime (s 20). Ensure applications meet documentary, testing and manufacturing principle requirements, and keep contemporaneous records.

3. Observe manufacturing principles and licensing conditions

• Comply with the manufacturing principles referenced in s 25, which are incorporated subject to the Agvet Code. Check the current manufacturing principles in force under the Commonwealth Act to ensure plant, process and quality systems conform with statutory standards.

4. Prepare for Commonwealth administrative law processes

• Administrative review and judicial review rights are available under the Commonwealth administrative laws applied by s 15(1). Understand and preserve rights to reasons, to administrative review tribunals and to judicial review, and be ready to engage FOI and privacy processes as relevant. Keep detailed administrative records that will support requests for reasons and tribunal or court review.

5. Budget and remit prescribed fees and taxes to the Commonwealth

• The Agvet Regulations prescribe fees and taxes (s 32). Budget for and ensure timely payment of these amounts, remembering that s 28 requires that fees and taxes, other than penalties and fines, be paid to the Commonwealth. Confirm payment mechanisms and timetables with the NRA or the applicable financial instructions.

6. Manage civil liability risk independent of NRA approvals

• Do not assume NRA approval eliminates civil liability. Section 30(2) disallows the defence of NRA approval in private suits. Maintain product stewardship, insurance, quality control, labelling, SDS and contract clauses to manage risk, and consider indemnity arrangements with suppliers. Keep records of compliance testing and independent verification.

7. Prepare for inspections and authorised officer interactions

• Territory officers may be authorised by the NRA to exercise inspector powers under s 27. Ensure personnel are familiar with inspection protocols, that records and premises are accessible, and that any statutory notices are responded to promptly. Understand the authorisation basis and seek clarification if inspector authorisation conditions appear not to have been met.

8. Record management and transfer obligations

• If you hold documents or substances that may be required by the NRA, be ready to produce them. Section 29 allows previous authorities to give records to the NRA despite other laws. Maintain a record-retention schedule that tracks transfers and legal bases for retention or transfer.

9. Consider prosecutorial and litigation exposure

• Criminal enforcement may be carried out by the Commonwealth DPP (s 33) and civil disputes can be litigated in the Federal Court (s 18). Prepare litigation strategies accordingly, monitor NRA decisions that could precipitate legal action, and obtain early legal advice if enforcement notices or proceedings are threatened.

10. Watch for interjurisdictional consequences and agreements

• The NRA can act as the Territory’s agent under agreement with the Commonwealth Minister (s 21), and can perform functions conferred by corresponding laws in other jurisdictions (s 22). If your operations span jurisdictions, align compliance programmes to national registration and labelling regimes and track any interstate approvals or restrictions.

11. Clarify the scope of Crown protections and regulatory obligations

• Understand that the State and certain officials have immunities for specified harms under s 30(1) but that the Crown is bound by the Code (s 11) and not subject to prosecution (s 12). This affects whom to sue and what remedies may be available in disputes involving public authorities.

12. Liaise early with the NRA and seek administrative review where warranted

• If unsatisfied with an NRA decision, use the administrative review and judicial review pathways available under the Commonwealth administrative laws applied by s 15. Request reasons and, where necessary, lodge review applications promptly in accordance with statutory time limits and procedural requirements.

13. Monitor changes to the adopted Code and Regulations

• The Agvet Code and Regulations adopted under ss 5-6 are maintained and amended at Commonwealth level. Develop a regulatory monitoring process to capture changes, and update internal operating procedures and compliance matrices accordingly.

14. Seek specialist legal and technical advice

• Given the interplay between Commonwealth administrative law, the Agvet Code and Regulations, criminal accessory provisions and civil liability rules, obtain specialist legal advice on complex matters such as product registration strategy, emergency permit use, response to enforcement notices and evaluation of civil exposure.

These compliance steps are derived from the statutory allocation of functions and duties in the Act. Practitioners should read the adopted Agvet Code and Regulations in full to identify the specific procedural and substantive obligations relevant to their activities, and follow the Commonwealth administrative law pathways for procedural challenges and information access created by the Act.
