What it does
This Order imposes across-Tasmania controls on the use of specified agricultural and chemical products by (1) requiring a permit for certain sprays, (2) prohibiting spraying of particular products during a specified seasonal window, (3) forbidding aerial spraying of items on a separate list, and (4) barring the use of specified poisons for vertebrate pest control except in a narrow authorised case. The instrument makes the whole State a chemical control area (cl 4). Persons who perform agricultural spraying of products listed in Schedule 1 or Schedule 2 do so only if the spraying is “conducted in accordance with a permit granted and in force under section 29 of the Act” (cl 5; cl 6). Aerial spraying of items in Schedule 3 is prohibited except under the same permit route (cl 7(1)), and contravention of a Code of Practice for Aerial Spraying published by “the Council” is independently an offence (cl 7(2)). The Order also forbids spraying certain chemical products for the purpose of controlling vertebrate pests (cl 8(1)), with an express exemption for an inspector authorised by the Chief Veterinary Officer (cl 8(2)). The monetary consequences are civil penalties expressed as fines in penalty units: up to 50 penalty units for permit breaches in cl 5 and cl 6, and up to 100 penalty units for most aerial or vertebrate-pest related contraventions in cl 7 and cl 8.
Mechanically, the Order operates by reference to four Schedules. Schedule 1 lists substances that cannot be sprayed except with a section 29 permit (including 4‑aminopyridine hydrochloride, alpha and beta chloralose, mevinphos, fenthion when used for bird control, and pindone). Schedule 2 imposes a seasonal ban on 2,4‑D between 15 September and 15 April each year unless a section 29 permit applies. Schedule 3 cross‑references Schedule 7 to the Standard for the Uniform Scheduling of Drugs and Poisons (as understood under the Agvet Regulations of Tasmania) to define substances that cannot be aerial sprayed without a permit. Schedule 4 forbids spraying strychnine, potassium cyanide and sodium cyanide for vertebrate pest control, except for authorised inspectors. The Order takes effect on the day proclaimed under section 2 of the parent Act (cl 2) and is administered by the Department of Primary Industry and Fisheries (notice at end of instrument).
