#### 83 Preliminary notices issued under old Code (1) This regulation applies to an old Code application if: (a) a notice was issued under subsection 11A(3) of the old Code requiring the applicant to rectify defects in the application; and (b) the period for rectifying the defects (the rectification period) ends after 30 June 2015; and (c) the applicant has not rectified the defects before 1 July 2015. > Note: Paragraph 11A(3)(a) of the old Code provides that the notice must require the applicant to rectify the defects within 1 month or such further period as the APVMA allows. (2) For subitem 58(1) of Schedule 6 to the Amendment Act, the APVMA must: (a) for an application made under section 10 of the old Code: (i) complete a preliminary assessment of the application under section 11 of the new Code within 1 month of the earlier of the following dates: (A) the day the applicant has rectified all of the defects; (B) the last day of the rectification period; and (ii) comply with the requirements of subsection 11(2) and (3) of the new Code; and (b) for an application made under section 27 of the old Code: (i) complete a preliminary assessment of the application under section 28 of the new Code within 1 month of the earlier of the following dates: (A) the day the applicant has rectified all of the defects; (B) the last day of the rectification period; and (ii) comply with the requirements of subsection 28(2) and (3) of the new Code.
