#### 59D Manufacture of chemical products—exempt persons—person that acquires business including transfer of licence (1) For paragraph 121(4)(a) of the Code, a person who is the transferee of a business: (a) involving the manufacture of chemical products; and (b) in relation to which a licence has been issued; is an exempt person in relation to the manufacture of a product the production of which is authorised by the licence, subject to the following conditions: (c) that the person notifies the APVMA, in writing, of the transfer not later than 6 weeks after it is agreed; (d) that the person complies with the terms of the licence as if he or she were the holder of the licence; (e) that the person applies for a licence in relation to the business, in accordance with section 122 of the Code, within 3 months after acquiring the business. (2) An exemption under subregulation (1): (a) ceases to have effect if the person’s application under paragraph (1)(e) is refused by the APVMA; and (b) has no effect if the licence referred to in paragraph (1)(b) is not in force.
