Agricultural and Veterinary Chemicals Code (Pre-application Assistance Fee) Instrument 2015

The central concept is the unit fee of $192.50, which functions as the base pricing unit. The instrument does not define what a "unit" represents in terms of APVMA staff time or resources. It is simply a mathematical building block. The fee for any pre-application assistance application is calculated as the total number of units allocated to the elements involved, multiplied by the unit fee.

The instrument creates three tiers of pre-application assistance, each defined by the nature and depth of guidance sought.

Tier 1 is described as assistance for applicants "seeking guidance in the early stages of preparing for the making of an application" to help "clarify the types of regulatory assessments likely to be conducted for a particular submission to inform that applicant in collating relevant information and data likely to be necessary." This is essentially preliminary scoping advice. The available elements in Tier 1 are: administration (always 1 unit), preparation of a written response including research (2 units), and a meeting (2 units). There is no analysis element in Tier 1.

Tier 2 includes all aspects of Tier 1 with further provision for applicants "seeking guidance in matters relating to the types of information and data that may be appropriate in a particular submission." The key difference is that the written response element in Tier 2 attracts 4 units (rather than 2) and still includes research. The meeting remains at 2 units. Administration is still 1 unit.

Tier 3 includes all aspects of Tiers 1 and 2 with further provision for applicants "seeking appraisal of the specifics of conducting studies and finalisation of project plans for Global Joint Reviews." This is the deepest level of assistance. The written response in Tier 3 involves analysis (not merely research) and is charged at 6 units per module type. Module types are defined by reference to items 2 to 10 of Schedule 7 to the Regulations. Those items cover various assessment modules such as toxicology, metabolism and kinetics, residues, efficacy and safety, etc. A single application may involve multiple module types; each additional module type attracts another 6-unit fee. Meeting remains 2 units, administration 1 unit.

The concept of module type is critical for Tier 3 fee calculation. The instrument states: "If the assistance involves more than one module type, more than one 6-unit fee applies." That means the cost multiplies linearly with the number of module types discussed. For a product requiring several assessment areas, the fee escalates quickly. For example, an applicant seeking appraisal for both efficacy/safety and residues (two module types) plus administration and a meeting would pay: 1 (admin) + 6 (module one) + 6 (module two) + 2 (meeting) = 15 units, or $2,887.50. The instrument's own examples stop at two module types (13 units) but do not illustrate a scenario with three or more module types.

Another key concept is the elements of assistance table. Each tier has a defined set of elements. The instrument implies that administration is a mandatory element that always incurs the 1-unit fee, but the examples show that administration is always included. The written response and meeting are optional elements; the applicant can request only administration and a written response without a meeting. The examples confirm this: example (a) Tier 1 with administration and written response (3 units); example (c) Tier 2 with administration, written response and meeting (7 units); example (d) Tier 3 with administration, 1 module type and meeting (9 units).

The instrument also includes a transitional concept: the 2014 Instrument continues to apply to applications made before commencement. This means there are two sets of criteria potentially in operation depending on timing, adding complexity for applicants who might be mid-preparation.

The primary affected parties are applicants for pre-application assistance from the APVMA. These are typically businesses, organisations or individuals who intend to apply for registration or approval of an agricultural chemical product (e.g., pesticides, herbicides, fungicides) or a veterinary chemical product (e.g., animal medicines, vaccines, feed additives) under the Agvet Code. The instrument affects any entity that wants preliminary guidance before formal submission. This includes:

• Large multinational agrochemical and pharmaceutical companies that routinely develop new products and need extensive pre-application discussions, often involving multiple module types for complex products. For them, the fee structure is a known cost of doing business, but the tier definitions may still require internal classification processes.

• Small to medium enterprises (SMEs) and independent formulators that may have limited regulatory experience. For them, the tier system imposes a burden of correctly interpreting which level of assistance they need. A mistake could mean paying for a higher tier than necessary or being quoted a fee that is unexpectedly high because multiple module types are assessed. The lack of an explicit right to a refund if the APVMA reclassifies the tier after payment is a risk.

• Generic and off-patent manufacturers seeking to enter the Australian market. They may require less assistance but still need to pay the 1-unit administration fee even for the most basic inquiry. The instrument does not exempt simple inquiries from the fee.

• Consultants and regulatory affairs specialists acting on behalf of product owners. They must understand the tier criteria to advise clients on likely fees and to manage expectations. The 6-unit fee per module type may be a significant budget item for complex products.

The APVMA itself is affected as the administrator. The instrument imposes an obligation on the APVMA to correctly classify applications into tiers and to identify which module types are involved. That classification work has an administrative cost that is partly recovered through the administration fee element. However, the APVMA also bears the risk of disputes if applicants disagree with the classification. The instrument provides no dispute resolution mechanism.

Indirectly, the instrument affects final consumers of agricultural and veterinary products through the cost of regulatory compliance. Higher fees for pre-application assistance may be passed on in the prices of approved products. For farmers and livestock producers, this could mean higher input costs. For the Australian economy as a whole, the fee structure is a regulatory tax on innovation and market entry. The more complex and expensive the pre-application process, the fewer products may be brought to market, potentially reducing competition and choice.

The instrument likely has a greater impact on smaller players relative to larger ones because the per-module fee does not scale with company size. A single-module Tier 3 pre-application costs $1,347.50 (admin + 1 module + meeting) regardless of whether the applicant is a major multinational or a small local business. That proportional burden is higher for those with smaller budgets.

The instrument imposes a duty to pay the correct fee determined by the tier and elements of the application. The legal duty to pay arises from the Regulations (subregulations 69B(3)-(5)), not from this instrument directly. However, this instrument defines how the fee is calculated, so the applicant must ensure they provide sufficient information to allow the APVMA to apply the correct tier and element count. An applicant who misdescribes the assistance sought may inadvertently trigger a different fee than expected.

The instrument gives the APVMA the right to require payment of the calculated fee before providing the pre-application assistance. Although not explicitly stated, it is implicit from the nature of a fee that the APVMA can withhold the service until the fee is paid. The Regulations themselves likely provide the enforcement mechanism.

The instrument also gives the APVMA the right to classify the application into a tier. The tier definitions use subjective language: "guidance in the early stages", "matters relating to the types of information and data", "appraisal of the specifics of conducting studies". The APVMA will exercise discretion in determining which tier applies based on the applicant's request. An applicant who requests "early stage guidance" but provides detailed information about study protocols might be classified as Tier 3.

The applicant's rights under this instrument are limited. There is no express right to a refund if the classification is changed after payment, no right to an internal review of the tier determination, and no right to a partial refund if they do not use all the assistance paid for (e.g., cancelling a meeting). The instrument does not set timeframes for providing the assistance, so an applicant could pay and then wait an indeterminate period for a written response or meeting. The instrument also does not give the applicant the right to choose which APVMA officer provides the assistance or to specify the format of the written response.

The examples in the instrument illustrate the fee calculation for common scenarios, but they are not exhaustive. For instance, there is no example for Tier 1 with all three elements (admin, written response, meeting) which would be 1+2+2=5 units ($962.50). An applicant might need to work through the logic themselves.

Another duty implied by the instrument is the duty to identify the correct module types for Tier 3 applications. The module types are defined by reference to Schedule 7 of the Regulations, which the instrument does not reproduce. Applicants must cross-reference that Schedule to know what counts as one module type. That adds an extra compliance step.

The instrument does not create any private right of action for breach of its provisions. It is a legislative instrument that operates within the framework of the Agvet Code and Regulations. Enforcement for non-payment would be under the Code by the APVMA, likely by refusing to process the application or providing the service.

The instrument itself contains no penalty provisions. It is a fee-setting instrument, not a penal one. However, the broader legislative framework provides enforcement mechanisms for non-payment or abuse.

Under the Agvet Code, failure to pay a required fee may result in the APVMA refusing to provide the pre-application assistance. The Regulations likely empower the APVMA to treat the application as incomplete until the fee is paid. There is no criminal penalty for non-payment of a pre-application assistance fee, but civil recovery of the debt may be pursued in a court. Since the instrument does not create a statutory debt provision, the APVMA would rely on contract or restitution principles if assistance has already been provided without payment.

Potential enforcement risks for applicants include:

• Underpayment: If an applicant mistakenly pays a lower fee than the correct amount based on a misinterpretation of the tier or module types, the APVMA might demand additional payment before completing the assistance. This could delay the pre-application process and push back the overall product registration timeline. There is no provision in the instrument for waiving the shortfall due to a genuine mistake.

• Overpayment: If an applicant pays more than required (e.g., paying for two module types when only one was involved), the instrument does not provide a mechanism for refund. The APVMA might refund as a matter of policy, but it is not legally obligated.

• Misrepresentation: If an applicant deliberately misrepresents the nature of the assistance sought to obtain a lower fee (e.g., describing Tier 3 work as Tier 1), that could constitute an offence under the Agvet Code for providing false or misleading information. The penalty for such an offence could involve fines or criminal liability, though this instrument would not create that offence directly.

• Indirect penalties: The real penalty for non-compliance is opportunity cost. The APVMA may deprioritise applications from entities that have a history of incorrect fee payment, or may require full upfront payment before any assistance. Smaller entities with less regulatory clout may face stricter scrutiny.

The APVMA itself faces no express penalty for misclassifying an application. If an APVMA official incorrectly places an application in a higher tier and overcharges, the applicant might have a claim for judicial review of the decision as an improper exercise of power. However, the instrument does not specify any internal review or appeal rights. The practical recourse would be to complain to the APVMA or seek legal advice.

The instrument also does not address late payment. No late fee or interest is prescribed in this instrument, though the parent Regulations might contain general provisions about late payment of fees.

Enforcement of the fee structure ultimately relies on the APVMA's gatekeeping role. Pre-application assistance is a voluntary service; no one is compelled to use it. Therefore, non-payment simply results in non-provision of the service. The most significant enforcement action is refusal to assist, which itself may harm the applicant's ability to prepare a compliant formal application.

This instrument is part of an integrated regulatory framework for agricultural and veterinary chemicals in Australia. Its interactions with other laws and instruments are important for understanding its full effect.

Primary legislation: The Agricultural and Veterinary Chemicals Code Act 1994 is the enabling Act. The Code scheduled to that Act contains the core regulatory provisions. Section 164(1A) authorises the APVMA CEO to make instruments prescribing matters required or permitted by the regulations, including fee criteria. This instrument is therefore a legislative instrument under that section, subject to disallowance by Parliament.

Agricultural and Veterinary Chemicals Code Regulations 1995: This instrument directly interacts with several provisions of the Regulations:

• Regulation 8AT establishes the pre-application assistance service. This instrument operates under that regulation.
• Regulation 69B prescribes the fee structure, including the unit fee of $192.50 in subregulation 69B(3). Subregulation 69B(4) provides that a 2-unit fee is payable in all cases? Wait, the instrument's overview says "subregulation 69B(4) provides that a 2-unit fee is payable in all cases; additional units attract fees pursuant to subregulation 69B(5)." That is confusing because the instrument's table shows different unit counts. The overview text in the instrument may be referring to a base 2-unit fee that applies regardless, but the instrument's own table only shows 1-unit for administration. There appears to be an inconsistency or perhaps the overview is paraphrasing the regulations inaccurately. The instrument itself overrides that general statement by setting specific criteria. The practical interaction is that the instrument modifies the default rule in reg 69B(4) by providing a more nuanced breakdown.
• Schedule 7 to the Regulations defines the module types referenced in the Tier 3 analysis fee. The instrument does not list those module types; it merely cross-references them. Any amendment to Schedule 7 will automatically affect the scope of Tier 3 fees, potentially adding or removing module types without amending this instrument.

Other fee instruments: The APVMA issues multiple fee instruments under the Agvet Code for different services (e.g., application fees, variation fees, annual fees). This instrument is specific to pre-application assistance. An applicant may also have to pay fees under separate instruments for the formal application itself. The pre-application assistance fee is separate and not offset against later application fees. There is no credit or refund if the same work is later used in a formal application.

GST legislation: The unit fee is expressed as GST inclusive. That means the APVMA must account for GST under A New Tax System (Goods and Services Tax) Act 1999. The fee is $192.50, which is $175 plus $17.50 GST at 10%. The instrument does not state which fees are subject to GST or whether input tax credits are available to applicants. The flat inclusion of GST simplifies calculation but may affect the net cost for GST-registered businesses.

Transitional and revocations: The instrument revokes the 2014 instrument. Applications made before commencement continue under the 2014 instrument. This creates a dual regime during transitional periods. Applicants who had ongoing pre-application assistance under the 2014 instrument are unaffected by this new instrument's criteria. This interaction adds complexity for the APVMA's administrative systems.

Freedom of Information and Privacy Acts: The pre-application assistance process may involve sharing of confidential business information. The instrument does not address privacy. Other laws (such as the Privacy Act 1988 and the Agvet Code's confidentiality provisions) regulate how the APVMA handles information obtained during pre-application assistance.

The instrument's amendment history is limited based on the text provided. The instrument itself is a replacement for the earlier 2014 Instrument. The only amendment-related content is the revocation clause and transitional arrangements.

The instrument was made by Kareena Arthy, APVMA CEO, on 2 November 2015. It commenced on the day after registration. The precise registration date is not given, but it would have been shortly after signing.

The revoked Agricultural and Veterinary Chemicals Code Regulations (Pre-application Assistance Fee) Instrument 2014 was the predecessor. There is no detail about differences between the 2014 and 2015 instruments. The instrument does not include a table of amendments or a summary of changes. Practitioners who worked under the 2014 instrument would need to compare the two texts to identify changes. The tier structure may have been different, or the unit fees may have increased. The unit fee of $192.50 may have been changed from the 2014 Instrument's fee, but we cannot verify from this source.

The instrument does not list any subsequent amendments up to the date of the text provided (2015). It is possible that later instruments have amended or replaced this one, but this deep dive is confined to the source text.

There is a placeholder note in the original document indicating "Placeholder 1 of 11" through "Placeholder 11 of 11" and then eight additional placeholders. These appear to be formatting artifacts or incomplete drafting from the source copy. They do not affect the legal content, but they suggest the document may have been extracted from a larger compilation or may have had sections removed. The substantive instrument appears to be contained in the sections from "Name of Instrument" through the examples.

The instrument's ongoing relevance depends on whether the Agvet Regulations have been amended since 2015. If the unit fee under reg 69B has been changed by regulation amendment, the dollar amounts in this instrument's examples would become outdated. However, the instrument's criteria (tiers, elements, module types) would remain operative even if the base unit fee changes.

The source text does not mention any litigation history. There is no reference to court cases, tribunal decisions, or review proceedings involving this instrument or its predecessor.

Given the nature of the instrument (a delegated legislative instrument setting fee criteria), litigation is unlikely unless a dispute arises over the classification of an application or the amount charged. Possible grounds for legal challenge could include:

• Jurisdictional error: If the APVMA misapplied the tier criteria, an applicant could seek judicial review under the Administrative Decisions (Judicial Review) Act 1977. However, the instrument defines the criteria in fairly broad terms, giving the APVMA significant discretion. A court would likely defer to the agency's expertise in classifying assistance.

• Ultra vires: If the instrument exceeded the scope of subsection 164(1A) or regulation 69B, it could be invalid. But the criteria appear to be within power; they are directly tied to the fee provisions.

• No case law cited: There are no reported cases in the source. A search of Australian case law databases might reveal cases, but those are not in the source.

The instrument has likely been applied administratively without generating litigation. Most applicants would pay the fee rather than challenge it, as the fee amounts are relatively modest (up to a few thousand dollars). Legal challenge would cost more than the fee difference.

It is worth noting that the instrument is subject to Parliamentary disallowance under the Legislation Act 2003. That is a political check, not a judicial one. If a stakeholder believed the fee criteria were unreasonable, they could lobby Parliament to disallow the instrument, but that is not litigation.

The absence of litigation history may also indicate that the tier definitions are sufficiently clear in practice, or that the APVMA and applicants negotiate informally without formal dispute.

Several features of this instrument can trap the unwary applicant or advisor.

1. The unit fee may change without updating this instrument. The instrument fixes the criteria (units per element) but the dollar value per unit is in the Regulations (subreg 69B(3)). If the Regulations are amended to increase the unit fee from $192.50, the examples in this instrument (e.g., $577.50 for 3 units) become misleading. The instrument itself does not carry a warning that dollar amounts are current as of 2015. An applicant relying on the instrument alone might underpay if the fee has risen.

2. Multiple module types create geometric cost increases. A Tier 3 application involving just one module type plus a meeting costs 9 units ($1,732.50). With two module types no meeting it is 13 units ($2,502.50). With three module types and a meeting it would be 1 + 6 + 6 + 6 + 2 = 21 units ($4,042.50). The instrument's examples only go up to two modules. There is no cap or discount for volume. This can surprise applicants with complex products.

3. Administration is always charged. Even for the most basic Tier 1 inquiry, the 1-unit administration fee ($192.50) applies. There is no free initial consultation. An applicant seeking only a short telephone call to clarify a straightforward question must still pay. This may discourage some applicants from seeking early guidance.

4. The meeting fee applies per meeting, not per hour. The instrument allocates a fixed 2-unit fee ($385) for "Meeting between the applicant and the APVMA". It does not specify duration. If the meeting is very short, the applicant still pays the same fee. Conversely, if the meeting runs long, there is no additional charge. The fixed fee creates a cross-subsidy between short and long meetings. Applicants with simple questions pay for those with complex discussions.

5. Tier classification is subjective. The definitions of Tiers 1, 2 and 3 rely on terms like "early stages", "types of information and data that may be appropriate", and "appraisal of the specifics of conducting studies". These are not objective criteria. Two different APVMA officers could classify the same application differently, leading to different fees. Applicants cannot rely on a written formula.

6. Module types are not listed in this instrument. The instrument says module types are those set out in items 2 to 10 of Schedule 7 to the Regulations. An applicant must locate and read that Schedule to understand what constitutes a module type. The instrument does not provide a summary. This adds a research burden.

7. The examples are not exhaustive and may be misinterpreted. Example (e) shows a 13-unit fee for Tier 3 with 2 module types and no meeting. But what if the applicant wants administration, a written response for module type 1, a written response for module type 2, and a meeting? That would be 1 + 6 + 6 + 2 = 15 units, not 13. The example omits the meeting in that scenario. Someone could mistakenly think a meeting is always included with two module types.

8. Transitional period trap. Applications made before commencement are governed by the 2014 Instrument. If an applicant submitted a request right before the new instrument took effect, they might be treated under old fee criteria. An applicant unaware of the transition might wait for the new instrument to apply and unknowingly become subject to the old rules if they submitted before commencement.

9. No right to refund or review. If an applicant pays for Tier 3 and the APVMA provides advice that is merely Tier 1 level (e.g., no analysis), there is no provision in the instrument for a partial refund. The service is consumed as provided. The applicant's only recourse would be to argue that the APVMA did not provide the agreed scope of service, which would involve contract law rather than the instrument itself.

10. GST inclusive pricing can hide the actual cost to business. The $192.50 figure includes GST. For a GST-registered business that can claim input tax credits, the net cost is $175. But the instrument does not state whether the fee is subject to GST (it says inclusive, so it is). A non-GST-registered applicant pays the full $192.50. The instrument does not differentiate.

Compliance with this instrument involves correctly calculating and paying the pre-application assistance fee before the APVMA provides the service. The following steps are recommended.

Step 1: Determine the tier of assistance sought. Read the tier definitions carefully. If the assistance sought is merely to understand what regulatory assessments will be required and what information may be needed, it is likely Tier 1. If the applicant already knows the assessments but wants guidance on the appropriateness of specific data or study designs, it is Tier 2. If the applicant wants the APVMA to appraise detailed study protocols or finalise project plans for a Global Joint Review, it is Tier 3. Be honest about the depth of assistance needed; classifying too low may result in the APVMA requesting additional payment.

Step 2: Identify the elements required. Every application will involve administration (1 unit). Decide if a written response is needed. If yes, note that the unit allocation for the written response depends on tier: Tier 1 = 2 units (research), Tier 2 = 4 units (research), Tier 3 = 6 units per module type (analysis). Decide if a meeting is needed (2 units regardless of tier).

Step 3: For Tier 3, determine the number of module types. Reference items 2 to 10 of Schedule 7 to the Regulations. Count how many distinct module types are involved. If the assistance will cover both residues and environmental safety, that is likely two module types. Each attracts a separate 6-unit fee.

Step 4: Calculate total units. Sum the units for each element and each module type. Add the meeting fee if applicable. The total units multiplied by $192.50 gives the fee. But use the current unit fee from the Regulations, not necessarily the amount in this instrument if it has been amended.

Step 5: Pay the fee. The APVMA will likely provide an invoice or quote based on the information provided. The applicant should pay before the service commences. Keep records of the application details and the classification used.

Step 6: Monitor for changes. The instrument may be amended or replaced. The Regulations may change the unit fee. Applicants should check the current versions of both the instrument and the Regulations before each application.

Step 7: Seek pre-payment confirmation. Before paying, ask the APVMA to confirm the tier and fee amount in writing. This reduces the risk of disputes later. If the APVMA classifies differently than expected, ask for the reasoning.

Step 8: For transitional cases, check the date of application submission. If it was before the commencement of this instrument, the 2014 Instrument criteria apply. The applicant may need to locate the 2014 Instrument or ask the APVMA which criteria apply.

Step 9: Consider whether pre-application assistance is cost-effective. Given that even basic assistance costs at least $192.50 for administration alone, applicants with very simple inquiries might be better off reading APVMA guidelines and preparing the application themselves. The fee structure incentivises applicants to aggregate their questions into a single tier-appropriate request rather than making multiple separate inquiries.

Step 10: Consult a regulatory specialist if in doubt. The tier classification and module type identification are not always straightforward. A specialist familiar with APVMA practices can advise on likely classification and help draft the request to minimise costs (e.g., by narrowing the scope to fewer module types).
