Agricultural and Veterinary Chemicals Code (Manufacturing Principles) Determination 2014

Code of Good Manufacturing Practice (GMP). This is the foundational concept of the Determination. Section 5 mandates that veterinary chemical products must be manufactured in compliance with the Code of Good Manufacturing Practice published by the APVMA on 29 March 2007, including its Annexes. The Determination does not reproduce the Code’s content; it incorporates it by reference. This means a manufacturer must obtain and follow that separate document, which contains detailed technical requirements for premises, equipment, hygiene, documentation, validation, and quality control. Any future amendment to the Code would automatically apply unless the Determination is itself amended or the APVMA issues a revised version. Because the Code is incorporated by reference, a manufacturer cannot comply merely by following the fourteen sections of the Determination; the Code contains additional requirements that are legally binding.

Quality assurance system. Section 6 requires manufacturers to have in place a documented quality assurance system that is monitored for effectiveness and provides for continuous improvement. The system must ensure that finished products are fit for their intended use, manufactured in accordance with the manufacturing information supplied as part of the relevant approval (see below), and do not place treated animals or users at risk due to inadequate quality, safety or efficacy. The system must cover: appropriate procedures to meet required quality standards; release of materials only after compliance verification; cross-contamination prevention measures; safeguards against foreseeable errors or process failures; and verification that finished products have been made and stored correctly before release. The system must be relevant to the nature and intended use of the product. This is not a one-size-fits-all requirement; a manufacturer of a simple oral drench will need a less elaborate system than a manufacturer of sterile injectable immunobiologicals.

Relevant approval. Defined in section 4(2) as an administrative decision permitting the supply of a chemical product, whether made in Australia (by the APVMA) or overseas (by a foreign authority). This concept is critical because it ties the manufacturing standard to the specifications on which the product was approved. Section 12(1) requires products to be manufactured to those specifications. If a manufacturer changes a process and the change affects specifications so that the product no longer matches the relevant approval, formal approval from the relevant authority must be obtained before the affected product is released for supply. This means a manufacturer cannot unilaterally alter a formulation or process that alters the product as approved; it must seek regulatory approval, which can be costly and time-consuming.

Specified biological process. Defined in section 4(2) to include microbial, cell or tissue culture (including fermentation); extraction from biological tissues; derivatives from blood and body fluids; genetic manipulation (including recombinant DNA and hybridoma techniques); biotechnological processes; propagation in embryos or animals; and formation or isolation of protein fragments or their derivatives. Products manufactured using any such process are subject to the additional requirements of section 18 (immunobiologicals and other products of biological origin), which imposes stricter controls on starting materials, premises containment, decontamination procedures, and seed lot management.

GMP Agreement. Section 14 requires that where a licensed manufacturer contracts out all or some manufacturing steps, it must enter into a signed written GMP Agreement with the other person before manufacture commences. The agreement must clearly specify each party’s responsibility for every aspect of the manufacturing process, assurance of product quality, and consistency with the specifications on which the relevant approval is based. This is a formal legal document, not a simple purchase order or verbal arrangement. The licence holder must also exert direct control over and maintain oversight of the quality management of the step if the contractor is acting under the licence holder’s licence pursuant to regulation 59A of the Agvet Regulations.

The Determination directly binds any person who holds a licence under the Agvet Code to manufacture veterinary chemical products in a licensed facility, unless the product is exempt from the licensing requirement under the Agvet Regulations. This covers Australian-based manufacturers as well as overseas manufacturers whose products are supplied in Australia and who have been issued a licence or who rely on the Australian licence of another entity. It also affects persons who carry out only a single step in the manufacturing process under the licence of another manufacturer, whether as a contractor or under regulation 59A arrangements. Such persons are not themselves licensed but are bound by the terms of the GMP Agreement and the oversight of the licence holder.

Manufacturing staff, including operators, supervisors and quality control personnel, are directly affected by sections 7 and 13. Staff must be trained to a satisfactory level of competency in the basic principles of GMP and their specific duties. Quality control personnel must be sufficiently independent of other manufacturing operations to allow effective implementation of the quality control function. This can create tension in smaller operations where one person may wear multiple hats; the Determination demands structural independence.

The APVMA is the administrative body that enforces compliance. The Determination gives the APVMA a clear standard against which to assess licence holders during inspections, audits, and investigations. The APVMA can also require corrective action or suspend or cancel licences if the principles are not met.

Indirectly affected parties include contract laboratories that test products for quality control (section 13(3) requires them to follow good laboratory practice), suppliers of starting materials (since the manufacturer must ensure materials comply with quality standards before release), and animal owners or veterinary professionals who ultimately rely on the quality, safety and efficacy of the products. If defective products reach the market, the manufacturer’s liability may be increased by its failure to comply with the Determination, as non-compliance could be evidence of negligence or breach of statutory duty.

The Determination does not affect manufacturers of agricultural chemical products (pesticides), even if those products are used in veterinary contexts. It also does not affect manufacturers of veterinary chemical products that are exempt from the licensing requirement, such as certain low-risk products or those manufactured under a minor use permit exemption if such exemptions exist under the Regulations. However, the object in section 3 says the principles apply unless the products are exempt; so if a product is not required to be manufactured in a licensed facility, the Determination does not apply. Manufacturers of exempt products remain subject to other provisions of the Agvet Code.

The Determination imposes a set of positive duties on the manufacturer, with no corresponding rights other than the right to manufacture in compliance. The duties are cumulative and must all be satisfied.

Duty to comply with the GMP Code (section 5). This is the overarching obligation. It incorporates by reference the entire Australian Code of Good Manufacturing Practice for Veterinary Chemical Products 2007, which runs to many pages of detailed technical requirements.

Duty to maintain a quality assurance system (section 6). The system must be documented, monitored, and provide for continuous improvement. It must cover all the elements listed in subsection (2), including procedures for material release, cross-contamination prevention, error prevention, and finished product release.

Duty to ensure qualified management and trained staff (section 7). Manufacturing must be under the management and supervision of appropriately qualified, trained or experienced persons. Their duties must be clearly defined. All staff must be trained to a satisfactory level of competency.

Duty to provide suitable buildings and grounds (section 8). The premises must be located, designed, constructed, maintained and utilised to suit operations, protect products from contamination, permit effective cleaning, and minimise the risk of manufacturing error. An appropriate standard of hygiene must be maintained, with measures to minimise cross-contamination and ensure operator safety and environmental protection.

Duty to provide suitable equipment (section 9). Equipment must be suitable, properly operated, maintained and cleaned, with written instructions. Design and layout must minimise error risk and allow effective cleaning.

Duty to establish a documentation system (section 10). This must provide precise specifications, complete batch history, and traceable connection between raw materials and finished product.

Duty to ensure computer systems do not adversely affect quality (section 11). Any computer system affecting quality, safety or efficacy must be subject to quality system management.

Duty to manufacture to approved specifications and validate changes (section 12). Production must follow documented procedures. Critical processes must be validated. Changes affecting specifications require regulatory approval before release.

Duty to implement quality control (section 13). Must have an effective QC system. QC personnel must be independent. Analytical labs and animal testing facilities must follow good laboratory practice.

Duty to have written GMP Agreements for contracted steps (section 14). Must be signed before manufacture commences. Licence holder must oversee quality management.

Duty to conduct internal audits (section 15). Must be regular, systematic, covering all aspects, with corrective and preventive actions.

Duty to handle complaints and have recall procedures (section 16). Documented system for recording, investigating and acting on complaints. Effective recall procedure for defective or suspected defective product.

Additional duties for sterile products (section 17) and immunobiologicals (section 18). These impose stricter facility, hygiene, containment and record-keeping requirements.

The Determination itself is a legislative instrument made under the Agvet Code. It does not create its own penalty provisions. Instead, non-compliance triggers enforcement mechanisms under the Agvet Code and the Agvet Regulations. The most significant consequence is that a manufacturer who fails to comply with these principles may be found to have breached a condition of its licence, because the licence is conditional on manufacturing in accordance with the Determination and the GMP Code. The APVMA can then take action to suspend or cancel the licence under the Agvet Code. Operating without a licence or in breach of licence conditions can also attract civil penalties of up to specified penalty units (which are indexed and substantial) and, in serious cases, criminal prosecution for offences such as manufacturing an unregistered product or supplying a product that does not meet approval specifications.

The APVMA has powers of inspection, information gathering, and direction. It can issue directions requiring a manufacturer to take specific corrective action, such as ceasing production, recalling products, or implementing new quality measures. Failure to comply with a direction can itself be an offence.

Beyond direct regulatory action, non-compliance exposes the manufacturer to private liability. A product that causes harm because it was not manufactured in accordance with these principles could be the subject of a claim for damages under Australian Consumer Law for breach of the statutory guarantees of acceptable quality and fitness for purpose, or for negligence. Documenting compliance is therefore not only a regulatory obligation but also a key risk management tool.

The Determination includes a specific enforcement hook in section 12(3): if a change to a critical manufacturing process affects the product specifications so that the product no longer complies with the particulars or conditions of a relevant approval, formal approval from the relevant authority must be obtained before the affected product is released for supply. Supplying product without that approval constitutes an unauthorised supply of a product that varies from its approval, which is a serious breach.

The internal audit requirement (section 15) and complaints/recall system (section 16) are also enforcement levers because they require the manufacturer to self-identify problems. If a manufacturer fails to act on audit findings or does not properly investigate complaints, this can be used as evidence of systemic non-compliance.

The Determination sits within a broader legislative framework centred on the Agricultural and Veterinary Chemicals Code (the Agvet Code), which is scheduled to the Agricultural and Veterinary Chemicals Code Act 1994. That Code is the primary statute governing the registration, licensing, and control of agricultural and veterinary chemical products in Australia. The Determination is made under section 23(1) of that Act for the purpose of prescribing manufacturing principles. It is therefore subordinate to the Code; any inconsistency between the Determination and the Code itself would be resolved in favour of the Code.

The Agvet Regulations 1995 are referred to in the Determination on several points. The object (section 3) excludes products that are exempt from the licensed facility requirement under the Regulations. Regulation 59A is specifically mentioned in section 14(3), which addresses arrangements where a person carries out a manufacturing step under the licence of another manufacturer. The Determination does not create those arrangements; it merely imposes duties on the licence holder when they are used. A manufacturer must understand both the Regulations and the Determination to structure contract manufacturing properly.

The Australian Code of Good Manufacturing Practice for Veterinary Chemical Products (2007) is incorporated by reference. It is not reproduced in the Determination, but it has the force of law for licensed manufacturers. Any amendment to that Code made by the APVMA would automatically apply, unless the Determination is itself amended to adopt a different version. Manufacturers must monitor the APVMA’s publications to ensure they are using the current version.

State and territory legislation may also apply to manufacturing facilities, particularly in relation to occupational health and safety, environmental protection, and waste disposal. For example, a warehouse used to store hazardous starting materials must comply with state dangerous goods legislation. The Determination does not override those laws; it adds an additional layer of regulatory burden.

Products manufactured overseas and imported into Australia must still comply with the Agvet Code. If the overseas manufacturer is the holder of an Australian licence (or supplies under the licence of an Australian entity), the manufacturing principles apply to the overseas facility. The APVMA can inspect overseas facilities. The Determination’s definition of “relevant approval” includes overseas approvals, tying specifications to the foreign registration. This can create practical difficulties if foreign approval specifications differ from Australian requirements; the Australian approval will prevail.

The Therapeutic Goods Act 1989 does not apply to veterinary chemical products per se, but some products that are also used in animals (e.g., certain biologicals) may be regulated by the Therapeutic Goods Administration if they are for human use. The Determination does not interact with that regime.

The Determination was made on 25 June 2014 by Kareena Arthy, the then Chief Executive Officer of the APVMA, and commenced on the commencement of Schedules 1 to 6 to the Agricultural and Veterinary Chemicals Legislation Amendment Act 2013. That amending Act was originally passed in 2013 and, depending on the commencement proclamation, likely came into force in 2014 or later. The exact date of commencement is not recorded in the source text, but the Determination itself has no further amendment history recorded in this version. It repealed the earlier Agricultural and Veterinary Chemicals Instrument No. 1 (Manufacturing Principles) 2007, which had been in place for approximately seven years. The 2007 instrument presumably set out similar principles, but the 2014 Determination reflects changes made by the 2013 Amendment Act, which updated the Agvet Code and Regulations in various respects. No later amending instruments are mentioned in the source text. However, the user should be aware that the APVMA may have issued further amendments to the Determination since 2014, or may have updated the Code of Good Manufacturing Practice. The version provided appears to be the original as made, and any subsequent amendments would need to be checked on the Federal Register of Legislation. The Determination does not include a sunsetting clause or a review date, though as a legislative instrument it may be subject to automatic repeal under the Legislation Act 2003 unless it is remade. At the time of writing, it is assumed to remain in force.

The source text does not refer to any litigation concerning this Determination. There is no mention of court cases challenging the validity of the instrument, its interpretation, or enforcement actions taken under it. This is unsurprising given that the Determination is a detailed technical standard that is more likely to be enforced administratively than litigated. Most disputes over manufacturing compliance are handled through the APVMA’s internal review mechanisms or through the Administrative Appeals Tribunal (now the Administrative Review Tribunal) if a licence is suspended or cancelled. It is possible that the Determination has been referenced in tribunal decisions regarding licence conditions, but no such cases are identified in the source. The Determination itself does not create a cause of action; it is a standard to be applied in other proceedings. As such, its litigation history is thin. However, the Agvet Code more broadly has been the subject of litigation in the Federal Court and the Administrative Appeals Tribunal, particularly on questions of whether a product is a veterinary chemical product, the validity of approvals, and the scope of licensing requirements. Those cases may touch on the manufacturing principles indirectly, but the Determination itself is not a frequent subject of judicial consideration. Practitioners should search the relevant case law databases for decisions involving the GMP Code or the manufacturing principles if they are involved in a dispute. The absence of cited litigation does not mean the Determination is uncontroversial; it may simply reflect that compliance is typically achieved through negotiation and regulatory direction rather than court proceedings.

The GMP Agreement must be signed before manufacture commences. Section 14(1) is explicit: the licensed manufacturer must ensure that, before manufacture commences, it has entered into a signed written GMP Agreement with the other person. A manufacturer who starts contract manufacturing and only later formalises the agreement is in breach, even if the substantive arrangements are identical. This trap can catch companies that treat contract manufacturing as a routine procurement rather than a regulated activity.

Computer systems in the manufacturing process. Section 11 applies to “any activity that may affect the quality, safety or efficacy of the product” if a computer is used. This is broader than just process control systems; it can include inventory management software that controls the release of raw materials, labelling systems, and quality control data management. Many manufacturers do not validate these systems to GMP standards, assuming they are administrative tools. The Determination requires them to be subject to quality system management, which is a significant compliance burden.

Independence of quality control. Section 13(2) requires the person responsible for quality control to be sufficiently independent of other aspects of manufacturing. In a small facility with only a few staff, the person who performs quality control may also manage production. That arrangement may not satisfy the independence requirement. The manufacturer must restructure or hire additional staff to achieve genuine independence, even if it is uneconomical.

Validation of critical changes. Section 12(3) requires that any change to a critical manufacturing process be validated and formally approved by the licence holder or their authorised delegate. More subtly, if the change affects the product specifications such that the product no longer complies with the relevant approval, formal approval from the relevant authority (e.g., APVMA for an Australian approval) must be obtained before release. This means manufacturers cannot make even minor process changes that alter product characteristics without prior regulatory approval. The time and cost of obtaining approval can delay product supply and increase working capital requirements.

Traceability requirements. Section 10(c) requires “a traceable connection between raw materials and the finished product.” This implies full forward and backward traceability from starting materials through each intermediate to the final batch. Manufacturers whose documentation is not integrated or who use third-party suppliers without proper chain-of-custody records will struggle to meet this requirement.

Sterile products require separate controlled areas. Section 17(1)(a) mandates separate, controlled areas with high standards of hygiene and a system of controlling particulate contaminants. This can require significant capital investment in cleanroom facilities, HEPA filtration, airlocks, and environmental monitoring equipment. Small manufacturers who wish to produce a sterile product may need to build new facilities or contract out the sterile step, triggering the GMP Agreement requirement.

Immunobiologicals: biological starting materials. Section 18(a) requires that biological starting materials be demonstrated to be “as free as practicable from adventitious contamination.” This is a strict standard that requires supplier audits, testing, and risk assessment. “As free as practicable” is not absolute; it leaves room for interpretation but creates uncertainty about the required level of testing. A manufacturer that relies on a supplier’s certificate of analysis without verifying the supplier’s own contamination controls may be non-compliant.

Internal audits must lead to corrective action. Section 15 requires not just audits but “steps must be taken to assess the outcomes of the internal audits and to implement any necessary corrective and preventive action.” A manufacturer that conducts audits but does not act on findings is failing to comply. The APVMA can point to a backlog of unaddressed audit observations as evidence of systemic non-compliance.

Documentation must cover “each item, batch, or quantity.” Section 10(b) requires a complete history of each item, batch, or quantity manufactured in a specified timeframe. This means even single items or small quantities (e.g., experimental batches) must be documented to the same standard as production batches. A manufacturer that treats small batches as informal or exempt is in breach.

A manufacturer subject to the Determination should adopt a systematic approach to compliance, integrating the fourteen sections of the Instrument with the full Code of Good Manufacturing Practice. The following steps are a practical guide, not a substitute for legal advice.

Step one: obtain the full GMP Code. Request a copy of the Australian Code of Good Manufacturing Practice for Veterinary Chemical Products (including Annexes) from the APVMA. Read it in full. The Code contains detailed requirements on premises, HVAC, water systems, cleaning validation, and more that are not set out in the Determination. Without the Code, compliance is impossible.

Step two: appoint a quality manager. This person should have the authority and independence to implement the quality assurance system (section 6) and oversee quality control (section 13). Define their duties in writing. Ensure they report to senior management and are not subordinated to production managers.

Step three: document everything. Establish a documentation system under section 10 that includes: standard operating procedures for all manufacturing steps; specifications for starting materials, intermediates, and finished products; batch production records; cleaning records; equipment maintenance logs; training records; and complaint and recall procedures. Ensure traceability from raw material lot numbers to finished product batch numbers.

Step four: validate critical processes. Identify which manufacturing processes are critical (e.g., sterilisation, blending, aseptic filling) and validate them according to approved protocols. Document the validation. Establish a change control procedure that requires any change to a critical process to be formally approved and, if it affects product specifications, regulatory approval before release.

Step five: train all staff. Develop a training matrix. Train all personnel on GMP principles and their specific duties. Maintain training records including dates and assessments of competency. For staff handling immunobiologicals or sterile products, provide specialised training.

Step six: facility and equipment controls. Ensure buildings comply with section 8: appropriate location, design, cleaning, and hygiene. Install equipment per section 9: written operating instructions, maintenance schedules, and cleaning protocols. For sterile products, construct separate controlled areas with particulate control. For immunobiologicals, ensure containment and decontamination capability.

Step seven: manage contract manufacturing. If any step is contracted out, prepare a written GMP Agreement that complies with section 14. Sign it before work begins. Retain oversight of the contractor’s quality management. Conduct audits of the contractor.

Step eight: implement a quality control system. Set up an independent QC function. Ensure laboratory testing follows good laboratory practice. Establish procedures for sampling, testing, and release of materials and finished products.

Step nine: conduct internal audits. Schedule audits at regular intervals (e.g., annually at minimum). Cover all manufacturing and quality activities. Document findings, assess them, and implement corrective and preventive actions. Keep records for APVMA inspection.

Step ten: establish complaint and recall systems. Have a documented process for receiving, investigating, and acting on complaints. Have a recall plan that can be activated quickly. Test the recall procedure periodically.

Step eleven: computer system compliance. Identify all computer systems used in activities affecting quality, safety or efficacy. Validate them or justify why they do not require validation. Apply quality system management principles to their operation and change control.

Step twelve: maintain records and stay current. Keep all records for the period required by the Agvet Regulations (typically several years after the product’s shelf life). Monitor the APVMA website for updates to the GMP Code or amendments to the Determination. Review compliance annually.
