Agricultural and Veterinary Chemicals Code (Allowable Variation in Concentrations of Constituents in Agricultural Chemical Products) Standard 2022

Active constituent is defined by section 3 of the Code and, for the purposes of this instrument, means the constituent (or one of several constituents) responsible for the biological or other effect that identifies the product as an agricultural chemical product. Non-active constituent is defined negatively: any constituent other than an active constituent (commonly called an excipient). The declared content, also called nominal content or nominal concentration, is the expected, mean, or target concentration stated in the application form or, for active constituents or poisons-scheduled constituents, on the product label. This is the value against which the measured concentration is compared to determine whether the product is within tolerance.

The distinction between homogeneous formulation and heterogeneous formulation is central to the first tolerance tier for active constituents (up to 25 g/kg or g/L). A homogeneous formulation has a lower degree of spatial variability of particle size and chemical composition, as determined by the APVMA from time to time; examples include soluble concentrates (SL) and emulsifiable concentrates (EC). A heterogeneous formulation has a higher degree of such variability; examples include water-dispersible granules (WG) and granules (GR). The instrument does not itself define these terms exhaustively; it leaves the classification to the APVMA’s discretion over time, which introduces an element of regulatory uncertainty for novel formulation types.

Validated analytical method means a method validated in accordance with the APVMA guidance document Validation of analytical methods for active constituents and agricultural products, which is incorporated by reference as in force from time to time. This means that if the APVMA updates that guidance, manufacturers must adapt their methods accordingly without a formal amendment to this instrument. The note provides a URL to access the guidance free of charge.

The instrument also introduces the concept of q.s. (quantum sufficit, or “as much as suffices”) for two specific categories of non-active constituents: solvents or carriers in liquid products, and fillers or carriers in solid products, where the quantity may be adjusted to balance variable amounts of other ingredients; and constituents such as pH adjusters, salt-forming acids or bases, buffers, antifoams, or viscosity modifiers whose concentrations are adjusted to bring a parameter (for example, pH, foam, or viscosity) within a desired range. For these ingredients, the tolerance may be expressed not as a fixed percentage but as something like “q.s. 1 L” or “q.s. pH 4.0-5.0”. Critically, a nominal concentration must still be provided for the purpose of correct scheduling under the Poisons Standard.

The primary duty holders are registrants and manufacturers of agricultural chemical products. Any person who holds a registration for an agricultural chemical product must ensure that each batch of product, when tested using a validated analytical method, has measured concentrations of active and non-active constituents within the tolerance ranges set out in the tables. This affects not only the initial registration but ongoing quality assurance and batch release. If a manufacturer produces a product on behalf of a registrant (for example, under a toll-manufacturing arrangement), the manufacturer’s quality system must be capable of consistently hitting the declared content within the allowed variation. The instrument also affects applicants for variation of registration: if a registrant wishes to change the nominal concentration of a constituent, they must apply to the APVMA for a variation of the relevant particulars; the tolerance tables cannot be used as a backdoor way to shift the target because the instrument explicitly prohibits deliberate variation even if the new value falls within the tolerance.

The APVMA is the regulator that classifies formulations as homogeneous or heterogeneous, assesses scientific justifications for alternative allowable variations, and enforces compliance. The instrument indirectly affects downstream users (farmers, agronomists, agricultural contractors) because the tolerances govern whether a product’s label claim is accurate. A product that is out of tolerance but within the allowed variation is still compliant; a product outside the tolerance is non-compliant and may be subject to enforcement action, which in theory protects users from gross under-dosing or over-dosing. However, the instrument also creates a compliance burden for smaller formulators who lack the resources to validate analytical methods or prepare the scientific justification needed to propose alternative tolerances. The q.s. provisions provide flexibility for certain ingredients, but the requirement to still state a nominal concentration for scheduling purposes means manufacturers cannot simply declare “q.s.” without a number; they must commit to a mean target, which may increase record-keeping costs.

The central duty under the instrument is to ensure that the concentration of each constituent of a registered agricultural chemical product, when measured by a validated analytical method, does not differ from the declared content recorded in the Register by more than the prescribed extent. This is a duty that flows from section 5AA(3) of the Code, which prohibits a difference beyond the prescribed extent, and regulation 41(2), which refers to this standard. The duty is ongoing: every batch must comply, not just the batch used for initial registration.

A right (or flexibility) conferred by the instrument is the ability for an applicant to propose alternative allowable variations that differ from the standard tables for both active and non-active constituents. To exercise this right, the applicant must provide an appropriate scientific justification, and the APVMA must be satisfied that the alternative variation would still ensure compliance with the safety, efficacy, and trade criteria in sections 5A, 5B, and 5C of the Code. This allows a manufacturer to argue for tighter tolerances (for example, to meet export requirements) or, in some cases, broader tolerances if justified by product chemistry or manufacturing constraints. However, the burden of proof rests on the applicant, and the APVMA retains full discretion.

For non-active constituents used as solvents, carriers, fillers, pH adjusters, buffers, antifoams, or viscosity modifiers, the instrument grants the right to declare tolerances using q.s. expressions rather than fixed percentages. This is a meaningful concession to legitimate manufacturing variability, but it comes with the duty to still provide a nominal concentration for scheduling purposes. The purpose of that duty is to ensure correct placement in the Poisons Standard, which affects labelling, packing, and supply chain controls. A manufacturer that uses q.s. without recording a nominal concentration would be non-compliant with the instrument.

The instrument also creates a negative duty: do not deliberately vary the nominal concentration without an application for variation of registration. This means a registrant cannot, for example, reduce the target concentration of an active ingredient by 5% to cut costs (even if the reduction falls within the ±5% tolerance) without first seeking APVMA approval. The tolerance is for normal manufacturing and analytical variability only.

The Allowable Variation Standard itself does not set out penalties; it is a prescriptive standard that defines what “prescribed extent” of variation is permissible. The penalty for non-compliance is found in the parent Code. Under section 5AA of the Code, a registered chemical product must comply with its relevant particulars. If the measured concentration of a constituent exceeds the allowable variation defined by this instrument, the product is in breach of section 5AA. The consequences include civil or criminal penalties under Part 9 of the Code (offences), and the APVMA may also take administrative action such as suspending or cancelling the registration, issuing a recall notice, or requiring corrective labelling. The maximum penalties in the Code are substantial: for corporations, fines can reach hundreds of thousands of dollars per offence, and for individuals, imprisonment is possible for serious offences involving deliberate deception.

Enforcement is risk-based. The APVMA conducts audits, reviews batch testing data, and may request samples for independent analysis. If a pattern of non-compliance emerges - for instance, a manufacturer whose batches consistently exceed the tolerance - the APVMA could treat that as evidence of deliberate variation (which is prohibited) rather than mere manufacturing variability. The instrument’s prohibition on deliberate variation, even within tolerance, means that registrants cannot rely on the tables as a safe harbour if they intentionally shift the target. This creates an enforcement grey area: the regulator would need to prove intent, which may be difficult without internal documents. However, a pattern of batches always at the upper or lower edge of the tolerance could prompt an inquiry.

The use of a validated analytical method is integral to enforcement. If a manufacturer uses an unvalidated method, any measurement purporting to show compliance with the tolerance may be rejected, making the product presumptively non-compliant. The incorporation by reference of the APVMA’s validation guidance means that the standard for “validated” can change without notice, and manufacturers must keep pace.

This instrument operates within a hierarchy. The Code (scheduled to the Agricultural and Veterinary Chemicals Code Act 1994) is the primary legislation. Section 5AA(3) says the concentration must not differ from the Register by more than the extent prescribed by regulations made for section 83(1)(b). Regulation 41(2) of the Regulations states that the prescribed extent is the extent permitted by standards prescribed by regulation 42. Regulation 42(3) prescribes a standard made under section 6E(1) for constituents in chemical products, provided it is not already dealt with in an order under section 7 of the Act. This instrument is that section 6E standard.

The instrument interacts with the Poisons Standard (the Standard for the Uniform Scheduling of Medicines and Poisons) in two ways. First, the definition of “declared content” for active constituents or constituents in a Schedule of the Poisons Standard includes the concentration listed on the product label, meaning the label must match the Register. Second, the instrument requires that even where q.s. tolerances are used for non-active constituents, a nominal concentration must still be provided for scheduling purposes. This ensures that the scheduling decision (for example, whether a product is in Schedule 5 or Schedule 6) is based on a specific target concentration, not a range.

The instrument does not interact with the definition of “closely similar” in Schedule 6 of the Regulations. Clause 1.2(1) of Schedule 6 sets out criteria for when a product is “closely similar” to an existing product for the purpose of certain streamlined registration pathways. The instrument explicitly states it does not provide guidance on changes in concentration that meet that definition. This means that a variation in concentration that falls within this instrument’s tolerances may still constitute a change that makes the product not closely similar, depending on the criteria in Schedule 6. Registrants cannot rely on the tolerances here to argue that a minor shift in concentration is immaterial for the “closely similar” test.

The instrument also incorporates by reference the APVMA guidance on validation of analytical methods. That guidance is an external document that can be updated without amendment to this instrument. This creates a dynamic compliance burden: manufacturers must monitor the APVMA website for changes.

The instrument was made on 9 August 2022 by Sheila Logan, a Delegate of the APVMA, and commenced on the day after registration (likely in August 2022). No earlier version of this specific standard existed under this name; it replaced or formalised a prior approach that may have relied on individual registration conditions or the now-repealed Agricultural and Veterinary Chemicals Code (Allowable Variation in Concentrations of Constituents in Agricultural Chemical Products) Standard 2012 (though the source does not name a predecessor). Because the source text is the instrument itself, there is no amendment history provided. The instrument has not been amended since commencement. Any future amendments would be made by a new legislative instrument under section 6E of the Code, following the procedures in regulation 8AF of the Regulations (which includes consultation). Practitioners should check the Federal Register of Legislation for any subsequent amending instruments.

The instrument is recent (2022) and, as of the date of the source text, there is no reported litigation concerning its interpretation or application. The source does not mention any court or tribunal decisions. This is not surprising: the instrument is a technical standard that defines a numerical boundary; disputes are more likely to arise as administrative review matters in the Administrative Appeals Tribunal (or its successor, the Administrative Review Tribunal) concerning APVMA refusal to accept alternative tolerances or decisions that a product is non-compliant. No such cases are recorded in the instrument. The potential for litigation exists around the classification of a formulation as homogeneous or heterogeneous, the adequacy of a scientific justification for alternative tolerances, or the meaning of “deliberate variation”. The prohibition on deliberate variation even within tolerance could be challenged if a registrant argues that a systematic adjustment is justified by raw material variability, but no such case has yet been brought.

Several provisions in the instrument can catch unwary registrants.

First, the deliberate variation prohibition is a trap. A manufacturer who decides to permanently manufacture at the upper end of the tolerance range to ensure that every batch meets label claims may inadvertently be deliberately varying the nominal concentration if they have adjusted the target formulation. The instrument says this is not permitted without an application. The line between normal process drift and deliberate adjustment is often blurred. The safer course is to maintain the nominal target and document any shifts as normal variability, not as a new target.

Second, the q.s. flexibility comes with strings. Although a manufacturer can declare a tolerance as “q.s. 1 L” for a solvent, they still must provide a nominal concentration for scheduling. If they fail to do so, the product may be misclassified under the Poisons Standard, which carries its own compliance risks (including state-based controls). Moreover, the q.s. tolerance only applies to the specific categories listed: solvents, carriers, fillers, pH adjusters, buffers, antifoams, and viscosity modifiers. A manufacturer cannot use q.s. for a preservative or antioxidant not listed.

Third, the definition of homogeneous and heterogeneous is delegated to the APVMA “from time to time”. This means that a formulation type the APVMA currently treats as homogeneous might later be reclassified as heterogeneous if the APVMA changes its interpretation, thus widening the tolerance for that product. Conversely, a new formulation type that does not fit the examples may be subject to uncertainty until the APVMA issues a determination. The examples given (SL, EC for homogeneous; WG, GR for heterogeneous) are not exhaustive, and the APVMA could classify a formulation as heterogeneous even if the manufacturer considers it homogeneous.

Fourth, the incorporation by reference of the validation guidance means that the standard for a “validated analytical method” can change without the instrument being amended. A manufacturer that validated its method against an earlier edition of the guidance may find that its method no longer qualifies if the guidance is updated, potentially rendering all batch results non-compliant until revalidation.

Fifth, the instrument does not cover the “closely similar” test in Schedule 6 of the Regulations. Even if a concentration change falls within the allowable variation, it may still cause a product to lose its closely similar status, which can affect the ability to use streamlined registration pathways. This is a separate compliance consideration beyond the tolerance itself.

Sixth, the transition from the previous standard (if any) is not addressed in this instrument. Old registration particulars may have contained individually negotiated tolerances that differ from the standard tables. The instrument does not state whether those pre-existing tolerances are preserved or overridden. Given that the instrument is made under section 6E and prescribed by regulation 42(3), it likely applies to all products unless a specific alternative tolerance has been approved. Companies with old registrations should check whether their registration particulars include tolerances that are narrower or broader than the standard, and whether those particulars are still valid or need to be aligned.

Compliance with the Allowable Variation Standard requires a systematic quality assurance programme integrated into manufacturing and batch release.

Step 1: Determine the classification of each constituent. For each registered product, identify every active constituent and every non-active constituent, and note whether the formulation is classified as homogeneous or heterogeneous by the APVMA. If the APVMA has not issued a classification for a novel formulation type, the manufacturer should seek guidance or assume the worst-case tolerance (heterogeneous) until confirmed.

Step 2: Establish the declared content for each constituent. Ensure that the target concentration recorded in the Register matches the label statement and the nominal concentration used for scheduling. For active constituents and any constituent in the Poisons Standard, the declared content must include the label concentration.

Step 3: Validate the analytical method. The method used to measure each constituent must be validated in accordance with the APVMA’s current guidance document on validation of analytical methods. The guidance is incorporated by reference as in force from time to time, so the manufacturer must maintain an up-to-date copy and adjust validation parameters whenever the guidance is amended. The validation must be documented and available for APVMA audit.

Step 4: Test each batch and compare measured concentrations against the tolerance tables. For active constituents, apply the table in clause 1(a) based on the declared content in g/kg or g/L. For the lowest tier (up to 25 g/kg or g/L), apply ±15% for homogeneous formulations and ±25% for heterogeneous formulations. For non-active constituents, apply the table in clause 2(a). If an ingredient qualifies for q.s. tolerances under clause 2(c) or 2(d), compute the tolerance as the range needed to achieve the target parameter, but still record a nominal concentration for scheduling.

Step 5: If a batch is outside the standard tolerance but within the product’s approved alternative tolerance, rely on the alternative. Ensure that the alternative tolerance was approved in writing by the APVMA with a scientific justification addressing safety, efficacy, and trade. Keep the approval on file.

Step 6: Never deliberately shift the nominal concentration without submitting an application for variation of registration to the APVMA. Even if the shift would result in a new target that is within the tolerance range, it is not permitted by this instrument. Document any process changes that affect the target and assess whether they constitute a deliberate variation.

Step 7: Maintain records. The APVMA may request batch testing data, validation reports, and any scientific justification for alternative tolerances. Records should be retained for at least the period specified in the Code (typically five years after manufacture). For q.s. ingredients, record the actual amount used in each batch and confirm that the target parameter (e.g., pH, viscosity) was met.

Step 8: Review for changes. Monitor the APVMA website for updates to the validation guidance, for any new determinations on formulation classification, and for any amendments to the instrument itself. Also review the Poisons Standard periodically to ensure the nominal concentration provided for scheduling remains correct.

By following these steps, a manufacturer or registrant can demonstrate compliance and avoid the penalties and business disruption that come from non-compliant product. The compliance burden is not trivial, particularly for small manufacturers who must invest in validated methods and record-keeping, but the instrument provides clear numeric targets that reduce discretion and uncertainty compared with a purely case-by-case approach.
