64Appointment of arbitrator

#### 64 Appointment of arbitrator (1) If the mediation has ceased without the parties having reached agreement as to the terms of the compensation, the APVMA must appoint a person as an arbitrator to determine those terms in accordance with any reasonable proposals that were made in the course of the negotiations (including negotiations during the period of the mediation). (2) If, before the functions of an arbitrator appointed under this section (including this subsection) are fully performed, the person appointed as the arbitrator: (a) dies; or (b) becomes incapable of performing, or continuing to perform, his or her functions; or (c) resigns his or her appointment; or (d) for any other reason refuses or fails to perform, or to complete the performance of, his or her functions as required by this section; the APVMA may appoint another person as arbitrator in place of the first‑mentioned person.
