#### 12 APVMA to publish notice before deciding whether to approve new active constituent (1) This section applies if the application: (a) has passed preliminary assessment; and (b) is for approval of an active constituent not previously contained in a chemical product registered in this or another jurisdiction under the Agvet Code, or a corresponding previous law, of the jurisdiction concerned. (2) The APVMA must publish a notice in the Gazette and in any other manner that it thinks appropriate. (3) The notice must state that the APVMA has to decide whether to approve the constituent and must: (a) set out the following: (i) the name of the constituent; (ii) particulars of the constituent; (iii) a summary of the APVMA’s assessment of whether the constituent meets the safety criteria; (iv) any other matters that the APVMA thinks appropriate; and (b) invite any person to make, within a specified period of at least 28 days, a written submission as to whether the constituent should be approved and stating the grounds on which the submission is based, which must be grounds that relate to the safety criteria.
