29 Retention of things that are seized
(1) If an inspector seizes a thing under section 19 or 20, the inspector must take reasonable steps to return it if the reason for its seizure no longer exists. (2) If the thing has not been returned before the end of 60 days after its seizure, the inspector must take reasonable steps to return it unless: (a) proceedings in which the thing may be used in evidence were begun before the end of the 60 days and the proceedings (including an appeal to a court in relation to the proceedings) have not been completed; or (b) the inspector may keep the thing because of an order under section 30; or (c) the inspector is authorised by this Act or by an order of a court to keep, destroy or dispose of the thing. (3) If the thing is required to be returned, it must be returned to the person from whom it was seized or, if that person is not entitled to possess it, to the owner. (4) If there is a dispute as to the ownership of the thing, the inspector may keep the thing until the dispute is resolved. (5) This section has effect subject to section 30.
