61 Continuation of existing registrations until renewal
applications decided
(1) If a registered assistant property agent applies to renew the
registration under section 60, the registration remains in force until
the application is decided.
(2) Subsection (1) applies even if it causes the existing registration to be
in force for longer than 3 years.
(3) If a person who has been a registered assistant property agent applies,
within 3 months after the day the term of the registration ends (the
last registration day), to renew the registration—
(a) any service provided by the person after the last registration day
and before the day of the commissioner for fair trading’s
decision about the renewal application (whether or not the
registration is renewed) is taken to have been provided by the
person as a registered assistant property agent; and
(b) if the registration is renewed, the term of the renewed
registration is backdated to the day after the last registration day.
(4) Subsection (3) (a) does not prevent the person committing, being
prosecuted for, or being found guilty of, an offence against
division 4.1 (Assistant property agents to be registered).
