128 How records must be kept (1) A licensed agent commits an offence if the agent— (a) keeps a record that the agent is required to keep under section 127; and Record keeping Division 8.1 (b) fails to keep the record in at least 1 of the following ways: (i) at the agent’s main place of business; (ii) in an electronic form that is immediately accessible by the agent at their main place of business; (iii) if the commissioner for fair trading has agreed in writing that the record may be kept in another way—in that way.
