Age of Majority Act 1977

The central concept is “full age and full capacity”. Full age means the legal status of being no longer a minor. Full capacity under section 3(1) means the juristic competence to do any act or enter any transaction that a person of twenty-one could previously do. This includes the capacity to contract, to sue and be sued, to make a will, to hold property absolutely, to give a valid receipt, and to consent to medical treatment. The Act does not define these capacities exhaustively. Instead it sweeps away the common law disabilities of minority for all persons eighteen and over.

“Minor” is defined by section 3(1)(c) as a person not of full age. Before the Act, a minor was a person under twenty-one. After commencement, a minor is a person under eighteen. This definition applies for all purposes of the laws of the State unless a specific enactment provides otherwise. However, section 3(2) preserves references to an age expressed in years in any Act, proclamation, regulation, by-law, local law, rule or instrument. This means that if another Act sets a particular age for a specific purpose, such as the minimum drinking age or the age for marriage without parental consent, that age is not altered by the general reduction of majority. The Act changes the default background rule, not the specific age thresholds that other laws expressly establish.

The Act also introduces the concept of “attaining a particular age” through section 2. This codifies the rule that a person attains an age at the start of the relevant anniversary of birth. For example, a person born on 15 June 2000 attains the age of eighteen at 12.00 am on 15 June 2018. This is a mechanical rule that applies only to ages expressed in years. It overrides any common law or custom that might have treated the attainment as occurring at a different time, such as the beginning of the day before the anniversary.

Section 3(3) preserves deficiencies of juristic competence or capacity that are attributable to insanity, mental infirmity or any other factor as distinct from age. This makes clear that the grant of full capacity at eighteen is not a guarantee of capacity. A person of eighteen may still lack capacity due to mental illness, cognitive impairment, intoxication, undue influence or duress. The Act removes age alone as a disqualifying factor, but does not otherwise reform the law of capacity.

The term “sui juris” appears in section 3(4). This is a common law term meaning having full legal capacity to manage one’s own affairs. The Act confirms that a person eighteen or over is sui juris for all purposes, subject to the specific exceptions in subsections (4) to (7). Those exceptions deal with rights under wills and trusts, distribution of intestate estates, and pre-existing property interests. They are transitional protections for arrangements entered into before the Act took effect.

The primary group affected are individuals aged between eighteen and twenty on 1 February 1978. Those persons automatically gained full capacity on that day under section 3(1)(b). They were no longer minors, could contract, own property, make wills, and sue in their own name without a litigation guardian. This was a one-time immediate change affecting approximately three birth years of Victorians.

The second group are persons who turned eighteen after 1 February 1978. They attain full capacity upon reaching eighteen, not twenty-one. This affects every Victorian turning eighteen since the Act commenced. For those individuals, the period of legal minority is shortened by three years. The Act reduces the time during which they are subject to legal disabilities and protections, such as the ability to avoid contracts for non-necessaries, the requirement for parental consent for medical treatment, or the inability to hold legal title to land. That has both benefits and costs. An eighteen-year-old gains the freedom to enter contracts, borrow money and engage in business, but also loses the protection of the infancy doctrine which allowed minors to repudiate unfair contracts in some circumstances.

Trustees and administrators of estates are directly affected by sections 3(4) to 3(7). Trustees of trusts created by wills or instruments executed before the Act must continue to treat beneficiaries as not entitled to require distribution of trust property until age twenty-one, even if those beneficiaries are now eighteen and otherwise sui juris. This exception applies only to wills and instruments executed before the Act; a codicil executed after the Act confirming an earlier will does not make the will post-commencement if the will itself was pre-1978. Similarly, administrators of estates of persons who died intestate before the Act are not obliged to distribute any portion of the estate to a beneficiary before that beneficiary reaches twenty-one. This preserves the old age threshold for those affected estates.

The Act also affects drafters of documents and legal practitioners. Section 4 requires that any reference to “minor”, “infant” or similar terms in existing or future regulations, by-laws and statutory instruments be construed in accordance with the new definition unless the context requires otherwise. That imposes a compliance burden on those who rely on such instruments: they must verify whether the specific instrument has its own definition or a contrary intention, or whether the default eighteen-year threshold applies.

Industrial relations parties are largely unaffected. Section 4(3) expressly excludes industrial awards, apprenticeship instruments and employment condition provisions from the modification rule. An award that sets a minimum age for adult wages at twenty-one, for example, is not automatically read down to eighteen. Such provisions must be amended individually if the parties or the tribunal wish to reflect the new age of majority. This creates a patchwork: the general law of capacity changes, but specific industrial instruments may retain twenty-one as the relevant age.

The Act confers one primary right: the right to be treated as having full legal capacity upon reaching eighteen, or if already eighteen on commencement, immediately. This right is both a duty on the state and on private parties. Courts must accept that an eighteen-year-old can sue or be sued without a next friend or guardian ad litem. Banks must accept that an eighteen-year-old can open an account, borrow and give valid security. Landlords must treat an eighteen-year-old as capable of entering a lease. Medical practitioners must obtain consent from the eighteen-year-old patient directly, not from a parent or guardian, unless the patient lacks capacity for other reasons.

The Act also confers a right of the government and instrumentalities to rely on the new definition when interpreting statutory references to “majority” or “minor” unless a contrary intention appears. This right is constrained by section 3(2), which says the Act does not affect any reference to an age expressed in years in any Act, proclamation, regulation, by-law, rule or instrument. So if a specific Act says “a person must be twenty-one years of age to serve as a jury member”, that reference to twenty-one years is untouched. The right to read down “minor” to under eighteen does not extend to overriding an explicit age number.

The Act imposes no positive duties to do anything. Rather, it removes barriers and clarifies which age threshold governs. The main duty it creates is a negative one: not to treat a person eighteen or over as lacking capacity solely because of age. A person who denies an eighteen-year-old the right to contract or to manage their own affairs on the ground that they are under twenty-one would be acting contrary to law. That does not mean every eighteen-year-old has capacity: section 3(3) preserves capacity defences based on mental infirmity or other factors.

For beneficiaries under pre-1978 wills and trusts, the Act creates a limitation on rights. Section 3(4) provides that a beneficiary who is sui juris and entitled to require disposition of trust property before the trust’s fixed time can only exercise that right if the will or trust was executed on or after the Act. For pre-1978 instruments, the beneficiary must wait until twenty-one regardless of being sui juris. This is a restriction, not a grant of rights. It protects the expectations of settlors and testators who drafted documents assuming the old age of majority.

For administrators of pre-commencement intestacies, section 3(6) gives a right not to distribute to an entitled person before that person reaches twenty-one. This is a protection, not a duty. The administrator may choose to distribute earlier, but is not obliged to do so. The provision avoids putting administrators in breach if they hold property for a beneficiary until twenty-one.

Section 4 imposes a duty on those interpreting subordinate instruments to read them as modified to give effect to the Act. This duty is subject to exceptions in section 4(3). It means a regulation that says “a minor may not enter a licensed premises” is to be read as referring to a person under eighteen, not under twenty-one, unless the regulation contains its own definition. However, the duty is to construe “as if they were so far modified as is necessary”. This is a rule of construction, not a power to rewrite. Where the modification cannot be achieved by construction, amendment of the instrument may be required.

The Act contains no penalty provisions of its own. It does not create any offence for failing to recognise the age of majority of eighteen. There is no criminal liability for treating an eighteen-year-old as a minor, although that treatment may give rise to civil liability for breach of contract, discrimination, or other wrongs under other laws. Enforcement is indirect, through the general law.

If a person contracts with an eighteen-year-old believing them to be a minor and later seeks to avoid the contract on the ground of infancy, the court would enforce the contract because the eighteen-year-old has full capacity. The would-be victim of the infancy defence cannot rely on it. If a trustee refuses to pay trust income to an eighteen-year-old beneficiary on the ground that the beneficiary is not yet twenty-one and the trust is post-1978, the beneficiary can seek a court order for payment or removal of the trustee. The remedy is equitable or common law, not penal.

If a government body denies a licence or benefit to an eighteen-year-old based on an age threshold that should be read down under section 4, the individual could challenge that decision through judicial review or an application under the relevant Act. The court would apply the construction rule in section 4(1) and, if the instrument is inconsistent, may quash the decision. Again, no penalty flows from the Act itself.

The lack of penalties is consistent with the Act being a declaratory and transitional measure. Its enforcement relies on private parties asserting their rights or on public bodies voluntarily complying. For breaches that cause loss, the wronged party must rely on other causes of action: breach of contract, trespass to property, conversion, or tort. The Act does not create a statutory cause of action for being treated as a minor.

Compliance risk is therefore primarily legal risk for institutions that fail to update their practices. A bank that refuses to open an account for an eighteen-year-old in 2024, citing a policy from 1975 requiring customers to be twenty-one, is exposed to claims for breach of contract or discrimination under the Equal Opportunity Act 2010. The bank cannot rely on the old age of majority as a defence. Similarly, a medical practitioner who operates on an eighteen-year-old based solely on parental consent, without the patient’s own consent, may face an action for battery or negligence. The Act does not impose a penalty itself, but the underlying legal framework penalises those who do not respect the capacity it confers.

The Act also has no enforcement agency. No regulator monitors compliance. The onus is on individuals and their advisors to know the law and act accordingly. This creates a diffuse compliance burden, particularly for organisations that serve young people and must now treat eighteen to twenty year olds as adults for capacity purposes. The burden falls on those who fail to update outdated forms, terms and conditions, or internal policies.

The Act is expressed to apply “for all the purposes of the laws of the State”. It overrides earlier inconsistent statutes to the extent they are based on an age of majority of twenty-one. However, the interaction is carefully qualified. Section 3(2) says the Act does not affect any reference to an age expressed in years in any Act, proclamation, regulation, by-law, local law, rule or instrument. This preserves specific age thresholds set by other Victorian enactments. For example, the Major Crime (Investigative Powers) Act 2004 might set an age of twenty-one for a particular power; that age remains unless separately amended. The Act only changes the default status of being a minor.

Section 4(2) provides that expressions like “majority”, “full age”, “sui juris”, “minor”, “minority”, “infant” and “infancy” in any Act, instrument or rule are to be construed in accordance with the Act unless there is a definition or contrary intention. This is a powerful interpretive direction. It means that a pre-1978 Act that says “any infant” will be read as meaning any person under eighteen. The burden is on the party arguing for the old meaning to point to a contrary intention or an express definition in the specific Act.

However, section 4(3) carves out three categories from this interpretive rule: industrial awards, orders, determinations and agreements; instruments made under an Act prescribing wages or apprenticeship conditions; and provisions of any Act governing employment conditions or employment rights or obligations. These instruments retain their own age definitions. An award that refers to “adult worker” and defines adult as twenty-one is not affected. The result is that the same person might be of full age for contract and property purposes at eighteen, but still treated as a junior for award wages and apprenticeship grades until twenty-one.

The Act interacts with property and trust law through sections 3(4) to 3(7). For pre-1978 wills and trusts, the age of majority remains twenty-one for the purpose of the beneficiary’s right to require distribution. For post-1978 instruments, the beneficiary can require distribution at eighteen if otherwise entitled. This creates a distinction that trustees and legal practitioners must check for every trust they administer. The same distinction applies for pre-1978 intestacies under section 3(6).

The Act interacts with the law of evidence and procedure. A minor (under eighteen) cannot commence or defend legal proceedings without a litigation guardian. The Act reduced that threshold from twenty-one to eighteen. Court rules and practice notes that refer to “infant” will be read as referring to persons under eighteen, unless the specific rule has its own definition. This is a practical interaction that affects all litigation involving young people.

The Act also interacts with the common law doctrine of infancy. The doctrine allowed minors to avoid certain contracts. By redefining full age as eighteen, the Act reduces by three years the period during which that protective doctrine applies. Persons aged eighteen to twenty lose the ability to repudiate contracts on the ground of age alone. Whether this is a net benefit or cost depends on one’s view of individual autonomy versus protection. The Act chooses autonomy.

Finally, the Act interacts with other Australian jurisdictions. Victoria was not the first or last state to lower the age of majority. The Act is Victoria-specific, but other states and territories have similar legislation. For cross-border transactions, the age of majority is generally determined by the law of the state with the closest connection to the transaction or the domicile of the individual. The Act’s uniform definition of “attaining a particular age” in section 2 may conflict with the common law rule still applied in some other states, but that is a question of private international law, not addressed in the Act.

The Act has been amended three times since its enactment. The first amendment was by the Statute Law Revision (Repeals) Act 1982 (No. 9863/1982), which repealed section 5 and the Schedules. Section 5 and the Schedules were consequential provisions that had been spent by 1982. The repeal cleaned up the statute book but did not affect the substantive operation of the remaining sections. The repeal took effect on 5 January 1983.

The second amendment was by the Local Government (Consequential Provisions) Act 1989 (No. 12/1989). This Act amended section 3(2) and section 4(1) and 4(2) to replace references to “proclamation, regulation, by-law, local law, rule or instrument” with updated wording. The amendments were consequential to changes in local government legislation. They came into operation on 1 November 1989. The changes were stylistic and did not alter the meaning of the provisions.

The third amendment was by the Statute Law Revision Act 2015 (No. 21/2015). Section 3(Schedule 1 item 3) repealed the heading to the Schedule. The Schedule itself had already been repealed in 1982, so this was a further tidying-up measure. It came into operation on 1 August 2015.

No amendments have changed the core provisions on age of majority, capacity, or the transitional rules for pre-1978 wills, trusts and intestacies. The Act has remained substantively unchanged for over forty years. This stability suggests that the policy decision to lower the age of majority has been uncontroversial in Victoria. The limited amendments solely address housekeeping matters.

The version history shows that the Act has been consolidated with amendments as at 1 August 2015, which is the current version available. No amendments not in operation are listed. The Act is effectively static.

The Act itself does not name or discuss any cases. Its sparse text and clear purpose have likely generated little litigation directly on its interpretation. The key provisions are straightforward: the age of majority is eighteen, full capacity follows, and there are specific transitional exceptions. Most disputes would instead involve other laws that incorporate the concept of majority or minority, such as contracts, property, trusts, family law and administrative law.

One potential area of litigation is the meaning of “attaining a particular age” in section 2. The common law had different rules in different states about whether a person attained an age at the start of the anniversary day or at the start of the day before. Section 2 codifies the anniversary rule for Victoria. On rare occasions, a dispute may arise about the precise time of attainment for a legal deadline, such as when a person reached eighteen for the purpose of making a will or owning land. The section would resolve such disputes.

Another potential area is section 3(2) and its preservation of references to an age expressed in years. A litigant might argue that a reference to “twenty-one years” in an old Act should be read down to eighteen on the basis that it is not an age expressed in years but a proxy for majority. The section preserves the literal age reference, so such an argument would likely fail. No case law is available in the Act’s endnotes to illustrate this.

Section 3(4) on pre-1978 wills and trusts could generate disputes about whether a will was “executed on or after the commencement of this Act” for the purposes of the beneficiary’s right to require distribution. Section 3(5) clarifies that a confirmatory codicil does not change the date of execution of the original will. That provision likely arose from anticipating arguments to the contrary. A testator might have made a will in 1975, then executed a codicil in 1980 confirming the will. The beneficiary might argue that the codicil “restates” the will, making it a post-commencement instrument. Section 3(5) blocks that argument, preserving the 1975 date.

Trustees and beneficiaries may also have litigated about whether a trust is “executed” on or after commencement when it is an irrevocable settlement made inter vivos or by deed. The Act’s text covers “will or instrument of trust” but does not define when an instrument of trust is executed. A deed executed before the Act but containing provisions that only crystallised after commencement might raise interpretive questions. The Act’s silence leaves those to general law.

Because the Act has been in force for over forty years and is unambiguous, reported litigation is likely minimal. The High Court of Australia and Victorian Court of Appeal have not had to interpret it at length in published judgments. The practical effect of the Act has been absorbed into everyday legal practice without contest.

The most significant trap is section 3(2): the Act does not affect any reference to an age expressed in years in any Act, proclamation, regulation, by-law, local law, rule or instrument. This means that a specific age set in another Act, such as an age for jury service, buying alcohol, driving, or holding public office, is not changed by this Act. A practitioner might assume that because the age of majority is eighteen, all age thresholds drop to eighteen. That is false. Each age threshold must be checked individually in the relevant enactment. The Act only changes the default status of being a minor.

The second trap is section 3(4) for those dealing with pre-1978 wills and trusts. A beneficiary who has turned eighteen and is sui juris may believe they can call for distribution of trust property before the trust’s fixed distribution date. If the will or trust was executed before 1 February 1978, they cannot. The beneficiary must wait until twenty-one, unless the trust instrument itself provides otherwise. This can catch young beneficiaries and their financial advisors who are unaware of this transitional provision.

Section 3(5) reinforces the trap: a codicil executed after commencement that confirms a pre-1978 will does not change the will’s date. Even if the codicil largely rewrites the will, the original will is still treated as pre-commencement. Careful scrutiny of the original execution date is essential.

Section 3(6) allows administrators of pre-commencement intestacies to withhold distribution until the beneficiary reaches twenty-one. But this is a permission, not a requirement. An administrator who distributes to an eighteen-year-old beneficiary might still be safe, but the provision exists to protect administrators who delay. The risk is that a beneficiary might argue the administrator should have distributed earlier. The administrator can rely on the section as a defence.

Section 4(3) is a trap for anyone dealing with industrial instruments. The construction modification rule in section 4(1) and (2) does not apply to industrial awards, apprenticeship instruments, or employment condition provisions. A person who is eighteen and fully capacitated for general law purposes may still be treated as a junior or minor for award wage rates, minimum wage classifications or apprenticeship conditions. This can cause confusion for employers and young workers. The age of majority for capacity and the age for adult wages may differ.

Section 3(3) is a trap for those who assume that because the Act grants full capacity at eighteen, all eighteen-year-olds have full capacity. The Act preserves capacity defences based on insanity, mental infirmity or any other factor. A contract with an eighteen-year-old who lacks mental capacity is still voidable. The Act removes age, not all capacity issues.

There is also a potential trap in the definition of “attaining a particular age” in section 2. The rule is the anniversary at commencement of the day. For something that requires the person to turn eighteen the day before an event, such as being allowed to vote or buy property, the timing matters. The section ensures that the age is reached at the first moment of the birthday anniversary, not at the end of the day before or any other time. Practitioners handling deadlines that depend on age should verify the precise rule in Victoria.

Finally, the Act does not itself override Commonwealth laws or the laws of other states. It applies for the purposes of Victorian law. A Victorian eighteen-year-old is a minor for Commonwealth purposes if a Commonwealth Act defines a minor as under twenty-one. The interaction with federal law requires separate analysis.

Compliance with the Age of Majority Act 1977 does not involve filing documents, obtaining approvals, or reporting to any authority. It is a matter of changing internal policies, contract forms, terms and conditions, and training to reflect that for all purposes of Victorian law, a person aged eighteen or over has full legal capacity. The Act imposes no ongoing obligations beyond ensuring that no one is treated as lacking capacity solely because of age.

For organisations that deal with young people, the first step is to audit all documents and procedures that refer to “minor”, “infant” or “age of consent” as proxies for legal capacity. Any such reference should be read as referring to a person under eighteen, unless the specific context provides its own definition or indicates a contrary intention. If a document was created before February 1978 and uses “infant” to mean under twenty-one, it must be updated or interpreted in light of the Act.

For trustees and administrators, the key compliance step is to check the date of execution of any will or trust instrument that affects beneficiaries. If the instrument was executed before 1 February 1978, the beneficiary cannot require distribution of trust property before reaching twenty-one, regardless of being sui juris. Administrators of pre-1978 intestacies are not obliged to distribute before twenty-one. Maintain clear records of execution dates and, where there is doubt, obtain legal advice on whether the beneficiary has a current right to call for distribution.

For government bodies and agencies that make subordinate legislation, regulations, by-laws or rules that refer to age, ensure that any reference to “majority” or “minor” is either defined explicitly or intended to follow the Act. Section 4(2) will apply a contrary intention if the instrument provides its own definition. Avoid making a regulation that says “no minor may enter” without defining minor, because the Act will read it as under eighteen, which may not be the intended effect.

For legal practitioners advising clients on capacity issues, confirm that the client is over eighteen. If so, the Act says they have full age and full capacity unless other factors (insanity, mental infirmity, intoxication, undue influence) apply. Do not assume that an eighteen-year-old cannot give a valid power of attorney, make a will, or contract without a parent’s involvement. The Act removes the parental role for those over eighteen.

For employers and training organisations, note the exception for industrial instruments under section 4(3). A person who is eighteen may still be an “apprentice” under an award that sets twenty-one as the adult age. The Act does not automatically change that. Check the relevant award or industrial instrument for its own age definitions. Do not treat an eighteen-year-old as an adult for wage purposes if the award still uses twenty-one as the adult threshold.

For anyone facing a dispute about capacity, the Act provides a clear rule: if the person is eighteen or over and the dispute arises under Victorian law, the person is of full age and capacity unless the specific legal context preserves a different age (section 3(2)) or the person lacks capacity due to a non-age factor (section 3(3)). Use the Act to resolve the preliminary question of capacity before addressing substantive issues.

Finally, for those drafting new documents that rely on the age of majority, state the age explicitly. A will that says “my child shall become entitled to the property at the age of majority” will be interpreted as eighteen under the Act. If the testator intends twenty-one, they must say “twenty-one years of age” and ensure that reference is not overridden by the Act’s definition. The Act preserves references to an age expressed in years, so explicitly stating “twenty-one years” will be effective.
