Age Discrimination Regulations 2020

The Regulations rest on a small set of statutory concepts: prescription, reference by item to Schedule tables in the Act, and the delegation/authority to make subordinate instruments under the Act. Those concepts appear explicitly in the text.

• Prescription as a device: Section 5 uses the verb “are prescribed” to add specific instruments or provisions to the list of instruments relevant to items in the Act’s Schedules. That is a common drafting technique where an Act contains items identifying classes or examples to which an exemption or special rule applies; the Regulations make explicit which modern instruments or sections are to be treated as falling within those items. The Regulations do not define the scope of the Schedule items themselves; they only identify the external source to be read into the item.

• Cross‑reference to Schedule items in the Act: The Regulations operate by reference to particular items in the Act’s Schedules , item 8 of the table in Schedule 1, and item 3AA of the table in Schedule 2. The Regulations therefore depend on the Age Discrimination Act 2004’s own mechanics for how exemptions in those Schedule tables operate. The Regulations do not reproduce the Schedule text; they must be read together with the Act.

• Limited definitional scope: Section 4 contains a single definition , it defines “Act” to mean the Age Discrimination Act 2004. There are no other definitions, so the Regulations depend on the Act for operative definitions of terms used in the Schedule items. No new substantive legal standards, duties, or offences are created by the Regulations themselves; they change which external instruments are taken to be in scope of particular statutory exceptions.

• Delegation and authority: The Regulations explicitly state the authority under which they were made: “This instrument is made under the Age Discrimination Act 2004” (s 3). That identifies the parent Act as the source of power to make these Regulations; the Regulations do not claim any independent legislative policy power.

• Compilations and amendments: The front material and endnotes emphasise that this document is a compilation showing the text as amended to 1 April 2026, that it includes amendment F2026L00131, and that some amendments may be uncommenced or otherwise noted in the endnotes. The compilation notes also state that modifications by other laws may not be reflected in the text, and that First Parliamentary Counsel may make editorial or presentational changes under the Legislation Act 2003. Those meta‑legal points affect how to treat the published text and whether there may be other operative material not shown in the compilation.

These main concepts frame what the Regulations do: they are instruments of cross‑reference, not instruments that create or remove substantive civil liabilities under the Act. To understand the practical consequences one must read the relevant Schedule items of the Act and the instruments or sections prescribed by s 5.

The Regulations affect, directly and indirectly, a limited and identifiable set of regulated entities and decision makers. Because the text prescribes external instruments and provisions for the purposes of Schedule items in the Act, the immediate effect is on persons and organisations governed by those external instruments or sections, and on anyone who relies on the Act’s schedule exemptions.

• Airport operators, on‑airport service providers, and persons subject to on‑airport rules: Section 5(1) prescribes the Airports (Control of On‑Airport Activities) Regulations 2026 for the purposes of item 8 of the table in Schedule 1 to the Act. Entities that are subject to those airports regulations , operators, tenants, concessionaires, and licensed service providers that operate on airport land and are regulated under the prescribed Airports Regulations , will be affected because the prescribed reference determines how item 8 of Schedule 1 operates in relation to them. The Regulations do not themselves define the coverage or thresholds in the airports regulations; they only make the airports regulations the instrument to be read into item 8.

• Defence personnel, agencies and contractors affected by the Defence Regulation 2016: Section 5(2) prescribes sections 23 and 88 of the Defence Regulation 2016 for the purposes of item 3AA of the table in Schedule 2 to the Act. Persons and entities whose conduct is governed by those specific Defence Regulation provisions , which are cross‑referenced into the Act by this prescription , will therefore find the Act’s Schedule item 3AA applied with those Defence Regulation provisions in mind. That will include members of the Defence Force and, depending on how those Defence Regulation sections operate, possibly civilian personnel or contractors engaged under Defence Regulation regimes. The Regulations do not themselves expand or narrow who falls under the Defence provisions; they state that those specific sections are the ones to be taken as prescribed for the Act’s Schedule item.

• Parties using the Age Discrimination Act in disputes or compliance work: Lawyers, compliance officers, human resources departments, tribunals and courts that must determine whether an exemption in Schedule 1 or Schedule 2 applies will be affected because the prescribed instruments are the ones to be used when considering those particular items. The Regulations therefore shape which external instruments a tribunal or court will consult to decide whether an exemption applies.

• Regulators and government decision makers: Agencies responsible for administering the Age Discrimination Act will need to recognise the prescription when giving guidance, making decisions on complaints, or framing compliance materials. Similarly, agencies responsible for the prescribed instruments (for example, the agency that administers airport regulations, and the Department of Defence) may need to coordinate in practice because the Act’s exemptions will now operate with those instruments explicitly in scope.

Who pays and who decides, in practical terms: the Regulations do not levy fees or impose direct monetary charges. The “cost” in regulatory terms falls on those who must adapt to the cross‑reference: practitioners, regulated entities at airports and Defence, and administrative decision makers who must account for the prescribed cross‑references when assessing claims under the Age Discrimination Act. The decision to apply the exemption remains with the decision maker under the Act and any adjudicative or enforcement body; the Regulations only change which external instrument the decision maker must treat as relevant when considering the specified Schedule items.

The Regulations themselves create no new duties, obligations, or rights expressed in standalone terms. Instead, they operate by identifying which external instruments are to be treated as prescribed by particular items in the Act’s schedules. The key legal duties and rights therefore continue to stem from the Age Discrimination Act 2004 and from the external instruments that are prescribed. The Regulations change the reference points that determine how particular Schedule items operate.

• No standalone duties in the Regulations: There is no operative rule in the Regulations that imposes a compliance obligation such as a record‑keeping duty, a substantive anti‑discrimination duty, or a procedural requirement. Section 4 contains only a definitional provision for “Act.” The only operative provisions are the prescriptions in s 5(1) and s 5(2).

• Impact on rights and exemptions under the Act: By prescribing the Airports (Control of On‑Airport Activities) Regulations 2026 for item 8 of Schedule 1, s 5(1) makes that external airports regulation the instrument to be used when determining whether the exemption in item 8 applies. By prescribing Defence Regulation 2016 s 23 and s 88 for item 3AA of Schedule 2, s 5(2) does the same for that Schedule item. The practical result is that the applicability of those particular Schedule exemptions depends on the content and reach of the prescribed instruments. Rights that a complainant or respondent may assert under the Act, such as the right to non‑discrimination on the basis of age in particular contexts, will be assessed against the Act’s Schedule items read together with these prescribed instruments. The Regulations therefore affect the framework within which rights are adjudicated, not the intrinsic content of the rights.

• Administrative discretion remains with the Act’s processes: The Act provides the overall machinery for complaints, exceptions and enforcement. The Regulations do not alter who decides whether an exemption is made out under the Act; they only alter what material a decision maker should treat as the prescribed instrument for a Schedule item. Administrative bodies and courts that apply the Act must consider the prescribed instruments when construing the Schedule items referenced by s 5(1) and s 5(2).

• Practical duty on practitioners to consult cross‑references: For practitioners advising clients, the practical duty is to read the relevant Schedule items in the Act in conjunction with the instruments prescribed by the Regulations. The Regulations create an obligation, in practice, to consult those external instruments when providing legal advice or when compiling internal compliance policies. That is an implied compliance burden: legal advisers and compliance officers must incorporate the Effect of s 5 prescriptions into their legal analyses and documentation.

In short, the Regulations are a cross‑reference device that affects which external instruments are part of the legal picture for particular Schedule exemptions; the substantive duties and rights remain those in the Act and in the prescribed instruments.

The Regulations do not create new penalties or enforcement mechanisms. There is no provision in the text that establishes offences, monetary penalties, civil pecuniary penalties, or other sanctions. Enforcement processes and penalties continue to derive from the Age Discrimination Act 2004 and from any penalties embedded in the prescribed external instruments themselves. The Regulations’ effect on enforcement is therefore indirect and procedural.

• No enforcement provisions in the Regulations: The Regulations’ operative sections (s 5(1) and s 5(2)) simply prescribe external instruments for the purposes of Schedule items in the Act. There is no statement in these Regulations that creates a stand‑alone enforcement power, penalty, or compliance instrument.

• Enforcement remains under the Act: Any inquiry as to whether a Schedule item applies , which may determine whether a complainant can pursue certain remedies under the Act , will be decided under the Act’s existing enforcement framework. The Regulations change which external instruments are read into particular items, which in turn may affect the outcome of enforcement processes under the Act. But the Regulations do not change the Act’s enforcement coercive powers or civil remedies.

• Possible penalties in the prescribed instruments: The prescribed instruments themselves (the Airports (Control of On‑Airport Activities) Regulations 2026 and Defence Regulation 2016 ss 23 and 88) may contain their own enforcement regimes and sanctions applicable to regulated conduct. Where those instruments apply to the Schedule item through the Regulations’ prescription, any penalty or sanction in those instruments will remain a matter for those instruments and their administering agencies. The Regulations do not themselves impose or modify such penalties.

• Administrative burden for decision‑makers: While there are no penalties in the Regulations, there is an administrative enforcement implication: decision‑makers and adjudicators must account for the prescribed instruments when determining whether the Act’s exemptions apply. That requires reading the Act’s Schedule items alongside the prescribed instruments, which could increase evidentiary and interpretative work in enforcement proceedings.

• No new prosecutorial paths: Because the Regulations do not create offences, they do not create new prosecutorial or complaint‑lodging pathways beyond those available under the Act and the prescribed instruments. Any change in enforcement outcomes will be the result of a different statutory construction of Schedule items, not of newly created enforcement powers in the Regulations.

In short, penalties and enforcement remain rooted in the Age Discrimination Act and in the instruments the Regulations prescribe. The Regulations’ contribution is to specify which external instruments are relevant for interpreting exemptions; they do not introduce sanctions.

The Regulations are explicitly cross‑referential and therefore designed to interact with both the Age Discrimination Act 2004 and the external instruments they prescribe. The compilation notes and endnotes further explain how the Regulations interact with amending instruments and with the legislative compilation process. The interaction is primarily one of incorporation by reference: the Regulations identify which subordinate legislation items are to be taken into account under specified Schedule items in the Act.

• Interaction with the Age Discrimination Act 2004: The Regulations are made under the authority of the Act (s 3) and the sole definitional provision in the Regulations identifies the “Act” as the Age Discrimination Act 2004 (s 4). Sections 5(1) and 5(2) operate by referencing items of the Act’s schedules (item 8 of Schedule 1 and item 3AA of Schedule 2). The legal operation is therefore dependent on the construction and operation of those Schedule items in the Act; the Regulations cannot be read in isolation. Any substantive legal effect occurs via that interaction.

• Interaction with the Airports (Control of On‑Airport Activities) Regulations 2026: Section 5(1) prescribes that instrument for the purposes of item 8 of Schedule 1. The endnotes reveal that this prescription responds to the On‑Airport Activities Legislation (Repeal and Consequential Amendments) Regulations 2026 (registered 23 Feb 2026), which commenced on 1 April 2026 for the scheduled item (Endnote 3). That indicates a coordinated legislative change in airport regulation and the Act’s exemption lists; the Regulations ensure the Act’s Schedule item points to the relevant up‑to‑date airports instrument.

• Interaction with Defence Regulation 2016 ss 23 and 88: Section 5(2) expressly prescribes those two sections of the Defence Regulation 2016 for the purposes of item 3AA of Schedule 2. Where the Defence Regulation provisions deal with matters relevant to age‑based treatment within Defence, their prescription into item 3AA will determine how the Act’s schedule exemption applies in Defence contexts.

• Compilation and modification caveats: The compilation prefatory material emphasises that the published text shows the law as amended and in force on the compilation date, but it also warns that modifications by other laws may not be reflected in the compiled text and that uncommenced amendments are noted in the endnotes (front matter). First Parliamentary Counsel may also have made editorial or presentational changes under the Legislation Act 2003. Those meta‑legal interactions are relevant: practitioners should check both the Act, the prescribed instruments, and the Register for any modifications or related instruments that might not be visible within this compilation.

• No displacement of other laws: The Regulations do not state that they displace or override other laws. They simply prescribe which instruments should be treated as the ones referenced by specific Schedule items. Any conflict between the Act read with the prescribed instruments and other Commonwealth, state or territory laws would continue to be governed by the ordinary rules of statutory construction and conflict resolution under the Constitution and relevant statutes; the Regulations do not attempt to settle such conflicts.

• Practical coordination across regimes: The instruments prescribed (airports regulation and Defence Regulation sections) sit in different administrative regimes. The Regulations therefore create a coordination point where the Age Discrimination Act’s exceptions will be interpreted in light of sector‑specific rules. That increases the need for coordinated statutory interpretation across regulatory silos when complaints or compliance issues arise.

The compilation includes an explicit amendment history and notes showing how the Regulations have been altered since their original registration. The endnotes capture both the initial registration and the amendments made up to the compilation date, and they identify the specific amending instrument.

• Original registration and commencement: The legislation history in Endnote 3 records the Age Discrimination Regulations 2020 as registered on 4 September 2020 (F2020L01138) and commenced on 6 September 2020 (Endnote 3 table). That is the baseline instrument that this compilation reflects.

• 2026 amendment: The compilation notes and Endnote 3 show an amending instrument titled On‑Airport Activities Legislation (Repeal and Consequential Amendments) Regulations 2026, registered on 23 February 2026 (F2026L00131). Endnote 3 records that schedule 2 (item 1) of that instrument commenced on 1 April 2026. Endnote 4, the amendment history at provision level, shows that s 5 of these Regulations was amended by F2026L00131. The front matter also states that the compilation includes amendment F2026L00131.

• What the amendment did: The only substantive change recorded in the provision‑level amendment history is to s 5 (Endnote 4). The text of s 5 as compiled shows two prescriptions, which likely reflect the content after the amendment. The amendment history does not include the prior text within this compilation, but the present s 5(1) and s 5(2) are the operative text as at the compilation date.

• Editorial and presentational changes: The compilation explanatory material states that First Parliamentary Counsel may make editorial and presentational changes under the Legislation Act 2003 and that those changes will not affect the law’s effect. The endnotes include an entry on editorial changes and the Legislation Act authority for such changes; practitioners should be aware that the compiled text may include presentational edits that do not change substance.

• Uncommenced amendments and modifications: The front material emphasises that uncommenced amendments existing at the compilation date are not shown in the text and are instead noted in the endnotes. It also warns that modifications by other laws may not be reflected in the compiled text; any modifications are accessible on the Register. The compilation therefore signals that this snapshot captures the law as in force on 1 April 2026, but other legislative instruments may operate to further modify the effect of the Regulations and are documented separately.

• Practical effect of history: The amendment history indicates a targeted change to s 5, reflecting a legislative response to airport regulation changes in 2026 and possibly to Defence Regulation cross‑references. Users of the law should consult the endnote entries and the Register to track precisely when and how the prescription in s 5 altered the legal landscape.

The compiled Regulations do not include any case law, judicial decisions, or litigation annotations. The text and the endnotes provide no record of litigation or judicial interpretation of these Regulations. The compilation therefore supplies no litigation history to inform interpretation.

• No judicial authority cited in the instrument: The Regulations themselves are short and administrative in nature and do not contain references to decisions or precedent. The endnotes and compilation notes also do not record cases or tribunal decisions that have considered these Regulations.

• Implications for practitioners: Because there is no litigation history set out in the compilation, practitioners cannot rely on settled judicial construction of the specific prescriptions in s 5 from within this document. Any argument about how the prescribed instruments should influence the construction of Schedule items in the Age Discrimination Act would rely on general principles of statutory interpretation and on any case law that addresses the Act’s Schedule items or the prescribed instruments, none of which is included here.

• Need to search external sources: If a practitioner requires precedent on how the Act’s schedule exemptions have been applied in contexts like airports or Defence, they must search tribunal and court databases for decisions on the Age Discrimination Act, on the prescribed airports regulations, or on the Defence Regulation provisions. The absence of litigation history in this compilation is not evidence that litigation does not exist; it merely records that no cases are included in the instrument’s endnotes.

• Administrative determinations: Similarly, the compilation does not include any administrative determinations or tribunal guidance that interpret the cross‑referenced Schedule items in light of the prescribed instruments. Administrative decisions, if any, will need to be located in tribunal records or agency guidance repositories.

In summary, there is no litigation history included in this compiled instrument; practitioners must therefore look to external sources to obtain any adjudicative interpretation of the prescribed cross‑references.

This instrument’s narrow drafting yields several practical pitfalls to watch for. Those risks are not speculative policy critiques; they are concrete interpretative and administrative tensions that follow from the Regulations’ form and the compilation notes. All statements here are grounded in text in this compilation.

• The Regulations do not contain the substance of the Schedule items: Section 5 prescribes external instruments for specified Schedule items in the Act, but the Regulations do not reproduce the Schedule items themselves. Practitioners must not assume the nature or scope of item 8 in Schedule 1 or item 3AA in Schedule 2 from these Regulations alone. You must read the Age Discrimination Act’s schedules to understand the exemption content; s 5 simply defines which external instruments are used for those items.

• Prescription is limited to the items named: The Regulations only prescribe instruments for two specific items (item 8 in Schedule 1 and item 3AA in Schedule 2). If other Schedule items or exemptions are relevant to a matter, those remain governed by whatever instruments are already prescribed or by the baseline text of the Act. Do not over‑generalise from the two prescriptions in s 5.

• Compiled text may not show modifications or uncommenced amendments: The compilation front matter explicitly warns that modifications by other laws may not be shown and uncommenced amendments are not included in the text, but are referenced in the endnotes. That means practitioners must check the Register for any modifications or uncommenced amendments that could affect the operation of the prescribed instruments or the Schedule items (front matter notes).

• Timing and commencement nuances matter: Endnote 3 shows that the On‑Airport Activities Legislation (Repeal and Consequential Amendments) Regulations 2026 were registered on 23 February 2026 and that schedule 2 item 1 of that instrument commenced on 1 April 2026. Section 5(1) prescribes the Airports (Control of On‑Airport Activities) Regulations 2026; to determine whether that airports instrument is in force in a given dispute, you must check its own commencement and transitional provisions as well as the timing in the endnotes. Don’t assume instantaneous effect without confirming commencement timing.

• Possible divergence between the prescribed instrument’s scope and the Act’s expectations: Because the Regulations point to sector‑specific instruments (airport regulation and Defence Regulation sections), there is a risk of mismatch in granularity. For example, an airport regulation may focus on safety, security, and operational control and may not use the same terminology or thresholds the Act’s Schedule item assumes. Such doctrinal mismatches are not resolved by the Regulations; they potentially create interpretative work for decision‑makers who must reconcile the two texts.

• Editorial and presentational changes may conceal prior drafting choices: The compilation notes that First Parliamentary Counsel may have made editorial changes. While those changes are not supposed to affect substance, they may alter pagination, cross‑referencing formats, or punctuation. When working across multiple instruments, rely on the Register or original instruments for authoritative formatting and historical versions where necessary.

• The Regulations do not create a comprehensive map of all sector exemptions: Users should not rely on this instrument as a complete list of exemptions relevant to age discrimination law. It only addresses two prescriptions. Other exemptions may exist in the Act’s schedules or in other instruments; confirm by consulting the Act and the broader legislative register.

• No guidance on interpretation of prescribed sections: The Regulations do not provide statutory guidance on how to interpret the prescribed Defence Regulation sections or the airports regulations in the context of the Act. That leaves adjudicators to develop interpretive approaches case by case.

In sum, the main “gotchas” arise from the Regulations’ brevity, their reliance on cross‑references, and the compilation caveats about commencement and modification. Practical compliance requires consulting multiple instruments and tracking commencement history.

Compliance with these Regulations is primarily about recognising the applicable cross‑references when applying the Age Discrimination Act. Because the Regulations do not create separate substantive duties or reporting obligations, compliance work consists of correctly incorporating the prescribed instruments into legal analyses, policies, and decision‑making processes. Below are concrete, source‑grounded steps drawn from the Regulations and the compilation material.

1. Consult the Age Discrimination Act 2004 schedules immediately: The Regulations operate by reference to specific items in the Act’s schedules (s 5(1) refers to item 8 in Schedule 1; s 5(2) refers to item 3AA in Schedule 2). To know what exemption or treatment follows, read those Schedule items in the Act. The Regulations do not reproduce those items.

2. Read the prescribed instruments or sections cited in s 5: For matters relating to item 8 of Schedule 1, obtain and read the Airports (Control of On‑Airport Activities) Regulations 2026. For matters relating to item 3AA of Schedule 2, obtain and read sections 23 and 88 of the Defence Regulation 2016. The Regulations operate by making those instruments the relevant references for the Schedule items; compliance requires integrating their content into your analysis.

3. Verify commencement and any transitional rules: The compilation notes and Endnote 3 show the amendment pathway for the airports prescription (On‑Airport Activities Legislation (Repeal and Consequential Amendments) Regulations 2026, registered 23 Feb 2026; sch 2 item 1 commenced 1 Apr 2026). Confirm the commencement dates and any transitional provisions in the prescribed instruments themselves. Do not assume that the effect is retroactive unless the instruments expressly provide so.

4. Track modifications and uncommenced amendments: The compilation foreword warns that modifications by other laws and uncommenced amendments may not be shown in the compiled text. Check the Register and the endnotes for any uncommenced amendments or modifications that might alter either the Regulations or the prescribed instruments. The compilation includes the relevant amending instrument reference (F2026L00131), but other changes may exist.

5. Incorporate the prescriptions into internal policies and training: If you are an airport operator, a Defence body, or an entity regularly dealing with age discrimination issues in those sectors, update compliance manuals, HR policies, tender documents and training materials to reflect that the specified airport regulations and Defence Regulation sections are to be treated as the relevant instruments for the Act’s Schedule items.

6. Prepare to explain cross‑reference during dispute resolution: In any complaint or tribunal matter under the Age Discrimination Act that involves airport or Defence contexts, be prepared to demonstrate how the prescribed instruments (the airports regulations or the Defence Regulation sections) interact with the relevant Schedule items. This includes assembling the prescribed instrument text, commencement history and any sectoral guidance that may assist interpretation.

7. For advisers: When forming legal opinions, expressly state that your advice assumes the prescription in s 5 of the Age Discrimination Regulations 2020 and identify the operative instruments you consulted. Note the compilation date (1 April 2026) and the amending instrument identifier (F2026L00131) when documenting the sources relied upon.

8. If in doubt, check the Register and primary sources: Because the compilation may not show modifications and because editorial changes are possible, use the Register and the original instruments (the airports regulations and Defence Regulation 2016) as authoritative sources. The compilation’s endnotes identify the amending instrument and its registration number if you need to trace the change history.

9. Watch for sectoral differences in focus and terminology: The prescribed airport and Defence instruments will have sectoral emphases. When drafting policies or litigating, align the statutory language from the Act’s Schedule items with the technical terms used in the prescribed instruments. That alignment is necessary to avoid interpretative gaps in compliance and dispute responses.

10. Document decisions: When an administrative body or an employer relies on a Schedule exemption that invokes a prescribed instrument under s 5, document the reasoning, the statutory text applied, and the specific provisions of the prescribed instrument that were determinative. That documentation will be important in case of review, complaint, or other proceedings.

Following these concrete steps will ensure that the prescription effected by s 5 of the Regulations is properly integrated into legal and compliance practices. The Regulations themselves are narrow; compliance involves correct cross‑referencing and careful attention to commencement and modification history as recorded in the compilation endnotes.
