Aerodrome Landing Fees Act 2003

Definitions and scope: The Act depends on several defined terms. “Aerodrome” means land used or intended for use wholly or partly for arrival, departure or movement of aircraft, but the definition expressly allows for certain aerodromes to be excluded by regulation (s 3, definition of “aerodrome”). “Aircraft” is restricted to aircraft registered under Part 3 of the Commonwealth Civil Aviation Regulations (s 3, definition of “aircraft”), and the Act refers to the Aircraft Register established under those Regulations. The definition of a “training flight approach” is functional and captures a planned descent to, or in the immediate vicinity of, a runway whether or not the aircraft touches the runway, where the flight is for training or testing a person as a pilot or flight crew member (s 3).

Fee-making power: Section 6 is the central operational provision. It lists permitted fee categories (arrival; departure; parking; training flight approach; directly related activities or services; and late payment of an existing fee, with a proviso about charging a late fee on a late fee (s 6(1)(f)). The operator’s discretion is structured by publication and commencement rules (s 6(2)-(3)). The Act expressly permits replacement of a previously fixed fee by another fee fixed in accordance with the section (s 6(3)(a)). The operator is “entitled” to set fees to ensure revenue covers the cost of the service or activity (s 6(4)(a)), and may provide for reductions, waivers or refunds in specified circumstances (s 6(4)(b)). Subsection (5) clarifies that an operator is not compelled to fix a fee: the power is permissive (s 6(5)).

Liability and assignment: The default liable party is the holder of the certificate of registration as entered on the Aircraft Register (s 7(1)). The Act provides an opt-out mechanism by written agreement: the holder may assign the liability or future liability to another person by written agreement (s 7(2)). Unless the assignment agreement says otherwise, the assignee must notify each relevant aerodrome operator of the agreement details (s 7(3)).

Enforcement construct: Recovery is civil: an aerodrome operator may commence proceedings in a court of competent jurisdiction to recover a fee fixed under section 6 as a debt (s 8). The Act confers no other statutory enforcement mechanics; the recovery mechanism is framed as ordinary debt collection through the courts.

Interaction and gaps: The Act does not purport to displace other powers or contractual mechanisms, section 5 states that it does not limit or affect contractual or other powers, rights or obligations of aerodrome operators to charge and recover aerodrome fees. The Governor in Council has regulation-making power to prescribe matters necessary to give effect to the Act, which includes the possibility of excluding certain aerodromes from the definition or prescribing the periodical in which notices may appear (s 9; s 3 definition of “aerodrome”; s 6(2)(b)).

Crown application: The Act expressly binds the Crown in right of Victoria and, so far as legislative power permits, the Crown in all its other capacities (s 4).

Regulatory references: The Act relies on the Commonwealth Civil Aviation Regulations for the definitions of “aircraft” and for the Aircraft Register, so practical operation of the liability rule and the scope of “aircraft” depends on those external instruments (s 3).

Primary actors:

• Aerodrome operators are the principal duty-holders and rights-holders under the Act. They are authorised to fix fees under s 6(1), obliged (as a precondition of fee validity) to publish fee notices per s 6(2), able to specify when a fee comes into force (s 6(3)(b)) and empowered to recover fees by court action under s 8. They also have an express entitlement to set fees to cover costs and to reduce, waive or refund fees in specified circumstances (s 6(4)).
• Holders of certificates of registration of aircraft are the default persons liable to pay fees incurred in respect of their aircraft (s 7(1)). The Act defines holder of a certificate of registration as the person whose name is entered in the Aircraft Register established under the Commonwealth Civil Aviation Regulations (s 3). That ties liability to the Register entry rather than necessarily to the person physically operating or flying the aircraft.

Secondary or contingent actors:

• Assignees of liability. The holder of the certificate of registration may, by written agreement, assign present or future liability for a fee to another party (s 7(2)). An assignee who takes on liability is generally required to notify each relevant aerodrome operator of the agreement details unless the assignment specifies otherwise (s 7(3)).
• Publishers. The Act requires publication in the Government Gazette and in either a daily newspaper circulating generally in the State or a periodical prescribed by regulation (s 6(2)). That creates a practical interaction with publishers and with the regulation-making power that could alter the prescribed publication conduit.
• The Crown. The Act binds the Crown in right of Victoria and, where legislative power extends, binds the Crown in other capacities (s 4). That means Victorian government-owned aerodromes and Crown-operated aircraft may be subject to the Act’s provisions unless an exemption or other legislative arrangement applies.

Indirectly affected parties:

• Pilots, operators and flying schools may be affected by fees charged for training flight approaches, including those approaches that do not touch the runway but fall within the statutory definition (s 3, definition of “training flight approach”).
• Aviation service providers or businesses that provide directly related activities or services at an aerodrome may be included within the “directly related” ambit if the aerodrome operator fixes fees for such services (s 6(1)(e)). The Act does not define “directly related,” so the practical scope depends on how operators exercise the power and on any regulation.

Regulatory authorities:

• The Governor in Council, through the regulation-making power in s 9, can shape which aerodromes are captured, what periodicals satisfy the publication requirement and other matters necessary to give effect to the Act. That introduces a vector through which administrative decisions can alter who is affected in practice (s 3; s 6(2)(b); s 9).

Excluded or borderline actors:

• Aircraft that are not registered under Part 3 of the Civil Aviation Regulations fall outside the Act’s definition of “aircraft” (s 3). Therefore the statutory liability rule in s 7(1) would not apply to them under this Act, though other legal regimes may apply.

Rights conferred on aerodrome operators:

• Power to fix fees. An aerodrome operator may fix fees for arrivals, departures, parking, training flight approaches, directly related activities or services and for late payment of such fees (s 6(1)). Operators may replace an existing fee by a different fee fixed in accordance with the Act (s 6(3)(a)).
• Discretion to tailor fees for cost recovery. The operator is explicitly entitled to ensure that the total amount collected is sufficient to cover the operator’s cost of providing the service or carrying out the activity (s 6(4)(a)). The operator may also provide for reduction, waiver or refund of fees in specified circumstances (s 6(4)(b)).
• Civil enforcement. Operators have a statutory route to recovery: they may commence proceedings in a court of competent jurisdiction to recover a fee fixed under the Act as a debt (s 8).

Duties imposed on aerodrome operators:

• Publication duty. If an operator fixes a fee under s 6, a notice setting out the fee must be published in the Government Gazette and in either a daily newspaper circulating generally in the State or a periodical prescribed by regulation (s 6(2)). The timing of publication affects when the fee can come into force (s 6(3)(b)).
• Temporal rule on commencement. Even where a day is specified for the fee to come into force, the fee cannot come into force earlier than the day after the last required publication under s 6(2) (s 6(3)(b)).

Default liabilities and procedural duties for holders:

• Default liability. Where a fee is incurred in respect of an aircraft, the holder of the certificate of registration is liable to pay the fee to the aerodrome operator (s 7(1)). The Act links liability to the Aircraft Register entry and to registration under Commonwealth Civil Aviation Regulations (s 3; s 7(1)).
• Assignment mechanism and notification duty. The holder may, by written agreement, assign liability or future liability to another person (s 7(2)). Unless that agreement specifies otherwise, the assignee is required to notify each relevant aerodrome operator of the details of the assignment (s 7(3)).

Limitations and clarifications:

• No compulsion to fix fees. The Act does not compel an aerodrome operator to fix fees; the power is permissive (s 6(5)). That preserves operator discretion whether to charge statutory fees under s 6 or to rely on other contractual arrangements.
• Non-exhaustive interaction with other powers. Section 5 states that the Act does not limit or affect contractual or other powers, rights or obligations of aerodrome operators to charge and recover aerodrome fees. This means operators may continue to rely on contractual charging mechanisms in addition to or instead of the statutory route (s 5).

Regulatory powers that affect duties and rights:

• The Governor in Council may make regulations for or with respect to any matter required or permitted by the Act to be prescribed or necessary to give effect to the Act (s 9). That includes the capacity to exclude aerodromes from the definition, prescribe periodicals for publication and set out any other procedural matters that the Act contemplates will be prescribed (s 3; s 6(2)(b); s 9).

Crown obligations:

• The Act binds the Crown in right of Victoria and, to the extent permitted, the Crown in other capacities (s 4). That places the Crown within the set of entities who may both exercise the powers and be subject to the liabilities in the Act.

Statutory enforcement mechanism:

• The Act provides a civil enforcement path only. Section 8 authorises an aerodrome operator to recover a fee fixed under section 6 by commencing proceedings in a court of competent jurisdiction to recover the fee as a debt owing to the aerodrome operator. That is the explicit statutory enforcement mechanism (s 8).

Absence of alternative statutory sanctions:

• The Act does not set out a separate administrative penalty regime, does not create criminal offences for non-payment, and does not itself prescribe statutory interest, garnishment processes or administrative enforcement measures. The Act’s text confines enforcement to the ordinary civil process of debt recovery as provided in s 8 and leaves other remedies to existing contractual or statutory mechanisms elsewhere (s 5; s 8). Where an operator wishes to pursue non-contractual enforcement beyond debt recovery, the Act does not itself provide additional statutory tools.

Practical enforcement implications:

• The recovery route requires a court proceeding. An aerodrome operator seeking recovery must institute proceedings in a court of competent jurisdiction. The Act does not specify particular procedural thresholds, limitation periods, venue rules or interlocutory relief related to enforcement; these are matters handled by the relevant court procedure and other legislation, not by this Act (s 8).
• Nature of the recoverable claim. The Act frames the entitlement as a debt owing to the aerodrome operator, which signals a proprietary claim by the operator against the liable person for the amount of the fee. The Act does not itself quantify the fee or set a statutory rate; those are set by the operator under s 6 and become recoverable under s 8 once properly fixed and published.

Late payment charges and the scope of repeat charging:

• The Act explicitly contemplates that one of the categories of fee an operator may fix is a fee for late payment of a fee fixed under the Act, but places a textual limit: the late payment fee cannot be applied to a late payment fee itself (s 6(1)(f)). In practical terms that prevents layering a late-payment-on-late-payment charge as a further statutory fee under the same provision.

Discretionary enforcement and consent-based shifts of liability:

• The Act permits assignment by written agreement of present or future liability (s 7(2)), which means operators may have alternative enforcement strategies depending on contractual arrangements between the holder of the certificate and third parties. The statutory recovery route preserves the operator’s right to sue the person liable under the Act irrespective of underlying commercial arrangements (s 8), although contractual rights and obligations remain available (s 5).

Regulatory instruments and enforcement changes:

• The Governor in Council has power to make regulations necessary to give effect to the Act (s 9). Regulations could prescribe procedural or administrative mechanisms to streamline enforcement or clarify publication requirements. The Act itself does not confer novel enforcement tools beyond debt recovery in court.

Preservation of contractual and other legal rights:

• Section 5 expressly states that the Act does not limit or affect contractual or other powers, rights or obligations of aerodrome operators to charge and recover aerodrome fees. That means private contractual mechanisms remain available in addition to the statutory fee regime set out in s 6. An operator may therefore rely on contractual indemnities, licence agreements, or other civil remedies independent of the statutory route (s 5).

Dependency on Commonwealth aviation law for definitions:

• The Act imports the concepts of “aircraft” and the Aircraft Register from Part 3 of the Civil Aviation Regulations 1988 (Commonwealth), and defines “Aircraft Register” and “Civil Aviation Regulations” by reference to those Commonwealth instruments (s 3). Consequently, the reach of the Act’s liability rules depends on the Commonwealth regulatory framework: who is recorded on the Aircraft Register and what aircraft are treated as registered under Part 3 affects who is liable under s 7(1).

Regulatory modification of scope:

• The Act contemplates that the Governor in Council may make regulations for matters required or permitted by the Act or necessary to give it effect (s 9). The Act also permits an aerodrome to be excluded from the definition of “aerodrome” by regulation (s 3). Therefore State regulation can alter which physical locations and operators are captured by the statutory fee regime and can prescribe the periodical publications in which notices may run (s 6(2)(b); s 3).

Crown liability and interactions with public law:

• Section 4 binds the Crown in right of Victoria and, as far as legislative power allows, the Crown in other capacities (s 4). That makes the Act applicable to Crown-owned or Crown-operated aerodromes and aircraft insofar as the Parliament’s legislative competence extends, and interacts with other statutes or contractual arrangements that govern Crown property and Crown commercial activity.

Overlap with existing charging schemes:

• Because the Act does not displace contractual rights (s 5) and because operators retain discretion whether to fix fees under the Act (s 6(5)), operators may choose to deploy statutory fees in parallel with, or instead of, contractual charging regimes. That can produce an overlay of claims a single operator may assert, though the Act itself does not prescribe priority rules between statutory fees and contractual claims.

Absence of internal conflict-resolution mechanism:

• The Act contains no procedural mechanism to resolve disputes about the validity or reasonableness of a fee short of ordinary court proceedings to recover a debt (s 8). Any interaction with other laws that create administrative review or alternative dispute resolution will therefore depend on those separate regimes; the Act does not supplant them.

Relation to regulation-making scope:

• The regulation-making power in s 9 provides a point of legal interaction: regulations may create further prescriptions relevant to the Act’s operation, potentially creating State-level administrative detail that interacts with Commonwealth aviation law, municipal planning controls and commercial arrangements. The Act does not limit the scope of regulations beyond the statement that regulations may be made for matters required or permitted by the Act or necessary to give effect to it (s 9).

Assent and commencement:

• The Act was assented to on 11 November 2003 and, under the commencement provision, came into operation on 1 January 2004 as a result of section 2(2) (Endnotes; s 2(2)). Section 2 also provides for proclamation commencement, with a fallback to 1 January 2004 if not proclaimed earlier (s 2(1)-(2)).

Subsequent amendments:

• The published version of the Act provided in the source includes an Endnote titled Table of Amendments which states explicitly that there are no amendments made to the Aerodrome Landing Fees Act 2003 by Acts and subordinate instruments (Endnotes, Table of Amendments). The version supplied is "Version No. 003" as at 14 June 2012 and records no alterations to the principal text.

Explanatory materials:

• The endnotes record the Minister’s second reading speech dates in the Legislative Assembly (28 August 2003) and the Legislative Council (18 September 2003) and reproduce the long title for the Bill as “to provide for the fixing of a fee by an aerodrome operator for certain matters and for other purposes” (Endnotes). No explanatory details are included in the Endnotes beyond the dates and these procedural entries (Endnotes, Explanatory Details).

Regulatory history:

• The Act grants regulation-making power in s 9, and the definitions in s 3 anticipate that regulations may exclude certain aerodromes from the statutory definition and may prescribe periodical publications for the notice requirement. The Endnotes include no record of regulations made under the Act in the supplied text, and the Table of Amendments records no amendments to the Act by subordinate instruments as at the version date.

Practical consequences of the history:

• Since the Act has not been amended in the compiled version provided, the operative statutory provisions are those enacted as originally assented. Any later regulations or statutory amendments made after the version date would not be reflected in this source; this Endnote record states no amendments up to 14 June 2012.

Recorded litigation:

• The supplied source contains no reported cases or litigation history connected to the Aerodrome Landing Fees Act 2003. The Endnotes include no entries under litigation history or reported cases, and the Act’s text does not identify any judicial determinations.

Implication of silence in the source:

• Because the source provides no judicial authorities or references to any court decisions construing the Act, users must treat the statutory text as the primary guidance for interpretation. The Act’s operational features,fee-making, publication, commencement, liability, assignment and civil recovery, stand as the governing statutory framework in the absence of case law in the supplied material.

What to look for if undertaking research:

• Any legal practitioner or researcher wanting an up-to-date litigation picture should search court databases and law reports for cases that might have arisen since the version date. The Act’s substantive provisions lend themselves to challenges or clarifications in litigation on issues such as: the meaning of “directly related” services, the scope of the “training flight approach” definition, the sufficiency of publication notices, the operation of assignments under s 7(2)-(3), and the extent to which an operator’s cost-recovery entitlement under s 6(4)(a) can be tested in court. The supplied source does not record such cases.

Limits on using the Act as precedent:

• Without judicial interpretation recorded in the provided text, the Act’s phrases, particularly open-textured terms like “directly related” or cost-recovery “sufficient to cover the cost” (s 6(4)(a)),remain matters of statutory language to be applied in practice. Those terms may require case-specific analysis if litigated, but the supplied material includes no judicial gloss.

Publication and commencement technicalities:

• A fee fixed under s 6 is only validly announced if published both in the Government Gazette and in either a daily newspaper circulating generally in the State or a prescribed periodical (s 6(2)). The Act sets a temporal limit: a fee cannot come into force earlier than the day after the last required publication under s 6(2) (s 6(3)(b)). Practically, failure to comply with either the Gazette or the other publication requirement could render a fee ineffective until the publication defects are cured.

Ambiguity of “directly related”:

• Section 6(1)(e) permits fees for “the carrying out of an activity, or the provision of a service, directly related to the arrival, departure, parking or training flight approach of an aircraft.” The Act does not define “directly related,” which leaves room for divergent operator practice about what services fall within the power. The absence of a statutory definition creates scope for dispute between operators and those charged, particularly where a fee is charged for ancillary or borderline services.

Training flights captured even where runway not touched:

• The definition of “training flight approach” in s 3 includes planned descents to the immediate vicinity of a runway, whether or not the aircraft touches the runway. That can capture practice approaches, circuits and other training manoeuvres that do not involve landing, so flight schools and training operators should note that fees could be charged even when a landing is not completed (s 3).

Liability tied to registration:

• Liability is allocated to the holder of the certificate of registration as recorded on the Aircraft Register (s 3; s 7(1)). That means the person recorded on the Register, not necessarily the operator or user of the aircraft on a particular flight, is the default liable party. Commercial arrangements that separate ownership, registration and operation need express written assignments to alter liability for fees (s 7(2)).

Assignment notification requirement:

• When an assignment of liability occurs by written agreement under s 7(2), the assignee must notify each relevant aerodrome operator of the agreement’s details unless the agreement otherwise specifies (s 7(3)). Failing to notify aerodrome operators may complicate recovery efforts and the operator’s ability to rely on the assignee as the liable party.

Late fees and compounding protection:

• Section 6(1)(f) allows the operator to fix a fee for late payment of a fee fixed under the Act but includes the qualifier “other than this late payment fee,” which prevents applying a late-payment fee to the late-payment fee itself. That prevents recursive layering within the statutory fee categories but does not preclude contractual arrangements outside the Act that might attempt similar layering; the Act’s protection is textual and limited to statutory fees being fixed under s 6 (s 6(1)(f)).

No internal definition of “cost”:

• The operator is entitled to ensure fees are sufficient to cover the operator’s costs of providing services or activities (s 6(4)(a)), but the Act does not define what counts as “cost,” nor does it prescribe accounting or audit requirements to substantiate cost recovery. That can make fee-setting vulnerable to disputes about whether charges are genuinely cost-based.

Interaction with regulations and delegated exclusions:

• The Act permits certain aerodromes to be excluded from the definition of “aerodrome” by regulation (s 3). That creates the possibility that a location an operator or user expects to be captured by the Act might in fact be excluded by subordinate instrument. Anyone relying on the Act’s framework must check current regulations.

No statutory alternative enforcement:

• The Act confines enforcement to court-based debt recovery (s 8). The Act does not provide for administrative fines, summary adjudication, or other expedited collection mechanisms. This may affect practical recoverability and costs of enforcement.

Crown-binding caveat:

• The Act binds the Crown in right of Victoria and, where legislative power allows, the Crown in other capacities (s 4). The phrase “so far as the legislative power of the Parliament permits” signals that there may be constitutional or legal limits to binding the Crown in other jurisdictions or contexts. Practical dealings with Commonwealth Crown entities or other states are not resolved by the Act’s Crown-binding language and may require additional legal analysis.

Preservation of contractual remedies and possible double claims:

• Because s 5 preserves contractual rights to charge and recover fees, an operator may have parallel contractual and statutory routes against a person. That can produce practical complexity in deciding which remedy to pursue and in avoiding double recovery; the Act does not itself set rules for reconciling overlapping claims.

For aerodrome operators:

1. Authorise and document fee policy. Adopt a written fee schedule identifying which of the statutory categories (arrival; departure; parking; training flight approach; directly related services; late payment) the operator intends to charge. Record the rationale linking fees to recoverable costs, noting the entitlement under s 6(4)(a) to ensure collection covers the operator’s cost.
2. Prepare publication notices. Before a fee takes effect, arrange for publication in the Government Gazette and in either a daily newspaper circulating generally in the State or a periodical prescribed by regulation (s 6(2)). Retain proof of publication dates and the content of the notices. Ensure the fee’s commencement date is not earlier than the day after the last publication (s 6(3)(b)).
3. Draft fee terms with procedural clarity. Include the amount, the scope (which activities or services are captured), the effective date, refund/waiver conditions (if any), and whether a late payment fee is applied, ensuring not to attempt to apply a late payment fee to a late payment fee itself under s 6(1)(f).
4. Maintain cost records. If charges are justified by cost recovery, keep contemporaneous accounting evidence showing how fee levels were calculated and what costs they are intended to cover. The Act permits cost recovery as an entitlement (s 6(4)(a)); documentation supports reasonableness if contested.
5. Consider contractual overlay. Because s 5 preserves contractual powers, maintain or amend existing contractual arrangements (agreements with aircraft operators, lessees, tenants and service providers) so that commercial obligations and statutory fees align and to avoid duplication or gaps.
6. Enforce by court where necessary. If fees are unpaid, follow ordinary civil debt recovery procedures; s 8 authorises court proceedings to recover the fee as a debt. Plan for litigation costs and evidentiary needs, including publication proof and proof that the fee was properly fixed under s 6.
7. Monitor regulations and Gazette requirements. The Act contemplates regulations that can modify scope and prescribe the periodical for notices (s 3; s 6(2)(b); s 9). Regularly check applicable regulations to ensure compliance with any prescribed publication channels and to confirm whether any aerodromes are excluded from the Act’s definition.

For holders of certificates of registration:

1. Be aware of default liability. Understand that the person named on the Aircraft Register is prima facie liable for fees incurred in respect of the aircraft (s 7(1)). Verify the registration record is accurate and reflects commercial reality where possible.
2. Use written assignments if transferring liability. If the registered holder expects to transfer liability to another party, execute a written assignment agreement in accordance with s 7(2). Clearly state whether notification to aerodrome operators is required or whether the agreement will specify otherwise to avoid ambiguity under s 7(3).
3. Keep documentary evidence. Where an assignment transfers liability, preserve copies of the written agreement and any notifications to aerodrome operators to prevent disputes over who is the liable person.

For assignees and third parties:

1. Ensure written assignment meets statutory form. The Act requires a written agreement to assign liability or future liability (s 7(2)). The agreement should unambiguously state the scope and timing of liability transferred.
2. Notify operators unless the agreement specifies otherwise. Unless the assignment agreement provides otherwise, the assignee is required to notify each relevant aerodrome operator of the details of the assignment (s 7(3)). Compliance with this notification duty reduces risk of being pursued incorrectly or of operational mismatch.

For legal advisers and compliance officers:

1. Review publication practices and evidence. Confirm the aerodrome operator’s publication procedures meet s 6(2) and that notice wording, timing and proof are retained for potential court proceedings (s 6(2)-(3)).
2. Scrutinise the scope of fees. Advise clients on the interpretive risks around “directly related” services and the statutory capture of training flight approaches that do not land (s 3; s 6(1)(e)). Draft clear contractual terms to reduce ambiguity and to coordinate statutory fees with contractual charging.
3. Plan enforcement strategy. Because enforcement is limited to civil debt recovery (s 8), evaluate the cost-effectiveness of litigation, potential defences and evidentiary burdens before initiating proceedings.
4. Monitor subordinate instruments. Regularly check for regulations made under s 9 that may alter which aerodromes are captured, what publications satisfy s 6(2)(b) and other procedural details. Confirm whether regulations have excluded any aerodromes from the definition (s 3).
5. Consider Crown interactions. Where dealing with Crown-litigation risk or Crown-owned aircraft, assess whether binding the Crown in the relevant capacity is within the Parliament’s legislative power as noted by s 4, and ensure any governmental arrangements are documented.

Recordkeeping and operational checklist:

• Fee schedule and rationale tied to provider costs (s 6(4)(a)).
• Gazette notice and additional publication (s 6(2)); retain copies and publication affidavits.
• Clear effective date chosen that complies with the “not earlier than the day after last publication” rule (s 6(3)(b)).
• Written assignment agreements and notification records where liability is transferred (s 7(2)-(3)).
• Contractual terms aligned with statutory fee power and with existing commercial arrangements (s 5).
• Procedure for initiating court recovery with proof bundles that include registration details (Aircraft Register entry), fee notice publications and invoices/demands.

By following the steps above and keeping close documentary evidence tied to the specific sections cited, operators, registrants and advisers can align operational practice with the Act’s statutory architecture.
