Aerodrome Fees Act 1998

The Act creates parties with defined roles and liabilities; those roles determine who pays, who decides and who carries compliance actions.

• Aerodrome operators. The Act confers decision‑making power on an aerodrome operator to fix fees for arrivals, departures, parking, training flight approaches, related services and late payment (s 6(1)). Operators must publish fee notices in the Gazette and on one of the other channels listed (s 6(2)). Operators are the parties who will initiate debt recovery proceedings for unpaid fees (s 8). Operators are also a necessary party to any assignment of liability under ss 7(2)-(4), because assignment agreements must be signed by the aerodrome operator.

• Holders of certificates of registration. The holder of the certificate of registration of an aircraft, as recorded on the Aircraft Register (defined in s 3(1)), is the person liable for payment of fees incurred under the Act in respect of that aircraft, subject to the assignment mechanism (s 7(1)). Practically, registered owners or certificate holders bear primary financial exposure for statutory fees.

• Assignees of liability. A holder may assign liability for specified future periods of use at specified aerodromes to another person by a written agreement that is to be signed by the holder, the assignee and the aerodrome operator (ss 7(2)-(4)). The assignee becomes the person contractually identified as responsible under the written agreement; however, the statutory liability architecture requires that the agreement be executed by the aerodrome operator for it to be effective under the Act.

• The Crown. The Act binds the Crown (s 4), so government entities operating an aerodrome, or government‑owned aircraft, fall within the Act’s reach unless excluded by regulation under the definition of “aerodrome” (s 3(1)).

• Users of aerodromes and service providers. Pilots, flight schools and operators conducting training flight approaches are affected because the Act explicitly contemplates fees for training flight approaches (s 6(1)(d)) and defines the term for inclusion of touch‑and‑go‑type activities (s 3(3)). Commercial and private users will be affected by fee structures and by the operator’s ability to vary fees by factor or circumstance (s 6(3)(a)).

• Parties to publication channels and the public. The public interest in notice is operationalised through a statutory publication requirement in the Gazette and at least one other channel (s 6(2)), which affects how changes to fees are communicated to users and other stakeholders.

• Regulators and courts. The Governor may make regulations (s 9), and courts are the forum for recovery of unpaid fees (s 8). The Civil Aviation Regulations of the Commonwealth are referenced for definitions, which means Commonwealth regulatory changes affect the Act by reference (s 3(1)-(2)).

Who ultimately bears costs depends on commercial arrangements and whether assignments under ss 7(2)-(4) are used. The holder of the aircraft certificate is the statutory backstop for liability unless there is a valid, signed assignment that complies with the Act.

The Act imposes specific duties on aerodrome operators and creates statutory rights and liabilities for aircraft certificate holders and assignees.

Duties and powers of aerodrome operators

• Power to fix fees. Operators may fix fees for enumerated activities including arrivals, departures, parking, training flight approaches, related services and late payment charges (s 6(1)). This is a statutory power, not an entitlement to impose any fee without observing the Act’s procedural requirements.

• Publication duty. If fees are fixed, the operator must publish a notice setting out the fees in the Government Gazette and on one other prescribed channel (s 6(2)). The notice must include the day fees come into force, and that day cannot be earlier than the day the notice is published (s 6(3)(b)). The Act therefore requires operators to undertake public notification and to allow notice publication before a fee commences.

• Inclusion and variability. Operators may structure fees to vary by different factors or circumstances (s 6(3)(a)). The Act does not prescribe limits on permissible factors; it expressly permits variability but leaves the content of the fee schedule to the operator.

Duties and liabilities of certificate holders

• Primary liability. The holder of the certificate of registration of an aircraft is liable for payment of fees incurred under the Act in respect of that aircraft (s 7(1)). Liability attaches due to registration on the Aircraft Register.

• Assignment by written agreement. The holder may assign liability for future periods of use of a specified aerodrome by agreement in writing. The assignment must be signed by the holder, the assignee and the aerodrome operator to be effective under the Act (ss 7(2)-(4)). The Act thus conditions the transfer of statutory liability on a tripartite writing involving the operator.

Rights of aerodrome operators

• Recovery as debt. Operators may recover fees by action in a court as a debt due (s 8). That right places unpaid fees within ordinary civil recovery processes.

Rights and limitations preserved

• Preservation of other powers. The Act explicitly states it does not limit or affect contractual or other powers that would exist apart from the Act to charge and recover aerodrome fees (s 5). That means parties retain any pre‑existing legal rights to impose fees under contract or other statutory regimes; the Act supplements rather than displaces other bases for charging fees.

Regulatory power

• Regulation-making power. The Governor may make regulations contemplated by, or necessary or expedient for the purposes of, the Act (s 9). This creates a delegated legislative avenue to flesh out operational matters, including potentially the periodical publication option in s 6(2) which has itself been the subject of amendment.

Interpretive duties

• Definitions and their effects. The Act defines “aerodrome”, “aircraft” and “training flight approach” (s 3), which places duties on operators and users to apply these statutory meanings when deciding whether fees can be fixed or are payable.

The statutory architecture therefore places primary decision rights over fee content with the aerodrome operator, imposes notification duties, creates a designated liable person unless a compliant assignment is executed, and provides a civil enforcement route for collection.

The Act does not create criminal offences or express administrative penalties; enforcement is civil and limited in mechanism.

Civil recovery

• Recovery as debt. The sole express enforcement mechanism in the Act is that an aerodrome operator may recover a fee fixed under the Act "by action in a court of competent jurisdiction as a debt due" to the operator from the person liable for payment under the Act (s 8). That provision places unpaid fees within ordinary civil litigation or debt recovery processes and subjects collection to the procedural rules, limitation periods and remedies of the court seized of the claim.

No express statutory fines or offences

• Absence of criminal penalties. The Act contains no provision imposing criminal liability, administrative fines, or pecuniary penalties beyond the operator’s ability to fix a late payment fee (s 6(1)(f)). The Act therefore relies on civil enforcement and the threat of debt recovery rather than penal sanctions.

Late payment charges

• Permitted late fees. An aerodrome operator may fix a fee for "late payment of a fee fixed under this section" (s 6(1)(f)). This is a civil pricing tool that an operator may include in its fee schedule and then enforce through s 8 for recovery as a debt. The Act does not prescribe interest rates, calculation methods or maximums for late payment fees.

Burden of proof and procedure

• Court process implied. The Act does not set special evidential rules; recovery will proceed under ordinary civil procedure. The operator must demonstrate the liability under the Act, the fee notice publication where relevant, the person’s status as the liable certificate holder (which may require reference to the Aircraft Register), and any assignment document if relied upon by the defendant.

Regulatory enforcement and delegated powers

• Regulations may create additional mechanisms. Section 9 empowers the Governor to make regulations necessary or expedient for the Act’s purposes. The Act does not itself specify what regulations may include; consequential regulatory instruments could create procedural requirements or fees associated with enforcement, but no such instruments are set out in the source provided.

Crown binding

• Suit against and by Crown. The Act binds the Crown (s 4). That both subjects Crown entities to the Act and permits actions involving Crown parties under the same recovery mechanism. The Act does not specify procedural variations for suing the Crown; standard rules about suing the Crown would apply unless regulations or other law make adjustments.

Practical consequences

• Litigation costs and evidentiary requirements are borne by the parties. Aerodrome operators exercising their enforcement right under s 8 will face the costs and time of civil litigation. The Act places no expedited administrative recovery or self-help powers on operators; recovery is via court process. The absence of statutory penalty regimes limits the State’s direct enforcement role to regulation‑making only, subject to the scope of s 9.

The Act references and interacts with Commonwealth aviation regulation and leaves other legal rights intact; it also contemplates subordinate legislation.

Reference to Commonwealth Civil Aviation Regulations

• Definitions tied to Commonwealth regulation. The Act defines "aircraft" as an aircraft registered under Part III of the Civil Aviation Regulations and the "Aircraft Register" as the register established under Part III of those Regulations (s 3(1)). Section 3(2) confirms that references to Commonwealth regulations include their amendments and substitutions. The Act therefore operates with dynamic cross‑references to Commonwealth aviation law; changes at Commonwealth level to Part III registration or the register’s operation will affect who is a liable person under s 7 and the boundaries of the Act’s reach.

Preservation of other legal powers

• Does not exclude other bases for fees. Section 5 expressly states the Act does not limit or affect contractual or other powers that would exist apart from the Act to charge and recover aerodrome arrival, departure, parking or other fees. That means existing commercial contracts, statutory arrangements, local government powers, airport lease provisions, or Commonwealth regulatory fee mechanisms can coexist with the Act. Practically, parties retain the ability to rely on contract, trust instruments, licences, leases or other statutory causes of action to levy or recover fees in addition to, or instead of, the Act’s mechanisms.

Interaction with Crown immunity and procedure

• Act binds the Crown. Section 4 brings Crown entities within the Act’s ambit. However, procedural rules about suits involving the Crown, or sovereign immunity exceptions present in other legislation, remain applicable. The Act does not override procedural or substantive rules outside its express text.

Regulations and subordinate law

• Governor’s regulation‑making power. Section 9 authorises regulations "contemplated by, or necessary or expedient for the purposes of, this Act". That is a broad enabling power that allows the making of subordinate instruments to elaborate publication requirements (s 6(2) already references prescribed periodicals), procedural matters, exemptions for aerodromes, or other operational details. The Act’s definition of "aerodrome" allows for exclusions by regulation (s 3(1)), providing a direct intersection with subordinate law.

Implications for contractual arrangements

• Assignment and operator involvement. The assignment mechanism in ss 7(2)-(4) requires the assignment agreement to be signed by the aerodrome operator to be effective under the Act. That affects how commercial parties structure liability allocation. A written assignment that omits the operator’s signature will not effect the statutory assignment required by the Act, though it might still create contractual rights and obligations outside the Act under s 5.

Absence of explicit interaction with other enforcement regimes

• No express preclusion or supplanting. The Act does not preclude debt recovery under other laws or contract; nor does it specify interaction with insolvency, bankruptcy, tort or regulatory enforcement regimes. Operators and liable persons must therefore consider other applicable legal regimes when enforcing or resisting claims.

In short, the Act is designed to sit alongside Commonwealth aviation regulations and existing contractual or statutory mechanisms for charging fees, while enabling state‑level fee fixing, publication and civil recovery in a narrowly defined statutory framework.

The legislative history supplied in the source is concise and identifies the principal Act and a consequential amendment.

Principal Act

• Aerodrome Fees Act 1998, South Australia, No. 45 of 1998. Assented 3 September 1998. Commencement recorded as 1 November 1998 with Gazette reference (Gazette 24.9.1998 p930).

Subsequent amendment recorded in source

• Statutes Amendment and Repeal (Simplify) Act 2019, No. 25 of 2019. Assent 3 October 2019. The legislative history notes Part 2 (s 4) of that amending Act commenced 6 April 2020 (Gazette 2.4.2020 p631). The amending provision substituted s 6(2) of the Aerodrome Fees Act 1998. The legislative history demonstrates that the publication requirement in s 6(2) was materially revised by the 2019 amendment, with the substitution taking effect on 6 April 2020.

Other editorial changes

• The history notes that s 2 was omitted under the Legislation Revision and Publication Act 2002; that omission is recorded but s 2 does not appear in the present text.

Observations on amendment scope

• The substitution of s 6(2) indicates legislative attention to how fee notices are published. The current s 6(2) requires publication in the Gazette and one of: the operator’s website, a periodical prescribed by regulation, or a daily newspaper circulating in the State. The 2019 amendment therefore adjusted the statutory notification channels; the precise previous text is not provided in the source but the history signals a change intended to modernise or simplify publication options.

• No other substantive amendments are recorded in the supplied legislative history beyond the 2019 substitution and the earlier omission of s 2. The Act’s core structure, including ss 3, 4, 5, 6(1), 6(3), 7-9, remains as presented.

Effect of amendment timing

• The substitution of s 6(2) on 6 April 2020 means operators and users needed to comply with the updated publication regime from that date. The Act’s commencement dates and amendment dates are relevant for determining validity of fee notices and compliance with publication requirements in any period straddling the amendment.

This history should be checked against official parliamentary records and the South Australian legislation database for any regulations made under s 9 or further amendments not shown in the supplied source.

The provided Act text and legislative history do not include or cite any court decisions, statutory interpretations, or litigation outcomes arising under the Aerodrome Fees Act 1998. The source supplies no reported cases, appeals, or judicial guidance about the Act’s construction, enforcement, or interaction with Commonwealth law.

Consequences of absent litigation record in the source

• No judicial construction provided. Users of the Act must rely on the plain statutory text in s 3-9 for construction because the supplied material does not record any authoritative judicial interpretation. Key interpretive points likely to benefit from judicial guidance include the extent of permissible variability in fees under s 6(3)(a), the evidential requirements for publication under s 6(2), the limits of the assignment mechanism in ss 7(2)-(4), and how the Act interacts with Commonwealth registration mechanics under the Civil Aviation Regulations (s 3).

• Unresolved practical issues. The Act leaves open several practical and procedural questions not resolved by case law in the supplied source, such as the scope of recoverable late payment charges, evidentiary thresholds for proving publication and the due date for fees, the treatment of transient or foreign‑registered aircraft (given the definition of "aircraft" in s 3(1)), and whether operators have any statutory rights to perform self‑help remedies. Without litigation history in the source, these points remain matters of statutory interpretation and commercial negotiation.

• Reliance on other law. In the absence of Act‑specific case law, litigants and advisers will need to assess recovery and disputes under the Civil Procedure Acts, ordinary contract and debt jurisprudence, and any relevant decisions interpreting analogous statutory fee‑making regimes.

If court decisions exist, they are not included in the provided material. Practitioners requiring case law should consult case reports, court databases and the consolidated South Australian legislation and judicial databases to identify any authorities that post‑date or sit outside the supplied source.

The Act is short and operational, but it contains specific drafting features and gaps that create practical risks if misunderstood.

Publication requirement technicalities

• Gazette plus one channel. Section 6(2) requires publication in the Gazette and in one of three alternative channels: the operator’s website, a prescribed periodical, or a daily newspaper circulating in the State. Failure to publish in the Gazette or to use an acceptable second channel may mean the publication requirement is not met. Because the Act requires Gazette publication as a minimum, relying solely on a website or newspaper without Gazette notice will not comply with s 6(2).

• Commencement date not earlier than publication. Section 6(3)(b) expressly prohibits a fee from coming into force on a date earlier than the publication date. An operator that attempts to back‑date a fee or make it effective before the Gazette (or other required) publication risks challenge to the fee’s validity for that earlier period.

Assignments conditional on operator signature

• Tripartite signature required. The assignment mechanism in ss 7(2)-(4) requires that the agreement be signed by or on behalf of each of the holder, the assignee and the aerodrome operator. An assignment that is agreed in private between a holder and a third party but lacks the aerodrome operator’s signature will not be effective under the Act to shift statutory liability. Parties relying on such assignments must ensure the operator signs the agreement; otherwise the statutory liability remains with the certificate holder.

Statutory definition of “aircraft” and registration dependency

• Limited to Part III registrations. The Act defines “aircraft” by reference to Part III of the Commonwealth Civil Aviation Regulations (s 3(1)). Aircraft not registered under that Part , for example, certain foreign‑registered aircraft or aircraft of types outside the Part III regime , may fall outside the Act’s statutory liability scheme. Users must verify registration status on the Aircraft Register to identify the person statutorily liable under s 7(1).

Training flight approach scope

• Wide definition. Section 3(3) defines a training flight approach to include a planned descent to, or in the immediate proximity of, a runway during training or testing, "whether or not the aircraft touches the runway". That can encompass touch‑and‑go operations commonly used in pilot training. Operators charging for training flight approaches should expect that routine training activities are captured, and training operators should be aware fees may apply.

Lack of limits on fee structure

• No statutory caps or criteria. The Act permits fees to "vary according to different factors or to the circumstances in which they are to apply" (s 6(3)(a)) but does not specify what factors are permissible or impose caps or proportionality tests. This leaves operators with broad discretion on fee design but also exposes fee schedules to commercial or contractual challenge, and possibly statutory review if regulations are enacted, though the Act itself imposes no substantive constraints.

No express dispute resolution or billing procedure

• Billing, timing and dispute processes absent. The Act does not prescribe billing intervals, due dates, notice content or dispute resolution mechanisms. Operators and users must therefore rely on commercial practices or contractual terms to define these matters unless regulations provide otherwise.

Late payment fee mechanics unclear

• No calculation method provided. Section 6(1)(f) permits a fee for late payment, but the Act does not prescribe interest rates, calculation bases, grace periods or compounding rules. Disputes may arise over what constitutes a lawful late fee if not clearly specified by the operator and agreed in any assignment.

Regulatory exclusions and uncertainty

• Aerodrome exclusions by regulation. The definition of “aerodrome” permits regulation to exclude certain aerodromes from the Act’s ambit (s 3(1)). Unless practitioners check the regulations, they may incorrectly assume the Act applies to every aerodrome.

Recovery as debt without expedited remedies

• Court action only. Section 8 limits recovery to court action as a debt; operators lack statutory self‑help powers such as lien enforcement or detention specified in the Act. If operators have contractual liens or remedies under other laws, they must invoke them separately; the Act itself does not supply them.

Practical evidentiary points

• Proof of Gazette publication and register entries. A successful s 8 claim will require proof of publication and of the liable person’s status on the Aircraft Register. Operators should preserve evidence of Gazette notices, web pages, printed periodicals or newspaper articles and contemporaneous Aircraft Register extracts.

These "gotchas" indicate process and evidential mistakes that commonly produce disputes; the Act’s operative text puts a premium on careful publication, formal documentation of assignments and attention to registration status.

For aerodrome operators, certificate holders and assignees, compliance requires attention to procedures the Act prescribes and to practical documentation and timing.

Checklist for aerodrome operators

1. Fee policy and schedule. Draft a clear fee schedule identifying the activities for which fees are charged, including arrivals, departures, parking, training flight approaches, related services and any late payment charges in accordance with s 6(1). Specify the factors or circumstances governing variability (s 6(3)(a)).

2. Publication plan. Prepare to publish the fee notice in the Government Gazette and one of the alternative channels listed in s 6(2): the operator’s website, a periodical prescribed by regulation, or a daily newspaper circulating in the State. Ensure the Gazette notice is lodged with sufficient lead time because the fee cannot commence before publication (s 6(3)(b)). Keep copies and timestamps of all published items.

3. Notice content. Include the commencement date in the notice and ensure that date is not earlier than the publication date (s 6(3)(b)). Set out sufficient detail for users to understand which activities attract which fees and any conditions for variability (s 6(3)(a)).

4. Assignment protocol. Adopt a standard, written assignment form that complies with ss 7(2)-(4). The form should be signed by the holder, the assignee and the aerodrome operator. Retain executed originals and record the assignment’s scope (which aerodrome and what future period).

5. Record keeping. Maintain contemporaneous proof of Gazette publication and the other chosen publication channel, a public copy of the fee schedule, a register of executed assignments, invoices issued, and records of Aircraft Register entries relied upon.

6. Debt recovery process. Develop an internal process to pursue unpaid fees through civil recovery per s 8, including pre‑litigation notices, timeframes, and escalation to court if necessary, noting that recovery will follow ordinary debt procedures.

Checklist for holders of certificates of registration

1. Verify registration status. Confirm the aircraft’s registration under Part III of the Civil Aviation Regulations and the registered holder’s name on the Aircraft Register, as liability under s 7(1) attaches to the person entered on that register (s 3(1)).

2. Assignment considerations. If intending to delegate liability for specified future use at a specified aerodrome, negotiate a written assignment that is also signed by the aerodrome operator. Ensure copies of executed assignments are lodged with all relevant parties and retained.

3. Commercial contracts. Where operating under leases, charter arrangements or flight training agreements, ensure contracts address who pays statutory fees and the scope of any assignment under the Act, and align contractual terms with the formal assignment required under ss 7(2)-(4).

Checklist for assignees

1. Ensure operator sign‑off. Before relying on statutory assignment, confirm the aerodrome operator has signed the assignment agreement as required by s 7(4). Without that signature the Act does not effect the assignment.

2. Clarify effective period and scope. Ensure the assignment specifies the aerodrome and the future period for which the assignee assumes liability (s 7(3)).

3. Preserve documentation. Keep signed originals, and obtain confirmation of the operator’s fee notices and their commencement dates to calculate the assignee’s exposure.

Practical steps common to all parties

• Check regulations and Gazette notices. Confirm whether regulations exclude particular aerodromes from the Act’s ambit (s 3(1)) or prescribe periodicals for publication (s 6(2)). Updated subordinate instruments may change publication or other procedural requirements.

• Include clarity on late fees. If late payment fees are to be applied under s 6(1)(f), include clear calculation and timing terms in the published fee schedule and in any assignment so chargeability and amount are unambiguous.

• Provide for dispute resolution. Because the Act does not prescribe dispute mechanisms, parties should include contractual dispute resolution, billing and payment timelines to reduce the likelihood of litigation.

• Evidence and timing for litigation. If recovery becomes necessary, collate evidence: the Gazette notice, the second publication channel, the Aircraft Register extract showing the registered holder, invoices and any signed assignment. Start recovery promptly to avoid limitation issues under general civil law.

• Monitor Commonwealth changes. Because the Act cross‑references the Civil Aviation Regulations dynamically (s 3(2)), monitor relevant Commonwealth regulatory changes that could affect registration status or the scope of the Aircraft Register.

Following these steps will align operational behaviour with the Act’s procedural and documentation requirements and reduce the risk of enforcement disputes.
