Adoption Rules 1995

The Rules organise adoption litigation and administrative interaction around a small set of procedural concepts: prescribed forms and format, proof and affidavit requirements, service and proof of service, Registrar responsibilities, and courtroom practice for contested and non‑contentious matters. The main concepts are as follows, with the rule anchors that create them.

1. Prescribed form and document hygiene (r 5(2); Schedule 1 Form 1). The Rules require documents to be legible, printed single‑sided on A4 durable paper, to include a cover sheet in the form of Form 1, to have specified margins and line spacing, and to be sequentially paginated. The Registrar may refuse non‑compliant filings (r 5(2)). The Registrar must mark the date of filing and seal service copies (r 7).

2. Address for service in Western Australia (r 6; Form 2). A person cannot file in adoption proceedings without filing a notice of address for service within the State in the statutory Form 2. The Form requires the address to be within Western Australia (Form 2 note). A change in address is effected by filing and serving a new Form 2 (r 6(2)).

3. Standardised application types and evidentiary minima (r 9, r 11, r 11A, r 12, r 12A, r 12B, Schedule 1 Forms). The Rules prescribe separate forms for general applications (Form 3), adoption orders (Form 4), adoption orders under s 78A (Form 4A), orders under s 136B (Form 4B), and declarations under s 136F (Form 4C). Rule 12 prescribes the affidavit evidence and documents to be filed with an adoption order application, including the requirement that affidavits establish jurisdiction and statutory compliance (r 12(1)(a)(i)-(iv)), and require birth certificates and marriage certificates where relevant (r 12(1)(b)-(c)). The Form 4 note explicitly links to the Act’s requirement for a memorandum of the adoption plan (s 62 of the Act).

4. Service modalities and presumptions (r 23, r 25, r 26, r 27). The Rules allow personal service, post to last known address where no address for service is filed, leaving or posting to the filed address for service, facsimile transmission, use of document exchange boxes, and other Court‑directed methods (r 23). An acknowledgement of service (Form 6) establishes proof of service unless the contrary is proved (r 25). Postal and facsimile presumptions are established in r 26.

5. Timetabling and disposition of non‑contentious business (r 14, r 15). Non‑contentious applications may be dealt with in chambers and in the absence of parties (r 14), and where the Court directs that a hearing be held the Registrar must give not less than 28 days’ notice to those entitled to be heard, unless the Court directs otherwise (r 15).

6. Compelled evidence and witness logistics (r 28, r 29). The Registrar is to issue witness summonses at the Court’s direction or on request and must tender reasonable return travel money upon service (r 28(1)-(4)). Non‑compliance without reasonable excuse is an offence carrying a $1,000 fine (r 29).

7. Administrative recording and inter‑agency flow (r 31, r 32). The Registrar must keep a register of applications and orders (r 31), mark filings and seal service copies (r 7), and supply copies of orders and notices to the CEO as specified (r 32).

8. Judicial discretion and exemptions (r 3). The Court may exempt any person from compliance with procedural requirements of the Rules, in whole or subject to conditions, if it would be just to do so (r 3).

9. Procedural cross‑references to the Adoption Act (multiple rules). The Rules operate as procedural adjuncts to the Adoption Act by requiring affidavit proof of compliance with specific statutory provisions (for example, s 68, s 69, s 78A, s 62 and s 133), and by creating forms and processes for statutory mechanisms such as recognition/non‑recognition of overseas adoptions (Forms 4A, 4C) and termination of legal parent-child relationships in simple adoptions (Form 4B; r 12C table).

Collectively these concepts convert statutory conditions and judicial case management into a consistent court process: standard filing practices, defined evidence packs, clarified service and proof rules, and defined Registrar duties for record keeping and inter‑agency notification.

These Rules affect the parties and participants in adoption proceedings under the Adoption Act 1994 conducted in the Family Court of Western Australia, and a small set of institutional actors. The principal affected actors are:

• Prospective adoptive parents and applicants. Anyone applying for an adoption order must prepare and file applications using the prescribed forms (Form 4, Form 4A for s 78A matters) and must supply the affidavit evidence and documentary materials required by rule 12. Joint prospective adoptive parents must file a marriage certificate if joint adoption is proposed (r 12(1)(c); Form 4). Applicants must also file a notice of address for service within Western Australia (r 6(1); Form 2).

• Respondents and other persons entitled to be heard. Persons entitled to be heard in adoption proceedings must be served with a sealed copy of the application and supporting affidavits as the Court directs (r 13). If a person is to be served, they may be served by personal service, post, service to a filed address for service, fax, or other Court‑directed methods (r 23). A person served may sign an acknowledgment of service (Form 6), which, unless disproved, is conclusive for service purposes (r 25).

• Legal practitioners. Lawyers representing parties are responsible for ensuring compliance with the format and content rules (r 5(2)), completing and filing Form 2 for address for service where they act for a party, and may sign acknowledgements of service on behalf of clients (r 25(2)). Where a legal practitioner signs an acknowledgment of service, the filing is taken as proof that service was effected in accordance with the rules (r 25(4)).

• The Registrar and Registry staff. The Registrar has multiple operational duties: to mark the date of filing and seal service copies (r 7), to refuse to accept non‑compliant documents (r 5(2)), to serve hearings notices (r 15), to issue witness summonses at the Court’s direction and upon request (r 28), to keep a register of applications and orders (r 31), and to supply copies of orders and certain notices to the CEO (r 32). The Registrar is the primary gatekeeper for procedural compliance.

• The CEO (agency recipient). The Rules require the Registrar to give the CEO copies of orders for adoption and discharge orders, notice of s 83(1) applications that seek to prevent the CEO authorising access to information, and copies of orders made under s 136B or s 136F (r 32). The Rules therefore establish a formal information flow from Court to the CEO.

• Witnesses and third parties. Witness summonses may be issued under r 28 and must be personally served or served as the Court directs. The server must tender sufficient money for the witness’s return travel at the time of service (r 28(4)), and witnesses who refuse without reasonable excuse commit an offence punishable by a fine not exceeding $1,000 (r 29).

• Out‑of‑State or overseas parties. The Rules require an address for service within Western Australia (r 6(1); Form 2 note: “address must be within Western Australia”), which imposes a particular procedural requirement on out‑of‑State or overseas applicants and parties. The Court’s post service presumptions for overseas mail are stated (r 27(1)(b): receipt presumed 28 days after posting).

• The Family Court’s administrative system and, indirectly, state agencies responsible for adoption records and interjurisdictional recognition. The rules’ record and notice requirements (r 31, r 32) structure inter‑agency interactions and the Court’s internal records.

Non‑compliance consequences affect the above groups differently: the Registrar may refuse non‑compliant filings (r 5(2)); parties may face delays due to service or filing defects; witnesses face a $1,000 penalty for non‑compliance with summonses (r 29); and the CEO will receive defined notifications which can influence administrative records and access decisions (r 32).

The Rules allocate discrete procedural duties to parties, legal practitioners, the Registrar, and witnesses, and establish procedural rights and presumptions which parties can invoke. The principal duties and rights under the Rules, with their rule references, are as follows.

Duties of parties and applicants

• File a notice of address for service within Western Australia with filings (r 6(1); Form 2). If acting through a legal practitioner, the practitioner’s details must appear on the cover sheet (r 5(2)(c)).
• Comply with format and document standards: A4 durable paper, single‑sided, with specified margins and spacing, cover sheet in Form 1, and page numbering; otherwise the Registrar may refuse to accept the document for filing (r 5(2)(a)-(e); Schedule 1 Form 1).
• Ensure that an application for an adoption order is accompanied by the prescribed affidavit evidence and documents: affidavits proving jurisdictional and statutory preconditions (r 12(1)(a)(i)-(iv)), the prospective adoptee’s birth certificate (r 12(1)(b)), and the marriage certificate if adoption by two persons jointly is proposed (r 12(1)(c)). If an adoption plan is required by the Act (s 62), a written memorandum of the adoption plan must accompany the application or a separate application to dispense with it must be made (Form 4 note).
• Serve sealed copies of applications and supporting affidavits on persons the Court directs (r 13), following the permitted modes of service (r 23).

Rights and procedural presumptions for parties

• Right to be heard: the Registrar must give not less than 28 days’ notice for hearings (r 15), unless the Court directs otherwise. This provides a minimum notice right to persons entitled to be heard.
• Non‑contentious applications may be determined in chambers and, subject to s 133 of the Act, in the absence of parties (r 14), which means parties have the right to request or be subject to a more summary disposition for non‑contentious matters.

Duties and powers of the Registrar and Court

• Power to refuse non‑compliant filings (r 5(2)).
• Duty to mark the date of filing and to ensure service copies bear the Court seal (r 7).
• Power and duty to issue witness summonses at the Court’s direction and upon request, in Form 7 (r 28(1)-(3)).
• Duty to keep a register of applications and orders (r 31), and to give the CEO specified copies and notices (r 32).
• Discretion to direct how documents are served when the Rules do not provide a time or manner (r 22; r 23(d); r 27(1)(a)-(b) for Court‑sent documents).

Witness duties and protections

• Duty to comply with a witness summons unless there is reasonable cause or excuse (r 29). The burden of proving reasonable cause/ excuse lies on the witness.
• On personal service of a witness summons, the server must tender sufficient money for the witness’s return travel between residence or employment and the Court (r 28(4)).

Service and proof rules and evidentiary effects

• An acknowledgment of service in Form 6 signed by the person served, unless disproved, is taken to establish that service has been effected as stated (r 25(3)). If signed by a legal practitioner for the person, the filing of the acknowledgment is taken as proof that service has been effected (r 25(4)).
• Postal service in accordance with r 23(c)(ii) is presumed to be effected when the document would ordinarily be delivered in the post (r 26(1)); facsimile transmission is presumed effective upon completion of transmission unless the recipient proves non‑receipt or illegibility (r 26(2)).
• Court‑sent documents are to be posted by pre‑paid first class airmail; delivery presumptions differ by domestic and overseas destinations (r 27(1)(a)-(b)). The Registrar must seal Court‑sent documents in envelopes marked “Private and Confidential” (r 27(2)).

Right of exemption and Court discretion

• The Court may exempt any person from compliance with any procedural requirement of the Rules, either wholly or subject to conditions, “if it would be just to do so” (r 3). This is a broad discretionary safety valve applying to procedural compliance.

Penalties and compliance enforcement

• The Rules create an offence for failure or refusal to comply with a witness summons without reasonable cause, punishable by a fine not exceeding $1,000 (r 29). The Rules also provide that a warrant may issue for a defaulting witness (Form 7 text; r 28(4) & r 29).

Administrative duties to other agencies

• The Registrar must provide a copy of orders made in relation to each application for an adoption order and each application for discharge of an adoption order, and notice of s 83(1) applications, and copies of orders under s 136B or s 136F to the CEO (r 32). This creates an administrative duty to communicate Court determinations to an executive office.

These duties and rights structure the basic access, proof, service, recording and enforcement mechanics in the Court’s handling of adoption matters, while preserving judicial discretion (for exemptions, directions on service, and management of hearings).

The Rules themselves create a narrowly focussed enforcement architecture with two primary enforcement tools: (a) administrative gatekeeping by the Registrar in relation to document format and filing; and (b) a criminal penalty for non‑compliance with witness summonses, supplemented by Court coercive powers for contempts and warrants. The Rules’ enforcement provisions are set out as follows.

Registrar administrative enforcement

• The Registrar may refuse to accept for filing any document which does not comply with the formatting and filing specifications in rule 5(2). This is a preventative enforcement mechanism: the Registrar can deny entry to the court file for non‑complying documents (r 5(2)). The Registrar also has an ongoing role ensuring filings are properly dated and sealed (r 7).

Court and Registrar compulsion over evidence

• The Rules empower the Registrar to issue witness summonses at the Court’s direction and upon request from a party (r 28(1)-(3)). The Rules prescribe that on service of the summons the server must tender sufficient money for the witness’s return travel (r 28(4)). The Rules’ text of Form 7 includes potential consequences of non‑compliance: a warrant may issue for the person’s arrest and a fine not exceeding $1,000 may be imposed (Form 7 text; r 28 and r 29).

Criminal sanction for witness non‑compliance

• Rule 29 establishes an offence for failing or refusing to comply with a witness summons without reasonable cause or excuse. The penalty is a fine of $1,000. The burden of proof for the reasonable excuse lies on the person who failed or refused to comply (r 29). The Rules thus establish a statutory fine for witness defiance that is modest in quantum but backed by the Court’s coercive powers (warrants).

Service and evidentiary presumptions

• The Rules provide evidentiary presumptions that are operationalised as de facto enforcement tools: an acknowledgement of service in Form 6 signed by the person served is taken to be conclusive that service was effected unless disproved (r 25(3)); a legal practitioner’s signature on an acknowledgment is treated as proof that service has been effected (r 25(4)); postal and facsimile transmission presumptions under r 26 determine the operative starting points for procedural time limits and are therefore enforcement‑relevant in time‑sensitive proceedings.

Court discretion to manage non‑compliance

• Where a hearing has commenced, the filing of additional documents requires leave and compliance with any directions given by the Court (r 5(3)). The Court also has general power to direct other manners of service (r 23(d)) and to vary notice periods (r 15). The Court’s power to exempt persons from procedural requirements (r 3) also allows it to manage strict enforcement where justice requires.

Administrative notification obligations

• Rule 32 requires the Registrar to forward copies of orders and particular notices to the CEO. This creates an administrative enforcement dynamic: orders and certain applications are communicated to the executive arm that handles records and access, potentially triggering downstream administrative actions (for example, changes to state records or access permissions). The Rules themselves, however, do not prescribe administrative sanctions beyond the fine for witness non‑compliance.

Limitations and enforcement boundaries

• The Rules do not set fees or civil monetary penalties for procedural non‑compliance with filing format beyond the Registrar’s ability to refuse filing. They do not prescribe enforcement for failure to file a notice of address for service beyond not being able to file (r 6(1)). Substantive remedies or penalties for non‑compliance with the Adoption Act itself are matters of that Act rather than these Rules.

In short, the Rules rely mainly on administrative gatekeeping, evidentiary presumptions, and a small criminal provision ($1,000 fine for witness non‑compliance) to enforce procedural compliance. The Registrar and Court’s discretions are the principal instruments for managing departures from the Rules.

The Adoption Rules do not operate in isolation. They are expressly made under section 142 of the Adoption Act 1994 and are designed to be procedural implements of the substantive Adoption Act provisions which they reference. The compilation Note (item 2) explicitly provides a ladder for procedural gaps: where these Rules do not make provision, the Family Court Act 1975 rules most nearly applicable shall apply, and if none such, then the Family Law Act 1975 rules of the Commonwealth that are most nearly applicable shall apply. The practical interactions are as follows.

Direct cross‑references to the Adoption Act

• The Rules require affidavit evidence proving compliance with specific sections of the Adoption Act: s 68(1) and (2) (referred to in r 12(1)(a)(ii)) for child adoption applications, s 69(1) for adult adoptions (r 12(1)(a)(iii)), s 78A(2)(a)-(e) for applications under s 78A (r 12(1)(a)(iv) and r 11A), and references to s 62 regarding the adoption plan in the Form 4 note. The Rules therefore operationalise procedural steps necessary to establish compliance with statutory preconditions. The Rules also create forms (Form 4B and Form 4C) linked to s 136B and s 136F respectively and r 12C’s table connects those provisions to the defined procedural pathway.

Interaction with procedural content in the Adoption Act

• Where the Adoption Act requires records or particular orders (for example, orders to prevent the CEO giving authority in relation to access to information under s 83(1)), the Rules require the Registrar to notify the CEO of such applications (r 32(b)). The Rules thus establish a mechanism to feed Court outcomes into the administrative processes governed by the Adoption Act and the executive agency responsible for adoption records.

Fallback to Family Court Act 1975 and Family Law Act 1975 procedural rules

• The compilation Note clarifies that the Rules sit in a procedural hierarchy. If the Adoption Rules are silent on a matter, court practice rules under the Family Court Act 1975 that are most nearly applicable apply, and if none, Family Law Act 1975 rules apply. This creates a mechanism for procedural cross‑fertilisation and fills potential gaps in practice, ensuring that existing family law procedural frameworks and precedents can be drawn upon for matters not expressly covered by the Adoption Rules.

Interagency administrative law effects

• The Rules’ obligation to provide copies of orders to the CEO (r 32) produces an interaction with administrative law and internal agency decision‑making: the CEO will receive judicial orders and notices that may affect record keeping, access to adoption information, and interjurisdictional recognition processes. The Rules do not specify the CEO’s consequent actions; those are governed by the Adoption Act and related administrative instruments.

Postal, telecommunications and evidence rules

• The Rules create evidentiary presumptions regarding post and facsimile service (r 26; r 27). These presumptions interact with statutory limitation periods, jurisdictional time frames in the Adoption Act, and any relevant general evidence law or rules under the Family Court Act or Family Law Act that govern the timing of steps and the validity of service. They therefore import common administrative law concepts on notice and service into adoption procedures.

Coercive powers and criminal procedure

• The Rules’ provision for a fine (r 29) and for the Court to issue warrants on witness default (Form 7 text) link their procedural enforcement to general criminal and contempt powers of the Court. The Rules do not displace broader statutory or common law powers available to the Court under the Adoption Act, Family Court Act, or general Court practice.

International instruments and the Hague framework

• The Forms and rules reflect interaction with international adoption recognition frameworks. Form 4A expressly references Convention countries for adoptions of an Australian child to live in a Convention country (Form 4A text), and Form 4C relates to Hague Convention Article 27 decisions by a State Central Authority. The Rules therefore function at points of intersection between domestic adoption procedure and international adoption recognition frameworks, although the Rules do not themselves restate the substantive international obligations.

In summary, the Rules are procedural extensions of the Adoption Act, designed to work with the Court’s general family law practice rules under the Family Court Act and federal Family Law Act where gaps exist. They create specific, administrative interactions with the CEO and accommodate international adoption recognition processes. The Rules therefore form part of a layered procedural and administrative legal architecture linking domestic statutory conditions, court practice, and administrative follow‑up.

The Rules have been amended repeatedly since their original gazettal. The compilation table in the instrument provides the authoritative history of amendments and reprints. Key chronological points:

• Original adoption: The Adoption Rules 1995 were gazetted on 19 January 1995 and commenced on the same date (Adoption Rules 1995, Gazette 19 Jan 1995, p. 179-99). The Rules were made under s 142 of the Adoption Act 1994 (Notes, item 2).

• First amendment round: Adoption Amendment Rules 1995 (gazetted 5 December 1995) introduced early changes including removal or modification of certain forms (Form 5 deleted in a later amendment entry; see Schedule 1 notes).

• 2000 amendments: Adoption Amendment Rules 2000 were gazetted 21 March 2000 (and corrected 24 March 2000). These amendments inserted several new forms and rules: notably Forms 4, 4A, 4B, and 4C, and rules r 11A, r 12A, r 12B, and r 12C were introduced or adjusted at or around this time (Schedule 1 and r numbering indicate insertion dates and the Gazette references in the Schedule). The 2000 amendments also amended Rule 2 (interpretation) to confirm that “affidavit” includes exhibits (r 2 amended: Gazette 21 Mar 2000 p. 1496).

• 2002 amendments: Adoption Amendment Rules 2002 (gazetted 17 September 2002; commencement 21 September 2002) and Adoption Amendment Rules (No. 2) 2002 (gazetted 12 November 2002) made further changes. Form 4B was amended in September 2002 (see Form 4B insertion and later amendment references).

• 2003 amendments: Adoption Amendment Rules 2003 were gazetted 20 June 2003 and effected changes to rule 5 and other procedural details (r 5 amended: Gazette 20 Jun 2003 p. 2236).

• 2012/2013 amendments and reprint: Adoption Amendment Rules 2012 were gazetted 29 January 2013 and commenced immediately for r 1 and r 2, and on 30 January 2013 for the remaining rules (Notes). The reprint as at 1 August 2003 (Reprint 1) is noted in the compilation table, and subsequent amendments up to 29 January 2013 are included in later reprints/compilations.

The Schedule indicates discrete amendments to particular rules and forms with Gazette references: rule 2 (interpretation) amended 21 March 2000; rule 5 amended multiple times (2000, 2003); r 8, r 31 and r 32 amended 29 January 2013; r 12C inserted 21 March 2000; and Schedule 1 forms were added and modified across the 2000-2013 amendment rounds (Schedule 1 amended: Gazette 5 Dec 1995; 21 Mar 2000; 17 Sep 2002; 20 Jun 2003). The explicit dates and Gazette page references in the compilation table are the legislative record: Gazette entries and commencement dates are the source of amendment timing.

The amendment pattern shows iterative refinement: new forms and specific procedural rules were added (especially in 2000 around Hague Convention and interjurisdictional adoption matters), formatting and filing standards tightened, and deletion or consolidation of older forms occurred (for example, Forms 5 and 8 deleted by Gazette entries). The Notes also record that the Rules are made by Judges under s 142 and that the Act prescribes the fallback procedure where these Rules are silent (Notes item 2). Practitioners must consult the most recent consolidated/reprinted Rules and the Gazette amendment history for precise, operative wording, as the Schedule indicates multiple incremental changes.

The Adoption Rules 1995, as reproduced in the provided instrument, do not include citations to case law, judicial decisions, or reported litigation testing the Rules themselves. The Rules are procedural, and the instrument’s textual content and compilation notes make no reference to specific litigation or appellate treatment. Therefore, based on the source provided:

• There are no cases named in the Rules; the Rules do not include any statutory notes citing judicial decisions or interpretative authority.

• The Rules expressly state they are made by the Judges of the Family Court under s 142 of the Adoption Act 1994 (Notes, item 2). That provision contemplates that in the absence of a specific rule, Family Court Act 1975 or Family Law Act 1975 rules will apply, which means litigation addressing procedural points might instead arise under those general rules or in the Family Court’s broader jurisprudence.

• Practitioners seeking litigation history that specifically interprets or challenges these Rules will need to search Family Court decisions and reported decisions that reference the Adoption Rules, s 142 or the specific rules cited (for example, r 5 refusals, r 6 address‑for‑service disputes, r 23 service issues, r 29 witness non‑compliance penalties, or r 32 information flow to the CEO). Such searches are necessarily external to the Rules instrument itself.

Practical implications for research

• Because the Rules do not append or summarise case law, determining whether particular rules have been judicially tested requires independent jurisprudential research. For example, disputes over whether the Registrar lawfully refused to accept a non‑compliant filing under r 5(2), or whether a Court properly exercised its discretion under r 3 to exempt a party from a procedural requirement, would be matters litigated in the Family Court and reported (if at all). The instrument itself provides no litigation history.

• Similarly, questions of the evidentiary effect of acknowledgments of service (r 25), the presumption as to facsimile or postal service (r 26), or the adequacy of tendering travel money under r 28(4) may have been litigated. The Rules do not catalogue such litigation.

Recommendation for practitioners

• If litigation history is material, undertake a targeted case law search for Family Court of Western Australia decisions that cite the Adoption Rules by rule number or refer to the Registrar’s duties under r 5/r 7, service disputes under r 23/r 26/r 25, witness summons enforcement under r 28-29, or notification obligations under r 32. Also search for appellate treatment of s 142 rule‑making and its interaction with Family Court Act practice rules, as noted in the compilation notes.

In short, the Rules themselves are silent on precedent; establishing litigation history requires external case law research in Family Court decisions and possibly appellate courts, none of which are listed in this instrument.

The Rules include several traps for the unwary that create procedural risk and practical friction. The following are concrete pitfalls that practitioners, applicants, witnesses, and Registry staff should note, with rule pointers.

1. Format and Registrar refusal (r 5(2)). Documents that are not A4, single‑sided, printed and legible, with the prescribed margins and line spacing, a cover sheet in Form 1 and page numbers may be refused for filing. This is an absolute gatekeeper risk: a late‑hour file that fails formatting may be rejected and require re‑filing, causing delay. The “unless impracticable” caveat exists, but “impracticable” is a fact‑sensitive exception and the Registrar’s power to refuse remains.

2. Address for service must be within Western Australia (r 6(1); Form 2). The Form 2 explicit note states “address must be within Western Australia”. Applicants and respondents who live interstate or overseas must ensure they have an address for service in WA or an agent with such an address; failure to lodge a WA address will prevent filing. Changing the address requires filing and serving a new Form 2 (r 6(2)).

3. Filing after hearings commenced requires leave (r 5(3)). Once a hearing has started, additional material cannot be filed without leave and in the manner directed by the Court. Parties must plan their evidentiary bundles carefully to avoid post‑hearing exclusion.

4. Strict evidentiary checkboxes (r 12). Applications for adoption orders must accompany affidavit evidence satisfying the Court that it has jurisdiction and that statutory preconditions (s 68/s 69/s 78A as applicable) have been met, plus the birth certificate and, if joint adopters are proposed, a marriage certificate (r 12(1)(a)-(c)). There is also a Form 4 note about filing a written memorandum of the adoption plan (s 62). If any required statutory compliance is not evidenced, the application risks being delayed or dismissed.

5. Different forms for different statutory mechanisms (r 11, r 11A, r 12A, r 12B). Using the wrong form undermines procedural compliance (for example, Form 4A for s 78A matters, Form 4B for s 136B orders relating to simple adoptions, Form 4C for s 136F declarations). Check the Act’s section referenced in the rule to select the correct form.

6. Service by facsimile and postal presumptions (r 23(c)(iii), r 26). Service by fax is taken to be effected upon completion of transmission unless the recipient later establishes non‑receipt or illegibility. Postal service is presumed to be effected when delivery would ordinarily occur. Practitioners must keep transmission confirmations and evidence of postal dispatch because these presumptions can be rebutted only with proof.

7. Acknowledgment of service signed by legal practitioner is strong evidence (r 25(4)). Where a legal practitioner signs Form 6 on behalf of their client, that filing is taken as proof of service. If a client later claims they were not served, the acknowledgment by the lawyer is a difficult evidentiary hurdle.

8. Witness logistics and tender of travel money (r 28(4)). The person effecting service of a witness summons must tender sufficient money for return travel when serving the witness. Failure to tender may expose the server or issuing party to practical enforcement problems and possible argument about the validity of the service.

9. Penalty for witness non‑compliance is modest but enforceable (r 29; Form 7 text). A fine not exceeding $1,000 applies for failing to comply with a summons without reasonable excuse. The modest monetary amount may not be an effective deterrent in all cases; however, the Court retains power to issue warrants.

10. Court discretion to exempt (r 3). While the Court can exempt parties from procedural requirements where just, relying on s 3 is risky because it requires demonstrating justice in the individual case and is not a predictable remedy for systemic non‑compliance.

11. Registrar’s obligation to notify the CEO (r 32). Orders and certain applications must be notified to the CEO; parties may not appreciate that Court orders will be copied to an executive office and that this may trigger administrative consequences in records and access to information. Practitioners should consider the downstream administrative effects when litigating orders that affect records or access.

12. Timing implications for overseas parties (r 27(1)(b)). The Rule presumes overseas mail is received 28 days after posting. Where time is important, this presumption can generate significant delay; parties should plan with longer posting lead times in mind.

13. Non‑contentious applications may be decided without parties (r 14). If a matter is non‑contentious and the Court treats it as such, it can be handled in chambers and in absence of parties. Parties who think a matter is non‑contentious but who wish to be heard must take steps to prevent summary disposition.

14. Register entries and public record considerations (r 31). The Registrar keeps a register of applications and orders. Practitioners should be cautious about confidentiality and understand what becomes part of the register and what flows to the CEO under r 32.

These are concrete procedural risks. Attention to the specific rule numbers and prescribed forms mitigates most of them.

This section is a practical compliance checklist and procedural roadmap for parties, practitioners, and Registry staff dealing with adoption proceedings under the Adoption Rules 1995. Each numbered step cites the primary rule(s) to follow.

1. Determine the correct type of application and form

• Identify the statutory basis of the application under the Adoption Act (for example, ordinary adoption order, adoption order under s 78A, order under s 136B, declaration under s 136F). Use Form 4 for ordinary adoption orders (r 11), Form 4A for s 78A applications (r 11A), Form 4B for s 136B orders (r 12A), Form 4C for s 136F declarations (r 12B), and Form 3 for general applications other than these (r 9).

2. Prepare documents in the required format and include the Form 1 cover sheet

• Format every document per r 5(2): legible and printed or copied by machine on one side only of durable A4 paper; include the cover sheet headed in the form of Form 1 with a short description of the document and contact details (r 5(2)(a)-(c)); maintain approximately 30mm margins and 6mm line spacing (r 5(2)(d)); paginate each page (r 5(2)(e)). Non‑compliant documents may be refused (r 5(2)).

3. File a notice of address for service in Western Australia (Form 2)

• File Form 2 at the time of lodging the application, and ensure the address is within WA as required by Form 2 (r 6(1); Form 2 note). If the party’s address changes, file a new Form 2 and serve sealed copies on other parties (r 6(2)).

4. Assemble affidavit evidence and supporting documents

• For adoption order applications, lodge affidavit evidence that establishes jurisdiction and compliance with relevant statutory sections (r 12(1)(a)(i)-(iv)). Attach required documents: the prospective adoptee’s birth certificate (r 12(1)(b)), and, if the adoptee is to be adopted by two persons jointly, the marriage certificate of the prospective adoptive parents (r 12(1)(c)). For applications invoking s 78A, ensure affidavits address s 78A(2)(a)-(e) (r 12(1)(a)(iv)). For simple adoption termination orders or recognition declarations, use Form 4B/4C and file the evidence specified in r 12C.

5. File the application and supporting affidavits in a sealed envelope addressed to “Adoptions Officer”

• Deliver filings to the Court in a sealed envelope addressed to the “Adoptions Officer” (r 5(1)). Ensure the Registrar will be able to mark the filing date and seal service copies (r 7).

6. Serve sealed copies of the application and supporting affidavits as directed by the Court

• Follow r 23 for permitted service methods: personal service; posting to last known address if no address for service filed; leaving, posting, faxing, or document exchange where an address for service has been filed; or other methods directed by the Court. If using post under r 23(c)(ii), include a return acknowledgment form (Form 6) to be signed by the recipient.

7. Use acknowledgements and keep proof of service

• Ask recipients or their legal practitioners to sign Form 6 (r 25). Keep proof of postage and facsimile transmission confirmations because r 26 presumes service upon ordinary postal delivery times or completion of fax transmission, and these presumptions can be rebutted only with proof.

8. Comply with witness summons procedures if evidence must be compelled

• If you require a witness, request a witness summons from the Registrar or have the Court direct issuance (r 28(1)-(3)). Serve the summons personally unless the Court directs otherwise (r 28(3)) and tender sufficient return travel money at the time of service (r 28(4)). Be aware of the $1,000 penalty for non‑compliance without reasonable cause (r 29).

9. Be mindful of timelines and notice periods for hearings

• If the Court directs a hearing, the Registrar must give not less than 28 days’ notice to persons entitled to be heard unless otherwise ordered (r 15). Factor statutory and procedural timeframes into your schedule, especially where overseas posting is used (r 27(1)(b) presumes 28 days for overseas mail receipt).

10. File adoption plan memorandum if required by s 62 of the Act

• For child adoption applications the Act requires a written memorandum of the adoption plan. Form 4 notes that a memorandum of the adoption plan is to be filed unless an application will be made for the Court to dispense with the requirement (Form 4 note referencing s 62). Ensure the adoption plan memorandum is prepared or include an application to dispense with it.

11. Prepare separate applications and affidavits for ancillary orders

• If seeking orders under s 71 or s 73 of the Adoption Act at the hearing of the adoption order, prepare a separate application and separate affidavit evidence for those orders (r 12(2)(a)-(b)).

12. Anticipate Registrar administrative duties and CEO notifications

• The Registrar will keep a register of applications and orders (r 31) and will provide copies of orders and certain notices to the CEO (r 32). When drafting orders or settlements, consider whether copies will be forwarded to the CEO and whether that might trigger subsequent administrative action.

13. Plan for exemptions only as contingency

• If procedural compliance is impossible in the circumstances, seek the Court’s exemption under r 3; exemption is discretionary and will require an argument that it would be just to do so.

14. Use the Family Court Act or Family Law Act rules when the Adoption Rules are silent

• Remember the compilation note: where a matter is not provided for by these Rules, the Family Court Act 1975 rules most nearly applicable apply, or, if none, the Family Law Act 1975 rules apply (Notes, item 2). Be prepared to rely on those procedural rules for gap matters.

15. Maintain documentary evidence for rebutting service presumptions

• Retain mailing receipts, transmission logs and signed acknowledgements. If service is contested, be prepared to produce the objective evidence necessary to rebut the other side’s claims because r 25 and r 26 invert the burden in certain cases.

Checklist summary (minimum items to file on a typical adoption application):

• Correct Form (Form 4/4A/4B/4C) completed and signed (r 11, r 11A, r 12A, r 12B).
• Form 1 cover sheet attached to each filed document (r 5(2)(c); Schedule 1 Form 1).
• Form 2 notice of address for service in WA filed (r 6(1); Form 2).
• Affidavit evidence addressing jurisdiction and statutory preconditions (r 12(1)(a)(i)-(iv)).
• Birth certificate of prospective adoptee attached (r 12(1)(b)).
• Marriage certificate where joint adoption is proposed (r 12(1)(c)).
• Adoption plan memorandum filed, or application to dispense with it (Form 4 note; s 62 of the Act).
• Sealed envelope addressed to “Adoptions Officer” for filing (r 5(1)).
• Service copies ready for personal service/post/fax/document exchange as appropriate (r 23).
• Proofs of service and acknowledgements collected (r 24, r 25).

Following these steps and referencing the specific rule numbers reduces the risk of procedural rejection, service disputes, or delays. Where practice is uncertain, seek directions from the Court early, and if exceptional circumstances exist, apply for exemption under r 3 before risking non‑compliance.
