72 Secrecy to be observed (1) Subject to this Act, a person must not, directly or indirectly, except in the performance of the person's duties, or in the exercise of the person's powers or the performance of the person's functions, under this Act (while the person is holding or after the person has ceased to hold the relevant office or designation), make a record of, or disclose or communicate to any person, information in respect of the affairs or identity of another person (whether living or dead), acquired by the person in the performance of the person's duties or in the exercise of the person's powers or the performance of the person's functions under this Act. Maximum penalty: 40 penalty units. (2) This section does not apply where a person: (a) is required to produce a document that has come into the person's possession or under the person's control in a court; or (b) is required to disclose or communicate a matter or thing that has come to the person's notice or is within the person's knowledge to a court; or (c) discloses information or records to a person to whom the information or records relate or to a person who, in the opinion of the Minister, is expressly or impliedly authorised to obtain the information or records by the person to whom the information relates; or (d) discloses information or records in connection with the administration of this Act or for a purpose or to a person that the Minister directs.
