Adoption (General) Regulations 2018

The regulations revolve around a small number of interlocking administrative and substantive concepts. The Prospective Adoptive Parents Register and subregisters (r 7) form the central administrative device used to queue potential adoptive parents and to set selection order (r 19). Subregisters may be organised by characteristics of children, age, sex, racial origin or special needs (r 7(2)-(3)). The register is explicitly non‑public (r 7(6)), meaning access is controlled by the Chief Executive and limited to administrative and statutory purposes.

Suitability and assessment are core substantive concepts. An assessment report is required for registration (r 10(1)) and, where the applicant participates, must evaluate a comprehensive list of factors: parenting skills, capacity to provide for a child’s physical, intellectual and emotional welfare, health, emotional stability, economic position, criminal record, childhood experiences, attitudes to adoption and discipline, and capacity to manage special needs or cross‑cultural issues (r 10(3)-(4)). The Chief Executive can rely on assessment reports prepared by adoption agencies if satisfied they comply with these requirements (r 10(6)), and may decline to prepare or complete an assessment in particular circumstances such as the person not being resident in the State or failing to participate (r 10(2)).

Eligibility and exclusion rules are another major concept. Minimum requirements for applicants include State residence or domicile, permanent residency in Australia, and Australian citizenship (or at least one applicant being a citizen for joint applications) (r 9(1)). Exclusions are detailed and include prior cancelled registration for having been improperly obtained, being a "prohibited person" under the Child Safety (Prohibited Persons) Act 2016, or convictions as an adult for certain child‑related offences (r 9(2)). Applicants for overseas subregisters must also meet foreign legal minimums for adoption by an Australian resident (r 9(4)). The interpretative rule in r 3(2) expands the notion of "convicted" to include certain findings under the Criminal Law Consolidation Act 1935 Part 8A or corresponding findings in other jurisdictions, affecting eligibility assessments.

Administrative discretion and process control are central. The Chief Executive decides whether to invite expressions of interest to apply (r 8(3)-(5)), has discretion to accept late renewals (r 14(3)), to require further information, workshops, medical reports or authorisations (r 16), and may cancel registrations under a range of triggers (r 15). The Chief Executive also determines the order in which names are entered and the applicability of various exclusions to selection for a particular child (r 7(4-5), r 19(2)-(3)). Tribunal oversight exists but is bounded by time limits and specific exclusions (r 17; r 15(12) limits review for some cancellations).

Cultural preservation and contact obligations are reflected in the Aboriginal and Torres Strait Islander Child Placement Principle. Regulation 4 sets a hierarchy of placement preference for Aboriginal and Torres Strait Islander children, family, community member with responsibility, community member, or a person of Aboriginal or Torres Strait Islander cultural background, and requires provision for continuing contact with family, community or culture when placement in that order is not possible or not in the child's best interests (r 4(a)-(b)). The regulation explicitly ties cultural determinations to Aboriginal or Torres Strait Islander customary law.

Procedural protections and evidentiary presumptions are present. Consent counselling and the required brochure content (r 5), witnessing requirements and forwarding obligations (r 6), the Chief Executive's obligation to give written reasons for registration decisions and to inform applicants of review rights (r 11(5)-(6), r 14(11)-(12), r 15(10)-(11)), and evidentiary rules that treat apparently genuine consents or documents bearing official signatures as valid in the absence of proof to the contrary (r 26) are all intended to streamline administration and litigation. Criminal penalties attach to false or misleading statements in applications or renewals (r 25; maximum $5,000) and to failure by a registrant to notify cancellation‑liability within 28 days (r 15(6); maximum $5,000).

The concept of overseas adoptions is treated pragmatically. The regulations create an overseas subregister (r 7), require compliance with overseas legal minima (r 9(4)), and prescribe a two‑stage selection and documentation forwarding process for overseas children (r 19(5)). The Chief Executive must respect foreign legal requirements and the administrative timing and sequencing those requirements create.

Collectively, these concepts , register, assessment, eligibility, Chief Executive discretion, Tribunal review, cultural placement priorities, evidentiary presumptions and overseas compliance , structure how adoptive applicants progress from expression of interest to selection and possible adoption, and how the State supervises that progress.

The regulations affect several distinct groups and offices by name and function. First, prospective adoptive parents and couples who are considering adoption are the primary subjects. They are subject to eligibility criteria (residence/domicile, permanent residency, citizenship,r 9(1)), must submit expressions of interest and may be invited to apply (r 8), undergo assessment reports (r 10), may be registered on subregisters for specific kinds of children (r 7), and must comply with ongoing notification duties and renewal rules (r 14, r 15). Joint applicants are specifically addressed: couples living together in a "qualifying relationship" who intend to apply must apply jointly (r 8(6)), and single registrations that convert to joint registration are treated as if they were joint applications (r 13).

Adoption agencies approved under the Act are implicated as entities that may prepare assessment reports the Chief Executive can rely upon (r 10(6)). That gives adoption agencies a practical role in evaluations, and therefore influences their workload and potential contractual or operational relationships with the administrative unit.

The Chief Executive is the central decision‑maker under these regulations. The Chief Executive controls invitations to apply (r 8(3)-(5)), causes or accepts assessment reports (r 10), decides on registration, renewal and cancellation (rr 11, 14, 15), may invite or require specific additional information or participation in workshops (r 16), and administers fees, including permitting instalments or waivers (r 24A). The Chief Executive’s delegates and persons in equivalent offices in other States or Territories are given roles in evidentiary presumptions (r 26(2)-(3)).

Courts and the Registrar of Births are affected in procedural ways. The Court must notify the Registrar when it makes adoption orders, when it declares the adopted child’s name, or when it discharges an adoption order (r 22). The Registrar then provides extracts from the register of births that may include adoptive parents’ names in accordance with the wishes of the person requesting the extract (r 23(1)-(2)).

Legal practitioners who represent parties under 18 in adoption proceedings are expressly addressed (r 20). The regulation imposes a set of duties when representing such parties , to the extent consistent with the practitioner’s duty to the Court , including instructing the client appropriately, explaining the lawyer’s role, acting according to the client's instructions where practicable, or otherwise in the client's best interests, and explaining to the Court the basis of submissions (r 20(1)(a)-(d)). It also protects practitioners from being held to have breached codes of ethics when complying with these rules (r 20(2)).

Aboriginal and Torres Strait Islander children, families and organisations are specifically affected by the Child Placement Principle set out in regulation 4. The regulation requires, where reasonably practicable, placement in accordance with a specified order of priority and, if that cannot be achieved or is not in the child's best interests, provision for continuing contact with family, community or culture determined in accordance with customary law (r 4(a)-(b)). The regulation also requires counsellors to make persons aware of specialised counselling available from Aboriginal or Torres Strait Islander organisations and to assist in obtaining that counselling (r 5(1)(d)).

Third parties with information relevant to assessments , medical practitioners nominated by the Chief Executive, persons who may hold information on a registrant’s record under the Children and Young People (Safety) Act 2017, and overseas authorities in foreign adoptions , are implicated by the information‑gathering and verification mechanisms in rr 10(5), 12(2)(d), 16(c) and 19(5).

Finally, members of the public are indirectly affected by privacy and access settings. The register is not available for public inspection (r 7(6)), and extracts from the register of births relating to adopted persons may be issued in a form that shows or withholds the names of adoptive parents according to the wishes of the person seeking the extract (r 23(2)). This allocates practical confidentiality to adoptees and registrants while giving administrative transparency to relevant officials.

The regulations allocate a mix of statutory duties to public officers, rights to applicants and registrants, and procedural protections. Duties of the Chief Executive include cause‑and‑control responsibilities for the register and assessment process: causing assessment reports to be prepared (r 10(1)), making registration decisions within 18 months (r 11(1)), giving written notice with copies of assessment reports and reasons for decisions (r 11(5)-(6); r 14(11)), inviting persons who have expressed an interest to apply (r 8(3)), and cancelling registrations in specified circumstances (r 15). The Chief Executive also has the administrative discretion to require further information, workshops, medical reports or written authorisations (r 16).

Prospective adoptive parents have duties as applicants and as registrants. Applicants must meet the minimum requirements set out in r 9 to be eligible to apply. If registered, persons must inform the Chief Executive within 28 days of their registration becoming liable to cancellation under r 15 (r 15(6)(a)), and must inform the Chief Executive as soon as reasonably practicable after any significant change in circumstances that might affect suitability (r 15(6)(b)). Failure to comply with the notification duty under r 15(6)(a) attracts a maximum penalty of $5,000. Applicants must also provide accurate information in notices, applications and renewals; it is an offence to knowingly provide false or misleading statements or to omit material particulars, with a maximum penalty of $5,000 (r 25).

Applicants have rights of procedural fairness and review. Before the Chief Executive rejects an application or rejects a renewal, the applicant must be given an opportunity to make representations (r 11(4); r 14(10)). Written notification of decisions and assessment reports or reviews must be provided (r 11(5); r 14(11)). A person dissatisfied with a decision under Part 4 may, within 30 days of receipt of the notice of decision, apply to the South Australian Civil and Administrative Tribunal under s 34 of the SACAT Act for review (r 17). The Tribunal has powers to make incidental or ancillary orders relating to register entries, assessment reports and documentation to be sent overseas for adoption (r 18). Note that r 15(12) excludes review under regulation 17 for some cancellations (those under subreg 15(1) or (2)), thereby constraining review rights for automatic or mandatory cancellations in certain circumstances.

Witnesses and counsellors have duties when counselling or witnessing consent. An authorised officer counselling a person before consent must give an information brochure approved by the Chief Executive, explain the information and be satisfied the person understands it, assist the person to apply the information to their circumstances, and for Aboriginal and Torres Strait Islander adoptions ensure awareness and assistance in obtaining specialised counselling (r 5(1)). A witness to consent must be approved by the Chief Executive, cannot be the counsellor, satisfy themselves the person understands the instrument, ensure the instrument has been endorsed by a counsellor, forward a copy of the instrument to the Chief Executive and return the instrument to the person giving consent (r 6).

Legal practitioners acting for parties under 18 have duties to act, as far as reasonably practicable, in accordance with any instructions given by the party; to act according to the client’s best interests if the client cannot give instructions; to explain the practitioner’s role in an age‑appropriate way; and to explain the basis of submissions to the Court having regard to those constraints (r 20(1)(a)-(d)). Regulation 20(2) protects practitioners from allegations of ethical breach when complying with these duties.

Other rights include the option of transfer of registration from another State or Territory where the laws substantially correspond, and that transferred registrations are taken to have been made on the original registration day (r 12(1)-(4)). Registrants also have a right to have their details renewed for three‑year periods subject to review (r 14(1), (9)) and to have written reasons given for cancellation decisions and information on rights of review where review is available (r 15(10)-(11)).

Evidentiary rules create presumptive rights in legal proceedings to the validity of apparently genuine documents, consents and signatures in the absence of proof to the contrary (r 26(1)-(3)). This shifts the practical burden of proof onto a challenger once a document presented appears genuine.

Finally, for Aboriginal and Torres Strait Islander children, the regulations impose duties to apply placement priorities (r 4(a)) and to ensure opportunities for continuing contact with family, community or culture if placement under the priority order is not possible or not in the child’s best interests (r 4(b)). Counselling duties in r 5(1)(d) further require informing persons of specialised counselling and assisting in obtaining it.

The regulations create a limited set of criminal sanctions and provide administrative sanctions in the form of cancellation and refusal of registration. Criminal offences with monetary penalties include making a statement known to be false or misleading in a notice, application or renewal under these regulations, or omitting a material particular known to the person (r 25). The maximum penalty for that offence is $5,000. There is a further offence with the same maximum penalty for failing to inform the Chief Executive, within 28 days, that the person’s registration has become liable to cancellation (r 15(6)(a)). Both penalties are expressed as maximums; the regulations do not set out lower gradations or specific fine amounts beyond the cap.

The principal enforcement mechanism for suitability and compliance is administrative: registration may be cancelled under a range of circumstances (r 15). Cancellation events include: when a child is placed for adoption with the registrant (r 15(1)); loss of residence or permanent residency, loss of citizenship where a joint registrant is not an Australian citizen (r 15(2)(a)-(c)); removal of a child from the person’s care under specified child protection Acts (r 15(2)(d)); being a prohibited person under the Child Safety (Prohibited Persons) Act 2016 (r 15(2)(e)); convictions as an adult for criminal neglect or other offences involving violence, abuse or abduction of a child (r 15(2)(f)); transfer of registration to another jurisdiction (r 15(2)(g)); and registration obtained improperly (r 15(2)(h)). Registrations on overseas subregisters are cancelled if the registrant ceases to satisfy the minimum requirements of the foreign country (r 15(3)). The Chief Executive may also initiate an administrative review and cancel registration where the person is no longer a suitable person to adopt (r 15(8)). Before cancellation under most provisions (other than those in r 15(1) or (2)) the person must be given an opportunity to make representations (r 15(9)), and must receive written notice with reasons and information about review rights if any (r 15(10)-(11)). However, r 15(12) expressly bars tribunal review of cancellations under r 15(1) or (2).

Selection for adoption is also controlled administratively under r 19. Registrants are ordinarily selected in order of their position on the relevant subregister (r 19(1)), but the Chief Executive may exclude a person from selection where the adoption would be inconsistent with limitations of consent, contrary to birth parent wishes or foreign law, would be inferior for the child’s best interests compared to another registered person, the registration is liable to cancellation, a joint‑registering requirement is not met, spouse consent is absent in certain marriages, or the Court is unlikely to make an adoption order (r 19(2)). Selection may be cancelled if new information arises that would have excluded the person at the time of selection and the Chief Executive must notify the person of the cancellation (r 19(6)-(7)).

Evidentiary enforcement mechanisms include presumptions that appear to favour administrative efficiency: an apparently genuine consent to adoption or an apparently genuine document purporting to be signed by the Chief Executive or an authorised delegate will, in the absence of proof to the contrary, be taken to be valid or properly signed (r 26(1)-(3)). Those presumptions reduce the evidentiary burden on the State or other parties relying on documentary proof, and place the evidentiary onus on any challenger.

Tribunal oversight provides a judicial or quasi‑judicial enforcement path: persons dissatisfied with a Part 4 decision may apply to SACAT within 30 days for review (r 17). The Tribunal has powers to make ancillary orders relating to register entries, assessment reports and overseas documentation (r 18). The regulations do not provide for direct judicial review of all decisions; review rights are delineated and some cancellations are explicitly not reviewable under regulation 17 (r 15(12)).

Finally, the Chief Executive has administrative powers to impose procedural requirements, workshops, medical reports, written consents to third‑party disclosure, and other information, and to rely on adoption agencies for assessments (rr 10, 16). Non‑participation can result in the assessment not being completed and the application being rejected (r 10(2)-(3)). Those mechanisms function as soft enforcement: failure to cooperate can result in administrative denial rather than criminal sanction.

The regulations are subordinate to and operate under the Adoption Act 1988, implementing many of that Act’s procedural and substantive rules. Several explicit cross‑references to other South Australian Acts and laws of other jurisdictions create normative and operational links.

First, the Child Safety (Prohibited Persons) Act 2016 is a direct disqualification source. Regulation 9(2)(b) prohibits persons who are "prohibited persons" under that Act from applying for registration, and regulation 15(2)(e) repeats that status as a ground for cancellation. This creates an integrated screening mechanism across child safety and adoption administration.

Second, criminal law interacts through r 3(2) and references to the Criminal Law Consolidation Act 1935. The definition of conviction for the purposes of the regulations includes findings under Part 8A of the Criminal Law Consolidation Act that the objective elements of an offence are established, whether or not the person was found not guilty or unfit to stand trial; it also includes corresponding findings in other jurisdictions (r 3(2)). That interpretative provision broadens the scope of convictions and related findings that may disqualify a person or otherwise affect suitability in assessments and cancellations (r 9(2)(c); r 15(2)(f)).

Third, the regulations explicitly link to the Children and Young People (Safety) Act 2017 and the Children’s Protection Act 1993. A removal of a child from the care or custody of a registrant under those Acts or similar laws is a ground for cancellation (r 15(2)(d)). Assessment preparers must have regard to relevant information held by the administrative unit responsible for administration of the Children and Young People (Safety) Act 2017 (r 10(5)(a)). Those cross‑references create a data‑sharing and coordinated oversight relationship between agencies administering child protection and the adoption administration.

Fourth, the adoption registration transfer process presumes correspondence with the laws of other States or Territories. Regulation 12 allows transfer of a registration where the other jurisdiction’s law "substantially corresponds" to the Act and these regulations; transferred registrations are deemed to have been made on the original registration date (r 12(1)-(4)). This imports an element of interstate recognition and continuity, but also potential complexity where legislative differences or timing issues exist.

Fifth, the Tribunal review mechanism is implemented through cross‑reference to the South Australian Civil and Administrative Tribunal Act 2013. Regulation 17 explicitly provides the 30‑day window to apply to SACAT under s 34 of the SACAT Act, and r 18 relies on the Tribunal’s general powers, subject to the limits in the SACAT Act, to make ancillary orders relating to register entries, assessment reports and overseas documentation. That link channels administrative disputes into the established SACAT review framework.

Sixth, overseas adoptions require compliance with foreign laws. Regulation 9(4) and r 15(3) require applicants and registrants on overseas subregisters to meet the minimum requirements of the overseas country; r 19(5) sets out the practical sequencing for forwarding documentation to relevant overseas authorities. Thus, the regulations operate at the interface of domestic administrative law and foreign administrative requirements, creating dependencies on foreign procedural timelines and substantive legal standards.

Seventh, evidentiary presumptions interact with general rules of evidence and civil procedure by creating statutory presumptions that "apparently genuine" documents are valid in the absence of proof to the contrary (r 26). Those presumptions will interact with court practice and the rules of evidence in adoption proceedings under the Act.

Finally, the regulations provide for the Registrar of Births to alter or present entries in the register of births for adopted persons, including options to show adoptive parents’ names or not in accordance with the wishes of the person seeking a copy or extract (r 23). This intersects with birth registration law and privacy considerations administered by the Registrar.

Taken together, these interactions show a regulatory ecosystem where adoption administration is embedded in child protection, criminal law, interstate recognition regimes, overseas legal requirements and tribunal review processes. The regulations create both conduits for information sharing and points where differing legal standards across jurisdictions may affect outcomes.

The legislative history set out at the end of the instrument records the principal enactment and subsequent variations. The Adoption (General) Regulations 2018 were made as Statutory Instrument No. 227 of 2018, Gazette 29.11.2018 p4059, with commencement of the principal regulations at r 2 on 15 December 2018. Subsequent variations recorded are:

• 19 September 2019, Statutory Instrument No. 208 (Gazette 19.9.2019 p3329): the instrument varied provisions in Part 1 and Part 4, and substituted r 15(5). The immediate effect on provisions is signposted in the variation table under "Provisions varied" and "How varied", indicating r 2 omitted and r 15(5) substituted by 208/2019 r 4, both with commencement 19.9.2019.

• 1 July 2020, Statutory Instrument No. 174 (Gazette 4.6.2020 p3031): r 24A (Payment of fees etc) was inserted by 174/2020 r 4, commencing 1.7.2020. That insertion gives the Chief Executive express power to permit instalment payment of prescribed fees and to waive or remit whole or part of fees for the purposes of the Act or these regulations (r 24A(1)-(2)).

The legislative history section also records that earlier regulations were revoked by the principal regulations: the Adoption Regulations 2004 were revoked by the 2018 regulations. It notes that references in the legislation to other instruments or titles are not automatically updated and may be obsolete.

The printed "Provisions varied" table within the legislative history summarises which provisions were varied and how. It also records that some parts or schedules were omitted under the Legislation Revision and Publication Act 2002 (for example, r 2 omitted under that Act on 19.9.2019, and Sch 1 omitted under the same Act on 19.9.2019). The legislative history lists "Historical versions" and notes a historical version dated 19.9.2019 is available.

The regulations as printed include in‑text notes indicating which regulations were substituted or inserted and their instrument numbers and dates of commencement. The legislative history therefore provides the textual trail for the notable discrete amendments (notably the substitution in r 15(5) in 2019 and the insertion of r 24A in 2020) and identifies the date the principal instrument came into force. The instrument does not summarise the policy reasons for each variation; only the formal amendment details and commencement dates are recorded.

Users should consult the legislative history in the South Australian legislation database or official Gazette notices for the full text of the amending instruments and to check whether any further amendments post‑dating the historical version are in force. The regulations themselves include a note that references to other legislation, instruments or office titles may be obsolete and direct readers to the Index of South Australian Statutes and the online legislation site for further information.

The text of the Adoption (General) Regulations 2018 contains no case citations, reported judicial decisions, or express references to litigation arising under these specific regulations. The instrument therefore does not record any litigation history within its own text. The regulations do, however, prescribe and channel disputes and review rights which establish the primary forums and remedies for contesting administrative decisions made under Part 4 and related provisions.

Specifically, regulation 17 creates a statutory right of review to the South Australian Civil and Administrative Tribunal under s 34 of the South Australian Civil and Administrative Tribunal Act 2013. An aggrieved person must apply to the Tribunal within 30 days of receipt of notice of the Chief Executive’s decision (r 17). Regulation 18 sets out some of the Tribunal’s powers on review, namely to make incidental or ancillary orders relating to register entries, assessment reports, and documentation to be sent overseas for adoption, without limiting the Tribunal’s powers under s 37(1) of the SACAT Act (r 18). The Tribunal is therefore the principal administrative review body expressly provided by the regulations.

There are limits to internal review rights set out in the instrument: regulation 15(12) states that a decision to cancel the registration of a person under r 15(1) or (2) may not be the subject of an application for review under regulation 17. That removes the Tribunal as a route of review for cancellations that flow automatically from placement of a child with a registrant or the enumerated cancellation grounds in r 15(2). For other cancellations, the regulations require an opportunity to make representations (r 15(9)) and the notification must inform the person of the right to seek a review under the regulation (r 15(11)).

Beyond the Tribunal avenue the regulations do not themselves create other litigation pathways. Standard judicial review in the Supreme Court or appeals on questions of law may be available under general administrative law principles and statute, but such avenues are not mentioned in the instrument. The regulations provide evidentiary presumptions about apparently genuine documents and consents (r 26) which will affect litigation dynamics; once a document appears genuine it is presumed valid unless proof to the contrary is shown, altering burdens of proof in contentious proceedings.

Because the instrument does not list or cite cases, anyone researching litigation outcomes or authorities construing these particular regulations must look to case law databases, Tribunal decisions, and court reports external to the instrument. The regulations’ cross‑references to other statutes mean that litigation interpreting the Child Safety (Prohibited Persons) Act 2016, the Criminal Law Consolidation Act 1935 Part 8A, or the Children and Young People (Safety) Act 2017 may have practical relevance to interpretation and application of the regulations. Likewise, SACAT decisions applying regulation 17 and r 18’s powers, or any judicial review proceedings, would form the litigation history that practitioners would rely upon; none of that material is included or summarised in the regulations themselves.

The regulations contain several practical pitfalls and traps for practitioners and applicants; these are concrete operational points drawn from the text.

1. Invitation requirement to apply: An application for registration generally cannot be made except in accordance with an invitation given by the Chief Executive (r 8(5)). An expression of interest is not the same as an application; without an invitation an applicant may be ineligible to lodge their formal application immediately.

2. Joint application rules: Persons living together in a qualifying relationship must apply jointly (r 8(6)). A single registrant who later commences living together with a partner must apply jointly to convert to joint registration (r 13). Failure to convert or to meet the joint criteria can exclude a person from selection (r 19(2)(e)).

3. Non‑public register: The register is not available for public inspection (r 7(6)), which limits transparency about queue positions and administrative practice. Applicants cannot rely on public visibility to assess their place in selection order.

4. Decision timeframe is long but limited: The Chief Executive must decide within 18 months of lodgement (r 11(1)). That is a maximum period; the regulations do not create an express remedy tied to exceeding that period, so administrative delay beyond 18 months may require Tribunal action or other legal remedies.

5. Assessment can be declined or incomplete: An assessment report need not be prepared if the applicant is not resident in the State during assessment or if the Chief Executive considers the assessment cannot be completed due to inability to assess in the applicant’s home environment or failure to participate (r 10(2)). Where an assessment has not been prepared for these reasons the application may be rejected (r 11(3)). Applicants who do not participate in workshops, interviews or who are abroad risk rejection.

6. Broad grounds for cancellation without review: Registrations are automatically cancelled when a child is placed for adoption with the person and in other enumerated circumstances (r 15(1) and r 15(2)). Regulation 15(12) bars Tribunal review for cancellations under r 15(1) or (2), removing the statutory avenue of review for those cancellations. Administrative protections are therefore reduced in those categories.

7. Notification duty with criminal penalty: Registered persons must inform the Chief Executive within 28 days of the person’s registration becoming liable to cancellation (r 15(6)(a)). Failure to notify is an offence with a $5,000 maximum penalty. The defence in r 15(7) for changes in foreign law is narrow and requires proof the person did not know of the foreign law change.

8. Extensive discretionary power of the Chief Executive: The instrument uses "may" and "satisfied" repeatedly (for invitations r 8(3-5), reliance on agency reports r 10(6), cancellation r 15(8), late renewals r 14(3)), creating significant administrative discretion. Practitioners should expect decisions substantially influenced by delegated officers and agency practice.

9. Overseas adoptions require foreign compliance and create sequencing risks: Applicants for overseas subregisters must comply with minimum foreign requirements (r 9(4)) and documentation forwarding is done in the order received and subject to the overseas authority’s requirements (r 19(5)). This can lead to practical delays or loss of priority where foreign procedures or legal criteria change.

10. Evidentiary presumptions favour documents: Regulation 26 presumes apparently genuine consents and documents are valid absent proof to the contrary. Challengers bear the burden of rebutting the apparent genuineness of documents, which can be difficult if the documents are administratively processed and copies are held by officials.

11. Broad scope of assessment factors: The assessment factors in r 10(4) are wide, encompassing prior childhood experiences, attitudes to adopted children and access to origin information, the attitudes of other household members, financial management skills and attitudes to infertility. Applicants should therefore expect intrusive enquiries covering personal history and family dynamics.

12. Multiple overlapping statutes: The regulations cross‑reference the Children and Young People (Safety) Act 2017, the Child Safety (Prohibited Persons) Act 2016, and the Criminal Law Consolidation Act 1935. Adverse findings, removals, or specified criminal findings under those statutes will affect eligibility or lead to cancellation (rr 3(2), 9(2), 15(2)). Practitioners must track outcomes under those Acts as they can have immediate effect on registration status.

13. Forms and procedural requirements are centrally controlled: Notices, applications and renewals must be in a form determined by the Chief Executive and accompanied by such further documentation as required (r 24). Additional requirements can be imposed under r 16, including medical reports from nominated practitioners and authorisations for third‑party disclosure.

14. Witness and counselling mechanics are precise: Witnesses must be Chief Executive‑approved and cannot have been the counsellor (r 6(1)(a)). Witnesses must forward copies to the Chief Executive promptly and return the instrument to the person who gave consent (r 6(2)). Failure to follow these steps could lead to evidentiary challenges under r 26.

15. Selection exclusions can be factual and predictive: The Chief Executive may exclude based on an assessment that the Court is unlikely to make an adoption order in favour of the person (r 19(2)(g)). That introduces a predictive assessment about judicial likelihood, requiring the Chief Executive to make judgments about the Court’s probable decision.

Practitioners should therefore build compliance checklists around these technical points and ensure timely communications with the Chief Executive or delegated officers. Documentation, participation in required workshops or medical checks, timely notifications of changes, and careful handling of consents and witness steps are essential to avoid administrative exclusion or criminal penalties.

Compliance requires attention to sequential steps, documentary proof, participation in assessments and ongoing notification duties. The following practical checklist is grounded in the regulations’ requirements and cross‑references provided provisions.

1. Expression of interest and invitation: Lodge a written expression of interest with the Chief Executive specifying the kinds of child you are interested in (r 8(1)-(2)). Do not expect to submit a formal application until invited; the Chief Executive may invite persons who have expressed an interest to apply for registration on the relevant subregister (r 8(3)-(5)). Keep a copy of your expression and any correspondence evidencing the invitation.

2. Confirm eligibility before applying: Ensure you meet the minimum requirements in r 9(1): State residence or domicile, permanent residency in Australia, and Australian citizenship (or in a joint application that at least one applicant is a citizen). Check whether any prior registration was cancelled or whether you are a "prohibited person" under the Child Safety (Prohibited Persons) Act 2016 (r 9(2)(a)-(b)). Disclose any convictions that may fall within the list in r 9(2)(c) and remember the interpretative extension in r 3(2) which can include certain findings under Part 8A of the Criminal Law Consolidation Act or corresponding findings from other jurisdictions.

3. Joint applications and relationship evidence: If you are living together in a qualifying relationship and propose to apply, lodge the application jointly (r 8(6)). If you are a single registrant who later begins living with a partner, apply jointly to convert the registration (r 13). Keep documentary evidence of cohabitation and relationship length if relevant to r 19(3) (where a less than three‑year cohabitation creates presumptive exclusion absent special circumstances).

4. Prepare for assessment: The Chief Executive must cause an assessment report to be prepared (r 10(1)) and the report will look to the extensive factors in r 10(4). Provide comprehensive information on parenting skills, health, financial status, criminal history, attitudes to adoption and discipline, and the attitudes of household members. Expect home environment assessments and interviews. If you fail to participate or are not resident in the State during assessment, the assessment may not be completed and the application may be rejected (r 10(2), r 11(3)).

5. Respond to additional requirements: The Chief Executive may require further information, workshops, seminars, medical reports from nominated practitioners, or written authorisations for third‑party disclosures (r 16). Respond promptly and retain receipts and written confirmations for any workshops or medical certificates. If a medical report is required, obtain it from the practitioner nominated by the Chief Executive to avoid technical non‑compliance.

6. Maintain residency, citizenship and child protection standing: Keep your residency and citizenship status current. A change in these circumstances can lead to cancellation (r 15(2)(a)-(c)). Similarly, if a child has been removed from your care under the Children and Young People (Safety) Act 2017 or similar laws, notify the Chief Executive; such removals are grounds for cancellation under r 15(2)(d).

7. Notification obligations: If your registration becomes liable to cancellation, inform the Chief Executive within 28 days (r 15(6)(a)). Notify any significant changes in circumstances that might affect suitability as soon as is reasonably practicable (r 15(6)(b)). Failure to notify carries a maximum penalty of $5,000; keep proof of notification (email, registered post) to evidence compliance.

8. Consent counselling and witnessing where relevant: For persons giving consent to adoption, ensure the authorised counsellor provides the approved information brochure, explains it and verifies understanding (r 5(1)(a)-(c)); for Aboriginal and Torres Strait Islander adoptions, ensure the counsellor explains availability of specialised counselling and assists in obtaining it if requested (r 5(1)(d)). For witnessing consents, use a Chief Executive‑approved witness who is not the counsellor; ensure the witness is satisfied about understanding and that the instrument is endorsed by a counsellor, and that the witness forwards a copy to the Chief Executive and returns the instrument to the consenting person promptly (r 6).

9. Keep contemporaneous records: Given the evidentiary presumptions in r 26, retain originals and certified copies of consents, witness endorsements and all communications with the Chief Executive or agencies. Where a document is prima facie authentic, litigation will focus on rebutting genuineness; recordkeeping supports defence of compliance.

10. Fees and instalments: Be aware of any prescribed fees for applications, assessments or renewals. The Chief Executive may permit instalment payments or waive/remit fees in part or whole (r 24A). Apply in writing if financial hardship or other grounds make instalments or waiver appropriate.

11. Renewal timing: Registrations last three years (r 14(1)). Lodge renewal applications no more than three months and not less than one month before expiry (r 14(2)). The Chief Executive may accept late renewals at their discretion (r 14(3)). On renewal, the original assessment report must be reviewed with regard to changes in circumstances (r 14(5)); participate in the review process promptly.

12. Overseas adoptions: If seeking registration on an overseas subregister, confirm and document compliance with the overseas country’s minimum requirements for adoption by an Australian resident. Provide any information the Chief Executive requests to determine which overseas subregister(s) you should be entered on (r 9(4), r 12(3)). Follow the documentary submission sequencing set out in r 19(5).

13. Challenge adverse decisions promptly: If the Chief Executive refuses registration, renewal or makes another reviewable decision under Part 4, you have 30 days from receipt of notice to apply to SACAT under r 17. Prepare full documentary material including the relevant assessment report and any ancillary documents to support judicial review or SACAT arguments.

14. Legal practitioner duties: If you are a legal practitioner representing a party under 18 in adoption proceedings, comply with r 20 by explaining your role to the child in an age‑appropriate way and acting in accordance with the child’s instructions where practicable, or otherwise in the child’s best interests. Document your communications and the basis of submissions to the Court.

15. When in doubt, obtain clarity from Chief Executive or agency: Many processes are administratively driven (forms determined by the Chief Executive r 24, additional requirements under r 16). Seek written confirmation from the administrative unit where processes or documentary requirements are unclear.

Following these steps reduces the risk of administrative rejection, cancellation, or exposure to the statutory penalties in r 15(6) and r 25. Retain copies of all forms, notifications and assessment materials, and monitor correspondence for invitations to apply, selection notices, or cancellation decisions. If a decision adverse to you is received, act promptly to seek Tribunal review within the 30‑day window prescribed by r 17.
