#### 185 Improper witnessing of consent 185 Improper witnessing of consent (cf AC Act s 58) > A person who subscribes his or her name as a witness to the signature of a person to an instrument of consent to the adoption of a child without— > > > (a) being satisfied that the person signing the instrument is a parent of, or person who has parental responsibility for, the child, and > > > (b) being satisfied that the person signing the instrument is doing so free from any threat, inducement or influence of a kind referred to in section 184, and > > > (c) taking such steps as are prescribed by the regulations to satisfy himself or herself that the person signing the instrument understands the effect of the consent, and > > > (d) being satisfied that the instrument bears the date on which it is signed by the person giving the consent, > > is guilty of an offence. > > Maximum penalty—25 penalty units or imprisonment for 12 months, or both. > > **s 185:** Am 2006 No 112, Sch 2 \[53\].
