39K Alternative orders on refusal of adoption order
(1) If the court refuses to make an adoption order for a child or young
person, the court may—
(a) if it considers that the child’s or young person’s best interests
would be promoted by doing so—make an order relating to
guardianship or custody of the child or young person; and
(b) make any other order it thinks fit.
(2) An order under subsection (1) (a) may be made in favour of the
director-general or any other person.
