What it does
This instrument, titled the Administrative Arrangements (Public Service agencies and Ministers) Order 2023, names the order (s 1) and fixes its commencement date as 5 April 2023 (s 2). Its operative content is Schedule 1, which performs two mechanical functions.
First, Schedule 1, section 1 lists Departments of the Public Service and specifies, for each Department, the Minister or Ministers to whom that Department is responsible. The Schedule is presented as a table pairing Department names (for example, Premier’s Department, Department of Education, Treasury) with one or more ministerial titles (for example, Premier, Treasurer, Minister for Education and Early Learning). Some Departments are listed with multiple ministers (for example, the Premier’s Department is listed as responsible to a long sequence of Ministers), others with a smaller set.
Second, Schedule 1, section 2 lists particular Public Service agencies that are not Departments and specifies the single Minister to whom each such agency is responsible (for example, Corrective Services NSW to the Minister for Corrections; Service NSW to the Minister for Customer Service and Digital Government).
Schedule 1, section 3 provides a fallback rule for agencies not captured by sections 1 or 2. It declares that where a Public Service agency comprises employees employed to enable a statutory body or statutory officer to exercise their functions, the responsible Minister is the Minister administering the Act under which that statutory body is constituted or the statutory officer is appointed.
Mechanically, the Order therefore (a) maps specific Departments to specified Ministers, (b) maps specified Public Service agencies to specified Ministers, and (c) supplies a rule for identifying the responsible Minister for other Public Service agencies that support statutory bodies or officers. The Schedule also records amendment references (sch 1: Am 2023 (236), Sch 2[1]-[7]; 2023 (316), Sch 3; 2023 (544), Sch 3[1]-[3]; 2023 (648), Sch 4[1]-[4]; 2024 (213), Sch 2; 2024 (244), Sch 3; 2024 (338), Sch 3; 2024 (371), Sch 2; 2025 (112), Sch 3[1]-[11]; 2025 (123), Sch 2; 2025 (209), Sch 3; 2025 (650), Sch 3), indicating the Schedule has been amended multiple times and that the printed Schedule reflects those amendments.
