Jurisdiction
New South Wales
Act Number

Collection
regulation
Plain English Summary
7/10 complexity
This Order assigns responsibility for administering hundreds of New South Wales Acts to named Ministers by listing allocations in Schedule 1, allowing partial and joint allocations (s 3), and repeals earlier allocation instruments (s 4). It commenced on 5 April 2023.
The allocation determines which minister and their agencies make statutory decisions, enforce the law and bear implementation and compliance costs — so it matters to ministers, public agencies and every person or business regulated under the affected Acts.
This instrument is an Administrative Arrangements Order that reallocates which Ministers administer which New South Wales Acts. Mechanically it does three things.
It allocates the administration of the Acts listed in Schedule 1 to the Ministers indicated in that schedule, including qualifications limiting allocations to parts or to joint administration (s 3(1)-(3); Schedule 1). The allocation can be limited to portions of an Act (s 3(2)) and may note joint administration by more than one Minister (s 3(3)). The Schedule contains the concrete mapping of Acts (and, where relevant, specified Parts, sections or clauses) to specific Ministers.
It clarifies how administration is to be allocated where an Act (or part of an Act) directly amends another Act: such provisions are allocated to the Ministers administering the Act amended (s 3(4)). The order therefore ties responsibility for amending provisions to the current administrator of the underlying statute.
It repeals prior administrative-arrangements instruments that only allocated Acts, and replaces inconsistent allocations made previously (s 4(1)-(2)). It expressly repeals the Administrative Arrangements (Second Perrottet Ministry,Allocation of Acts and Agencies) Order 2021 and treats that repeal as having commenced on 5 April 2023 (s 4(3)-(4)). The order itself commences on 5 April 2023 (s 2).
The Schedule is the operative mapping. Examples drawn from Schedule 1 include: the Premier is allocated the Constitution Act 1902 and jointly with the Special Minister of State the Electoral Act 2017 and the Electoral Funding Act 2018; the Treasurer is allocated numerous financial and revenue Acts (Appropriation Acts, Taxation Administration Act 1996 jointly with the Minister for Finance); the Minister for Health receives the Public Health Act 2010 and related health statutes; the Minister for Planning and Public Spaces receives the Environmental Planning and Assessment Act 1979 (whole Act except Part 6 and a subsection), etc. The Schedule also records when Ministerial allocations are wholly nil for particular portfolios.

This order commences on 5 April 2023.
3 Allocation of the administration of Acts
3 Allocation of the administration of Acts
3 Allocation of the administration of Acts
(1) The administration of the Acts listed in Schedule 1 are allocated to the Ministers indicated in that Schedule.
(2) An allocation of an Act listed in Schedule 1 may be qualified by words that limit the allocation to portions of the Act.
(3) Schedule 1 may contain words that note that an Act or portion of an Act is jointly allocated to more than one Minister.
(4) The administration of Acts or parts of Acts that directly amend other Acts are allocated to the Ministers administering the Act amended.
Note.
See the Interpretation Act 1987, section 15 for the interpretation of references to “the Minister” in an Act.
(5) Notes included in this order do not form part of this order.
4 Repeals
4 Repeals
4 Repeals
(1) The following cease to have effect—
(a) an order that only allocates the administration of Acts,
(b) a provision of another order that allocates the administration of Acts.
(2) To avoid doubt, the allocations made by this order replace any previous allocations relating to the Acts concerned that are inconsistent with the allocations made by this order.
(3) The Administrative Arrangements (Second Perrottet Ministry—Allocation of Acts and Agencies) Order 2021 is repealed.
(4) To avoid doubt, subsection (3) is taken to have commenced on 5 April 2023.
Am 2023 (236), Sch 1[1].
Notes inserted in the order are expressly not part of the order (s 3(5)). The order cross‑refers to an external interpretive provision: the Interpretation Act 1987 s 15 for the meaning of references to “the Minister” in an Act (s 3, note).
Mechanically, therefore, the order reallocates legal administrative responsibility across Ministers, identifies exceptions and joint arrangements at a granular level, ties amendment-provision administration to the administrator of the amended Act, and overwrites previous inconsistent allocations. It contains no operational directions about departmental structures, budgets, or agency transfers and contains no penalty regime.
Main concepts
The instrument pivots on a small set of legal and organisational concepts embodied in its core text and the Schedule. Setting out those concepts precisely anchors how the order will operate in practice.
Administration of an Act (s 3(1)). The primary legal act of the order is to allocate "the administration of the Acts listed in Schedule 1" to designated Ministers. In administrative law and practice, "administration" denotes the ministerial responsibility for oversight, policy direction, and executive functions under the statute. The order makes that allocation explicit in respect of each Act and, where necessary, in respect of specified Parts, sections or clauses.
Partial allocations (s 3(2); Schedule 1 entries). Allocation can be limited to portions of an Act. The Schedule repeatedly marks allocations that are limited to Parts, sections or specific functions (for example, Premier: Essential Services Act 1988, Parts 1 and 2; Treasurer: Government Sector Audit Act 1983 , whole Act except certain sections).
Joint allocation (s 3(3); Schedule entries). Multiple Ministers may be jointly allocated administration of an Act or part of an Act. The Schedule contains numerous joint allocations (for example, Premier and Special Minister of State jointly administer the Electoral Act 2017 and Electoral Funding Act 2018). Joint allocation creates overlapping ministerial responsibilities for the same statutory provisions.
Allocation for amending provisions (s 3(4)). Where an Act or part of an Act directly amends another Act, administration of that amending provision is allocated to the Ministers who administer the Act amended. This creates a rule that keeps amendment administration with the legal owner of the amended Act, rather than with the sponsor of the amending provision.
Repeal and replacement (s 4(1)-(4)). The order expressly ceases to give effect to prior instruments that only allocated administration of Acts and replaces any previous inconsistent allocations (s 4(1)-(2)). It also repeals a named prior order and backdates that repeal to the commencement date (s 4(3)-(4)).
Notes and external interpretation (s 3(5); note re Interpretation Act 1987). Notes included in the order do not form part of the order (s 3(5)). The order relies on the Interpretation Act 1987 s 15 to define references to "the Minister" in statutes, rather than attempting to restate that definition within this instrument.
The Schedule is not an abstract list; it specifies the precise legal objects being allocated and any carve-outs. Administratively, the effect is to create a set of ministerial accountabilities linked to named Acts and specified components of Acts. The order does not itself create ministerial powers, nor does it alter statutory text; it assigns which Minister is responsible for administering existing statutory provisions. It therefore operates as an organisational re-labelling that determines which ministerial portfolio will carry statutory responsibilities in government practice.
Where the Schedule records joint administration or partial allocations, the legal consequence is that multiple Ministers hold the administration of the same statutory power or only particular powers within an Act. The instrument does not articulate how conflicts between joint Ministers are to be resolved. The Schedule also evidences the granularity of allocations: whole Acts, specific Parts, individual sections or even single clauses are allocated.
Understanding these concepts is necessary to map administrative responsibility, to identify which Minister should be consulted on legislative reform or decisions under a particular Act, and to interpret cross-references where an amending provision appears in one instrument but affects an Act administered by another Minister.
Who it affects
The instrument assigns administrative responsibilities and therefore affects a range of actors within the NSW executive and public sector who implement, regulate under, or rely on the Acts listed in Schedule 1. The primary affected groups, derivable directly from the order’s mechanics and schedule, are:
Ministers and their portfolios. Each Minister listed in Schedule 1 receives the administration of one or more Acts (s 3(1); Schedule 1). That allocation changes ministerial responsibilities and the focal point for policy decisions, statutory discretion and executive oversight under those Acts. For example, the Treasurer is allocated a large set of financial, taxation and appropriation statutes; the Minister for Health is allocated the Public Health Act 2010 and allied health statutes; the Minister for Planning and Public Spaces is allocated the Environmental Planning and Assessment Act 1979 (subject to specified exceptions).
Departments and agencies. Although the order does not expressly name departments, administering Ministers are the legal and political heads of government departments and agencies. Agencies that carry out functions under a listed Act will report to or be accountable to the Minister allocated that Act. The Schedule’s granular allocations, including partial and joint allocations, determine which ministerial office will direct agency priorities for each statutory function.
Other Ministers with joint administration. Where the Schedule records joint administration, more than one Minister is formally responsible for the same Act or Part. Examples include the Premier jointly with the Special Minister of State for the Electoral Act 2017, or the Treasurer jointly with the Minister for Finance for duty and taxation statutes. This affects inter-ministerial coordination and determines who must be consulted on decisions or legislative amendments affecting those statutes.
Stakeholders regulated under the Acts. Businesses, local governments, non-government organisations and individuals whose rights or obligations stem from the listed Acts (for example, local councils under the Local Government Act 1993; employers under industrial relations statutes; health providers under the Health Practitioner Regulation arrangements) will have a new ministerial contact point and potentially different policy oversight arising from the allocation.
Legal and regulatory actors. Solicitors, counsel, regulators, and tribunals that work with or interpret the Acts will need to recognise which Minister has administrative carriage for engagement, approvals, or recommendations under the statute. For instance, where a provision grants rule-making or approval powers to "the Minister", the Interpretation Act 1987 s 15 (referred to in a note to s 3) determines how references to "the Minister" in an Act are read in light of the allocation.
Parliamentary and oversight mechanisms. Ministers allocated particular Acts become the responsible Ministers before Parliament for those statutes, and thereby the subjects of ministerial questioning, estimates, and accountability mechanisms in relation to those Acts.
The order also affects prior administrative instruments by repealing allocations that were inconsistent (s 4(2)) and by expressly repealing the 2021 Perrottet Ministry order (s 4(3)). That repeal means offices and agencies must switch their formal administrative reporting lines where the new order diverges from the old.
The order places no obligations or penalties on private parties directly; its effect is organisational. Nevertheless, it reshapes who makes decisions under statutes, who issues policy guidance, and which Minister will be the legal and political point of contact for affected stakeholders. Where allocations are partial or joint, stakeholders may face more complex channels for approvals, complaints or legislative engagement because more than one ministerial office has a formal administrative role under the same statute or statutory function.
Key duties and rights
This Administrative Arrangements Order itself does not create new substantive duties, rights, or enforcement powers for private parties. Its legal effect is an allocation of administrative responsibility within the executive government. Nevertheless, the order identifies who holds ministerial administration for powers and duties that exist in the underlying Acts listed in Schedule 1. The following points clarify how the order interacts with duties and rights arising from the statutes it allocates.
Allocation of administration is the mechanism for identifying the Minister who is responsible for exercising statutory powers and overseeing statutory duties under an Act (s 3(1)). Where an Act confers functions, decision-making powers, or obligations on "the Minister", those references will be read to indicate the Minister allocated by this Order, consistent with the Interpretation Act 1987 s 15 (note to s 3). Thus the order determines the officeholder who is answerable for the exercise of statutory discretions and the discharge of statutory duties.
Partial allocations mean that duties and powers within a single Act may be split between Ministers. The Schedule contains many examples where particular Parts, sections or functions are allocated separately. Where an Act imposes duties on more than one Minister under different parts, the order clarifies which Minister’s policies and priorities are likely to influence the exercise of those duties.
Joint allocation means multiple Ministers will administer the same statutory provisions. Joint administration can create concurrent duties for Ministers: each Minister so allocated will have the administrative responsibility for the same Act or provision. The order does not specify how joint administration is to be coordinated; it records the joint responsibility (s 3(3)). When an Act gives specific powers to "the Minister", and the Schedule records joint administration, both Ministers are the relevant administrators for those powers unless the underlying Act provides otherwise.
Allocation for amending provisions ties responsibility for changes to the Act's steward. Section 3(4) provides that the administration of Acts or parts of Acts that directly amend other Acts are allocated to the Ministers administering the Act amended. Practically this assigns responsibility for drafting and overseeing implementation of amending provisions to the Minister who already administers the target Act, thereby aligning stewardship of the substantive law with control over amendment provisions.
The order does not alter the text of the Acts listed in Schedule 1. It changes which Minister administers the Act but does not amend statutory duties, penalties or rights found in the Acts themselves. Users of the law should therefore read the relevant Act for specific duties and rights, with the order supplying who is the responsible Minister for those provisions.
Notes are not operative law. Section 3(5) states that notes included in this order do not form part of the order. Consequently any interpretive note printed alongside Schedule entries (for example, references to the Interpretation Act) are informational, not substantive.
In summary, the order reallocates ministerial stewardship of existing statutory duties, discretions and rights. It designates which Minister is responsible for the day-to-day administration and political accountability of those statutory functions. It does not itself impose new regulatory obligations, create new rights, or set enforcement mechanisms; those remain located in the primary legislation listed in Schedule 1.
Penalties and enforcement
The Administrative Arrangements (Minns Ministry,Administration of Acts) Order 2023 contains no penalty provisions and establishes no enforcement regime. Its function is organisational and administrative. The following points set out the consequences and limits of enforcement in the instrument.
No sanctions, offences or fines are created by the order. The text (ss 1-4 and Schedule 1) confines itself to allocation of administration; it does not create criminal or civil penalties, nor does it confer new enforcement powers.
Enforcement of statutory obligations remains governed by the underlying Acts. Where a statute allocated by the order contains penalties, sanctions or enforcement mechanisms, those provisions continue to operate as they do presently. The order only designates which Minister is to administer those Acts and therefore which Minister is politically and administratively responsible for enforcement policy, prosecutions, regulatory action and compliance frameworks under those Acts.
The order repeals prior administrative allocations and thus may change which Minister is responsible for enforcement oversight. Section 4(2) provides that the allocations made by this order replace any previous allocations that are inconsistent with this order. That replacement means the Minister now allocated an Act will be the Minister answerable for enforcement practices under that Act. The order does not, however, transfer prosecutorial functions or agency enforcement powers by itself; such operational changes occur through departmental arrangements or statutory mechanisms outside the order.
The order does not alter judicial or tribunal jurisdictions. Court and tribunal powers remain governed by the statutes establishing them. Allocation of administration can influence who appears and answers questions in Parliament or who directs administrative litigation strategy, but it does not change substantive jurisdictional thresholds or judicial review paths in the Acts themselves.
Administrative notes and interpretive references in the order are not enforceable provisions. Section 3(5) states that notes included do not form part of the order. The reliance on the Interpretation Act 1987 s 15 for reading "the Minister" is a cross-reference rather than a new legal power.
Practically, enforcement actions under the Acts listed in Schedule 1 will proceed under the statutory mechanisms in those Acts, but Ministers newly allocated administration become the accountable offices for enforcement policy, prosecutions where applicable, and resource allocation for enforcement agencies. Where joint allocations exist, the order does not specify mechanisms for resolving disagreements about enforcement priorities; such procedures will need to be handled through administrative practice or other instruments.
How it interacts with other laws
The order operates as an instrument of administrative organisation and interfaces with other laws in a limited and specified manner. The text itself sets out a few explicit cross‑references and rules about interaction; other interactions are implied by the role allocation has in statutory administration.
Interpretation Act 1987 (s 15). The order expressly refers to the Interpretation Act 1987 s 15 for the interpretation of references to "the Minister" in an Act (s 3, note). That cross-reference instructs that when an Act within Schedule 1 uses the phrase "the Minister", the identity of that Minister for the purposes of the Act is determined according to the rules of statutory interpretation provided in the Interpretation Act and by the allocations in this order.
Amending provisions and the Act amended (s 3(4)). The order contains a specific rule for interaction where an Act (or part of an Act) directly amends another Act: the administration of that amending provision is allocated to the Minister who administers the Act amended. This rule is a direct mechanism to prevent misalignment between the administrator of a statutory power and the administrator of a provision that changes that power.
Repeal and replacement of prior allocation instruments (s 4(1)-(3)). The order impacts the corpus of administrative instruments by repealing prior orders that only allocated Acts (s 4(1)). It further provides that allocations in this order replace previous inconsistent allocations (s 4(2)). The order therefore updates the statutory administrative map and should be read as the operative allocation instrument from its commencement date.
Relationship with the underlying Acts. This order does not amend the substantive law in any Act, nor does it modify statutory powers, duties, offences or remedies contained in the Acts listed. It changes which Minister is responsible for administering those provisions. Consequently, questions of legal effect for private parties (rights, obligations, penalties) remain determined by the text of the underlying Acts; the order affects the executive office that exercises or oversees those powers.
Interaction with departmental structures and statutory bodies. The order specifies which Minister administers which Acts; in practice, departments and statutory bodies that implement those Acts will be organisationally affected. The order does not itself reconstitute statutory bodies, transfer agency assets, or change departmental staff allocations. Such operational transitions require separate administrative action or statutory change.
Scope limits and non‑operative notes (s 3(5)). The order states that notes included in the order do not form part of the order (s 3(5)). Where the order includes explanatory or interpretive notes, they are not to be treated as legal text altering other laws.
Readers should therefore approach the order as an overlay to the existing statutory landscape: it does not change statutory entitlements or penalties, but it changes which Minister (or Ministers) will be responsible for administering and making decisions under those statutes. Where an Act refers to "the Minister" or otherwise prescribes ministerial functions, the identity of that Minister for administrative and political purposes is determined by the allocation in Schedule 1 together with the Interpretation Act rules.
Amendment history
The order and, in particular, Schedule 1, records amendment and substitution notations at the head of the Schedule. The order's amendment history is provided only in the instrument’s footnote line for Schedule 1 and in s 4 where a prior order is expressly repealed. The specific points recorded in the text are:
Schedule 1 contains an amendment line: "sch 1: Am 2023 (236), Sch 1[2]-[30]; 2023 (316), Sch 2[1]-[7]; 2023 (544), Sch 2[1]-[11]; 2023 (648), Sch 3[1]-[8]; 2024 (14), Sch 2[1]-[16]; 2024 (213), Sch 1[1]-[8]; 2024 (244), Sch 2; 2024 (338), Sch 2[1]-[8]; 2025 (9), Sch 2[1]-[8]. Subst 2025 (112), Sch 2. Am 2025 (207), Sch 2[1] [2]; 2025 (530), Sch 2[1]-[9]; 2025 (650), Sch 2[1]-[5]; 2026 (93), Sch 2[1] [2]; 2026 (136), Sch 2[1]-[5] [7]-[9]." This line indicates that Schedule 1 has been the subject of multiple amendments and substitutions across 2023-2026, with specific amendment instruments and schedule references noted.
Section 4(3) expressly repeals a named previous order: the Administrative Arrangements (Second Perrottet Ministry,Allocation of Acts and Agencies) Order 2021 is repealed (s 4(3)). Section 4(4) clarifies that subsection (3) is taken to have commenced on 5 April 2023.
Section 4(2) states that the allocations made by this order replace any previous allocations relating to the Acts concerned that are inconsistent with the allocations made by this order.
The instrument therefore documents its own evolutionary changes through the Schedule footnote (which lists amendment instruments and schedule references) and through an express repeal of the noted 2021 Administrative Arrangements Order. The Schedule footnote is the only place in the provided text that records a line of amendments and substitutions; it names the years and schedule numbers of amending instruments, but does not reproduce the amending texts.
Because the instrument lists multiple later amendment citations (extending into 2026), practitioners should check the consolidated or current legislative database for the precise content of each amendment noted in the footnote, particularly where Schedule 1 entries have changed for specific Acts or where carve-outs have been adjusted. The order’s explicit replacement-of‑inconsistent allocations clause (s 4(2)) means that any prior instrument assigning a different Minister to a listed Act is superseded to the extent of inconsistency as at this order’s commencement.
No other internal amendment mechanisms (for example, a power to vary allocations by regulation) are provided in the text supplied. Any future changes to allocations would therefore occur by subsequent Administrative Arrangements Orders or by statutory amendment.
Litigation history
The Administrative Arrangements (Minns Ministry,Administration of Acts) Order 2023, as with most administrative allocation instruments, does not itself create causes of action or novel legal rights that typically generate litigation. The text provided records no litigation history. The following points summarise the order’s litigation profile as inferable from its content.
No cases or judicial decisions are referenced in the text. The instrument is an executive allocation of administration and contains no penalty, enforcement or substantive regulatory change that would, in itself, generate litigation.
Legal challenges to administrative allocations typically arise where a party alleges ultra vires action by a Minister or a procedural defect in the allocation process, or where a reallocation affects agency decision-making that gives rise to judicial review. The order does not record any such proceedings.
The order refers to the Interpretation Act 1987 s 15 for reading references to "the Minister" in an Act (s 3, note). Litigation that involves identifying which Minister is "the Minister" for a statutory function will depend on the allocation recorded in Schedule 1 read with s 15 of the Interpretation Act and may be litigated in the future. The order itself provides the factual record that a court would consult when determining the identity of the administering Minister at a relevant time.
If disputes were to arise about whether a particular action taken under an Act is lawful, the underlying Act's provisions and the administrative allocation would be relevant evidence in judicial review or statutory interpretation proceedings. The order registers who is the Minister responsible, which is relevant to standing, justiciability and points of accountability in litigation, but the order contains no adjudicative or dispute-resolution mechanism of its own.
Practitioners wishing to identify any litigation related to the application or effect of this order will need to search court databases for judicial review or statutory interpretation cases that cite the order or that require an inquiry into which Minister was administering a particular Act at a relevant time. The absence of litigation references in the instrument means the Schedule should be treated as the prima facie administrative map unless and until a court orders otherwise.
Gotchas
The order is straightforward in its purpose but presents several practical and legal nuances that can lead to confusion or unintended administrative friction if not recognised. The following "gotchas" are drawn strictly from the instrument’s text and layout.
Notes do not form part of the order (s 3(5)). Any explanatory note printed alongside entries , including the note directing readers to the Interpretation Act 1987 s 15 for deciding who "the Minister" is , is not legally operative. Relying on a footnote as if it were a substantive allocation can mislead. Always treat the Schedule entries and operative sections as the source of legal allocation.
Partial allocations are frequent and granular. Many Schedule entries allocate only specified Parts, sections or clauses of an Act to a Minister. For example: the Minister for Planning and Public Spaces is allocated the Environmental Planning and Assessment Act 1979 "whole Act (except Part 6 and section 10.13 (1)(d), jointly with the Minister for Better Regulation and Fair Trading and the Minister for Building)". Practitioners must read the Schedule entry carefully to determine whether a Minister holds administration of the entire Act or only parts. Misreading a carve-out can lead to addressing the wrong Minister for approvals, consents or policy discussions.
Joint administration is common and not operationally explained. Numerous Acts are assigned jointly (for instance the Premier and the Special Minister of State jointly for the Electoral Act 2017). The order does not prescribe how Ministers share decision-making, how to resolve conflict or which Minister has primacy. Administrative practice, memoranda of understanding, or other instruments (not included in the order) will be needed to operationalise joint administration. Do not assume joint allocation equals shared daily operational control; it is a formal allocation that may require further administrative agreement.
Allocation of amending provisions follows the administrator of the amended Act (s 3(4)). If an Act contains provisions that amend other statutes, s 3(4) allocates the administration of those amending provisions to the Minister who administers the Act amended. This means that a Minister who sponsors an amending Act might not be the administrator of the amendment if the target Act is administered by another Minister. Practitioners drafting amending instruments should check this rule to identify the correct ministerial contact and to manage stakeholder expectations about who will implement and oversee the amendment.
Repeal of prior orders and replacement of inconsistent allocations (s 4(2)-(3)). The order expressly replaces inconsistent previous allocations and repeals the 2021 Perrottet Ministry order (s 4(3)). Be cautious where legacy approvals, memoranda, or agency practices reference a previous order; the current order governs administration for the relevant Acts.
Nil allocations. Some portfolios are recorded as "Nil" (for example Deputy Premier, Minister for Western Sydney). This indicates that at the time of the order the portfolio did not have Acts allocated. However, "Nil" can change on subsequent Administrative Arrangements Orders. Practitioners should verify current allocations rather than assume permanence.
The order does not reassign agency assets, staff or budget. Allocation of administration in the Schedule does not by itself effect transfers of departmental functions, staff, property or funding. Implementation of administrative changes will require separate executive and administrative actions. Expect a gap between the legal allocation and the administration experienced on the ground unless the relevant departments issue implementing directives.
The Schedule records many cross-portfolio exceptions. Several Acts are allocated "whole Act except" particular provisions that are allocated elsewhere (for example, the State Owned Corporations Act 1989 for the Premier is "whole Act (except section 37B)"). Cross-check the exceptions where multiple portfolios touch the same statute.
Version control risk. Schedule 1 carries a dense amendment history note. Because Schedule entries have been amended repeatedly, rely on the consolidated or current published version in statutory databases to ensure you are reading the operative allocation for any given date.
In short, the principal operational pitfalls are misidentifying which Minister administers a discrete function (due to carve-outs and joint allocations), presuming the order creates operational transfers of staff or resources, and relying on non-operative notes for legal interpretation. Practitioners should cross‑check specific Schedule entries against the current consolidated order and consult departmental releases or administrative guidance for how joint or partial administration is being operationalised.
How to comply
Compliance with this Administrative Arrangements Order is a matter of administrative alignment rather than regulatory obedience. The order requires public bodies, Ministers and advisers to recognise and act in accordance with the allocation of Acts recorded in Schedule 1. The following steps are practical measures for departments, statutory bodies, counsel and regulated entities to ensure compliance with the order’s mechanics and to reduce operational risk.
Confirm the operative text and commencement. The order commences on 5 April 2023 (s 2). Because Schedule 1 carries multiple amendment citations, always check the consolidated, up‑to‑date version of the order in the NSW legislation database to confirm which Minister is currently allocated a statute for the relevant period.
Map responsibilities at the statute and sub‑statute level. Read the Schedule entry for the specific Act and note any carve-outs (Parts, sections, clauses) or joint allocation. For example, some allocations are to entire Acts while others are to specified Parts or sections. Where an Act makes decisions under particular sub‑provisions, identify which Minister the Schedule allocates for those sub‑provisions.
For Ministers and departmental heads: issue internal administrative notices and update delegations and contact points. Although the order does not itself transfer staff or budgets, departments should update internal governance documents, delegation instruments, correspondence templates, websites and Ministerial briefs to reflect the allocations. Where joint administration occurs, create formal coordination arrangements (for example, memoranda of understanding, inter‑departmental committees) to specify decision‑making processes, consultation obligations and conflict‑resolution procedures between the joint Ministers.
For drafting amending legislation or subordinate instruments: check s 3(4). If an Act or provision amends another Act, the administration of that amending provision is allocated to the Minister who administers the Act amended. Ensure that the correct Minister is identified as the administrator in drafting, and consult with the Minister who administers the Act being amended to secure buy‑in and implementation pathways.
For statutory agencies and regulators: update ministerial reporting lines and stakeholder engagement. Agencies implementing the Acts listed in Schedule 1 should confirm which Minister they are accountable to for particular functions and ensure that ministerial briefings, approval requests and policy proposals are routed to the correct Ministerial office in accordance with the Schedule.
For lawyers and advisers: cite the order when identifying the responsible Minister. When advising clients about where to direct applications, approvals, complaints or representations under a particular Act, reference the order and the specific Schedule entry (including carve‑outs and joint allocations). Remember that the Interpretation Act 1987 s 15 is invoked by the order (s 3, note) to interpret references to “the Minister” in Acts.
For regulated entities and stakeholders: approach the designated Minister for statutory matters. If a statute confers a power to make determinations, issue approvals or vary licensing arrangements, seek the relevant Ministerial office in Schedule 1. Where the Schedule shows joint administration, consider engaging both Ministerial offices to avoid missing relevant consultations or approvals.
For inter‑ministerial coordination: prepare protocols. The order does not prescribe how joint allocations are to be coordinated. Prepare practical protocols for consultation thresholds, lead Minister roles for particular decision types, and mechanisms for public statements or policy releases involving jointly administered Acts.
Check prior instruments and transitional arrangements. Because s 4(2) replaces inconsistent prior allocations and s 4(3) repeals the 2021 Perrottet Ministry order, review any legacy administrative or procedural arrangements that relied on the previous allocation. Ensure approvals made under a previous order are recorded and that any future approvals follow the current allocation.
Keep records of ministerial agency assignments for legal certainty. Where ministerial accountability is likely to be questioned in litigation or review, retain contemporaneous records showing which Minister was treated as administering a particular Act at the relevant time, citing the Schedule entry and commencement date.
The order does not create criminal obligations or enforcement mechanisms; compliance is about ensuring administrative processes, delegations and points of contact align with the Schedule. Where joint or partial allocations exist, proactive coordination documentation will reduce the risk of misdirected applications, delays, and accountability gaps.
