Administration Ordinance 1990 (Jervis Bay Territory)

Applied Act is defined in section 2 to cover two categories: (a) an Act or Ordinance of the Australian Capital Territory that is in force in the Territory because of section 4A of the Jervis Bay Territory Acceptance Act 1915, and (b) a continued State law that is an Act of New South Wales. This definition is the conceptual linchpin of the Ordinance. The Territory has no legislature of its own; it is governed by importing legislation from the ACT and, for continued State laws, from NSW. The "applied Act" concept identifies precisely which of those borrowed instruments the Ordinance's mechanisms operate upon.

Determination refers to a Ministerial instrument setting a fee under section 3B or section 3D. A determination is not a regulation; it is an administrative instrument. Its legal effect is conditional on Gazette publication (sections 3B(2) and 3D(2)), and it is subject to parliamentary tabling and disallowance under the procedures in sections 4G, 4H, 4J and 4K of the Jervis Bay Territory Acceptance Act 1915, applied by section 5 of this Ordinance as if the determination were an Ordinance. That equivalence is significant: it gives the legislature a check over fee-setting that would not otherwise exist for a purely executive instrument.

Fee as a debt due to the Commonwealth is the key enforcement concept for utility charges. Section 3B(4) provides that the amount of a fee imposed under section 3B(1) is a debt due to the Commonwealth. This transforms an unpaid utility charge into a civil debt recoverable in federal jurisdiction, without needing to establish a separate contractual claim. The determination may also specify when and how the fee must be paid (section 3B(2A)), which means the debt crystallises on the date or within the period the determination specifies.

Delegation under section 6 allows the Minister to delegate in writing to the holder of an office in "the Department" the power to determine fees under sections 3B(1) and 3D(1). "The Department" is not defined in this Ordinance, but in context means the Commonwealth Department responsible for Territories administration at the relevant time. Delegation cannot extend to a person who is not an office-holder within that Department.

Tabling and disallowance under section 5 applies the disallowance provisions of the parent Act to determinations made under this Ordinance. The practical consequence is that a fee determination can be disallowed by either House of Parliament within the applicable period, giving legislative oversight over what would otherwise be an unchecked executive pricing power.

The primary group affected is the residential and institutional population of the Jervis Bay Territory, a territory with a small permanent population that has historically included Australian Defence Force personnel and their families, along with the Wreck Bay Aboriginal Community. Anyone who receives water, electricity, gas, drainage and sewerage services, or refuse removal provided by the Minister is subject to fee obligations imposed by determination under section 3B. Because section 3B(3) allows different fees to be fixed for different localities or different circumstances, the fee burden can vary across the Territory's geography.

Regulated operators and administrators who exercise functions under applied ACT or NSW Acts in the Territory are also affected, because section 3 confirms that the Minister may make regulations under those applied Acts. Any person whose rights or obligations are governed by an applied Act (for example, tenants, landowners, business operators, or service providers operating under ACT-origin licensing regimes) may find that the Minister has made regulations adapting that applied Act to Territory conditions.

The Commonwealth itself, as the entity to which fees are owed, is an interested party. Section 3B(4) makes unpaid utility fees a debt due to the Commonwealth, so the Commonwealth bears both the benefit of revenue collection and the cost of debt recovery proceedings if fees go unpaid.

Officers in the relevant Commonwealth Department are affected by the delegation mechanism in section 6. An office-holder to whom the Minister delegates fee-determination power under that section takes on the associated legal responsibilities, including the requirement to publish determinations in the Gazette.

Section 3 creates a Ministerial power, not a duty: the Minister "may" make regulations under an applied Act. This is permissive. The constraints on that power are that regulations must not be inconsistent with the applied Act under which they are made (section 3(2)(a)), may only prescribe matters required, permitted or necessary for carrying out the applied Act (sections 3(2)(b)(i) and (ii)), and, where the applied Act specifies other matters, may extend to those matters (section 3(2)(c)). The penalty-prescribing power is bounded: regulations may prescribe penalties only up to the ceiling permitted by the relevant applied Act (section 3(2)(d)).

Section 3A creates another Ministerial power, again permissive, to make provision for the supply of the five listed utilities. The Ordinance does not impose a duty to supply; it only authorises. This is an important asymmetry. A resident has no statutory right to demand supply under this instrument; the Minister has a discretion to provide or not provide each utility.

Section 3B(1) imposes a fee obligation on persons who receive a utility or use a service provided by the Minister. The obligation is not contractual but statutory. The right of the person paying is to have the fee properly published in the Gazette before it becomes effective (section 3B(2)), to know the commencement date and any payment deadline (section 3B(2A)), and to have the determination subject to parliamentary disallowance (section 5).

Section 3B(4) gives the Commonwealth the right to recover unpaid fees as a civil debt. This is a right, not a penalty mechanism; it does not criminalise non-payment.

Section 4 gives users and administrators the assurance that ACT Ministerial determinations lawfully made and published in the ACT Gazette are treated as valid in the Territory without a further Ministerial act, reducing the risk of fee invalidity through procedural failure (subsection 4(1)). The Minister's independent power to determine fees under applied Acts is expressly preserved by subsection 4(2).

The Ordinance contains no criminal penalties in its operative provisions. The sole enforcement mechanism for unpaid fees is the civil debt recovery path created by section 3B(4): an unpaid utility fee is a debt due to the Commonwealth, enforceable through ordinary civil proceedings.

Section 3(2)(d) preserves the capacity to prescribe penalties in regulations made under applied Acts, but only up to whatever ceiling the applied Act itself permits. Any such penalties would appear in the regulations themselves, not in this Ordinance.

The disallowance mechanism in section 5 is a form of legislative enforcement against Ministerial overreach in fee-setting, rather than enforcement against individuals. If a determination is disallowed, any fees imposed under it would lose their legal basis from the point of disallowance, which would have practical consequences for the Commonwealth's ability to collect debts arising from that determination.

There is no provision for infringement notices, administrative penalties, licence revocations, or other regulatory enforcement tools in this instrument. The enforcement architecture is deliberately thin: the instrument is administrative in character, and substantive enforcement mechanisms are expected to come from the applied Acts themselves and the regulations made under them.

The practical consequence of this sparse enforcement architecture is that the Commonwealth's leverage over non-paying utility users is limited to civil debt recovery. For a territory with a small population, that may be adequate; for larger or more complex regulatory contexts, it would not be.

The foundational relationship is with the Jervis Bay Territory Acceptance Act 1915. The Ordinance is made under that Act (see the preamble), and section 5 expressly applies sections 4G, 4H, 4J and 4K of that Act to determinations made under this Ordinance. Those provisions govern tabling and disallowance in Parliament. The Ordinance therefore inherits the parliamentary oversight framework of the parent Act.

The relationship with applied ACT Acts and Ordinances is structural. Section 3 allows the Minister to make regulations under those applied Acts, and section 3(3) makes clear that this does not displace regulations already made under ACT or Ordinance authority that continue to apply in the Territory. The two regulatory streams coexist. Section 3D allows the Minister to step into the shoes of an ACT officer or person empowered to determine fees under an applied Act, acting "as nearly as is practicable" in accordance with that Act and subject to the Gazette publication requirement.

Section 4 creates a deeming mechanism that integrates ACT Ministerial fee determinations into the Territory's legal framework automatically, treating them as Commonwealth Ministerial determinations for Territory purposes. This reduces administrative duplication: the ACT Minister does not need to issue a separate Territory determination, and the Commonwealth Minister does not need to replicate every ACT fee schedule. The Minister's independent power under subsection 4(2) means the two systems can also diverge where Territory conditions warrant.

The Ordinance does not mention the Legislation Act 2003 or any other general Commonwealth legislative instrument framework by name. Given its compilation date of 1 September 2005, later reforms to Commonwealth instrument-making law may affect how determinations made under this Ordinance are characterised and registered, but that interaction is not addressed on the face of the instrument.

The source records three instruments in the Table of Instruments. The original Ordinance is Ordinance No. 1 of 1990, notified in the Gazette on 9 January 1991 and commencing on that date.

Ordinance No. 1 of 1996 (notified and commencing 21 August 1996) added sections 3A, 3B, 3C, 3D, 5 and 6. The original 1990 Ordinance therefore contained only sections 1, 2, 3 and 4; the utility supply and fee-setting regime, the fee-determination mechanism for applied Acts, and the tabling and delegation provisions were all introduced six years later in a single amending instrument.

Ordinance No. 1 of 2001 (notified and commencing 2 August 2001) amended section 3B and repealed section 3C. The amendment to section 3B added subsection (2A), which requires a determination to specify a commencement date and permits it to specify payment manner and deadline. Section 3C, which was added in 1996 and repealed in 2001, does not appear in the current compiled text; its content and purpose are not recoverable from this source. The heading to section 5 was also repealed and substituted by the 2001 Ordinance.

No other amendments are recorded in the compilation up to 1 September 2005.

The source does not name any cases. No litigation history can be reported from the text of this instrument.

Gazette publication is a condition of validity, not a formality. Sections 3B(2) and 3D(2) each provide that a determination "is of no effect" unless notice of the fee is published in the Gazette. This is a strict condition precedent. A determination signed by the Minister but not yet published, or published in the wrong Gazette (for example, the ACT Gazette rather than the Commonwealth Gazette, in a context where section 4 does not apply), would be void. Any fee purportedly imposed under such a determination would not be a debt due to the Commonwealth under section 3B(4), and any attempt to recover it as a debt would fail.

Section 4 operates automatically but only in one direction. The deeming provision in section 4(1) treats an ACT Ministerial determination as a Commonwealth Ministerial determination for Territory purposes, but only if it was made under an applied Act, published in the ACT Gazette, and the ACT Minister had authority to make it under the applied Act as in force in the ACT. A determination that is valid in the ACT but whose authority derives from a source that is not an "applied Act" within the section 2 definition would not be caught by section 4.

Delegation under section 6 is limited to fee-determination powers only. Section 6 lists only the power under section 3B(1) and section 3D(1) as delegable. The power to make regulations under section 3, the power to make provision for utility supply under section 3A, and the fee-deeming mechanism under section 4 are not delegable under this provision. An officer in the Department who purports to exercise any of those undelegated powers acts without authority.

Section 3C was repealed in 2001 and its content is not reproduced. The Table of Amendments records that section 3C was added in 1996 and repealed in 2001. Practitioners relying on this compiled text have no visibility into what that section contained. If legal questions arise about acts done under section 3C during 1996 to 2001, the original 1996 and 2001 Ordinances would need to be consulted directly.

The fee obligation under section 3B(1) is statutory, not contractual. A person receiving a utility or service from the Minister cannot argue that no fee is owed because there was no contract or that the fee was not agreed. The obligation is imposed by statute once the conditions (provision of utility or service by the Minister, a valid determination) are satisfied. Conversely, if the Minister has not made a determination, or if the determination is invalid for want of Gazette publication, no fee obligation arises under this Ordinance regardless of what has been provided.

Different fees for different localities (section 3B(3)) can create intra-Territory pricing disparities. The Minister may fix different fees for different localities or circumstances. A resident in one part of the Territory may lawfully pay more for the same utility than a resident elsewhere. This is not a compliance trap but a pricing design feature that practitioners advising Territory residents should be aware of when assessing the reasonableness of a fee.

For the Minister (or delegate). Any determination setting a fee under section 3B or section 3D must: (a) be made in writing; (b) specify the fee amount applicable to the relevant utility or service; (c) specify the date on which the fee commences to apply (section 3B(2A)); and (d) be published in the Commonwealth Gazette before it takes effect (sections 3B(2) and 3D(2)). The determination may optionally specify the manner of payment and any payment deadline (section 3B(2A)(a) and (b)), and may set different fee levels for different localities or circumstances (section 3B(3)). Following publication, the determination must be tabled in both Houses of Parliament and is subject to disallowance under sections 4G, 4H, 4J and 4K of the Jervis Bay Territory Acceptance Act 1915, as applied by section 5 of this Ordinance.

Where the Minister exercises the power under section 3 to make regulations under an applied Act, those regulations must not be inconsistent with the applied Act, must be confined to matters the applied Act requires or permits to be prescribed, and must not prescribe penalties exceeding the ceiling the applied Act specifies. Regulations that go beyond these bounds would be invalid to the extent of the inconsistency or excess.

For utility users in the Territory. A fee obligation under section 3B(1) arises once the Minister provides a utility or service and a valid determination sets the applicable fee. A user should check that a determination has been published in the Gazette, confirm the commencement date, and pay by the date or within the period specified in the determination. Non-payment converts the unpaid amount into a civil debt due to the Commonwealth (section 3B(4)), which the Commonwealth may pursue through ordinary debt recovery proceedings.

For delegates. An officer in the Department acting under a delegation from the Minister under section 6 must ensure the delegation is in writing, covers the specific power being exercised (either section 3B(1) or section 3D(1), or both), and that the officer holds the relevant office within the Department at the time the power is exercised. The delegate's determinations are subject to the same Gazette publication requirement and the same disallowance regime as determinations made by the Minister personally.

For those relying on applied ACT determinations. Where an ACT Ministerial determination is being relied upon as automatically applying in the Territory under section 4(1), confirm that the applied Act under which it was made is in force in the Territory by virtue of section 4A of the Jervis Bay Territory Acceptance Act 1915, that the determination was validly made by the ACT Minister under that Act, and that it was published in the ACT Gazette. If those conditions are met, no separate Commonwealth Ministerial determination is needed for Territory purposes, but the Commonwealth Minister's independent power under section 4(2) remains available if Territory-specific fee adjustments are required.
