97 Claim barred against executor or administrator in certain
cases
(1) When an executor or administrator has given the notices mentioned
in section 96, and a claim against the estate is sent in to him or her,
the administrator or executor may, if he or she disputes the claim,
serve upon the person, by whom or on whose behalf the claim was
sent in, a notice calling upon that person to take proceedings to
enforce his or her claim within a period of 6 months, and to duly
prosecute the claim.
(2) If, after that period of 6 months has expired, that person does not
satisfy the Court that he or she is duly prosecuting his or her claim,
the Court may, on application by the executor or administrator,
make an order barring the claim against the executor or
administrator, subject to such conditions as appear just, or make
such other order as the Court thinks fit.
