57 Administration of assets
(1) Where the estate of a deceased person is sufficient for the payment
in full of all the expenses, debts and liabilities payable from the
estate, his or her real and personal property is, subject to the
provisions of his or her will, if any, and to any law in force in the
Territory as to charges on property, applicable in the order set out
in Part I of Schedule 4 for the payment of the expenses, debts and
liabilities payable from the estate.
(2) Where the estate of a deceased person is insufficient for the
payment in full of all the expenses, debts and liabilities payable
from the estate, his or her real and personal property shall, subject
to the Bankruptcy Act 1966 of the Commonwealth, be administered
in accordance with the rules set out in Part II of Schedule 4.
