42 Revocation of grant of person living at the date of the grant
(1) Where the Court is satisfied that a person was living at the time
when probate of his or her will, or administration of his or her
estate, was granted by the Court, the Court:
(a) shall revoke the grant on such terms, if any, as the Court
thinks fit with respect to proceedings which have been
commenced by or against the executor or administrator or with
respect to costs or any other matter; and
(b) may at any time, whether before or after the revocation of the
grant, make such orders as the Court thinks fit for the
protection of the estate, including an order for an injunction
against the executor or administrator or another person and
an order for the appointment of a receiver.
(2) An application to the Court for the revocation, under subsection (1),
of a grant of probate of the will, or administration of the estate, of a
person may be made:
(a) by the person; or
(b) if the person has died since the grant – by any person entitled
to apply for a grant of probate of the will, or administration of
the estate, of the person or by a person interested in the
estate of the person.
