50 Court powers where exception to ademption causes unjust advantage or unjust disadvantage (1) A beneficiary under a will may apply to the Court if any beneficiary under the will gains an unjust advantage or suffers an unjust disadvantage by the application of— S. 50(1)(a) amended by No. 13/2019 s. 221(Sch. 1 item 1). (a) section 76 or 136 of the **Guardianship and Administration Act 2019**; or (b) section 83A of the **Powers of Attorney Act 2014**. (2) If the Court is satisfied that a beneficiary under the will gains an unjust advantage or suffers an unjust disadvantage, the Court may make any order it thinks fit to remedy the unjust advantage or unjust disadvantage, as the case may be. (3) Without limiting the powers of the Court, an order under subsection (2) may direct that a conveyance, deed or any other document be executed or any other action be taken. (4) In this section— ***unjust advantage*** means an unjust or a disproportionate advantage of a kind not contemplated by the testator in the will; ***unjust disadvantage*** means an unjust or a disproportionate disadvantage of a kind not contemplated by the testator in the will.
