### 43 Power to postpone distribution: Executor's year > > (1)  Subject to the foregoing provisions of this Act, a personal representative is not bound to distribute the estate of the deceased before the expiration of one year from the death. > > > (2)  *\[Section 43 Subsection (2) added by 26 Geo. V No. 66, s. 2 \]*Upon application as prescribed, a judge may, if he thinks it expedient and prudent so to do, empower the personal representative to – > > > > > > (a) postpone, for such period as the judge may think expedient, the realization of the estate of the deceased or any part thereof; > > > > > > > (b) carry on, for such period as the judge may think expedient, the business or affairs of the deceased, and for that purpose use his estate or such part thereof as the judge directs. > > > (3)  *\[Section 43 Subsection (3) added by 26 Geo. V No. 66, s. 2 \]*A personal representative acting in pursuance of leave given under this section shall not be answerable for consequent loss, except in case of breach of trust, negligence, or wilful default.
