49J Right not exercisable for certain tenancies
The right given by this division is not exercisable if the interest of the
intestate in the dwelling house is a tenancy—
(a) that will determine within a period of 2 years after the date of
death of the intestate; or
(b) that the landlord is, by notice given after the date of death of the
intestate, entitled to determine before the end of that period.
