The central concept is component time in service (TIS). This is the accumulated operating time on the specific window component, not on the airframe. The life limit of 5,000 hours for single pane cockpit side windows is measured in component TIS. The phrase "before 5000 hours component time in service, or within 1000 hours time in service whichever occurs last" creates a tricky compliance trigger: the operator must accomplish the replacement by the later of two events - either the window reaching 5,000 hours, or the expiration of 1,000 hours after the AD's effective date. That means an aircraft that already has a window with 4,800 hours TIS at the effective date must replace it within 200 hours (since 5,000 is sooner than 1,000 from effective). Conversely, a window with only 100 hours TIS must be replaced within 1,000 hours after effective date, not at 5,000 hours, because the later of the two is 1,000 hours. This detail is critical to understand.

Crack length thresholds are another core concept. The AD uses two numeric limits: 0.30 inches as the threshold for an individual crack that triggers stricter action, and 4.3 inches as the combined total crack length across the window that triggers mandatory replacement before further flight. Cracks below 0.30 inches, provided the total combined length does not exceed 4.3 inches, only require accelerated re-inspection at 25 hours TIS or 30 calendar days. If any crack reaches 0.30 inches or more, or the total combined length exceeds 4.3 inches, the operator must either replace the window or placard the aircraft for unpressurised operation and insert the AD into the flight manual limitations section. That placard must have letters at least 0.10 inches in height and be installed within the pilot's clear view near the pressurisation controls. This placarding option effectively downgrades the aircraft's pressurisation capability permanently for that window condition; it is not a temporary fix.

The AD distinguishes between single pane cockpit side windows and dual pane cockpit side windows and cabin windows. The life limit and post-installation inspection apply only to single pane cockpit side windows. Dual pane cockpit side windows and cabin windows are subject only to visual inspection for cracks and the associated crack-length compliance tables. The applicable service bulletins differ by model and are listed in the AD's paragraph 4 for acrylic cabin windows and acrylic cockpit side windows. The AD also cross-references the FAA AD 96-20-08 and the approved Fairchild Airframe Airworthiness Limitations Manual ST-UN-M001, which means the repetitive inspection requirements are embedded in the approved maintenance program for these aircraft.

The AD directly applies to any person who is the registered operator or owner of a Fairchild SA226 or SA227 series aeroplane falling within the listed model designations: SA26-T, SA26-AT, SA226-T, SA226-T(B), SA226-AT, SA226-TC, SA227-AT, SA227-AC, SA227-BC, and SA227-TT. These are relatively small commuter and corporate turboprop aircraft, many of which operate in Australia under charter, freight, or private categories. The operator bears the legal obligation to ensure compliance and must maintain records of component times and inspection results.

Maintenance organisations that hold approvals under the Civil Aviation Safety Regulations to perform airframe maintenance on these models are also affected, because they must be familiar with the AD to correctly perform the inspections and replacements. The AD requires work to be done in accordance with specific service bulletins and the applicable maintenance manual. Any maintenance release or certificate of release to service issued for these aircraft must reflect compliance with the AD. The manufacturer, Fairchild (now part of M7 Aerospace or other entities), is indirectly affected because its service bulletins are mandatory under the AD.

Other affected parties include insurance underwriters and financiers who may require AD compliance as a condition of coverage or leasing. Purchasers of these aircraft must verify that the AD's requirements are current and that component history records reflect the life limit and inspection intervals. Because the aircraft are often operated in hard-used environments such as short-haul regional transport, the AD imposes a recurring cost on operators that is not optional. The AD also affects any person who might operate or maintain an aircraft on behalf of an owner without the owner's knowledge, because the legal duty attaches to the aircraft itself: the AD says "prior to further flight" for certain actions, meaning the pilot in command and the operator share responsibility for determining airworthiness before each flight.

The primary duty is to replace all single pane cockpit side windows by the applicable compliance time: before the window reaches 5,000 hours component TIS, or within 1,000 hours TIS after 2 January 1997 (the effective date), whichever occurs last. After each such replacement, a post-installation inspection must be conducted between 10 and 20 hours TIS after installation. This inspection is separate from the routine visual inspections for cracks. A second duty is to inspect all acrylic cockpit side windows (including dual pane) and cabin windows for cracks in accordance with the applicable service bulletin. That inspection must be conducted initially by the compliance times set out in the appendices to the AD, which depend on whether cracks were found in prior inspections.

If cracks are discovered, the operator has a duty to measure them and apply the appropriate compliance table entry. The table provides conditional obligations. For example, if a single crack is found that is 0.30 inches or more but the total combined crack length is less than 4.3 inches, the operator has a right to choose among three options: (a) replace the window immediately and then conduct a post-installation inspection and subsequent 1,000-hour/12-month reinspection; (b) placard the aircraft for unpressurised operation and insert the AD into the flight manual, then conduct the post-installation inspection if later replaced, or if not replaced, revert to 25-hour/30-day reinspection; (c) do not replace but switch to a more frequent reinspection at 25 hours or 30 days. This choice grants the operator flexibility but comes with ongoing monitoring costs.

If the total combined crack length meets or exceeds 4.3 inches, there is no right to placard or use accelerated inspection. The only permissible action is replacement before further flight. The operator also has the right to claim credit for an inspection performed under the previous version of this AD, provided that inspection occurred within the preceding 1,000 hours TIS or 12 calendar months. That credit allows the operator to skip the initial inspection requirement and start with the repetitive interval based on that previous inspection date. However, if cracks were found in that previous inspection, the applicable condition entry from the table still governs.

The AD does not confer any right of appeal within its text; such rights exist under the general civil aviation regulations. It does not create a private right of action for passengers or crew. Its duties are public law duties enforceable by the regulator.

An airworthiness directive is a legislative instrument made under the Civil Aviation Regulations. Operating an aircraft without complying with an applicable AD is a breach of the regulations. The specific penalty provisions are not contained in the AD itself but in the parent legislation. Under the Civil Aviation Act 1988 (Cth) and the Civil Aviation Safety Regulations 1998, the maximum penalty for operating an unairworthy aircraft or for failing to comply with an AD can be significant. For corporations, penalties may reach hundreds of thousands of dollars per offence. For individuals, fines and potentially imprisonment are possible, though imprisonment is rare. In practice, the primary enforcement mechanism is the grounding of the aircraft. The Civil Aviation Safety Authority can issue a direction under regulation 256 of CASR that prohibits flight until compliance is demonstrated.

The AD itself is structured as a self-executing rule. Its language "prior to further flight" creates an immediate prohibition. A pilot who knowingly flies an aircraft with a cracked window that exceeds the AD's tolerance would be operating contrary to the AD and could face enforcement action including suspension or cancellation of licences. The AD's references to placarding and insertion into the flight manual create additional documentation obligations that are also enforceable: failing to placard or to update the flight manual is itself a breach.

Because the AD incorporates service bulletins by reference, those bulletins become mandatory. If a service bulletin specifies a particular inspection method (including dye penetrant or other techniques), that method is compulsory. Using an alternative method without approval would be non-compliance. The AD does not set out its own penalty quantum; enforcement occurs through the general regulatory framework. However, the practical cost of non-compliance far exceeds any fine: an aircraft that cannot show AD compliance cannot be registered or issued with a certificate of airworthiness, and may be unable to obtain hull insurance.

This AD was issued by the Australian regulator and references the equivalent FAA Airworthiness Directive 96-20-08. That cross-reference indicates a policy of harmonisation between US and Australian airworthiness requirements. Aircraft imported from the United States or operating under bilateral agreements often must show compliance with both FAA and CASA ADs. In practice, if the FAA AD is revised, CASA may issue a new amendment to this AD to maintain alignment. The AD text notes that amendment 2 was issued in response to a new FAA AD that shortened the repetitive inspection interval after overseas acrylic window failures occurred before the previous interval. This illustrates the dynamic interaction: Australian ADs often shadow FAA ADs, but may also differ in effective dates or applicability details.

The AD also references the approved Fairchild Airframe Airworthiness Limitations Manual, ST-UN-M001. That manual forms part of the approved maintenance program for these aircraft under CASR Part 42 or Part 91. The repetitive inspections required by this AD are already listed in that manual, so compliance with the manual would overlap with compliance with the AD. However, the AD may impose stricter intervals or additional requirements not in the manual; operators must comply with the more restrictive requirement. The relationship between the AD and the maintenance manual is that the AD takes precedence where it is more stringent.

The AD interacts with the general framework of Civil Aviation Regulations regarding continuing airworthiness. An operator's maintenance control manual must include procedures for ensuring AD compliance. The AD does not specify record-keeping details beyond what is implied by the need to demonstrate component TIS and inspection dates, but records of AD compliance must be retained and made available to CASA on request. The AD also interacts with the aircraft flight manual: paragraph 2 of the compliance table requires inserting a copy of the AD into the Limitations Section if the placard option is used. This makes the AD itself part of the flight manual, which carries legal weight for the flight crew.

Finally, the AD interacts with product liability and tort law indirectly. If an operator fails to comply and a window fails causing injury, that failure could be evidence of negligence or breach of statutory duty in civil proceedings. However, the AD does not create a statutory cause of action. It is primarily a public safety regulation.

This version is Amendment 3. The original issue of this Airworthiness Directive became effective on 26 January 1989. Amendment 1 became effective on 15 June 1989. Amendment 1 revised the Applicability paragraph and updated the reference to the relevant FAA AD. The original issue and first amendment were relatively minor in scope: they established the initial inspection regime for cockpit and cabin windows based on the then-current FAA directive. Amendment 2 became effective on 1 December 1993. Its purpose was to shorten the repetitive inspection interval. The source notes that this shortening was a direct consequence of several acrylic window failures that occurred overseas prior to the previously required inspection interval. In other words, the inspection interval had proven too long to catch developing cracks before they led to in-flight failures. Amendment 2 reduced the maximum interval between repetitive inspections (likely from a previous longer period down to the 1,000-hour or 12-month interval that Amendment 3 retained for windows without cracks).

Amendment 3, which is the version under analysis, became effective on 2 January 1997. It introduced two new elements: a life limit of 5,000 hours component time in service for single pane cockpit side windows, and a post-installation inspection of those windows between 10 and 20 hours after each installation. These were absent from earlier amendments. The background section states that Amendment 1 updated the FAA AD reference, but does not specify which FAA AD. The source also includes a note referencing FAA AD 96-20-08, which is likely the US counterpart at the time of Amendment 3. The amendment history implies that the AD has become gradually more stringent over time: first establishing inspections, then shortening intervals, then adding a hard life limit. The life limit eliminates the possibility of indefinite use of single pane cockpit side windows even if no cracks are found. This imposes a predictable replacement cost on operators.

The effective date of each amendment is stated. The original issue and amendments are all legislative instruments but may not have been registered on the Federal Register of Legislation at the time. Current legislative instrument registration requirements apply to new ADs. Operators dealing with these aircraft today must check whether this AD has been further amended or superseded. The source provided does not indicate any amendments beyond No. 3.

The source text does not mention any litigation concerning this AD. No court cases or tribunal decisions are referenced. Airworthiness directives are rarely challenged in court in Australia because the standard of review is narrow: the regulator must be satisfied that a safety issue exists, and courts generally defer to the regulator's technical judgment. There may have been administrative appeals to the Administrative Appeals Tribunal concerning enforcement decisions, but the source does not discuss them. It is possible that compliance disputes have arisen over interpretation of the compliance times, especially the "whichever occurs last" wording for the life limit, but no such cases are recorded in the source.

Because the AD is relatively old and applies to a limited fleet, the likelihood of published litigation is low. Most disputes are resolved through bilateral discussions with CASA or through the maintenance release process. The absence of litigation history does not mean the AD is without controversy; it simply means no public court decisions are part of this source. Practitioners should not assume that compliance is uncontested, and should be aware that CASA may issue directions or impose conditions on individual aircraft certificates if they suspect non-compliance. The AD itself does not provide for any appeal mechanism within its text; general administrative law remedies apply if an operator wishes to challenge a CASA enforcement action.

The source's reference to "in-flight failures have been reported overseas, involving injuries" suggests that personal injury litigation may have occurred in foreign jurisdictions, but nothing in the source indicates that such litigation affected the wording of the AD or that it was litigated in Australia. The AD's background section uses overseas failures as its justification, not domestic litigation.

Several traps await the unwary operator or maintainer. The first is the compliance time for the life limit of single pane cockpit side windows. The wording "before 5000 hours component time in service, or within 1000 hours time in service whichever occurs last" is counterintuitive. A window with 4,800 hours TIS at the effective date must be replaced within 200 hours (because 5,000 hours is sooner than 1,000 hours from effective). A window with 200 hours must be replaced within 1,000 hours from effective, not when it reaches 5,000 hours. Both trigger points are the later of the two, which means the earlier deadline might actually be the life limit itself if that limit is reached before the 1,000-hour window expires. Operators must calculate component TIS from installation records, not from airframe hours.

The second trap is the post-installation inspection interval: it must occur between 10 and 20 hours after installation, not later. If the window is replaced during a maintenance visit and the aircraft flies 20 hours before the inspection is performed, the compliance window has closed. The operator must ensure the inspection is scheduled before the 20-hour threshold. Similarly, if the inspection is done at 7 hours, it is too early and does not satisfy the AD. The AD expects the window to have been in service long enough for any installation-induced cracking to appear.

The crack length thresholds are easy to misread. The 0.30-inch threshold applies to any single crack, not the combined total. A crack 0.29 inches long with combined total 4.2 inches triggers the accelerated 25-hour/30-day reinspection, not the placard or replacement option. But if that same crack is 0.30 inches, the operator must either replace, placard, or switch to the even more restrictive 25-hour/30-day option - which is actually the same interval but with additional documentation obligations. The critical threshold is the 4.3-inch combined length, which forces immediate replacement with no alternative.

The placard and AFM insertion requirement carries its own traps. The placard must have letters at least 0.10 inches high and must be placed within the pilot's clear view near pressurisation controls. A placard placed elsewhere is non-compliant. The AFM insertion must be a copy of the AD into the Limitations Section, not just a note. If the window is later replaced, the placard must be removed and the AFM restored. Operators may forget to reverse the limitation after replacement.

The AD also allows credit for previous inspection results from the previous version, but only if the inspection was within 1,000 hours or 12 calendar months. If an operator had a crack-free inspection 1,100 hours ago, credit is not available. The operator must perform a new initial inspection.

Finally, the AD does not explicitly state that the life limit for single pane cockpit side windows resets after each replacement. It says "replace each single pane cockpit side window and then carry out a post installation inspection ... thereafter at each 5000 hours component time in service." That "thereafter" implies that the life limit applies repeatedly: each new window must be replaced at its own 5,000-hour mark. But component TIS for a new window starts at zero, so the 1,000-hour-from-effective date trigger only applies to the original replacement. Subsequent replacements are due solely at 5,000-hour intervals.

An operator of an affected Fairchild SA226/SA227 series aeroplane should take the following practical steps.

First, identify the aircraft model from its type certificate data sheet and confirm it is one of the listed models. Then obtain the applicable service bulletins from the AD's table. For cabin windows, the relevant bulletin depends on the model: for the SA26-T and SA26-AT, use 26-56-20-042 (issued November 1988, revised February 1991). For cockpit side windows, use bulletin 26-56-10-038 for the SA26 series, and the appropriate 226-56-003 or 227-56-003 for other models. Note that these bulletins may have been superseded by later revisions; the AD references a specific revision date, but using the latest revision that is approved by CASA would satisfy compliance if equivalent.

Second, determine the component time in service for each single pane cockpit side window. This requires examining maintenance records to find the installation date and the airframe hours at installation, then adding subsequent flight hours. If records are missing, it may be necessary to assume the window has no proven lower TIS and treat it as high-time. For aircraft with unknown history, the safest course is to replace all single pane cockpit side windows immediately.

Third, schedule the initial replacement for any single pane cockpit side window that does not meet the compliance time. After replacement, conduct the post-installation inspection between 10 and 20 hours after the aircraft returns to service. Document the inspection results. If cracks are found at that inspection, follow the compliance table: cracks below 0.30 inches and total under 4.3 inches require 25-hour/30-day re-inspection; cracks at or above 0.30 inches trigger a choice among replacement, placarding, or accelerated inspection. Most operators will opt for replacement to avoid the administrative burden of placarding and frequent re-inspection.

Fourth, for all other windows (dual pane cockpit side windows and cabin windows), conduct the initial visual inspection in accordance with the applicable service bulletin. The initial inspection must be performed by the compliance time set out in Appendix 1 (for cockpit side windows) and Appendix 2 (for cabin windows). The source provided does not reproduce those appendices, so the operator must obtain the full AD text from CASA or the FAA to see the specific initial compliance dates and crack condition tables. The tables in the source give examples but the appendices are authoritative.

Fifth, if no cracks are found, establish a re-inspection interval of 1,000 hours TIS or 12 calendar months, whichever occurs first. Maintain a system to track these intervals for each window individually. If cracks are found and the accelerated 25-hour/30-day regime is chosen, ensure that the next inspection occurs before that interval expires. This regime is onerous and should be avoided by replacing cracked windows as soon as practical.

Sixth, if using the placard option, fabricate a placard with "AIRPLANE MUST BE OPERATED UNPRESSURISED" in letters at least 0.10 inches high. Install it within the pilot's clear view near the pressurisation controls. Insert a copy of the entire AD into the Limitations Section of the approved Aircraft Flight Manual. Retain that copy in the AFM until the window is replaced. After replacement, remove the placard and remove the AD from the AFM limitations section.

Seventh, maintain a log of all inspections, replacements, and post-installation inspections. Record component TIS for each single pane cockpit side window from installation onward. Ensure that maintenance release certificates reference compliance with CASA AD/SWSA226/56 Amendment 3. If the aircraft is operated under a continuing airworthiness management organisation, that organisation must include this AD in its compliance monitoring system. Finally, check with CASA or a recognised aviation maintenance engineer for any subsequent amendments to this AD, because information provided here is based only on the source text for Amendment 3.
