The AD is constructed around a small set of core safety concepts and operational controls. First, it frames a class of meteorological events as "severe icing" that can exceed certification-protected operating envelopes. The Limitations Section to be added begins with a capitalised "WARNING" and states: "Severe icing may result from environmental conditions outside of those for which the aircraft is certificated." It identifies particular hazards: "Flight in freezing rain, freezing drizzle, or mixed icing conditions (super cooled liquid water and ice crystals) may result in: ice build-up on protected surfaces and exceed the capability of the ice protection system, or ice forming aft of the protected surfaces." The AD emphasises that such ice "may not be shed using the ice protection systems" and "may seriously degrade the performance and controllability of the aircraft."

Second, the AD relies on pilot observation of specific visual cues to identify when icing is more severe than certification assumptions. The cues listed are: "unusually extensive ice accumulation on the airframe and windscreen in areas not normally observed to collect ice, and/or accumulation of ice on the upper surface of the wing aft of the protected area." These cues are operationally decisive: their presence triggers procedural requirements.

Third, the AD imposes behavioural constraints on automation and configuration. It prohibits use of the autopilot "when any of the visual cues specified above exist, or when unusual lateral trim requirements or auto-pilot trim warnings are encountered while the aircraft is in icing conditions." This prohibition is premised on the observation that the autopilot may mask tactile cues signalling degraded handling.

Fourth, the AD prescribes pre‑flight and in‑flight equipment and procedural requirements. Pre‑flight it mandates that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night" and states that this requirement "supersedes any relief provided by any Minimum Equipment List." In flight it prescribes a sequence for exiting severe icing conditions: request priority handling from Air Traffic Control, avoid abrupt manoeuvres, do not engage the autopilot, disengage autopilot and hold the control wheel if it was previously engaged, reduce angle‑of‑attack for uncommanded roll, do not extend flaps while holding in icing conditions, and if flaps are extended do not retract them until clear of ice. The Normal Procedures Section also directs pilots to monitor ambient air temperature and warns that severe icing may form at temperatures as cold as minus 18 degrees Celsius but that pronounced vigilance is warranted around freezing.

Fifth, the AD sets administrative mechanics for compliance and certification. It states how compliance may be documented ("after a copy of this Directive is included in the appropriate sections of the aircraft's approved AFM") and permits certification of accomplishment by a private pilot licence holder. It contains two notes: Note 1 instructs registration certificate holders to notify potential PICs of the change, and Note 2 refers to an FAA AD.

These concepts together make the AD an operational regulation addressed to pilot behaviour, equipment operability at night, and AFM content. The AD does not supply technical modifications to the aircraft structure or ice protection systems; it changes operating limits, procedures, and documentation only.

The AD applies expressly to "Models PA46-310P, PA46-350P all serial numbers." That identification makes the scope aircraft-specific and model-specific. The principal affected parties are therefore:

• Certificate of registration holders for each applicable PA‑46 model. The Directive instructs certificate holders to "initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command" (Note 1), so holders have an affirmative duty to communicate the AFM change to potential operators.

• Pilots who act as pilot in command of the applicable aircraft models. The AD imposes operational prohibitions and procedures directly on pilot conduct in icing conditions: identification of visual cues, automatic-prohibition of autopilot use under specified cues or warnings, the requirement to request priority handling from Air Traffic Control, specified flap handling, and reporting to Air Traffic Control.

• Organisations responsible for the aircraft's AFM content, including the approved AFM custodian. The AFM must be revised in the Limitations and Normal Procedures sections to incorporate the AD text. The directive allows certification of accomplishment "after a copy of this Directive is included in the appropriate sections of the aircraft's approved AFM" which places an administrative requirement on the AFM custodian.

• Maintenance and ground operations staff insofar as they are responsible for ensuring wing icing inspection lights are operative prior to flight into known or forecast icing conditions at night. The AD states this requirement "supersedes any relief provided by any Minimum Equipment List," so maintenance sign‑off procedures may need to override MEL-based dispatch relief for these lights.

• Air Traffic Control may be indirectly affected, because pilots are instructed to "immediately request priority handling from Air Traffic Control" to facilitate route or altitude changes to exit severe icing. That instruction may increase requests for priority handling linked to these aircraft in icing conditions.

• Training providers and check instructors, who will need to ensure pilots understand the new AFM text, the visual cues, the autopilot prohibition context, and the specified emergency/exit procedures.

• Regulatory compliance and safety personnel within operators, who must ensure the AFM revision is incorporated "within 30 days after the Effective date of this Amendment" and certify compliance. The AD allows certification by a holder of a private pilot licence; that creates a low administrative barrier for operators without professional maintenance staff, but does not remove the need to update documentation and ensure crew awareness.

Entities not mentioned in the Directive remain outside its direct legal application. The AD does not require physical modification of the aircraft ice protection hardware, nor does it impose maintenance action beyond ensuring wing icing inspection lights are operative when required. The reference to FAA AD98-04-26 in Note 2 indicates external regulatory cross‑reference rather than an expansion of applicability within the text.

The Directive creates a set of discrete duties primarily on AFM holders and pilots. These obligations are textual and document-based rather than requiring physical modification beyond ensuring specified lights are operative.

AFM revision duty

• The Requirement mandates revision of two AFM sections. The Limitations Section must incorporate a "WARNING" and defined text identifying severe icing hazards. The Normal Procedures Section must incorporate identify‑and‑exit procedures, including monitoring ambient temperature and the listed procedures for exiting severe icing conditions. The Directive sets the content to be included; the duty is to incorporate that text into the aircraft's AFM.

Operational duties for pilots

• If any visual cues exist, the pilot must "immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions" and must follow the listed procedures for exiting the environment. The pilot must avoid abrupt manoeuvring, not engage the autopilot, hold the control wheel and disengage the autopilot if it had been engaged, reduce angle-of-attack on unusual roll or uncommanded roll control movements, not extend flaps when holding in icing conditions, and if flaps are extended, not retract them until clear of ice. The AD also requires reporting the weather conditions to Air Traffic Control.

Pre-flight equipment duty

• For night flight into known or forecast icing conditions, "All wing icing inspection lights must be operative prior to flight." The Directive emphasises that this requirement supersedes any relief otherwise provided by a Minimum Equipment List.

Notification duty for certificate holders

• Note 1 directs certificate of registration holders to "initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." That is an affirmative administrative duty.

Certification mechanics and right to certify

• The AD prescribes that "Certification for accomplishment of this Directive may be carried out: 1. after a copy of this Directive is included in the appropriate sections of the aircraft's approved AFM; and b. may be carried out at a minimum, by the holder of a private pilot's licence." This creates a right for a private pilot licence holder to certify that the AFM has been amended and that compliance has been accomplished, thereby lowering the procedural cost to operators who may not have a higher‑grade certifying authority readily available.

Rights or limits on rights

• The AD does not grant affirmative new permissions to operate in icing. Instead it imposes constraints and procedures. It does not provide exceptions, waivers, or variations in the text beyond the statement that certification may be carried out by a private pilot licence holder. The AD also states "This direction supersedes any relief provided by any Minimum Equipment List," thereby limiting any right to rely on an MEL to fly with non‑operative wing icing inspection lights for night flight into known or forecast icing conditions.

Temporal duty

• Compliance is time‑bound: the AFM revisions and other compliance must be completed "Within 30 days after the Effective date of this Amendment," with the Amendment effective 13 July 2000. The original AD had previously been effective on 23 March 2000; Amendment 1 corrects a word processing error.

Enforcement mechanism reference

• The AD is issued under the CASA delegate's powers under subregulation 39.1 (1) of CAR 1998. The AD text itself does not list penalties or enforcement procedures, but it connects the requirement to the regulatory authority invoked in the issuing paragraph.

Summary of concrete duties

• Revise the AFM Limitations and Normal Procedures sections with the specified text.
• Ensure wing icing inspection lights are serviceable for night flights into known or forecast icing conditions.
• Adopt and follow the in‑flight procedures when the specified visual cues or autopilot trim warnings occur.
• Notify prospective PICs of the AFM changes.
• Certify compliance, which may be done by a private pilot licence holder, after inserting a copy of the Directive into the AFM.

The AD does not itself state civil or criminal penalties, nor does it set out an enforcement regime or sanctions schedule within the text provided. The AD is framed as an instrument issued "under subregulation 39.1 (1) of CAR 1998" (introductory paragraph), which indicates it rests on statutory regulatory authority for issuance. The Directive therefore places the legal obligation in the regulatory domain but defers the expression of penalties and enforcement to the enabling regulation that it cites.

What is specified in this AD relevant to enforcement is procedural and administrative: operators must revise AFMs with the mandatory text and do so within a specified time period. The AD prescribes a precise compliance timeframe: "Within 30 days after the Effective date of this Amendment," and it sets the Amendment effective date as "13 July 2000." That fixed deadline creates a clear compliance window and a discrete act to certify. Certification may be performed "at a minimum, by the holder of a private pilot's licence," which provides a mechanism for documenting that the AFM has been amended and that the requirement has been fulfilled.

The AD also contains a statement intended to override operator reliefs: "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night. This direction supersedes any relief provided by any Minimum Equipment List." This is an operationally enforceable requirement because Minimum Equipment Lists ordinarily govern dispatch with inoperative equipment; superseding MEL relief means, operationally, operators cannot rely on MEL dispatch relief in this narrow context. Enforcement of that instruction would be through the aviation safety regulatory regime tied to CAR 1998, but the AD does not itself set penalties or procedures for enforcement actions.

In practical terms the AD creates conditions that inspectors, auditors, and enforcement officials would expect to find met during surveillance. Failure to have the AFM updated within the 30 day window or to have appropriate certification recorded, or failure to ensure wing icing inspection lights are operative when required, would place the operator in breach of the AD and thus potentially subject to regulatory enforcement under the enabling legislation. The AD itself directs certificate holders to notify any person who may operate their aircraft of the change, which gives a compliance record objective.

The AD does not provide for waivers, alternate compliance means, or specific rectification windows beyond the 30 day compliance period. Amendment 1 was issued to correct a word processing error, and the original AD effective date is recorded, but the text does not set differentiated enforcement consequences tied to the amendment history.

Because the AD references FAA AD98-04-26 in Note 2, it signals cognisance of equivalent or related regulatory measures by another authority, but the AD text does not invoke that FAA AD as a basis for enforcement within Australia.

The AD explicitly invokes and is issued under the authority provided by subregulation 39.1 (1) of CAR 1998. The text states that the CASA delegate revokes the earlier AD/PA-46/28 and issues this AD "under subregulation 39.1 (1) of CAR 1998." That linkage identifies the statutory rulemaking or directive authority. The AD’s requirements therefore sit within the broader regulatory regime created by CAR 1998 and subject to that regime’s enforcement and compliance frameworks, although this AD does not replicate CAR 1998’s enforcement provisions.

Operational cross‑reference within the AD is limited but important. The Directive states that its requirement concerning wing icing inspection lights "supersedes any relief provided by any Minimum Equipment List." Minimum Equipment Lists are the standard mechanism by which approved operators may receive relief to operate with certain inoperative equipment. By specifying that the wing icing inspection lights requirement supersedes any MEL relief, the AD creates a specific interaction: where MEL relief would otherwise permit dispatch at night with inoperative wing icing inspection lights, the AD removes that option for flights into known or forecast icing conditions at night. The result is a narrow, targeted override of MEL-based waivers in the specific operational context described.

The AD also refers to an FAA airworthiness directive in Note 2: "FAA AD98-04-26 refers." That reference situates the Directive in an international regulatory context, but the AD does not import or adopt the FAA AD text as operative in Australia. It is a cross-reference for information or consistency, not a legal incorporation.

The Directive contains certification mechanics that interact with operator documentation practices. It requires incorporation of the AD into the aircraft's "approved AFM" and allows certification "at a minimum, by the holder of a private pilot's licence." That interacts with rules concerning what constitutes the approved AFM for an aircraft and who may effect a certification for incorporation of amendments to that AFM. The AD's text therefore alters administrative practices within the universe of AFM control, but it does not directly amend AFM approval processes beyond requiring inclusion of the specified material.

Absent from the AD are explicit statements concerning insurance, contractual obligations, or airworthiness certificate status. The AD does not state that noncompliance will void airworthiness certificates or insurance coverage, although such consequences may follow under broader Australian aviation law or under insurer policy terms; those links are not made in the AD itself and therefore are outside the immediate text.

Overall, the AD sits as a regulatory instrument that modifies operator duties and AFM content, supersedes MEL relief in a narrow circumstance, and makes reference to the enabling CAR 1998 regulation and an FAA AD for informational context.

The document itself includes a compact amendment history covering the original AD and a single amendment. Key points are:

• The original Airworthiness Directive AD/PA-46/28 was issued earlier and "became effective on 23 March 2000." The AD text records that the original issue became effective on that date.

• Amendment 1 is issued to correct a word processing error in the initial issue. The front matter of this document states "Amdt 1" and in the Background it explicitly notes: "Amendment 1 is issued to correct a word processing error in the initial issue." The document therefore represents a technical editorial correction rather than a substantive policy or procedural extension.

• The Amendment 1 effective date is given as "This Amendment becomes effective on 13 July 2000." The Directive sets "Compliance: Within 30 days after the Effective date of this Amendment." Therefore the compliance deadline produced by Amendment 1 is 30 days after 13 July 2000.

• Administrative timing markers present in the document: it was signed by the CASA delegate, Bernard Malcolm Hole, dated "31 May 2000." The AD was "notified in the Commonwealth of Australia Gazette on 14 June 2000." These dates provide an administrative trail: signed 31 May, gazetted 14 June, Amendment effective 13 July, compliance within 30 days of effective date.

• The AD also revokes the prior AD/PA-46/28 and issues the following AD under the quoted regulatory authority; that revocation and replacement relationship is recorded at the start. The document therefore functions as both revocation and replacement, with Amendment 1 correcting a typographical or formatting error from the initial issue.

• The AD includes a Note 2 referring to FAA AD98-04-26, which indicates cross-reference to pre-existing FAA regulatory material; however the AD does not state any further amendment or incorporation of the FAA AD.

That is the complete amendment history present in the document. No further amendments, later revisions, or repeal language are in the provided text.

The AD text does not record any litigation, disputes, judicial decisions, or challenges arising from the Directive. The document contains no citations to cases, no records of enforcement proceedings, and no mention of appeals or judicial review matters. The only procedural legal references contained in the AD are to the enabling power "subregulation 39.1 (1) of CAR 1998" and to an external FAA AD as an informational note.

Therefore within the four corners of this Directive there is no litigation history to report. The AD was signed by the CASA delegate on 31 May 2000, notified in the Gazette on 14 June 2000, and the Amendment made effective on 13 July 2000. The document states that Amendment 1 corrects a word processing error. No disputes, court records, or tribunal proceedings are recorded in the text.

If litigation or administrative appeals occurred after issuance, they are not referenced here and are therefore outside the scope of the material provided.

Several operational and administrative points in the AD warrant careful attention because they are specific, potentially counterintuitive, or could be overlooked in standard AFM amendment workflows.

1. Scope is model‑specific and broad in serial number coverage

• The AD applies to "Models PA46-310P, PA46-350P all serial numbers." The "all serial numbers" language means every registered example of those two models is within scope, so operators cannot argue that only certain production blocks are affected. Failing to apply the AFM amendment to a single serial-numbered aeroplane would be noncompliance.

2. AFM insertion is mandatory and the text of the WARNING and procedures is prescriptive

• The AD prescribes verbatim text to be included in the Limitations and Normal Procedures sections. Operators must insert the specified WARNING and procedures; paraphrase or summary may not satisfy the Directive’s requirement. The certification mechanism requires incorporation "in the appropriate sections of the aircraft's approved AFM."

3. Night operations into icing are constrained regardless of MEL relief

• The AD expressly states "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night. This direction supersedes any relief provided by any Minimum Equipment List." That is a narrow but absolute override of MEL relief. Operators accustomed to MEL-based operational relief must ensure maintenance and dispatch procedures are updated so an MEL cannot be used to dispatch for such night icing flights.

4. Autopilot prohibition is conditional and potentially operationally disruptive

• The AD bans autopilot use when the visual cues are present or when "unusual lateral trim requirements or auto-pilot trim warnings" are encountered in icing. The prohibition rests on a visible or tactile pilot judgement. Because the autopilot may be engaged in routine operations, pilots must be trained to respond to the condition by immediately disengaging and holding the control wheel. The AD states "Since the auto-pilot, when installed and operating, may mask tactile cues that indicate adverse changes in handling characteristics, use of the auto‑pilot is prohibited" under the specified conditions. That is a safety trade-off: automation is restricted to preserve tactile feedback, but it requires clear pilot action.

5. Flap handling directions are counterintuitive for some pilots

• The AD warns "Do not extend flaps when holding in icing conditions" because flap extension "can result in a reduced wing angle-of-attack, with the possibility of ice forming on the upper surface further aft on the wing than normal, possibly aft of the protected area." Conversely, "If the flaps are extended, do not retract them until the airframe is clear of ice." This means pilots must avoid extending flaps in icing holds and must avoid retracting them if they were already extended, which may conflict with instinctive configuration management in some profile scenarios. The AD applies these directions "applicable to all flight phases from take-off to landing."

6. Visual cues may be subjective and depend on ambient light and inspection capability

• The AD’s trigger cues are visual: "unusually extensive ice accumulation ... and/or accumulation of ice on the upper surface of the wing aft of the protected area." Visual detection of ice aft of protected areas can be difficult in marginal light or with impaired inspection capability despite required wing icing inspection lights at night. The AD addresses this by mandating operative wing icing inspection lights for night flights into known or forecast icing conditions, but day‑time or poor visibility scenarios remain reliant on pilot observation.

7. Certification and recordkeeping can be performed by a private pilot licence holder

• The AD permits certification of accomplishment by "at a minimum, by the holder of a private pilot's licence." That is operationally convenient, but organisations should record who signed and ensure that their internal quality or audit procedures accept a private pilot certificate as adequate evidence.

8. Timeline is tight and effective dates are specific

• The Amendment becomes effective on 13 July 2000 and compliance is required within 30 days after that date. Operators needed to act promptly to incorporate the AFM amendment and to complete certification. The AD also revoked the previous AD, so care was needed to ensure that the replacement language was in force.

9. Reporting to Air Traffic Control is required

• Pilots are directed to "Report these weather conditions to Air Traffic Control." That adds an administrative interaction in addition to requesting priority handling. The requirement may generate ATC workload and needs to be reflected in pilot briefings.

10. The AD does not require physical modification to ice protection systems

• The directive focuses on procedures and AFM content. Operators looking for relief through hardware upgrades will find no requirement nor provision in this AD for structural or system changes. Any hardware upgrade or modification remains a separate matter.

Each of these items is grounded in the AD text. Operators, training departments, and maintenance planners should treat them as concrete implementation points rather than as advisory suggestions.

The AD sets out clear steps and a compliance timeline. Below is a practical, source-grounded compliance checklist distilled from the AD text. Each step follows directly from the AD’s Requirement, Notes, and Compliance sections.

1. Identify affected aircraft

• Confirm fleet registry for "Models PA46-310P, PA46-350P" and list all serial numbers under your control. The AD applies to "all serial numbers" for those models.

2. Revise AFM content

• Insert the precise WARNING text and the specified Normal Procedures text into the aircraft's approved AFM. The Limitations Section must include the WARNING about severe icing, the specified list of icing hazards, the visual cues, the autopilot prohibition language, the wing icing inspection lights statement, and any other text shown in the Requirement. The Normal Procedures Section must contain the weather conditions that may be conducive to severe icing, the procedures for exiting a severe icing environment (monitor ambient temperature, request priority handling from ATC, avoid abrupt manoeuvres, do not engage autopilot, hold control wheel and disengage autopilot if previously engaged, reduce angle-of-attack if unusual roll, do not extend flaps while holding in icing, do not retract flaps until clear of ice if already extended, report to ATC), and any Notes.

3. Incorporate the Directive into the "appropriate sections of the aircraft's approved AFM"

• The AD requires inclusion of a copy of the Directive in the appropriate AFM sections. Ensure the inclusion is physically placed in the AFM and that the AFM versioning and approval records are updated in accordance with your organisation’s document control practices.

4. Certify accomplishment

• After insertion of the Directive copy into the AFM, obtain certification of accomplishment. The AD allows certification "at a minimum, by the holder of a private pilot's licence." So either a private pilot licence holder or a higher-qualified person should certify that the AFM now contains the Directive text. Record the certifier’s name, licence number, date of certification, and aircraft registration. Maintain that documentation with the aircraft records.

5. Notify potential pilots

• As Note 1 directs, "Certificate of Registration holders should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." Implement a communication plan: written notification to owner/operators, posting to crew noticeboards, issuing a pilot briefing note or bulletin, and updating any electronic crew briefing material. Document distribution.

6. Maintenance and dispatch procedures for wing icing inspection lights

• Update maintenance release and dispatch checklists to ensure "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night." Remove any MEL-based dispatch relief for those lights in the specific scenario described. Maintenance control should log required rectification actions and ensure no flights are dispatched contrary to the AD.

7. Update training and SOPs

• Amend standard operating procedures and training syllabuses to reflect the AFM text: recognition of the visual cues, autopilot prohibition and immediate disengagement procedures, angle-of-attack reduction on uncommanded roll, flap handling rules in icing, requesting ATC priority handling, and mandatory reporting to ATC. Conduct a brief recurrent training or safety bulletin for all PICs and instructors emphasising that these procedures "are applicable to all flight phases from take-off to landing."

8. Operational contingency handling

• Implement in-flight decision-making checklists or quick-reference cards that incorporate the AD-prescribed steps (monitor ambient air temperature, identify visual cues, immediately request priority handling from ATC, avoid abrupt manoeuvres, do not engage autopilot, etc.). Ensure appropriate notations in the cockpit such as placards or quick-reference inserts for rapid recall.

9. Recordkeeping and audit trail

• Retain records showing the AFM amendment, certification of accomplishment, and distribution notices. Ensure these documents are available for regulatory inspection. Log maintenance actions relating to wing icing inspection lights and any operational incidents involving these procedures.

10. Review cross-references

• Note the AD reference to FAA AD98-04-26 in Note 2. Although the FAA AD is not incorporated, it may provide additional background information useful for training and safety analysis. Keep a copy of the FAA AD as a reference document if desired, but maintain primary compliance with the Australian AD text.

11. Timing

• Complete steps 2 through 4 within the compliance period set out by the AD: "Within 30 days after the Effective date of this Amendment," with the Amendment effective on 13 July 2000. Ensure that the compliance date is recorded and that actions are scheduled to meet it.

12. Operational enforcement and internal checks

• Conduct an internal compliance check after certification to ensure all aircraft in scope have AFMs updated, that certification is logged, and that pilots have been notified. Include inspection of wing icing inspection lights operability procedures in regular preflight and maintenance audits.

Following these steps will align the operator with the Directive’s requirements as stated. The AD does not require physical modifications to ice protection systems beyond ensuring wing icing inspection lights are operative when required, but it does require administrative, training, and operational changes that must be documented and certified.
