AD/PA-42/24 Amdt 1 - Aircraft Flight Manual, Flight into Icing Conditions

Applicability and legal basis: The AD is issued under subregulation 39.1(1) of CAR 1998 and applies to all serial numbers of PA42, PA42‑720 and PA42‑1000 aeroplanes. The instrument is an operational, safety‑directed amendment to the AFM rather than a physical modification mandate.

AFM amendment as the compliance mechanism: The AD requires textual insertions into two specific AFM sections, Limitations and Normal Procedures. The required text is presented verbatim in the AD. Compliance is achieved by incorporating the text into the appropriate AFM sections and by certifying that the incorporation has been made. The AD specifies that certification of accomplishment may be carried out after a copy of the Directive is included in the AFM, and that the certification may be performed by at least a private pilot licence holder.

Focused operational controls rather than hardware retrofit: The AD imposes operational limitations and procedures aimed at pilot recognition and immediate responses to severe icing, and it emphasises visual cues and procedural responses (requesting priority ATC handling, autopilot prohibition under specified circumstances, flap management, etc.). It does not mandate a retrofit or equipment change except for the operational requirement that “All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night,” which overrides any Minimum Equipment List relief.

Specific crew actions and prohibitions: The Limitations and Normal Procedures contain explicit behavioural prescriptions: identification cues, autopilot prohibition when cues exist (and when unusual lateral trim or autopilot trim warnings are encountered), non‑use or delayed retraction of flaps in icing, and immediate ATC coordination for exits from icing. The AD also cautions that autopilot may mask tactile cues and that severe icing can exist outside certificated envelopes.

Administrative and notification duties: The AD includes Note 1 directing certificate of registration holders to initiate action to ensure notification of the AFM change is conveyed to any person who may operate the aircraft as pilot in command. The AD gives a 30‑day compliance window from the effective date.

Reference to external safety material: The AD refers to FAA AD 99‑14‑01, indicating alignment or consistency with earlier FAA guidance; the AD states this as a reference (Note 2) but does not adopt other FAA content beyond the explicit textual insertions.

Scope of hazard addressed: The AD concentrates on hazards arising from severe icing conditions, including freezing rain, freezing drizzle and mixed icing (supercooled liquid water and ice crystals), and warns that such conditions can produce ice aft of protected surfaces that cannot be shed by ice protection systems, degrading performance and controllability.

Aircraft and operators: The AD applies to all serial numbers of the Piper PA‑42 family specified,PA42, PA42‑720 and PA42‑1000. Owners, operators, and certificate of registration holders of those aeroplanes are directly affected because they must incorporate the specified AFM revisions and ensure compliance within the 30‑day window following the effective date.

Pilots and flight crew: Pilots in command are directly affected by the new operational limitations and procedural requirements. The AD’s Limitations section contains prohibitions and mandatory actions that alter in‑flight decision‑making and handling (for example, autopilot not to be used when specified visual cues exist, immediate ATC priority request, flap handling rules). Note 1 specifically places a notification obligation on certificate holders to convey the change to any person who may operate the aircraft as pilot in command, thereby creating a downstream compliance obligation on employers, operators or owners who supply aircraft to other pilots.

Maintenance personnel and technical staff: The requirement that “All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night” affects maintenance and pre‑flight check procedures. Maintenance organisations and technical personnel will need to ensure inspection lights are operational before such flights; this may require adjustments to maintenance scheduling and pre‑flight verification processes.

Organisations using Minimum Equipment Lists (MELs): Operators that rely on an MEL for relief from inoperative equipment will be affected because the AD explicitly states that the wing icing inspection lights direction “supersedes any relief provided by any Minimum Equipment List.” That means MEL authorisations that would otherwise permit flight with inoperative wing icing inspection lights are displaced when the planned operation is into known or forecast icing conditions at night.

Regulatory and air traffic services: The AD requires pilots to “immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions.” That creates an expectation that ATC will be contacted and may, operationally, be asked to prioritise rerouting or altitude changes. ATC provision is not altered by the AD, but the operational pattern of requests may change for the affected aircraft in icing encounters.

Certification/administrative actors: The AD permits certification of compliance to be performed by at least a private pilot licence holder, which widens the class of people authorised to record accomplishment. This lowers the administrative barrier for certification compared with requirements that would limit certification to licensed maintenance engineers or authorised persons.

Third parties: Indirectly, passengers, insurers and other stakeholders in affected flights may face consequences from changes in operating patterns (e.g. diversions, delays or cancellations to avoid severe icing), but the AD itself addresses only operator obligations and pilot procedures.

Duties to amend AFM text: The principal duty imposed by the AD is to revise the AFM by incorporating the exact text provided into two sections: Limitations and Normal Procedures. The Limitations insertion includes a prominent WARNING about severe icing, a list of visual cues for identifying severe icing and specific prohibitions such as disallowing autopilot use when certain cues exist and requiring wing icing inspection lights operative prior to night flight into known or forecast icing. The Normal Procedures insertion defines weather conditions conducive to severe icing, prescribes actions to exit severe icing, and sets out monitoring and reporting steps. The AD requires that these textual changes be incorporated “in accordance with the instructions set out in the requirement section; and at the time mentioned in the compliance section.”

Notification duty: Note 1 places a duty on Certificate of Registration holders to “initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command.” That is an affirmative administrative duty to notify potential pilots of the AFM change.

Operational prohibitions and required actions: The AD requires pilots to act in specific ways when visual cues are present: immediately request priority ATC handling, avoid abrupt and excessive manoeuvring, do not engage autopilot (and if it was engaged, hold the control wheel firmly and disengage), reduce angle of attack if uncommanded roll is observed, avoid extending flaps when holding in icing conditions, and if flaps are extended do not retract until clear of ice. Pilots must report the weather conditions to ATC.

Inspection light requirement: The Limitations text requires that “All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night.” This is absolute in the AD and explicitly supersedes any MEL relief.

Certification of compliance: The AD prescribes how compliance may be certified: certification for accomplishment “may be carried out after a copy of this Directive is included in the appropriate sections of the aircraft's AFM; and b. may be carried out at a minimum, by the holder of a private pilot's licence.” That creates a delegated certification mechanism and defines who may sign off the accomplishment.

Timing duty: The AD sets a hard compliance timeframe: the AFM must be revised within 30 days after the effective date of the Amendment (effective date: 13 July 2000). The original AD became effective 23 March 2000; Amendment 1 became effective 13 July 2000 to correct a word processing error.

Reference duty: The AD includes reference to FAA AD 99‑14‑01 (Note 2), implying an informational linkage that operators and pilots may consult for related guidance. The AD itself, however, prescribes the mandatory AFM insertions that must be adopted.

Rights and omissions in the text: The AD does not create express rights for third parties or specify civil penalties within its text. It operates as a regulatory instrument under CAR 1998; enforcement and any penalty frameworks would be those provided by the relevant regulations, but the AD itself sets out mandatory operational and administrative duties.

Legal basis and regulatory force: The AD is issued under subregulation 39.1(1) of CAR 1998 and is presented as a mandatory safety instrument requiring action “that the delegate considers necessary to correct the unsafe condition” (as stated at the head of the AD). The directive language instructs that the action “be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.” This establishes the AD as a regulatorily enforceable requirement rather than advisory text.

Absence of specified penalties in the AD text: The AD itself does not enumerate specific monetary fines or criminal penalties for non‑compliance. The instrument focuses on prescriptive operational requirements and a compliance timeframe. Any sanctions for non‑compliance would flow from broader regulatory enforcement powers under CAR 1998 and related enforcement mechanisms available to CASA, rather than this AD’s text. The AD therefore sets duties but does not stipulate the enforcement tools or penalties in its content.

Enforcement mechanisms by implication: Because the AD is an amendment to the AFM and a directive from CASA under CAR 1998, practical enforcement is likely to occur through routine regulatory oversight, such as airworthiness inspections, ramp checks, review of AFMs, pre‑flight documentation and records, and responses to incident reports where failure to comply with the AFM could be a factor. The AD prescribes certification of accomplishment, which creates documentary evidence an inspector can review. The AD permits certification by a private pilot licence holder; such certification entry becomes the artefact that demonstrates compliance.

Operational enforcement interactions: The AD’s functional requirements (e.g. not using the autopilot when cues exist and ensuring wing icing inspection lights are operative prior to specified night flights) create conditions that will be verifiable during post‑flight investigations or routine audits. The “supersedes any relief provided by any Minimum Equipment List” clause for wing icing inspection lights means an operator’s MEL cannot be used to justify flight into known or forecast icing conditions at night with those lights inoperative, this is a direct operational constraint that inspectors can check against flight records and maintenance logs.

Certifying authority and signatory: The AD includes the delegate’s signature (Bernard Malcolm Hole) and was notified in the Commonwealth of Australia Gazette. Those formalities indicate the directive’s status as an official regulatory instrument enforceable under CASA authority.

Limits on the AD’s enforcement language: Because the AD does not include prescriptive enforcement measures or penalties within its contents, one cannot, from the AD text alone, specify the precise legal consequences of non‑compliance. Any enforcement process or sanctions would be governed by the wider statutory and regulatory framework under which the AD is issued.

Legal provenance: The AD is issued under subregulation 39.1(1) of CAR 1998, tying it into the broader airworthiness regulatory regime. The AD itself references that legal basis on its face; the AD text, however, contains no further cross‑references to other Australian statutes or regulations beyond the CAR citation.

Supersession of MEL relief: A specific and explicit interaction with operational regulatory instruments is provided: the AD states that the requirement that all wing icing inspection lights be operative before flight into known or forecast icing conditions at night “supersedes any relief provided by any Minimum Equipment List.” That is a direct operational override of MEL allowances, which normally allow some flights with inoperative equipment under specified conditions. Where the AD applies, the MEL cannot be relied upon to permit such flights.

Alignment with FAA AD: The AD notes “FAA AD 99‑14‑01 refers” (Note 2). This signals an intended alignment with existing FAA airworthiness directive guidance on similar issues. The inclusion of that reference does not itself alter Australian legal requirements, but it provides operators a cross‑jurisdictional reference for related guidance.

AFM regulatory relationship: The AD mandates AFM content changes. AFMs sit within an operator’s regulatory compliance documentation and are instruments relied on by regulators to determine standard operating procedures. The mandated insertions will thereby become the operator’s regulatory operational guidance. This affects the relationship between the operator’s manuals and any other regulatory approval documents or exemptions; in particular, it constrains how MELs and AFMs operate together given the MEL supersession clause.

Interaction with ATC responsibilities: The AD requires crew to “immediately request priority handling from Air Traffic Control” to obtain a route or altitude change to exit severe icing. This does not change ATC’s obligations under separate air traffic regulations, but it creates an identified interaction point between flight crew operating under the AFM and ATC services, effectively increasing the likelihood of ATC being asked to prioritise such aircraft in icing encounters.

Delegated certification and personnel regulations: The AD allows certification of accomplishment to be performed by a private pilot licence holder. That interacts with personnel qualification frameworks and may reduce the need to involve maintenance certifying staff for this administrative action. The legal effect is limited to the AD’s administrative certification of AFM amendment accomplishment and does not, in the AD text itself, change other certification or maintenance authorisation rules.

No express changes to airworthiness standards: The AD modifies operational documentation and procedures but does not, within its text, alter type certification standards, equipment mandates beyond the inspection lights requirement, or technical airworthiness limitations except as implemented through the AFM changes. Any broader change to airworthiness standards would be effected through separate regulatory instruments.

Issuance chronology: The AD indicates an original issue and a subsequent amendment. The original Airworthiness Directive became effective on 23 March 2000. Amendment 1 was issued to correct a word processing error in the initial issue and the Amendment became effective on 13 July 2000. The AD bears the delegate’s signature dated 31 May 2000 and was notified in the Commonwealth of Australia Gazette on 14 June 2000.

Reason for amendment: The AD states, in the Background, that “Amendment 1 is issued to correct a word processing error in the initial issue.” The substantive content of the safety requirements (AFM insertions) is presented in the Amendment; there is no indication in the AD text that Amendment 1 changes the safety intent, only that it corrects a textual error.

Citation and formal identification: The AD is numbered AD/PA‑42/24 Amdt 1 and titled “Aircraft Flight Manual, Flight into Icing Conditions 7/2000.” The formality of the delegate’s signature (Bernard Malcolm Hole) and Gazette notification provides the official record of the AD and its amendment.

Linkage to FAA AD: The AD includes a cross‑reference to FAA AD 99‑14‑01. The AD does not specify whether the original AD preceded or followed the FAA action beyond stating the reference and the dates above, but the inclusion signals coordination or cognisance of related FAA guidance.

Implementation timing: Compliance was required within 30 days after the effective date of the Amendment (i.e. within 30 days after 13 July 2000). The AD prescribes that incorporation of the text into the AFM and certification of accomplishment may be done after a copy of the Directive is included in the AFM.

Record of notification: The AD was notified in the Commonwealth of Australia Gazette on 14 June 2000. The signature date (31 May 2000) and Gazette publication date provide the formal public notification timeline in addition to the Amendment effective date.

No cases or litigation reported in the AD: The text of this AD does not recount any legal actions, appeals, or judicial decisions arising from its issuance. It does not name any court proceedings or administrative reviews relating to the content, compliance or enforcement of the directive.

Reference to FAA AD only: The AD notes “FAA AD 99‑14‑01 refers,” but that is a regulatory cross‑reference rather than an account of litigation. The AD’s background describes the purpose as minimising hazards by providing clearer procedures and limitations; it does not record any disputes or legal challenges to that purpose or to the directive itself.

Implication for legal research: Because the AD record provided contains no litigation history, a researcher seeking court commentary, challenges to CASA’s issuance, or precedent about the enforceability of these specific AFM amendments would need to consult external legal databases and administrative records beyond the AD text. The AD does not supply material on any appeals under administrative law or any civil suits linked to compliance.

MEL supersession is absolute for night icing flights: The AD states that “All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night. This direction supersedes any relief provided by any Minimum Equipment List.” Operators accustomed to using MEL relief for marginal equipment will be unable to rely on those MEL exemptions for this particular item where the flight is into known or forecast icing at night. This is a direct operational constraint and may require maintenance rectification or flight cancellations/delays where the lights are inoperative.

Autopilot prohibition and masking of tactile cues: The Limitations section explains that the autopilot “may mask tactile cues that indicate adverse changes in handling characteristics” and therefore prohibits autopilot use when the specified visual cues are present, or when “unusual lateral trim requirements or auto‑pilot trim warnings are encountered while the aircraft is in icing conditions.” Pilots and operators must plan for periods where manual flying is mandatory; this increases pilot workload and may have implications for single‑pilot operations, fatigue management and decision making, particularly during instrument meteorological conditions.

Visual‑cue reliance and subjective assessment: The AD relies on visual recognition of severe icing cues (unusually extensive ice in areas not normally observed, ice aft of protected areas, ice on nacelles/spinners farther aft than normal). These are subjective assessments requiring pilot judgement. The AD does not provide objective measurement thresholds, so crew training and clear operational guidance will be necessary to ensure consistent application.

Flap handling can be operationally constraining: The Normal Procedures admonish “Do not extend flaps when holding in icing conditions” and “If the flaps are extended, do not retract them until the airframe is clear of ice.” These instructions can complicate some holding or approach scenarios where flap changes are part of standard procedures; pilots must follow the AD’s instruction to avoid creating further aerodynamic hazards. Operators must ensure that SOPs and briefings incorporate these specific constraints.

Certification by private pilot licence holder: The AD allows certification of compliance to be carried out, at minimum, by a private pilot licence holder. While this lowers administrative barriers, it places responsibility on pilots (possibly non‑technical) to certify that AFM revisions have been incorporated. Operators should ensure that the certifying person understands the administrative and regulatory significance of the certification.

Short compliance window: Compliance is required within 30 days of the effective date (13 July 2000). That leaves little time for systematic operator roll‑outs, training and documentation updates, particularly for organisations with multiple aircraft. Operators will need to prioritise AFM revisions, distribution to pilots, and associated briefings.

No specific penalties listed: The AD does not enumerate monetary or criminal penalties; enforcement and sanctions will be those provided by the underlying regulatory framework. From a compliance management perspective, the absence of explicit penalties in the AD does not remove the regulatory risk of enforcement action if an operator is found non‑compliant.

Potential for operational disruptions: The combination of the inspection lights requirement and the autopilot/flap constraints could increase cancellations, diversions or delays for flights encountering icing forecasts or conditions, particularly at night. Operators must balance safety obligations in the AFM against commercial scheduling pressures.

Reference but no adoption of FAA material: The AD refers to FAA AD 99‑14‑01 but does not incorporate it by reference beyond that note. Operators seeking broader guidance may need to consult that FAA AD separately to understand related technical context.

Word processing correction note: Amendment 1 was issued to correct a word processing error in the original issue. Operators relying on versions of the AD should confirm they are using the corrected Amendment 1 text.

Immediate documentary actions (within 30 days): Incorporate verbatim the Limitations and Normal Procedures text provided in the AD into the appropriate sections of the aircraft’s AFM. The AD specifies that the Limitations section must include the WARNING and the visual cues, the autopilot prohibition clauses and the wing icing inspection lights requirement. The Normal Procedures section must include the listed weather conditions conducive to severe icing, the monitoring guidance (including the −18°C note), and the full “Procedures for exiting a severe icing environment” checklist items.

Certification of accomplishment: After a copy of the Directive is included in the appropriate AFM sections, certify the accomplishment. The AD states that certification “may be carried out at a minimum, by the holder of a private pilot's licence.” Ensure that the person signing the compliance certification records the date and that the AFM was updated with the AD text. Retain this certification entry as documentary evidence of compliance.

Operator notification duty: Certificate of Registration holders should “initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command.” Practically, this requires operators to distribute the updated AFM pages, conduct briefings for pilots, ensure that contract pilots or third‑party crews receive the new AFM content and secure sign‑offs documenting that pilots have been briefed and understand the changes.

Training and SOP updates: Train pilots and relevant crew on (a) the visual cues signalling severe icing, (b) the autopilot prohibition and the need to hold the control wheel firmly when disengaging an autopilot, (c) the checklist and communications steps to request priority ATC handling, (d) angle‑of‑attack reduction manoeuvres if uncommanded roll occurs, and (e) the flap handling rules in icing. Update standard operating procedures and briefings to align with the AFM changes. Because the AD relies on pilot recognition and immediate action, recurrent briefing and scenario training will reduce the risk of inconsistent responses.

Maintenance and pre‑flight checks: Ensure that wing icing inspection lights are in working order prior to any planned flight into known or forecast icing conditions at night. Given the AD’s explicit supersession of MEL relief for these lights, if the lights are inoperative the aircraft should not be dispatched for such flights unless the lights are repaired. Update maintenance control and pre‑flight checklists to capture a specific verification step for wing icing inspection lights where night icing flight is intended.

Flight planning and dispatch: Flight operations and dispatch teams should screen forecasts for known or forecast icing conditions and plan routes or contingencies accordingly. Ensure that pilots are briefed to request priority ATC handling immediately when visual cues of severe icing are observed. Where the risk of encountering severe icing cannot be reasonably mitigated, plan to avoid the flight or adjust departure times/altitudes.

Documentation retention and inspection readiness: Keep records demonstrating AFM revisions and pilot notification, and retain the compliance certification entry. These records will be the primary demonstrable proof of compliance for regulators or in post‑incident review.

Coordination with ATC and operational stakeholders: Inform operational control, dispatch, and relevant ATC liaison officers of the likely increased frequency of requests for priority handling in severe icing scenarios. While ATC response remains governed by ATC procedures, internal coordination will smooth execution when pilots request priority handling.

Cross‑reference FAA material if desired: Note 2 in the AD references FAA AD 99‑14‑01. Operators may consult that FAA AD for additional background or technical context, but compliance in Australia is achieved by adopting the AFM textual changes mandated by this AD.

Audit and internal compliance monitoring: Given the 30‑day compliance window, conduct internal audits shortly after implementation to verify that AFMs were amended, pilots were notified and trained, inspection lights procedures have been incorporated into maintenance/pre‑flight processes, and certification entries were properly recorded.

Practical considerations: Because the AD’s behavioural constraints (autopilot prohibition, flap rules, immediate ATC priority request) have operational consequences, integrate the AFM changes into normal crew briefings, approach/holding procedures and contingency planning to avoid ambiguity during a live encounter with severe icing.

Record the version used: Since Amendment 1 was issued to correct a word processing error in the initial issue, ensure the corrected Amendment 1 text is the version included in the AFM and that the documentation cites AD/PA‑42/24 Amdt 1 as the controlling instrument.
