AD/PA-31/127 Amdt 1 - Aircraft Flight Manual, Flight into Icing Conditions

This instrument is an Airworthiness Directive (AD), designated AD/PA-31/127 Amdt 1, issued by a delegate of the Civil Aviation Safety Authority (CASA) under subregulation 39.1(1) of the Civil Aviation Regulations 1998. The AD revokes the initial AD/PA-31/127 and re-issues the directive with a correction to a word‑processing error. Mechanically, it requires an amendment to the Aircraft Flight Manual (AFM) for the entire Piper PA-31 family listed in the Applicability: "Models PA31, PA31-300, PA31-325, PA31-350, PA31P, PA31T, PA31T2, and PA31-P-350, all serial numbers." The AD prescribes specific text that must be incorporated into two AFM sections: the Limitations Section and the Normal Procedures Section. The mandated Limitations text includes a WARNING that "Severe icing may result from environmental conditions outside of those for which the aircraft is certificated" and sets out visual cues that, if present in flight, require immediate action and prohibit autopilot use in certain circumstances. The Normal Procedures text prescribes monitoring ambient temperature, identifies weather conditions "conducive to severe in‑flight icing", sets out procedures for exiting severe icing (including requesting priority handling from Air Traffic Control), and contains operational prohibitions and manoeuvring guidance about autopilot and flap use.

The AD sets a fixed compliance timeframe: "Within 30 days after the Effective date of this Amendment." The Amendment becomes effective on 13 July 2000; the original AD became effective 23 March 2000. The AD also specifies how compliance may be certified: "after a copy of this Directive is included in the appropriate sections of the aircraft's AFM; and b. may be carried out at a minimum, by the holder of a private pilot's licence." The AD indicates that the wing icing inspection lights "must be operative prior to flight into known or forecast icing conditions at night" and explicitly notes that this direction "supersedes any relief provided by any Minimum Equipment List." The AD was signed by the CASA delegate and notified in the Commonwealth of Australia Gazette on 14 June 2000. The document also makes an explicit cross‑reference to FAA AD99‑14‑01.

The AD is founded on a single safety concept: defined procedures and AFM limitations reduce the hazard posed by severe in‑flight icing that may exceed the aircraft's certified icing envelope. The document identifies the unsafe condition as severe icing that may occur outside certificated conditions and which can produce ice "that may not be shed using the ice protection systems, and may seriously degrade the performance and controllability of the aircraft." That statement appears in the Limitations text the AD requires to be inserted into the AFM.

Key operational concepts mandated by the AD are:

• Visual cue‑based detection: The AD prescribes three visual cues to identify severe icing while airborne: "unusually extensive ice accumulation on the airframe and windscreen in areas not normally observed to collect ice," "accumulation of ice on the upper surface of the wing aft of the protected area," and "accumulation of ice on the engine nacelles and propeller spinners farther aft than normally observed." If any cue exists, the pilot must "immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions."

• Autopilot constraint: The AD states that the autopilot "may mask tactile cues that indicate adverse changes in handling characteristics" and therefore prohibits use of the autopilot "when any of the visual cues specified above exist, or when unusual lateral trim requirements or auto-pilot trim warnings are encountered while the aircraft is in icing conditions." If the autopilot is engaged when the cues appear, the pilot must "hold the control wheel firmly and disengage the autopilot."

• Lighting and MEL interaction: The AD requires that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night" and expressly declares this requirement to "supersede any relief provided by any Minimum Equipment List." That places this AD’s requirement above MEL authorisations for wing icing inspection lights in the context described.

• Temperature and moisture guidance: The Normal Procedures text expands on meteorological cues: "THE FOLLOWING WEATHER CONDITIONS MAY BE CONDUCIVE TO SEVERE IN-FLIGHT ICING: Visible rain at temperatures below 0 degrees Celsius ambient air temperature; Droplets that splash or splatter on impact at temperatures below 0 degrees Celsius ambient air temperature." It also warns severe icing "may form at temperatures as cold as -18 degrees Celsius" and recommends increased vigilance "at temperatures around freezing when visible moisture is present."

The AD explicitly targets a defined fleet and the parties responsible for their operation and documentation. Applicability is unqualified by serial number restrictions: "Models PA31, PA31-300, PA31-325, PA31-350, PA31P, PA31T, PA31T2, and PA31-P-350, all serial numbers." That means every aircraft of those model types registered in Australia must comply.

Affected parties and their roles, as stated or implied by the AD text, are:

• Certificate of Registration holders: The AD contains Note 1: "Certificate of Registration holders should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." That places a duty on the registered owner or entity named on the certificate to notify prospective PICs/operators of the AFM amendment.

• Operators and pilots-in-command: The AFM changes affect crew procedures and limitations. Pilots must follow the newly-mandated Limitations and Normal Procedures in flight, including monitoring ambient air temperature, recognising the specified visual cues, requesting ATC priority, and observing the autopilot and flap instructions.

• Maintenance organisations and maintenance personnel: The requirement that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night" affects pre‑flight inspection and maintenance decision‑making. Because this requirement "supersedes any relief provided by any Minimum Equipment List," maintenance or dispatch decisions that might otherwise permit flight under MEL relief cannot be used to lawfully depart at night into known/forecast icing if the wing inspection lights are inoperative.

• Flight operations and safety managers: They must ensure AFMs are revised with the mandated text and that pilots and relevant personnel are notified. The AD’s compliance certification provision ("Certification for accomplishment of this Directive may be carried out... may be carried out at a minimum, by the holder of a private pilot's licence") shifts some administrative burden, but the operational responsibility for training and SOP updates rests with operators and safety managers.

• Air Traffic Control interface: The AD requires pilots to request "priority handling from Air Traffic Control" and to report observed weather conditions to ATC, which will affect ATC workload and require ATC procedures that permit rerouting or altitude changes as requested.

The AD imposes discrete documentary, operational and equipment duties and defines limited rights regarding certification of compliance. The duties and rights in the text are:

Documentary duty

• Incorporation into AFM: The principal duty is to "Revise: The Limitations Section of the aircraft's Aircraft Flight Manual (AFM) by incorporating the following:" and similarly to incorporate specified text into "The Normal Procedures Section of the AFM." The AD provides exact wording and warnings that must be adopted.

Operational duties

• Recognition and exit: If any of the visual cues are observed, the pilot must "immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions."
• Avoidance of abrupt control inputs: The pilot must "Avoid abrupt and excessive manoeuvring that may exacerbate control difficulties."
• Autopilot restrictions: The AD instructs "use of the auto-pilot is prohibited when any of the visual cues specified above exist, or when unusual lateral trim requirements or auto-pilot trim warnings are encountered while the aircraft is in icing conditions." If the autopilot was previously engaged, the pilot must "hold the control wheel firmly and disengage the autopilot."
• Angle‑of‑attack and roll response: "If an unusual roll response or un-commanded roll control movement is observed, reduce the angle-of-attack."
• Flap management: "Do not extend flaps when holding in icing conditions." If flaps are extended, "do not retract them until the airframe is clear of ice."
• Lighting requirement: "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night." This direction "supersedes any relief provided by any Minimum Equipment List."

Reporting duty

• The pilot must "Report these weather conditions to Air Traffic Control."

Certification/administrative rights and duties

• Compliance timeframe: Compliance is required "Within 30 days after the Effective date of this Amendment."
• Certification mechanism: The AD permits certification of accomplishment "after a copy of this Directive is included in the appropriate sections of the aircraft's AFM; and b. may be carried out at a minimum, by the holder of a private pilot's licence." This provides a right to use a private pilot licence holder as the minimum qualified person to certify that the AFM has been updated.

The AD itself is issued under the authority of CASA "under subregulation 39.1 (1) of CAR 1998" and is signed by a CASA delegate. The document records it was "notified in the Commonwealth of Australia Gazette on 14 June 2000." Those facts indicate the AD is a formal regulatory instrument promulgated through appropriate administrative channels. The AD sets a clear compliance window: "Within 30 days after the Effective date of this Amendment" (effective 13 July 2000).

The AD text does not specify particular penalty provisions, monetary fines, or the precise enforcement process within the document. It does not list administrative sanctions, prosecution sections, or infringement notice details. Therefore, the AD itself must be read together with the statutory framework authorising CASA to issue and enforce ADs, namely CAR 1998 subregulation 39.1(1), which is referenced as the legal basis for issuance. The AD records the delegate's revocation and re‑issue of the earlier AD, indicating an administrative process for amending AD content.

What the AD does provide that is relevant to enforcement and evidentiary practice:

• Compliance deadline: It establishes an explicit timeline for compliance. Failure to complete the required AFM revision and associated actions within "Within 30 days after the Effective date of this Amendment" will, in practice, leave the aircraft out of compliance with the AD from a regulatory perspective.
• Certification of accomplishment: The AD prescribes a minimum pathway for certifying compliance: inclusion of a copy of the Directive in the AFM and certification "may be carried out at a minimum, by the holder of a private pilot's licence." That creates an administrative record that may be used to demonstrate compliance but does not purport to be the exclusive method of proof.
• Superseding MEL relief: The AD’s direction that certain equipment "must be operative" and that this "supersedes any relief provided by any Minimum Equipment List" creates a direct limitation on operators’ ability to rely on MEL authorisations to defer rectification of wing icing inspection lights for the specified flights at night.

Practitioners should therefore treat the AD as a binding operational requirement that must be complied with within the stated timeframe. Absent express penalty language in the AD text, enforcement actions (including notices, suspension of operations, or prosecutions) would be founded on the broader regulatory scheme under CASA and the CAR 1998 provisions referenced. The AD’s Gazette notification provides the public promulgation that typically underpins enforceability.

The AD is anchored to the Civil Aviation Regulations 1998 by explicit citation: it was "issued... under subregulation 39.1 (1) of CAR 1998." Consequently, the AD sits within the regulatory framework CASA operates under. The text also interacts with operational documentation regimes by directly addressing the Minimum Equipment List (MEL): it states that the wing icing inspection lights requirement "supersedes any relief provided by any Minimum Equipment List." That creates a hierarchy between AD requirements and MEL relief insofar as the specified lighting condition and flight context are concerned.

Other interactions stated or implied by the AD text:

• AFM and operational documentation: The AD requires specific amendments to the AFM’s Limitations and Normal Procedures sections. AFMs are a core instrument of airworthiness and operational control. The AD’s mandatory AFM text will therefore interact with operator standard operating procedures and training syllabi that reference AFM limitations. The AD does not specify how operators should manage any subsequent conflicts between company SOPs and the newly inserted AFM text; however, AFM limitations typically set a baseline that operators must observe.

• MELs and dispatch decisions: By declaring that the nighttime wing icing inspection lights requirement "supersedes any relief provided by any Minimum Equipment List," the AD precludes operators using MEL relief to lawfully dispatch at night into known or forecast icing when those inspection lights are inoperative. This is a specific intersection where an AD creates a higher priority obligation than the MEL in the scenario described.

• International airworthiness guidance: The AD references "FAA AD99‑14‑01" as "Note 2" in the AFM text. The AD does not make FAA AD99‑14‑01 binding in Australia, but the reference signals an alignment with or acknowledgement of FAA airworthiness guidance. For operators or maintainers who also work with FAA documentation, that cross‑reference is relevant to continued airworthiness considerations and may prompt coordination of compliance records across jurisdictions.

• ATC procedures and civil aviation practice: The AD requires pilots to "immediately request priority handling from Air Traffic Control" and to report the conditions. That intersects operationally with ATC responsibilities to facilitate route or altitude changes. The AD does not amend ATC obligations but imposes a duty on pilots to request priority handling. ATC agencies would therefore be the likely operational counterpart in executing the escape from severe icing conditions.

The document provides a short, explicit amendment trail. The AD appears as an amendment and replacement to a prior instrument. The key chronological points are:

• Original AD issuance: The "original issue of this Airworthiness Directive became effective on 23 March 2000." That is the starting point recorded in the document for the AD series.

• Amdt 1 issuance: This document is titled "AD/PA-31/127 Amdt 1" and is described as revoking AD/PA-31/127 and issuing the amended AD. The reason given for Amendment 1 is technical: "Amendment 1 is issued to correct a word processing error in the initial issue." The AD is dated and signed by the CASA delegate, Bernard Malcolm Hole, on "31 May 2000."

• Gazette notification and effective date: The text states that the AD "is notified in the Commonwealth of Australia Gazette on 14 June 2000." Despite that notification date, the AD sets an explicit "This Amendment becomes effective on 13 July 2000." In addition, the Compliance clause requires action "Within 30 days after the Effective date of this Amendment." That fixes the compliance deadline relative to 13 July 2000.

• Relationship to earlier AD and supersession: The AD begins by revoking the earlier instrument "for the reasons set out in the background section" and re-issues the directive. The Background statement explains the AD "is issued to minimise the potential hazards associated with operating the aircraft in severe icing conditions by providing more clearly defined procedures and limitations associated with such conditions." The Amendment 1 is specifically to correct a word processing error in the initial issue, so the substance of the operational requirements appears unchanged except for the corrected wording.

• Cross‑reference to other regulatory instruments: The AD includes "Note 2: FAA AD99-14-01 refers." That indicates a referenced related AD from the FAA, though the Amendment history contained within this Australian AD consists only of the original issue and this correction amendment.

Practitioners reviewing the amendment history should note the following operational points derived from the document:

• There was a prior AD with the same number that became effective on 23 March 2000, which was then revoked and re-issued with an amendment labelled 1; Amendment 1 corrects a drafting error.
• The amended AD provides an effective date and a 30‑day compliance window, so owners and operators needed to act within a specified administrative timetable.

The AD text provides no information about any litigation, appeals, judicial review, or administrative disputes related to AD/PA‑31/127 or its Amendment 1. There are no cases cited, no reference to legal challenges, and no mention of proceedings or decisions under review. The document’s content is confined to the regulatory amendments, required AFM text, compliance date, and administrative record (signature and Gazette notification).

Given the absence of litigation information in the AD itself, the instrument does not record nor purport to document previous or ongoing court or tribunal matters. The only cross‑reference to other jurisdictions is the note that "FAA AD99‑14‑01 refers," which is a reference to a United States Federal Aviation Administration AD; that reference is directional and does not indicate litigation.

For practitioners, the absence of litigation history within the AD text means:

• The AD as published provides the operative regulatory obligations without appended legal precedents or litigation‑derived qualifications.
• Any inquiry into whether this AD has been the subject of subsequent legal challenge would require documentary or legal research outside the text of the AD itself; the AD does not supply such a record.

This section is confined to what the AD records: a null entry for litigation history in the document itself.

Several practical pitfalls and specific compliance traps are embedded in the AD’s wording. These are matters that operators, owners and pilots should note carefully because the AD uses precise language that changes operational discretion and documentation practices.

AFM insertion and certification precision

• The AD requires insertion of exact wording into two AFM sections. The Compliance clause permits certification "after a copy of this Directive is included in the appropriate sections of the aircraft's AFM." A potential pitfall is failing to place the text exactly where the AD requires (Limitations and Normal Procedures). Certificate holders should document the location and method of insertion since the AD contemplates that act as the event permitting certification. The AD also permits a private pilot licence holder to effect the certification, which lowers the minimum personnel standard for the administrative sign‑off; operators should ensure their records clearly show who carried out the insertion and their qualifications to avoid later disputes about whether the administrative act complied with the AD.

Timeline squeeze

• The AD becomes effective on 13 July 2000 and requires compliance "Within 30 days after the Effective date of this Amendment." Missing the 30‑day window will leave the aircraft non‑compliant with an issued AD. The AD does not provide for staged or partial compliance with the AFM insertion requirement.

MEL supersession nuance

• The AD states that wing icing inspection lights "must be operative prior to flight into known or forecast icing conditions at night" and that this "supersedes any relief provided by any Minimum Equipment List." A common operational pitfall is assuming MEL relief can be used to defer repair of inspection lights for night icing flights. The AD eliminates that option in the contexts described; operators must ensure MEL-based dispatch practices are updated and that flight release authorities are aware of the supersession.

Autopilot operational constraint and masking tactile cues

• The AD prohibits autopilot use when specified visual cues exist, or when unusual lateral trim requirements or autopilot trim warnings are encountered while in icing conditions. Because some operators routinely use autopilot in cruise, and some SOPs envisage autopilot use during segments of flight where icing is possible, there is a risk that crews will not be current or trained to transition quickly to hand‑flying and to detect tactile cues after prolonged autopilot use. Training and SOPs must reflect the AD’s instruction: if cues arise, the autopilot must be disengaged. There is also the operational specificity that autopilot is permitted until the cues appear; that requires clear pilot understanding of the cues defined by the AD.

The AD prescribes a concise set of concrete steps that, taken as written, achieve compliance. The following is a pragmatic compliance checklist assembled strictly from the AD text. Each step should be documented in the aircraft’s compliance records.

1. Identify applicability and affected aircraft

• Confirm the aircraft model matches the Applicability clause: "Models PA31, PA31‑300, PA31‑325, PA31‑350, PA31P, PA31T, PA31T2, and PA31‑P‑350, all serial numbers." If the aircraft is in that list, proceed; otherwise this AD does not apply as written.

2. Insert mandated AFM text into the correct sections

• Revise the Limitations Section of the AFM by incorporating the exact WARNING and associated visual cues and autopilot prohibition text supplied in the AD. The AD supplies precise wording beginning with "WARNING" and the subsequent paragraphs describing severe icing hazards, visual cues, automatic pilot prohibition, and the wing inspection lights requirement.
• Revise the Normal Procedures Section of the AFM by incorporating the exact procedural text supplied: the "THE FOLLOWING WEATHER CONDITIONS MAY BE CONDUCIVE TO SEVERE IN‑FLIGHT ICING," the "PROCEDURES FOR EXITING A SEVERE ICING ENVIRONMENT" with its numbered actions and notes, and the caveats about ambient temperature and vigilance.

3. Certify the AFM revision within the compliance window

• Ensure the AFM revision is completed "Within 30 days after the Effective date of this Amendment" (Effective date 13 July 2000). The AD permits certification of accomplishment once a copy of the Directive is included in the AFM. The AD also provides that such certification "may be carried out at a minimum, by the holder of a private pilot's licence." Record the date of AFM insertion and the name and licence of the certifying person. Retain a copy of the AD in the AFM per the AD’s instruction.

4. Notification to pilots and operators

• As per Note 1: certificate of registration holders "should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." Maintain documented confirmation of notification (for example, signed acknowledgement, email trail or crew briefing record).

5. Update SOPs, training and briefings

• Update operator SOPs and crew briefings to reflect the restricted autopilot use: "use of the auto‑pilot is prohibited when any of the visual cues specified above exist, or when unusual lateral trim requirements or auto‑pilot trim warnings are encountered while the aircraft is in icing conditions." Ensure crews are trained to disengage autopilot as required and to "hold the control wheel firmly and disengage the autopilot" if engaged when cues appear.
