AD/PA-30/35 Amdt 1 - Aircraft Flight Manual, Flight into Icing Conditions

The AD rests on a small set of concrete safety concepts and operational controls, stated in the AFM text the AD directs be inserted. First, the hazard framing: "Severe icing may result from environmental conditions outside of those for which the aircraft is certificated." The AD highlights mixed icing and freezing precipitation, saying "Flight in freezing rain, freezing drizzle, or mixed icing conditions (super cooled liquid water and ice crystals) may result in: ice build-up on protected surfaces and exceed the capability of the ice protection system, or ice forming aft of the protected surfaces." The AD explains that such ice "may not be shed using the ice protection systems, and may seriously degrade the performance and controllability of the aircraft."

Second, identification is visual and symptom‑based. The operator is given a short list of visual cues to identify icing that exceeds certification: "unusually extensive ice accumulation on the airframe and windscreen in areas not normally observed to collect ice," "accumulation of ice on the upper surface of the wing aft of the protected area," and "accumulation of ice on the engine nacelles and propeller spinners farther aft than normally observed." These cues are the trigger for prescribed actions.

Third, immediate in‑flight constraints and responses are prescribed. The operator must "immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions" when any cue exists. Autopilot use is prohibited under the same trigger conditions, and the AD explains the rationale: "Since the auto-pilot, when installed and operating, may mask tactile cues that indicate adverse changes in handling characteristics, use of the auto-pilot is prohibited" when cues exist or certain trim warnings/requirements occur. Flap usage is constrained: "Do not extend flaps when holding in icing conditions" and, if flaps are already extended, "do not retract them until the airframe is clear of ice."

Fourth, operational support measures are required: "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night." The AD expressly states this direction "supersedes any relief provided by any Minimum Equipment List." The Normal Procedures section instructs monitoring ambient air temperature, noting that "While severe icing may form at temperatures as cold as -18 degrees Celsius, increased vigilance is warranted at temperatures around freezing when visible moisture is present."

Fifth, procedural recording and notification: Certificate of Registration holders are instructed to ensure notification of the AFM change to persons who may operate the aircraft as pilot in command. Finally, the AD sets minimum requirements for certification of compliance: incorporation of the AD into the AFM and certification that may be performed "at a minimum, by the holder of a private pilot's licence." The AD also cross-references FAA AD 99‑14‑01.

These concepts combine normative instructions (AFM text insertion), immediate operational prohibitions (autopilot, flap handling), equipment readiness (inspection lights operative), and administrative actions (notification, certification of incorporation).

The AD names specific aeroplane models as its applicability: "Models PA30, PA39, and PA40." That makes owners, operators, and pilots of those aircraft the primary affected parties. The document repeatedly addresses distinct roles and who must act. The "Certificate of Registration holders should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." This places an administrative duty on registered owners to disseminate the AFM change to potential PICs.

Pilots are affected operationally. The AFM text changes impose pilot behaviour rules while airborne: identification of visual cues, immediate request to ATC for priority handling to exit icing, prohibition on autopilot when the cues are present or when unusual trim warnings occur, specific actions if "an unusual roll response or un-commanded roll control movement is observed" (reduce angle of attack), and flap handling instructions during icing operations. The AD also provides that certification of incorporation of the AD into the AFM "may be carried out at a minimum, by the holder of a private pilot's licence," which means private pilots may be authorised to record compliance under this AD.

Maintenance and airworthiness personnel are affected in two ways. First, they must update the AFM Limitations and Normal Procedures by incorporating the exact wording required. Second, they must ensure wing icing inspection lights are operative prior to night flights into known or forecast icing conditions, an explicit equipment readiness requirement that the AD states "supersedes any relief provided by any Minimum Equipment List." This creates a hard requirement that may demand maintenance action before night icing flights.

Air Traffic Control is an operational interface, though not a duty-holder in a regulatory sense. The AD requires pilots to "immediately request priority handling from Air Traffic Control," which affects how ATC may be used in practice by affected flights.

Regulatory actors are implicated: the AD is issued "under subregulation 39.1 (1) of CAR 1998" by a CASA delegate, so CASA is the enforcement authority. The text does not list penalties, but CASA's authority under CAR 1998 is the statutory basis for the AD.

Indirectly affected parties include operators who use Minimum Equipment Lists. The AD explicitly displaces any MEL relief regarding wing icing inspection lights for night flight into icing conditions, so operators who rely on MEL relief for dispatch must adjust operational decision-making.

Finally, the AD references FAA AD 99‑14‑01, indicating a cross‑jurisdictional technical reference; that may affect stakeholders who track both FAA and CASA directives, such as maintenance organisations and manufacturers.

The AD creates a mix of prescriptive duties and operational rights, specified in the AFM text the AD requires to be inserted.

Duties

• AFM revision duty: Operators must "Revise: The Limitations Section of the aircraft's Aircraft Flight Manual (AFM) by incorporating the following" warning text, and "The Normal Procedures Section of the AFM by incorporating the following" procedures text. This is an affirmative duty to alter the AFM content as specified.

• Visual monitoring and action duty: Pilots must monitor for the enumerated visual cues and, if any exists, "immediately request priority handling from Air Traffic Control to facilitate a route or an altitude change to exit the icing conditions." The duty to request ATC priority is expressly stated.

• Autopilot prohibition: Where the visual cues exist, or "when unusual lateral trim requirements or auto-pilot trim warnings are encountered while the aircraft is in icing conditions," "use of the auto-pilot is prohibited." If the autopilot "had previously been engaged, hold the control wheel firmly and disengage the autopilot." This is both a prohibition and an affirmative handling instruction.

• Flap handling: "Do not extend flaps when holding in icing conditions." If flaps are already extended, "do not retract them until the airframe is clear of ice." Those are specific aerodynamic-control duties in the icing context.

• Equipment readiness: "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night." The AD states this direction "supersedes any relief provided by any Minimum Equipment List."

• Reporting: The Normal Procedures text instructs pilots to "Report these weather conditions to Air Traffic Control."

• Administrative notification: "Certificate of Registration holders should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." This places an administrative duty on registrants.

• Certification of compliance: Incorporation of the AD into the AFM must be certified before it is considered accomplished. The AD states certification "may be carried out at a minimum, by the holder of a private pilot's licence."

Rights

• Right to seek ATC assistance: The AFM text gives pilots an operational right to "request priority handling from Air Traffic Control" so they can obtain a route or altitude change to exit the icing conditions.

Operational latitude and limits

• Monitoring and discretion: The AD delegates to the pilot the task of determining whether one or more of the visual cues "exist." That determination triggers duties and prohibitions. The AD provides ambient temperature guidance ("severe icing may form at temperatures as cold as -18 degrees Celsius," "increased vigilance is warranted at temperatures around freezing when visible moisture is present") but leaves detection and judgment to the pilot.

• Certification authority: The AD lowers the administrative barrier to compliance certification by allowing a private pilot licence holder to certify accomplishment of the AFM revision and thereby record compliance.

Other features

• Supersession of MEL relief: The AD imposes a more stringent equipment requirement that "supersedes any relief provided by any Minimum Equipment List" with respect to wing icing inspection lights for night icing flights. That constrains operators who might otherwise accept MEL relief for dispatch.

• Cross-reference: The AD notes "FAA AD 99-14-01 refers," which signals that related obligations or technical context exist in the FAA directive, though the CASA AD itself is the operative Australian requirement.

The AD does not itself state civil penalties or sanctions for noncompliance within its text, but it is issued under CAR 1998 subregulation 39.1(1), which is the legal authority for CASA to require corrective action. The AD prescribes who must act, how they must act, and what in‑flight rights they may exercise, while leaving recognition-based judgment calls to pilot discretion.

The AD is issued under statutory authority: it is "issued under subregulation 39.1 (1) of CAR 1998" and a CASA delegate signed and promulgated the amendment. As presented, the document prescribes the required AFM text changes, operational prohibitions and equipment readiness obligations, and a compliance timeframe: "Within 30 days after the Effective date of this Amendment." The AD becomes effective on 13 July 2000. It requires that the action set out be taken "in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section." That language frames the AD as mandatory.

The AD text itself does not enumerate specific civil or criminal penalties for noncompliance. It does not include statutory penalty clauses, infringement notices, or prescribed fines in the printed directive. Enforcement therefore rests on the regulatory framework referenced (CAR 1998) and the general enforcement powers of the Civil Aviation Safety Authority and its delegates. The AD’s preamble sets out the delegate’s authority and the legal mechanism for requiring corrective action, but the directive does not recite the enforcement steps or sanctions that would follow a failure to comply.

Practically, enforcement consideration points from the text are:

• Mandatory nature: The directive is framed as an action the delegate "considers necessary to correct the unsafe condition." The AD requires operators to revise AFMs and carry out specified procedures; compliance is required within a fixed window.

• Certification requirement: The directive requires that incorporation of the AD into the AFM be certified. The AD explicitly describes how certification "may be carried out" following inclusion in the AFM. Failure to provide the required certification would leave the operator without the documentary record of compliance the AD contemplates.

• Supersession of MEL relief: The AD unambiguously overrides any operational relief in the Minimum Equipment List for wing icing inspection lights when flying at night into known or forecast icing. That creates a clear compliance boundary where previously MEL relief might have allowed an operator to dispatch.

• Signature and gazettal: The AD bears the signature of the CASA delegate and is noted as "notified in the Commonwealth of Australia Gazette on 14 June 2000." Those formalities give the AD public force and notice; failure to comply after notice can expose operators to regulatory enforcement actions under the broader CAR framework.

Because the AD does not state penalties in the text provided, parties wishing to understand the specific legal consequences of noncompliance must consult the Civil Aviation Regulations 1998 and CASA enforcement policies, which are outside the content of this document. The AD sets mandatory requirements and a compliance timeframe, but does not itself list fines, suspension mechanisms, or administrative penalty processes.

The AD is explicitly grounded in the Civil Aviation Regulations 1998, being issued "under subregulation 39.1 (1) of CAR 1998." That identifies the CAR as the enabling statutory framework for the delegate to require corrective action to address unsafe conditions. The AD therefore operates as a direction under the CAR regulatory system.

The AD makes an express interaction with operational equipment rules: it provides that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night. This direction supersedes any relief provided by any Minimum Equipment List." That is a direct, textual override of any MEL-based relief that an operator might otherwise rely upon, and it establishes that for purposes of night flights into icing conditions the AD's requirement takes precedence over MEL entries. In operational terms, the AD narrows dispatch discretion by removing MEL exceptions for that particular equipment requirement in the specified circumstances.

The AD also refers to external regulatory action by another authority: "Note 2: FAA AD 99-14-01 refers." This indicates a cross-reference to a United States Federal Aviation Administration airworthiness directive that the CASA AD considers relevant. The AD does not substitute the FAA directive, but its mention signals that related technical information or prior action exists in FAA material. The AD itself, however, is the operative Australian requirement for the affected aircraft.

The AD calls for notification by Certificate of Registration holders to "any person who may operate their aircraft as pilot in command." That administrative obligation sits alongside duties under CAR and other regulatory instruments for maintaining airworthiness and operational documentation. The AD also prescribes the means of certification of compliance, including that "Certification for accomplishment of this Directive may be carried out: after a copy of this Directive is included in the appropriate sections of the aircraft's AFM; and b. may be carried out at a minimum, by the holder of a private pilot's licence." This interacts with airworthiness recordkeeping practices and maintenance release responsibilities by indicating who may record completion.

The AD does not itself amend the CARs, nor does it specify penalty mechanisms; enforcement would be implemented under the CAR regime and CASA policies, which are not reproduced in the AD text. The AD’s supersession of MEL relief is a narrow but direct interaction with operator dispatch rules and their operating manuals. Any operational or contractual requirements that reference the AFM will need to account for the mandated wording, because the AFM is a governing operational document for the aircraft.

Lastly, by revoking the earlier AD/PA‑30/35, the Amendment alters the regulatory landscape for the affected models by replacing the prior AD obligations with the updated text. The amendment corrects a word processing error in the initial issue, but otherwise the AD stands as the operative regulatory direction for the specified aircraft until further amendment or revocation.

The face of the document shows a short and specific amendment history recorded within the AD text. The AD heading reads "AD/PA-30/35 Amdt 1" and the preamble states that the CASA delegate "revokes Airworthiness Directive (AD) AD/PA-30/35 and issues the following AD under subregulation 39.1 (1) of CAR 1998." The document records that "Amendment 1 is issued to correct a word processing error in the initial issue." The AD also notes that "The original issue of this Airworthiness Directive became effective on 23 March 2000."

Key dates and formalities in the AD:

• Original issue effective date: The AD states "The original issue of this Airworthiness Directive became effective on 23 March 2000." That identifies the first issuance and its effective date.

• Signature date: The AD is signed by Bernard Malcolm Hole, "Delegate of the Civil Aviation Safety Authority," with the date "31 May 2000" under the signature block. That is the date the delegate executed the amendment instrument.

• Gazette notification: The document records that "The above AD is notified in the Commonwealth of Australia Gazette on 14 June 2000." That records public notice in the Gazette.

• Amendment effective date: The AD states "This Amendment becomes effective on 13 July 2000." The compliance line requires action "Within 30 days after the Effective date of this Amendment," which ties the compliance window to the 13 July 2000 effective date.

Sequence: The AD indicates the original AD became effective 23 March 2000. Subsequently, an Amendment 1 was issued to correct a word processing error; the delegate signed the amendment on 31 May 2000, it was notified in the Gazette on 14 June 2000, and the amendment is declared to become effective on 13 July 2000. The AD text also explicitly shows that Amendment 1 "revokes Airworthiness Directive (AD) AD/PA-30/35" and replaces it with the currently required AFM insertions and procedures.

The Amendment is limited in purpose, as the AD explicitly describes Amendment 1 as correcting a word processing error in the initial issue. The substantive operative text required for AFM amendment and operational procedures is set out in the body. The AD retains a reference to FAA AD 99‑14‑01 as an informational cross-reference.

No additional amendments, subsequent modifications, or revocations beyond Amdt 1 are recorded in this document. The AD therefore replaces the original AD for the specified models and includes the correction of the identified textual error, with formal signature, gazettal notice, and a new effective date and compliance timeline.

The AD text itself contains no reference to litigation. It records administrative history, signature, and gazettal, but does not reference any court decisions, challenges, or disputes. The document provides no account of judicial review, enforcement proceedings, or legal challenge concerning either the original AD or Amendment 1.

Because the AD is an administrative safety instrument issued under subregulation 39.1(1) of the Civil Aviation Regulations 1998, any litigation or legal proceedings that might arise from compliance, alleged noncompliance, or the validity of the AD would be located in records outside this document. The AD contains only its own text, the amendment rationale ("to minimise the potential hazards associated with operating the aircraft in severe icing conditions by providing more clearly defined procedures and limitations associated with such conditions"), and its formalities (signature, gazettal). It does not include references to court proceedings, appeals to tribunals, or any adjudicative outcomes.

For those seeking litigation history, the AD itself signals where to look for potential enforcement or judicial records: CASA enforcement actions under the CAR framework, disputes over the content or implementation of AFM changes, or challenged revocations of earlier ADs would be matters handled under administrative law and aviation regulatory processes. The AD does not direct any such materials or identify past litigation, and none is quoted or referenced in its text.

Therefore, based on the contents of this AD document alone, there is no recorded litigation history to summarise. Any assertion of litigation or adjudicative events would require consultation of external legal databases, CASA enforcement records, tribunal or court registers, or parties’ public statements, none of which are contained in this instrument.

The AD contains a number of operational and compliance features that may be overlooked or misunderstood if readers rely on routine practices.

1. Supersession of MEL relief: The AD states, unambiguously, that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night. This direction supersedes any relief provided by any Minimum Equipment List." Operators accustomed to dispatch using MEL relief for certain lighting items may mistakenly believe MEL relief still applies. Under this AD, MEL relief is displaced for that item and circumstance.

2. Visual‑cue dependence and subjectivity: The trigger for many of the in‑flight duties is the pilot’s determination that "one or more of these visual cues exists." The cues are descriptive and situational, for example, "unusually extensive ice accumulation" or "accumulation of ice on the upper surface of the wing aft of the protected area." Those are recognitional judgments, which introduces subjectivity into whether the autopilot prohibition and other duties apply. The AD instructs pilots to act when these cues are observed, placing weight on in‑flight visual assessment under potentially degraded visibility.

3. Autopilot prohibition and workload: The AD bans autopilot "when any of the visual cues specified above exist, or when unusual lateral trim requirements or auto-pilot trim warnings are encountered while the aircraft is in icing conditions." The AD also explains that autopilot can "mask tactile cues." Removing autopilot increases pilot workload at a time when handling may already be degraded by icing. This is a procedural trade-off inherent in the AD: the pilot must be prepared to fly manually under possibly challenging aerodynamic conditions.

4. Flap handling counterintuitive rule: The AD instructs "Do not extend flaps when holding in icing conditions" but also says "If the flaps are extended, do not retract them until the airframe is clear of ice." Both rules may be situation dependent and could be misinterpreted in a hurry. The first is a preventive instruction; the second is a retention rule to avoid sudden changes in the wing angle-of-attack with ice present.

5. Certification minimum: The AD permits certification of incorporation "at a minimum, by the holder of a private pilot's licence." That lowers the administrative barrier for compliance recording, but it may create questions among operators about whether their standard maintenance release or authorised personnel procedures should nonetheless be used. The AD requires the AFM text inclusion and certification, but does not prescribe additional documentary format beyond those two steps.

6. Temperature guidance: The Normal Procedures identify that "severe icing may form at temperatures as cold as -18 degrees Celsius" but they single out "increased vigilance" around freezing when visible moisture is present. Operators that equate icing risk only with temperatures near 0 degrees Celsius might under-appreciate the risk at much colder ambient temperatures.

7. Timing of compliance: The AD states the Amendment "becomes effective on 13 July 2000" and compliance is "Within 30 days after the Effective date of this Amendment." That creates a fixed compliance period tied to the stated effective date. Failure to act within that window would leave the operator noncompliant with the AD mandate.

8. FAA cross‑reference: "Note 2: FAA AD 99-14-01 refers." The AD references FAA material but does not incorporate it. Operators might assume the FAA AD provides procedural relief or detail, but the CASA AD is the operative instrument for Australian operators.

9. No penalties listed: The AD does not list enforcement penalties in its text. That could mislead operators into underestimating regulatory risk. Enforcement mechanisms and penalties would derive from the CAR and CASA enforcement policy, which are not reproduced here.

10. Notification duty on registrants: The AD tasks "Certificate of Registration holders" to ensure notice to persons who may act as pilot in command. Operators relying on informal notification may miss formalizing this step; the AD anticipates a proactive administrative action by registrants.

These are concrete procedural and legal friction points visible within the AD text. Each is tied to specific lines in the instrument, so implementers should treat them as binding operational constraints rather than optional guidance.

The AD specifies a short, concrete compliance pathway and the minimum steps required to meet the directive.

1. Insert the mandated AFM text. The principal compliance action is to "Revise the Limitations Section of the aircraft's Aircraft Flight Manual (AFM) by incorporating the following" warning text, and "The Normal Procedures Section of the AFM by incorporating the following." Practically, this requires amending the AFM to include the exact warning and procedures reproduced in the AD. The AD states that "Certification for accomplishment of this Directive may be carried out: after a copy of this Directive is included in the appropriate sections of the aircraft's AFM." Therefore, the first compliance step is to place the AD text into the AFM, in Limitation and Normal Procedures sections as specified.

2. Certify the AFM amendment. After the AFM sections are updated, the AD requires certification of accomplishment. The AD provides that certification "may be carried out at a minimum, by the holder of a private pilot's licence." Ensure that the person making the certification records the incorporation in the aircraft records in accordance with normal AFM amendment practices and keeps an auditable record.

3. Meet the compliance timeline. The AD requires completion "Within 30 days after the Effective date of this Amendment." The AD states the Amendment is effective on 13 July 2000. Ensure AFM insertion and certification are completed within that 30 day window.

4. Ensure wing icing inspection lights are serviceable for night icing flights. The AD requires that "All wing icing inspection lights must be operative prior to flight into known or forecast icing conditions at night." This obligation "supersedes any relief provided by any Minimum Equipment List." Before any night flight into known or forecast icing conditions, confirm those lights are operative; if not, ground or defer the flight until maintenance restores function.

5. Brief pilots and registrants. The AD directs "Certificate of Registration holders should initiate action to ensure notification of this change is conveyed to any person who may operate their aircraft as pilot in command." Registrants should circulate the updated AFM and the AD to all likely PICs, and include specific briefings on the visual cues, the prohibition on autopilot under those cues, the required ATC priority request, and the flap handling rules.

6. Incorporate procedural training and SOPs. Pilots should be trained and made familiar with the visual cues listed in the AFM, the prohibition on autopilot when cues exist or when "unusual lateral trim requirements or auto-pilot trim warnings" occur, and the steps to take: request ATC priority, avoid abrupt manoeuvres, hold control wheel and disengage autopilot if necessary, reduce angle-of-attack if un-commanded roll occurs, and report conditions to ATC. SOPs should reflect the AD's instruction that flaps not be extended when holding in icing, and if flaps are extended, that they not be retracted until clear of ice.

7. Recordkeeping. Maintain records that the AFM has been amended in the appropriate sections, that the incorporation was certified, and that registrants have notified PICs. Keep maintenance records demonstrating that wing icing inspection lights were made operative prior to known/forecast icing night flights.

8. Operational planning. Flight planners and dispatchers should incorporate the AD's temperature guidance and visual cue awareness into preflight planning: monitor ambient air temperatures (recorded in flight planning) and be alert to the AD’s note that "severe icing may form at temperatures as cold as -18 degrees Celsius" while exercising increased vigilance near freezing with visible moisture. Plan fuel, alternate routes, and ATC coordination options to allow for "priority handling" requests if exiting icing necessitates route or altitude changes.

9. Maintain awareness of related directives. The AD notes "FAA AD 99-14-01 refers." Operators should have access to that FAA AD as reference material, but must treat the CASA AD as the binding Australian requirement. Any technical guidance in the FAA AD may inform maintenance or training, but compliance obligations in Australia are those set out in this AD.

10. Monitor for further amendments. The AD revokes the prior AD/PA-30/35 and replaces it. Operators should maintain a process for monitoring CASA ADs for subsequent amendments or superseding directives that could change obligations.

Following these steps will implement the AD’s directions as they appear in the instrument: inclusion of mandated AFM text, certification of the incorporation, maintaining required equipment serviceability for night icing flights, pilot notification and briefing, and operational conformity with the in‑flight prohibitions and procedures. The AD provides a low bar for certification (private pilot licence holder) but places clear operational requirements on pilots and registrants that must be documented and enforced locally.
