AD/ENST 28/40 - Main Rotor Push Pull Rod

The central concept is the “airworthiness directive” itself, which is a mandatory regulatory instrument issued under section 98 of the Civil Aviation Act 1988 and regulations 39.001 to 39.009 of the Civil Aviation Safety Regulations 1998. An AD is a legally binding order to correct an unsafe condition in an aircraft, aircraft engine, propeller, or appliance. It overrides the aircraft’s type certificate and any less restrictive maintenance schedule. Non-compliance with an AD renders the aircraft unairworthy and illegal to fly.

The second concept is the “main rotor push-pull control rod,” a specific component that transmits pilot cyclic and collective control inputs to the main rotor system. The AD identifies two part numbers (P/N 28-16253 and P/N 4140532) and covers all dash numbers of those parts. The rod is a mechanical link that operates in tension and compression; its failure would interrupt control. The AD focuses on corrosion and moisture as failure precursors. Corrosion can reduce the rod’s cross-sectional area and create stress raisers, while moisture inside the rod (which is a hollow tube) can cause hidden corrosion or freezing damage.

The third concept is “service life” as defined by time since installation. The AD does not define a calendar life in terms of years from manufacture; it uses installation date. This is significant because a rod could have been manufactured years before installation (e.g., as a spare part). The AD’s explicit fallback to “Date MFD” if records are lost captures that scenario.

The fourth concept is the compliance time structure based on age bands. The AD uses three age bands for the F-28/280 models (20+, 10-20, less than 10) and two for the TH-28/480 models (10+, less than 10). The thresholds trigger different inspection windows. The AD does not explain why the TH-28/480 models have a different structure, but it likely reflects differences in service experience or the available service bulletins.

The fifth concept is “before further flight” as a compliance milestone for corrective actions. This is a standard aviation safety term meaning the aircraft may not be operated again until the specified action is completed. It is the highest urgency compliance category, reserved for conditions that are an immediate safety hazard. Here, it applies to both repair and replacement after a finding of corrosion with pitting or visible moisture. That means if the inspection reveals such conditions, the aircraft cannot fly until the rod is fixed or replaced, even if the inspection was performed within the allowable grace period.

The sixth concept is the role of the service directive bulletins (SDB 0096 and SDB T-019) and the service information letters (SIL 0156 and SIL T-019). The AD makes the inspection procedures in the SDBs mandatory. The SILs are referenced only as notes, describing a less invasive exterior-only check that might indicate continued serviceability. The AD does not mandate use of the SILs; they are optional. However, the notes create a degree of regulatory guidance that may be considered by maintenance organisations as an alternative means of compliance, though the AD itself does not explicitly approve such alternatives.

The seventh concept is the interaction with the corresponding FAA AD 2007-11-02 (Amendment 39-15059, dated 5 July 2007). The Australian AD notes that the FAA AD is the source. Because Enstrom is a US manufacturer and the helicopters are type certificated under FAA, the Australian AD likely harmonises with the FAA directive. However, the Australian AD is a distinct legal instrument under Australian law. The FAA AD may have different wording, compliance times, or applicability. Operators must comply with the Australian AD for aircraft registered in Australia, regardless of FAA requirements.

This AD directly affects owners, operators, and maintenance organisations responsible for the following Enstrom helicopter models: F-28A, F-28C, F-28F, 280, 280C, 280F, 280FX, TH-28, 480, and 480B. However, the AD excludes higher serial numbers where a production change occurred. Specifically, for F-28 models, serial number (S/N) 816 and subsequent are excluded. For 280 models, S/N 2100 and subsequent are excluded. For TH-28, 480, and 480B models, S/N 5058 and subsequent are excluded. This means that only earlier production helicopters are caught. The exclusion suggests that Enstrom may have introduced a design change or a different push-pull rod part number at those serial numbers, but the AD does not state that. Operators of excluded helicopters do not need to comply, but they should verify their serial number is indeed excluded; if the helicopter has been modified or the rod replaced with an earlier part number, the exclusion may not apply.

The AD affects any person who operates or maintains an affected helicopter on the Australian civil aircraft register. It also affects any helicopter operating in Australian territory even if registered elsewhere, because the Civil Aviation Act applies to all aircraft in Australian airspace. However, enforcement would typically focus on Australian-registered aircraft.

Maintenance organisations (approved maintenance organisations under Part 145 of CASR) will be the ones performing the records review, inspection, repair, and replacement. They must ensure their technicians are familiar with the SDBs and have access to them. The AD does not require specialised training, but the SDBs may contain proprietary information from Enstrom.

The AD also indirectly affects parts suppliers, because the replacement push-pull rod must be “airworthy.” That means the rod must be in a condition for safe operation and conform to the type certificate. Typically, a new rod from Enstrom or an overhauled rod with appropriate release documentation (e.g., FAA Form 8130-3 or CASA Form 1) would qualify. The AD does not mandate a specific manufacturer source, so an approved repair station could overhaul a rod and return it to service.

Helicopter pilots are affected because they must not operate the aircraft unless the AD has been complied with. The pilot in command bears ultimate responsibility for the airworthiness of the aircraft before flight. If the maintenance records indicate the AD has not been accomplished (or the 10-hour/50-hour window has expired), the pilot cannot legally fly.

Insurance companies and financiers with an interest in the helicopter may also be affected. A helicopter that is not compliant with an AD may lose its airworthiness certificate, affecting its insurability or loan value. The AD may also be relevant in a pre-purchase inspection.

Regulatory bodies such as CASA and other national aviation authorities that have accepted the Australian AD (through bilateral agreements) may also be indirectly affected, as they rely on compliance to maintain safety oversight.

The cost burden falls on the helicopter owner/operator. The AD does not provide any government subsidy or tax offset. The owner must pay for the records search, the visual inspection (labour and possible disassembly), any repair or replacement parts, and the paperwork. For a helicopter that has the rod removed for inspection, the cost includes the opportunity cost of downtime. For a helicopter used in commercial operations (e.g., aerial photography, patrol, training), that downtime is revenue lost. The AD does not differentiate between private and commercial operators; both must comply.

The AD may also affect the resale value of affected helicopters. A buyer will want evidence of AD compliance. If the push-pull rod has been replaced, that is a positive; if the helicopter has an older rod that is approaching the 10-year mark, the buyer may factor in the impending inspection cost.

The AD imposes several distinct duties. The first duty is a record-keeping duty: the operator must ascertain the installation date of each push-pull rod. If the installation date is not in the maintenance records, the duty is to use the manufacture date from the data plate. The AD does not require the operator to create records beyond what is already required by CASR 42. But the duty to determine and document the date is necessary to establish the compliance baseline.

The second duty is a duty to inspect. The inspection must be performed within the compliance times set out in Tables 1 and 2. The inspection must be a visual inspection of both exterior and interior of each of the three push-pull rods, with special attention to the lower fitting area. The inspection must be carried out in accordance with the procedures in SDB 0096 or SDB T-019. This means the inspector cannot simply look at the rod; they must follow the specific steps in the service bulletin, which may require disassembly or borescoping.

The third duty is a duty to correct: if corrosion with pitting or visible moisture is found, the operator must replace the rod with an airworthy one before further flight. If corrosion without pitting is found, the operator must repair, reassemble, remark, and reinstall the rod in accordance with the SDB’s repair procedures, also before further flight. The duty to act “before further flight” is absolute; there is no grace period after the finding.

The fourth duty is a duty to document the compliance. While the AD does not explicitly state a documentation requirement, the necessity of proving compliance to CASA or during an audit implies that the operator must keep records of the inspection, findings, and corrective actions. Standard maintenance records practices under CASR Part 42 would apply.

The operator has the right to request an alternative means of compliance from CASA under regulation 39.008 of CASR. The AD itself does not grant any alternative, but the CASR framework allows the manufacturer or operator to propose a different method. CASA may approve an alternative if it provides an equivalent level of safety. However, the AD does not mention any pre-approved alternatives.

The operator also has the right to dispute the applicability if the helicopter’s serial number is excluded. If the helicopter falls in the excluded range, the AD does not apply. If the operator has replaced the push-pull rod with a part number not covered by the AD, the AD may also not apply (since it specifies specific part numbers). But the AD covers “all dash numbers” of the two part numbers, so any variation of those parts is caught.

The operator has the right to use original equipment manufacturer (OEM) parts or approved parts from other sources, provided the part is “airworthy.” The AD does not restrict sources.

The operator has the right to fly the helicopter within the compliance window (e.g., 10 hours TIS) before performing the inspection, as long as the push-pull rod is not already known to have corrosion with pitting or moisture. However, once the compliance time is reached, the inspection must be performed.

The operator does not have the right to defer the corrective action if corrosion with pitting or moisture is found, because the AD mandates “before further flight.” That provision overrides any maintenance deferral scheme under the operator’s MEL or CDL.

The maintenance organisation performing the work has a duty to certify the work in accordance with CASR Part 145. They must also have the SDBs available and follow them precisely. If they deviate, they risk invalidating the compliance.

The rights and duties under this AD are not negotiable. Failure to comply is a breach of the Civil Aviation Act and can lead to enforcement action, as discussed in the penalties section.

Non-compliance with an airworthiness directive is a serious offence under Australian aviation law. The AD itself does not specify a penalty; penalties are found in the primary legislation. Under section 20A of the Civil Aviation Act 1988, a person who operates an aircraft in a manner that contravenes a condition of an airworthiness certificate, which includes compliance with ADs, is liable to a civil penalty of up to 200 penalty units for an individual and 1000 penalty units for a body corporate. As of 2007, one penalty unit was $110; thus, an individual could face a maximum fine of $22,000 and a company $110,000. Additionally, under section 20AA, a person who contravenes a direction under section 98 (which includes ADs) is liable to a civil penalty of up to 200 penalty units. Criminal prosecution is also possible under section 20A for reckless conduct, with higher penalties including imprisonment.

CASA has broad enforcement powers. It can issue a direction to ground the aircraft, suspend or cancel the airworthiness certificate, or impose a civil penalty through the Administrative Appeals Tribunal or Federal Court. The AD itself does not contain a dispute resolution mechanism; challenges to the AD or its application must be made through CASA’s internal review or the AAT.

The AD does not create a private right of action for damages. However, if a person suffers loss due to non-compliance (e.g., a crash caused by a failed push-pull rod that was not inspected), they could bring a common law negligence claim against the operator or maintainer. Compliance with the AD would be strong evidence of due diligence; non-compliance would likely be strong evidence of negligence per se.

From an enforcement perspective, CASA typically relies on audits and incident investigations to detect non-compliance. The AD is a one-time action, so after the initial compliance, the operator’s records should show a completed entry. CASA inspectors may check during a ramp check or a scheduled maintenance review. If the records do not show the AD stamped off, the helicopter is unairworthy.

The AD also has implications for the issuance of a certificate of airworthiness following import or re-registration. The aircraft must have all applicable ADs complied with.

The AD does not provide an immunity period or grace for late compliance beyond the stated compliance times. The 10-hour window is short. If the operator misses the window and flies the helicopter, they are in breach from the moment the time expires. The enforcement penalty would be calculated from the date of the first flight after the deadline.

In practice, most compliance is self-reported through maintenance logs. The probability of detection is low unless a random audit occurs or the aircraft is involved in an incident. However, the legal risk is significant.

This AD operates within a hierarchy of Australian aviation safety regulations. It is a legislative instrument made under section 98 of the Civil Aviation Act 1988. The Civil Aviation Safety Regulations 1998, particularly Part 39 (Airworthiness Directives), provide the framework for ADs. Regulation 39.001 defines an AD, and regulation 39.003 states that a person must not perform maintenance or operate an aircraft unless the AD is complied with. The AD itself does not repeat these provisions; it imposes the specific technical requirements.

The AD interacts with CASR Part 42 (Continuing Airworthiness), which requires operators to maintain a continuing airworthiness management system (CAME) or at least a maintenance schedule. The AD becomes part of that schedule. If the operator’s CAME does not reference this AD, it must be amended.

The AD also interacts with CASR Part 145 (Maintenance Organisations). An AMO must hold the appropriate ratings to perform the structural repair or replacement of the push-pull rod. The repair procedures in SDB 0096 and SDB T-019 may require specialised skills; the AMO must ensure its personnel are competent.

The AD cross-references the FAA AD 2007-11-02. For helicopters that are dual-registered or operated under a bilateral agreement, compliance with the FAA AD may satisfy the Australian AD if it is identical. However, the Australian AD is a separate legal requirement. If the FAA AD has different compliance times, the operator must comply with the stricter of the two. The Australian AD appears to mirror the FAA AD, but the operator should check the FAA version for any variations.

The AD also references two service information letters (SIL 0156 and SIL T-019). These are not mandatory but are advisory. If an operator uses the exterior-only inspection described in those SILs to determine continued serviceability, they must still comply with the AD’s mandatory visual interior/exterior inspection at the required times. The SILs do not replace the AD.

The AD does not interact with the Criminal Code or Work Health and Safety laws directly, but a breach that leads to an incident could trigger prosecution under those laws separately.

If the helicopter is used in a commercial air transport operation under CASR Part 133 (Aerial Work) or Part 121/135 (Air Transport), the operator’s exposition or manuals must incorporate the AD. The Civil Aviation Safety Authority can enforce compliance through the operator’s certificate.

The AD may also have implications for aircraft import/export. Under the Civil Aviation Safety Regulations, an imported aircraft must have its AD status checked. This AD would apply to any Enstrom model entering the Australian register, even if previously compliant with the FAA AD.

Finally, the AD has no direct interaction with environmental laws, customs, or taxation. It is purely an airworthiness requirement.

The source document does not include any explicit amendment history. It appears to be the original issue of AD/ENST 28/40, effective 2 October 2007. The document includes a file reference “11/2007 DM”. The “DM” may refer to a publication or serial code. There is no indication that this AD amends or supersedes any prior AD. The background section refers to a single reported incident, suggesting this is a new directive rather than a revision.

However, the AD does reference the FAA AD 2007-11-02 (Amendment 39-15059, dated 5 July 2007). That FAA AD likely superseded earlier FAA ADs if any existed, but the Australian AD does not mention any prior Australian AD. It is possible that this is the first Australian AD on this subject for these models.

The signature block shows the AD was signed on 30 August 2007 by Charles Lenarcic as a Delegate of CASA. The effective date is 2 October 2007. That suggests a routine promulgation timeline.

In aviation regulation, ADs are often not “amended” in the traditional sense; they are issued as new AD numbers or revised as AD/ENST 28/40 Amdt 1. The source text does not carry any amendment identifier. Therefore, for compliance purposes, this AD stands alone.

If CASA later issues a revision, it would be a new AD number or a suffix (e.g., AD/ENST 28/40 Amdt 1). Operators must monitor CASA’s AD listings to see if this AD is superseded. The absence of amendment history in the source does not mean the AD is timeless; it is a specific point-in-time requirement. Subsequent research would be needed to check if CASA has issued any changes. For the purpose of this deep dive, the AD is as published on 30 August 2007.

The source document does not mention any litigation related to this AD. It is a regulatory instrument, not a court decision. There is no record in the text of any challenge to the AD, any judicial review application, or any personal injury claim arising from the incident that prompted the AD.

It is likely that no litigation has occurred specifically concerning AD/ENST 28/40. Airworthiness directives are rarely litigated directly because they are technical and safety-driven; challenges are usually limited to appeals against CASA enforcement actions, where the operator argues non-compliance was not justified. Such cases are heard by the Administrative Appeals Tribunal and are not widely reported.

The background incident that prompted the AD (in-flight vibration due to push-pull rod failure, emergency landing) may have given rise to litigation in the United States if the incident involved personal injury or property damage. However, the Australian AD does not name the incident’s location, date, or regulatory outcome. No Australian court case is linked.

The AD could become relevant in subsequent litigation if a helicopter crash occurs involving corrosion of the push-pull rod and someone claims that the AD was not complied with. A failure to comply would be evidence of negligence. Conversely, compliance would be a defence. To date, no such reported Australian case is known.

Given that the AD is from 2007 and the helicopter models are low-production and niche, litigation is unlikely to be extensive.

Several aspects of this AD could trip up an unwary operator. The biggest gotcha is the “before further flight” requirement for corrective actions after a finding. Many maintenance tasks allow the aircraft to be flown to a repair facility or to complete the flight under certain conditions. This AD does not. If corrosion with pitting or visible moisture is found during inspection, the helicopter cannot fly again until the rod is replaced or repaired. This could leave an operator stranded away from base, requiring a mobile maintenance team or a ferry flight under a special permit (if CASA grants it). The AD does not explicitly prohibit a ferry permit, but the “before further flight” language is strong.

The second gotcha is the fallback to the aircraft’s manufacture date if maintenance records lack the installation date. This could bring the inspection deadline forward dramatically. For example, if a helicopter was manufactured in 1987 but the push-pull rod was replaced in 1995, the actual installation date is 1995, but if records are lost, the operator must use 1987. That would put the rod in the “20 years or more” band even though it has only been in service for 12 years. The inspection would be due within 10 hours or next annual, rather than the 50-hour window. There is no provision in the AD to accept an affidavit or other evidence; the AD mandates using the data plate date.

The third gotcha is that the AD requires inspection of “the exterior and interior of each of the three push-pull rods.” This means the rod must be removed or at least disassembled to access the interior. The SDBs likely specify removal. That adds labour and potential opportunity for damage during reinstallation. The AD does not require a recurring inspection, so the rod may never need to be removed again, but the initial removal is mandatory.

The fourth gotcha is the specific part numbers. The AD lists P/N 28-16253 and P/N 4140532. If a push-pull rod has been superseded by a different part number (e.g., through a manufacturer’s bulletin), the AD may not apply to that rod. But the AD says “all dash numbers” of those PN’s. If the rod bears a different base number, it may be outside the AD’s scope, but the operator needs to verify that the replacement rod is still eligible. The AD does not provide a procedure for accepting alternative parts. If in doubt, CASA approval would be needed.

The fifth gotcha is the exclusion of certain serial numbers. An operator with a helicopter at S/N 815 (F-28A) is caught; one with S/N 816 is not. The line is exact. If the helicopter was built as a model F-28A but later upgraded to F-28F under an STC, the serial number does not change, and the helicopter remains caught if S/N is below the exclusion. The AD does not address modifications.

The sixth gotcha is the compliance threshold for TH-28/480 models: 10 years installed triggers inspection within 50 hours or next annual. For an operator who acquired a helicopter with 9.5-year-old rods, they have only 6 months (or 50 hours) before the 10-year mark to perform the inspection. They cannot wait until the annual inspection if the 10-year anniversary falls between annuals. They must perform the inspection at the anniversary or earlier.

The seventh gotcha is record retention. After the AD is complied with, the operator must keep records proving compliance for the life of the aircraft. If the helicopter is sold, the new owner relies on those records. If the records are lost, the AD may be considered incomplete and the helicopter unairworthy until re-compliance. The AD does not require a placard, but a logbook entry is essential.

Compliance with AD/ENST 28/40 requires a systematic four-step process, followed by documentation. Step one: locate the helicopter’s serial number on the data plate and compare it to the applicability table. If the serial number is within the excluded range (S/N 816 and subsequent for F-28A, etc.), the AD does not apply, and no further action is needed. If the number is below the cut-off, proceed.

Step two: determine the installation date of each of the three main rotor push-pull rods. Pull the maintenance records for the aircraft and look for an entry showing when rod P/N 28-16253 (or P/N 4140532 for TH-28/480) was installed. If the records show a specific date, that is the installation date. If the records do not show the date, use the “Date MFD” from the aircraft data plate. That date is the default. Record the installation date for each rod separately; the three rods may have different dates if they were replaced at different times.

Step three: calculate the time since installation from the effective date of the AD (2 October 2007). This determines which compliance band applies from Tables 1 or 2. For F-28/280 models: if installed 20+ years ago, inspection due within 10 hours TIS or next annual, whichever first. If installed 10-20 years ago, inspection due within 50 hours TIS or next annual. If less than 10 years ago, inspection must be performed before that rod reaches 10 years since installation. For TH-28/480: if installed 10+ years ago, inspection due within 50 hours TIS or next annual. If less than 10 years, inspect before 10-year mark.

Step four: perform the visual inspection on all three rods. Obtain a copy of Enstrom SDB 0096 (for non-TH-28/480) or SDB T-019 (for TH-28/480/480B). Follow the inspection procedure in section 5.1 of that bulletin. This will involve removing the rod or gaining access to its interior to inspect for corrosion (particularly pitting) and moisture. Pay special attention to the lower fitting area. Document the findings for each rod.

If the inspection finds no corrosion and no moisture, no further action is needed except to enter the compliance in the logbook. If corrosion without pitting is found, perform the repair in accordance with section 5.2 of the appropriate SDB. This may involve cleaning, treating, and reassembly with remarking. After repair, the rod must be reinstalled. The helicopter cannot be flown until this is done (before further flight). If corrosion with pitting or any visible moisture is found, replace that rod with an airworthy push-pull rod. An airworthy rod is one that is in serviceable condition, conforms to the type design, and has appropriate release documentation. Install the new rod. The helicopter cannot fly until replacement is complete.

All work must be performed by an approved maintenance organisation under CASR Part 145, or by a licensed aircraft maintenance engineer (LAME) as appropriate. After compliance, make a logbook entry referencing AD/ENST 28/40, the SDB used, the inspection date, findings, and any repairs or replacements. Keep the records with the aircraft’s continuing airworthiness records. For rods that have been repaired, note the new installation date for future tracking. For rods replaced, record the new part number and installation date. If a rod was replaced with a new rod, check whether the new rod is from a later production that might be outside the AD’s part number scope; if so, the AD no longer applies to that rod. However, it is safer to treat the AD as still applicable to the aircraft if any rod remains that is caught. The AD does not require any action after initial compliance for rods that are in good condition and not yet 10 years old at the time of inspection; but the operator must continue to track the rod’s age to ensure the next inspection occurs before the 10-year mark.

Finally, for the TH-28/480 models, the note referencing SIL T-019 allows an exterior-only inspection as an alternative to determine continued serviceability. The AD does not mandate that alternative, but it can be used as a less-invasive check between inspections if desired. The mandatory compliance remains the full interior/exterior inspection at the specified times.

Operators should also verify that the SDBs in their possession are the correct revision (dated 10 September 2003 for both SDB 0096 and SDB T-019). Using an older or newer revision may not satisfy the AD. If the SDB has been revised after the AD was issued, the operator should check if CASA has issued a new AD or approved the revised bulletin. In the absence of such approval, the AD references the specific dated bulletins.
